This Act defines the legal and economic basis of the production and circulation of organic agricultural products and raw materials and aims to ensure the proper functioning of the market of organic products and raw materials and to guarantee confidence. consumers in products and raw materials labeled as organic.

Section I
GENERAL PROVISIONS

Article 1. Term Definition

1. In this Act, the following terms are used in this respect:

production of organic products (raw materials)-production activities of physical or legal entities (including growing and recycling), where during such production, the application of chemical fertilizers, pesticides, genetically modified organisms (GMO), preservatives, etc., and all stages of production (growing, recycling) are applied methods, principles and rules defined by this Act to produce natural (environmentally sound) products, and conservation and recovery Natural resources;

Organic raw materials are raw materials obtained from certified production according to the requirements of this Act and which aims at further use for the acquisition of new products;

Organic products-products derived from certified production according to the requirements of this Act;

Organic products of aquaculture-fish and other water living resources, are bred and grown in special artificial conditions or in the defined fisheries facilities under this Act;

traditional (inorganic) products-products made for the conventional technology of agricultural production, where any chemical means of protection, synthetic mineral fertilizers, preservatives, artificial materials can be used. The barents, growth stimulants, hormones, antibiotics, flavorings, stabilizers, amplifiers, etc. in accordance with the legislation;

Parallel production-simultaneous production of organic and traditional (inorganic) products;

The transition period is a period of transition from production of traditional (inorganic) products (raw materials) to the production of organic products (raw materials);

Hydroponic production is a method of growing plants where their roots are only in a mineral nutrient or in an inertial environment, such as pearl, gravel or mineral wool, to which nutritional solution is added;

Register of producers of organic products-lists of persons given the right to produce (grow, recycled) organic products (raw materials);

Article 2. Scope of the Act

1. This Act governs the relations of production and the circulation of organic products (raw materials) and is distributed to the subjects of the household, which carry out economic activity in this sphere, and to organic products (raw materials) obtained according to the requirements of this Act.

Article 3. Legislation of Ukraine in the field of production and implementation of organic products (raw materials)

1. Legislation in Ukraine in organic production consists of Constitution of Ukraine , Law of Ukraine "On the protection of the environment", this Act and other laws of Ukraine, the international treaties of Ukraine, the binding of which was provided by the Verkhovna Rada of Ukraine, the other regulations issued under them.

Article 4. Principles of production, storage, transportation and implementation of organic products (raw materials)

1. The general principles of production, storage, transportation and implementation of organic products (raw materials) are the principles:

(1) Voluntary

(2) The equality of the rights of the household entities that carry out the production, storage, transport and implementation of organic products (raw materials);

3) Rational use of natural resources, ensure their proper use and reproduction;

4) The rejection of the use of genetically modified organisms and products from them;

5) refusal to use chemically synthesized external resources, except for the excluded cases established by this Act;

(6) Long-term maintenance of soil fertility;

7) the use of living organisms and mechanical production methods;

8) providing a high level of biological diversity;

9) use in the production of processes that do not harm the surrounding natural environment, health of people, plants, health and animal welfare.

2. Special principles of production, storage, transportation and implementation of organic products (raw materials) are the principles:

1) ensuring the preservation and reproduction of soil fertility, soil sustainability and biological diversity of soils, which optimize the biological activity of soils, provide a balanced supply of nutrients for plants;

(2) Minimizing the use of non-renewable and external resources;

3) recycling of waste and related products of plant and animal origin for further use in the production of plant and animal origin products;

4) taking account of the local or regional environmental status of the territories under the choice of a category of products for production;

(5) Animal health by encouraging the natural immune protection of animals, selection of appropriate rocks;

(6) Protection of plants through preventive measures such as the choice of relevant species and varieties, resistant to disease and pest, siromines, mechanical and physical methods and protection against natural enemies (s);

7) taking into account selection of the degree of adaptation of animals to local conditions, their viability and resistance to disease;

8) adherence to the high level of animal welfare, satisfying the needs inherent to each individual species;

(9) Production of organic animal production from animals that have been grown in organic farms since birth throughout life;

10. Animal feeding by organic food;

(11) Exclusion of the use of artificially produced polyploid animals;

12) conservation of the biological diversity of natural aquatic ecological systems, the continuous protection of the aquatic environment and the quality of the surrounding water and surface environmental systems in the production of fisheries products.

