Section I
GENERAL PART

Chapter 1. General provisions

Article 1. Relations regulated by the Civil Protection Code of Ukraine

1. The Civil Protection Code of Ukraine regulates relations related to the protection of the population, territories, the natural environment and property of emergencies, responding to them, functioning of a unified state system of civilian protection, and defines the powers of the state authorities, the Council of Ministers of the Autonomous Republic of Crimea, the bodies of local self-government, the rights and duties of citizens of Ukraine, foreigners and persons without citizenship, businesses, institutions and organizations regardless of form Property.

Article 2. Term Definition

Article 3. Legal framework for civil protection

1. The legal basis for civil protection is Constitution of Ukraine , this Code, other laws of Ukraine, as well as acts of the President of Ukraine and Cabinet of Ministers of Ukraine.

Article 4. Civilian protection

1. Civil protection is a function of the state aimed at protecting the population, territories, environment and property from emergencies by preventing such situations, elimination of their effects and assist victims. peacetime and special period.

Article 5. Classification of emergencies

1. Emergency situations are classified by nature, the degree of spread, the size of human losses, and material damage.

2. Depending on the nature of the origin of the events of emergencies in the territory of Ukraine, the following types of emergencies are defined:

(1) Technogenic character;

(2) Natural character;

(3) Social;

(4) War.

3. Depending on the amount of emergency conditions, the volumes of technical and material resources required for their liquidation are determined by the following levels of emergencies:

(1) State;

(2) Regional;

(3) Local;

(4) Volume 1.

4. The order of classification of emergencies by their levels is established by the Cabinet of Ministers of Ukraine.

5. Emergencies Classification are defined by the central body of the executive branch, which provides for the formation and implementation of state policy in the field of civil protection.

Article 6. Civil protection entities

1. Civil protection is provided with features defined by the Law of Ukraine "On the Foundations of National Security of Ukraine" The entities authorized to protect the population, territory, natural environment and property, according to the requirements of this Code-in peacetime, and in the special period-within the implementation of the State defence measures of Ukraine.

2. The coordination of the activities of the executive branch in the field of civil protection within its authority shall be exercised by:

(1) The National Security and Defense Council of Ukraine;

(2) The Cabinet of Ministers of Ukraine.

3. To coordinate the activities of the central and local executive authorities, enterprises, institutions and organizations associated with the technology and environmental security, protection of population and territories, prevention and response to emergencies:

1) The Cabinet of Ministers of Ukraine is formed by the State Commission on Technologies and Environmental Security and Emergency Situations;

2) The Council of Ministers of the Autonomous Republic of Crimea, the regional, Kiev and Sevastopol city government administrations are formed by regional commissions on the issues of technology and environmental security and emergencies;

(3) Regional government administrations, executive bodies of city councils, district in cities and village councils are formed by local committees on the issues of technology and environmental security and emergencies;

4) the governing bodies of enterprises, institutions and organizations are formed by the Commission on Emergency Situations.

4. To coordinate the work on the eradication of the specific emergency situation and its consequences at the state, regional, local and volume levels, special relief commissions are formed.

Article 7. Basic principles of civil protection

1. Civil protection is carried out under the following basic principles:

(1) Guarantee and ensuring the state of the constitutional rights of citizens on the protection of life, health and property;

(2) A comprehensive approach to civil protection tasks;

(3) prioritizing tasks aimed at saving the life and conservation of the health of citizens;

(4) The maximum possible, cost-effective risk reduction of emergency situations;

5) centralization of management, unionality, subordination, statutory discipline of the Operational and Rescue Service of Civil Protection, Emergency Rescue Services;

6) publicity, transparency, free acquisition and dissemination of public information on the state of civil protection, other than restrictions established by law;

(7) Voluntary participation in the event of the involvement of citizens prior to the exercise of civil protection measures related to the risk to their lives and health;

8) the responsibility of the officials of the public authorities and local authorities for compliance with the requirements of civil protection legislation;

9) justified risk and responsibility of the leaders of the Civil Protection Force for security during the conduct of emergency rescue and other emergency work.

Chapter II
NATIONAL CIVIL PROTECTION SYSTEM

Chapter 2. The official civil protection system and its components

Article 8. United State Civil Protection System

1. Ensure the implementation of public policy in the field of civil protection is carried out by the sole civil protection system, which consists of functional and territorial subsystems and their lanoc.

3. The main objectives of the civil protection system are:

(5) Processing of emergency information, publication of information materials on the protection of the population and territories from the effects of emergencies;

6) forecasting and assessment of the socio-economic effects of emergencies, determination based on the forecast of the needs of the forces, means, material and financial resources;

7) the creation, rational preservation and use of the reserve of material and financial resources necessary to prevent and respond to emergencies;

8) to alert the population of the threat and occurrence of emergencies, timely and reliable informing of the actual environment and the exercise of measures;

(9) Protection of the population in case of emergency situations;

(10) To conduct rescue and other emergency efforts to eliminate the effects of emergencies, the organization of the life of the affected population;

11) mitigating the possible effects of emergencies in the event of their occurrence;

12) measures the social protection of the affected population;

(13) Implementation of the statutory rights of protection of the population from the effects of emergencies, including persons (or their families) who have taken immediate involvement in the elimination of these situations;

14) other tasks defined by the law.