Chapter II
STATE POLICY AND POWERS OF THE STATE AUTHORITIES IN THE FIELD OF PRODUCTION AND CIRCULATION OF ORGANIC PRODUCTS AND RAW MATERIALS

Article 5. Main areas of public policy in the field of production and circulation of organic products (raw materials)

1. The public policy in the field of production and circulation of organic products (raw materials) aims to create favourable conditions for:

1) the development of competitive, highly efficient agriculture by producing organic products (raw materials);

(2) Increasing the export of organic products;

3) the development of the internal market of organic products and the satisfaction of consumers ' needs in the assortment of organic products.

Article 6. Public policy on the production and circulation of organic products (raw materials)

1. The State policy in the field of production and circulation of organic products (raw materials) shall be carried out by the Cabinet of Ministers of Ukraine and other executive authorities in accordance with the laws of Ukraine.

Article 7. Powers of the Cabinet of Ministers of Ukraine in the sphere of production and circulation of organic products (raw materials)

1. Prior to the authority of the Cabinet of Ministers of Ukraine in the sphere of production and circulation of organic products (raw materials) include:

1) to ensure public policy and international cooperation in the sphere of production and the circulation of organic products (raw materials);

(2) The approval of detailed production rules and the circulation of organic products (raw materials);

3) to direct and coordinate the activities of ministries and other central executive bodies that ensure the formation or implementation of the state policy in the field of production and circulation of organic products (raw materials);

Article 8. The powers of the central authority of the executive branch, which provides the formation and implementation of state agrarian policies

1. To the authority of the Central Executive Authority, which provides for the formation and implementation of the State Agrarian Policy, in the sphere of production and circulation of organic products (raw materials):

1) the formation of public policy in the sphere of production and circulation of organic products (raw materials);

2) develop detailed rules of production and circulation of relevant organic products (raw materials) and presenting them to the approval of the Cabinet of Ministers of Ukraine;

Article 9. Powers of the Central Executive Authority, which implements the state policy in the area of safety and individual food quality indicators, in the field of production and circulation of organic products (raw materials)

1. To the authority of the central executive body, which implements the state policy in the area of safety and individual food quality indicators, in the field of production and circulation of organic products (raw materials):

1) the exercise of public oversight (control) for the activities of the household entities that carry out the production, transport, storage, implementation of organic products (raw materials);

2) to register manufacturers of organic products (raw materials) and provide the publication of official information on individuals who carry out the production and implementation of organic products (raw materials);

3) disseminating the information on production and implementation of organic products (raw materials), organic products, system of safeguards and control in the media with the involvement of involved parties;

4) other powers in accordance with the law.

Article 10. Powers of the central executive body implementing state policy in the scope of conformity assessment

1. The Central Executive Body, implementing state policy in the scope of conformity assessment, assigns bodies to conformity assessment activities to assess the conformity of production of organic products (raw materials) and the certification of certification auditors, supervises the evaluation of the conformity of work assessment works by the conformity assessment bodies and other powers predicted The Law of Ukraine "On Confirmation of Compliance" .

Article 11. State care (control) for production and circulation of organic products (raw materials)

1. State care (control) for the production and circulation of organic products (raw materials) is carried out by the central body of the executive branch, implementing state policy in the area of safety and individual food quality indicators.

Chapter III
PRODUCTION OF ORGANIC PRODUCTS AND RAW MATERIALS

Article 12. Right to the production of organic products (raw materials)

1. The production of organic products (raw materials) is entitled to a physical or legal entity that has passed the conformity assessment of organic products (raw materials), received conformity assessment and included in the Register of Organic Products products (raw materials).

Article 13. Registration of producers of organic products (raw materials)

1. Physical or legal persons who found intent to produce organic products and/or raw materials have been assessing the conformity of production of organic products (raw materials) and received correspondence certification, to the Register of Manufacturers Organic products (raw materials), which leads the central executive body, which implements government policies in the area of safety and individual food quality indicators.

2. The Regulation on the Manufacturers of Organic Products (raw materials) is being developed and approved by the central body of executive power, which provides for the formation and implementation of state agrarian policies.

3. The Register of Organic Products (raw materials) is open and publicly available. Access to the Register of Organic Products (raw materials) is free and provided by its release and support in the current state on the official website of the Central Executive Authority implementing state policy in the field. safety and individual food quality indices. The order of the conduct of the Register of Organic Products (raw materials) is being developed by the central executive body, which provides the formation and implementation of state agrarian policy, and approved by the Cabinet of Ministers of Ukraine.

4. Physical or legal entities that are not listed in the Register of Manufacturers of Organic Products (raw materials) do not have the right to produce organic products and/or raw materials.

Article 14. The rules of production and circulation of organic products and raw materials

1. General rules of production and circulation of organic products and raw materials are established by this Act.

2. Detailed rules of production and circulation of organic products and raw materials are being developed by the central executive body, which provides the formation and implementation of state agrarian policy, and approved by the Cabinet of Ministers of Ukraine.

3. The process rules for the production and circulation of organic products and raw materials should meet the requirements of this Act and set up the rules of production and circulation in such areas as follows:

1) the production of unrecycled organic products (raw materials) of plant origin, including fungi;

2) the production of unrecycled organic products (raw materials) of animal origin;

3) the production of organic products (raw materials) of aquaculture;

4) production of organic seaweed;

(5) Production of organic products (raw materials) of beekeeping;

6) transport, storage and implementation of organic products (raw materials);

7) collection of wild plants, forest products and algae;

(8) Production during the transition period;

9) order of transition to production of organic products (raw materials);

(10) List, conditions and permissible amounts of use of non-organic products, substances, products obtained during the transition period, in the production of organic products (raw materials) on each category of products, substances;

(11) List of substances which are forbidden to use in the production of organic products (raw materials);

12) permissible volumes and list of inorganic products, substances, products obtained during the transition period, which can in exclusive cases be used in the production of organic products (raw materials);

13) criteria for assessing the suitability of agricultural land for the production of organic products (raw materials).

Article 15. Methods for producing organic produce and/or raw materials

1. In the production of organic products and/or raw materials, methods are used which:

1) exclude the use of GMOs, derivatives of GMOs and products produced from GMO, as food, feed, technological additives, plant protection and improvement of soil, fertilizer, seed, vegetative origin of the salted material, Microorganisms and animals;

2) exclude the use of chemically synthesized substances, preservatives, synthesized (artificial) barents, hormones, antibiotics, aromatoators, stabilizers, taste amplifiers, growth stimulants;

3) exclude the use of ionizing radiation to process organic raw materials or feed used in the production of organic products;

(4) Excluding hydropont production;

5) use living organisms and methods of mechanical production;

6) perform plant power mainly through the soil ecosystem;

7) are based on risk assessment and use preventive measures.

Article 16. Common rules for organic production and/or raw materials

1. The physical or legal persons who are entitled to produce organic products (raw materials) are required to adhere to such general rules of production of organic products and/or raw materials:

1) comply with the requirements of this Act and the regulations of the production and circulation of organic products and raw materials and/or wild plants, use only methods of production of organic products and/or raw materials;

2) to provide the separation of organic products (raw materials) from the production of non-organic products (raw materials), transition products;

3) use production technologies that prevent pollution or minimise any increase in environmental pollution;

6) take into account the local and regional environmental status of the territories while selecting products for production;

(7) Minimise the use of non-renewable resources and external resources;

(8) enforce the preservation and reproduction of soil fertility.

2. In the production of organic food products by recyclable persons who are given the right to produce organic products (raw materials), apart from the rules listed in the first article of this article, are required to comply with the following requirements:

1) produce products mainly from ingredients of agricultural origin (besides water and kitchen salt);

2) do not use the organic ingredient together with the same ingredient in inorganic form or ingredient in the transition period;

3) not to use substances and technologies that restore the characteristics lost in recycling and storage of organic food products, and correct negligence results when recycling such products or otherwise injected into Oman. the true nature of the product.

4. Food and fishing products are not considered organic products.

5. The removal of diacrial plants and their parts, which naturally grow in forests and agricultural land, is considered to produce organic products if:

(1) Such areas have not been subjected to a period of no less than five years processing products whose use is prohibited by this Act;

2) such harvesting does not affect the stability of the natural environment, the existence or conservation of plant species in the building area.

6. The cleaning of wild algae and their parts growing in marine natural environments is considered organic production under the following conditions:

1) the areas of algae growth have high environmental quality, not contaminated with substances that are prohibited to use in the production of organic products (raw materials), or other harmful to human health;

2) such harvesting does not affect the stability of the natural environment, the existence or conservation of plant species in the building area.

Article 17. Exceptions to the production rules of organic produce and/or raw materials

1. In exclusive cases stipulated by this article, by the consent of the central executive body, implementing state policy in the sphere of safety and individual food quality indicators, allowed during the production of organic products, Raw materials use traditional products, raw materials (other than products, raw materials that contain GMO, derivative of GMO or obtained by GMO) and products, and the transition period to the following:

1) as products for plant protection;

2) as fertilizer and soil improvements;

3) as inorganic feed materials of plant, animal and mineral origin;

(4) How to feed or technological additives;

5) as products for purification and deinfection of water, clinics, structures and facilities production of animal products;

6) as products for cleaning and deinfection of structures and installations used to produce plant products, including facilities for storing such products.