Article 9. Functional subsystems of a unified civil protection system

1. The functional subsystems of the unified state system of civil protection (further-functional subsystems) are created by the central executive bodies in the respective sphere of public life.

2. Regulations on functional subsystems are being developed based on the default position on such a subsystem and are approved by the executive authorities that created them, by agreement with the central body of the executive branch providing Development and implementation of public policy in the field of civil protection.

Article 10. Territorial subsystems of the unified state system of civil protection and their Sri Lanka

Chapter 3. The functioning of the unified civil protection system

Article 11. The functioning of the unified civil protection system

Article 12. Daily operation mode

Article 13. Enhanced Readiness Mode

1. In case of the threat of an emergency, by decision of the Cabinet of Ministers of Ukraine, the Council of Ministers of the Autonomous Republic of Crimea, the regional, Kiev or Sevastopol city administrations for a unified state system. Article 14. Emergency Mode

1. Article 15. State of emergency

1. The state of emergency for the single public civil protection system in full or partly for individual its territorial subsystems is temporarily established within the territory on which the legal regime is imposed in accordance with Law of Ukraine "On the Legal Mode of Extraordinary State" .

Chapter III
POWERS OF CIVIL PROTECTION FACILITIES

Chapter 4. Powers of the executive branch, local government bodies, tasks and responsibilities of the administration, rights and duties of citizens of Ukraine in the field of civil protection

Article 16. Powers of the Cabinet of Ministers of Ukraine in the field of civil protection

1. Prior to the authority of the Cabinet of Ministers of Ukraine in the field of civil protection belongs to:

1) the leadership of the sole civil protection system;

(2) Organizing measures to eliminate the effects of emergencies;

(3) Setting the order of the bridge to the relevant civil protection groups, and the subjects of the host system are to the appropriate categories of civilian protection;

4) the return of cities to civil protection groups, approving their list;

(5) Establishment of a provision of means of individual protection and material reserves to prevent and eliminate the effects of emergencies, determine their volume and order of use;

(6) Action to ensure the readiness of a unified state system of civilian protection to actions in emergencies and in a special period;

(7) Determination of the order of the transfer of a single state system of civil protection from the regime of functioning in peacetime on the functioning of a special period;

8) the involvement of civil protection forces prior to the conduct of emergency rescue and other emergency work, disaster relief, humanitarian operations outside of Ukraine;

9) to ensure the social protection of victims of emergency situations;

11) to ensure the implementation of the requirements of the technology and fire safety;

(12) Definition of mobilisation to meet the needs of civil protection and the order of accumulation, storage and use of mobilization reserves for the needs of civilian protection in a special period;

(13) Definition Order Preparation and exercise of potentially dangerous measures in the presence of civilians involving personnel of the Armed Forces of Ukraine, other military formations and law enforcement agencies using weapons and military equipment;

(14) Determination of the order of civil protection plans for the special period and other plans in the field of civil protection;

15) approval of the annual plan of the major measures of civil protection of Ukraine and the plan for the implementation of the governing body and the professionals whose activities are related to the organization and implementation of civil protection measures;

16) determination of the order of learning of the population in emergency situations;

17) to carry out other powers stipulated by this Code and other legislative acts.

Article 17. Powers of the Central Executive Authority, which provides for the formation and implementation of state policy in the field of civil protection

1. To the system of the central executive authority, which provides for the formation and implementation of public policy in the field of civil protection, includes civil protection forces, training facilities and scientific institutions, health care facilities (medical units) (further-organs and units of civil protection) which are part of the scope of its management.

1) carries out the direct management of the unified state civil protection system;

3) undertake the training of the functional and territorial subsystems of the unified state system of civilian protection and their lanoc;

11) participates in the development of the mobilization plan of the state;

12) expands in the event of a mobilisation of special formations intended to perform separate tasks of civilian protection of cities taken to the civil protection groups, and the entities of the household, attributed to the categories of civilian protection;

13) leads the accounts of persons undergoing the civil protection service, as well as those who have contracted to stay in the civil protection service reserve;

14) determine the need for financial and logistical resources of the bodies and units of the civil protection to carry out the tasks of the special period and in the event of a targeted mobilisation, delivers the relevant proposals to the central body The executive branch, which provides for the formation and implementation of public policy in the sphere of economic and social development;

15) provides coordination, organization and methodological guidance on determining the status of functional and territorial subsystems to address the tasks of civil protection in peacetime and in the special period;

16) forms and implements state policy measures on the establishment, maintenance and reconstruction of the protection facilities of the civil protection, and the conduct of their accounts;