2. Valid volumes and lists of non-organic products, substances, products obtained during the transition period, which can in exclusive cases be used in the production of organic products (raw materials), for each of the categories of products, substances are set up by the Cabinet of Ministers of Ukraine.

3. The use of traditional products (raw materials) and products (raw materials) of transition period is only possible if:

1) such products are essential to ensure the ability to start or continue producing organic products (raw materials) in areas that have climatic, geographical or structural constraints;

2) this is essential to ensure access to feed, manual material and material for vegetative reproduction, living animals and other inputs, if such resources or their alternatives are unavailable on the market in organic form;

3) this is essential to ensure access to ingredients of agricultural origin, if such ingredients or their alternatives are unavailable on the market in organic form;

4) this is necessary to address the individual problems associated with the management of organic livestock.

4. When establishing the acceptable volumes and list of inorganic products, substances, products obtained during the transition period, which can in exclusive cases be used in the production of organic products (raw materials), such factors:

(1) The use in the production of such products, substances have no harmful effect on the environment or does not enhance this impact;

2) their negative impact on health and the quality of life of people or animals is minimal;

(3) Such products, the substance is plant, animal, microbial or mineral origin, and may be subjected to physical (mechanical, thermal), fermentative or microbial processes.

5. In case of cases prescribed by this part, namely, the case of impossibility to meet the needs of plants in nutrients, is allowed to apply fertilizer and substance to improve the soil defined by the central body of the executive branch. provides the formation and implementation of state agrarian policies.

6. Manufacturers of organic produce (raw materials) are required to minimize the use of traditional products (raw materials) and transition period products and, for expediency, limit its use in time.

Article 18. Rules for production of organic products (raw materials) of plant origin

1. Before the general rules of production of organic products (raw materials) of plant origin include:

(1) the use of methods to optimize the biological activity of soils, provide a balanced supply of nutrients to plants, while maintaining land and other natural resources needed to produce organic products (raw materials);

(2) The introduction of soil conservation technologies to the cultivation of agricultural crops that prevent the onset of erosion or other degraded processes;

(3) To maintain plant resilience by preventive measures by choosing the appropriate species and varieties resistant to the pest and disease, appropriate ciabming, mechanical, physical and biological methods of protection;

4) an increase in the population of useful insects, microorganisms and natural parasites as biological control of pest control and plant diseases;

(5) Use as a fertilizer of microbiologic, plant or animal origin, which are split biologically;

6) the use of only certified organic seeds and landing material;

7) fertilizer and soil improvements can only be used if their use is permitted according to Article 17 of this Act. It is forbidden to use mineral nitrogen fertilizers;

8) in the event of establishing a threat to plants the plant protection products can only be used if their use is permitted according to Article 17 This Act;

9) products for cleaning and deinfection in the production of plant products are used only if their use is allowed in organic production according to Article 17 of this Act.

2. Detailed rules of production of organic products (raw materials) of plant origin are established by the Cabinet of Ministers of Ukraine.

Article 19. Rules for production of organic products (raw materials) of animal origin

1. Before the general rules of production of organic products (raw materials), animal origins include:

(1) The selection of breeds takes into account the ability of animals to adapt to local conditions, their viability, resistance to disease;

(2) The maintenance of animals is carried out with respect to physiological and behavioral needs by providing animal conditions, which appropriately considers the basic aspects of their natural treatment, sufficient degree of freedom of movement, compliance the optimal number of animals per unit area, the application of animal breeding system that takes into account their behavioral needs;

(3) Animal maintenance is carried out by minimizing the stress of animals, promoting their health and wellbeing, stimulating their natural immune protection and preventing the use of chemical allopathy veterinary drugs;

(4) Animal maintenance must conform to the biological and behavioural needs of animals and provide free access to the areas of the guests and sources of drinking water; proper heat insulation, heating, cooling, ventilation of premises Support for air circulation, level of entry, temperature, relative humidity of the air within the limits required for animal health; due to the natural performance of the premises and the excess of light; to anticipate the appropriate measures in the case of a fire, The exit of the mechanical maintenance system and the transfer of energy;

(7) Natural methods are used in reproduction;

(10) The transport time of animals must be minimized;

11) animal husbandry products are produced from animals that have been on organic care from birth and throughout life;

12) excludes the cultivation of artificially produced polyploid animals;

13) products for cleaning and deinfection in the production of livestock products are used only if their use is allowed in organic production according to Article 17 This Act;

14. Animal care personnel must have basic knowledge and skills on the health and wellbeing of animals.

2. Detailed rules of production of organic products (raw materials) of animal origin are set by the Cabinet of Ministers of Ukraine.

Article 20. Rules for production of organic products (raw materials) aquaculture

1. Prior to the general rules of production of organic aquaculture products include:

(1) The selection of rocks takes into account the ability of animals to adjust to the stay in artificial conditions or in their respective fisheries facilities;

(2) In reproduction, mainly natural methods are used;

(3) The maintenance of animals must provide the satisfaction of the evolutionary, physiological and behavioral needs of animals through proper and sufficient feeding, ensuring proper water quality, construction of structures, which take into account the basic aspects of animals. their natural handling, the density of the chase;

5) in the production of such aquaculture products like molluscs, and other species that are not fed by humans, but by natural plankton, should be provided with the ability to meet their needs in feeding the natural path other than young individuals -We are reborn in the sprawers and incubators;

(6) Regular cleaning and disinfection of premises and structures shall be carried out;

(7) The maintenance shall be carried out in such a way to minimize the possibility of an escape herd;

8) organic animals must be kept separate from other animals of aquaculture;

(9) Any painful feeling of animals are reduced to a minimum, including feeling in the care.

2. Detailed rules for production of organic products (raw materials) aquaculture are set up by the Cabinet of Ministers of Ukraine.

Article 21. Rules for the production of organic seaweed

1. Prior to the general rules of production of organic seaweed production include:

1) the cultivation of seaweed occurs in coastal areas which have high environmental quality, not contaminated with substances that are forbidden to use when producing organic products (raw materials), or other harmful to health. Human substances;

(2) The harvesting of young algae should occur on a regular basis to support the internal population of the culture;

3) fertilizer can only be used in internal premises if their use was permitted according to Article 17 of this Act.

2. Detailed rules of organic seaweed production are set up by the Cabinet of Ministers of Ukraine.

Article 22. Rules for the production of organic products (raw materials)

1. Before the general rules of production of organic products (raw materials):

(1) The selection of species takes into account the ability of bees to adjust to local conditions, their viability, resistance to disease;

(2) In reproduction, mainly natural methods are used;

(3) The packaging area shall provide the necessary and sufficient food, access to water;

4) sources of natural nectar and pollen must consist of plants grown according to the requirements of this Law and regulations of production and circulation of organic products and raw materials, and/or wild plants;

(5) The health of the bees should be maintained on the basis of preventive measures;

6) The streets should be made of natural materials that do not pose the dangers of pollution to the environment and beekeeping products;

7) prohibits the destruction of bees in chairs as a method associated with the building of beekeeping products.

Chapter IV
THE HABITABILITY OF THE LAND FOR ORGANIC PRODUCTION AND RAW MATERIALS. CONFIRMING THE CONFORMITY OF PRODUCTION OF ORGANIC PRODUCE AND RAW MATERIALS

Article 23. The suitability of land (soils) for the production of organic products and raw materials

1. The assessment of the suitability of land (soils) for organic production and raw materials is carried out by the central body of executive power, implementing state policy on enforcement of environmental protection (control) the environment, in the field of land conservation.

2. The order of estimating the suitability of land (soil) for the production of organic products is approved by the Cabinet of Ministers of Ukraine.

3. The assessment of the suitability of land (soils) is done in order to obtain an independent from stakeholders (the entities that carry out the production, transportation, storage and implementation of organic products, raw materials) of objective information on the state of land, establishing their suitability for the production of organic products and raw materials, suitability for the production of individual crops.

Article 24. Assessment and confirmation of the conformity of production of organic products (raw materials)

1. Evaluation of the conformity of production of organic products (raw materials) is conducted by an organ in conformity assessment according to the rules of procedure for the approval of compliance by the central body of the executive branch Public policy in the field of conformity assessment, and with detailed production rules and the circulation of relevant organic products (raw materials).

2. Organic production and raw materials must comply with detailed production rules and the circulation of appropriate organic products (raw materials).

3. Evaluation of the conformity of production of organic products and raw materials is carried out by an auditor for certification.

To conduct an assessment of the correspondence, the person gives a statement on the transition to produce organic products to the body of conformity assessment.

The conformity assessment is made no later than 30 days from the day of the submission of a statement on the transition to production of organic products.

The conformity assessment is conducted by the certification auditor according to the plan and correspondence program, in which the objects are defined, the date of the conformity assessment. Copies of the plan and conformity assessment programs are sent to the applicant ' s address in the line no later than five working days prior to the start of the conformity assessment.

According to the evaluation results, the correspondence is (report) of a certification audit that within two days from the end of the conformity assessment process is transferred to the authority assessment authority to make decision about the issuance or failure of the issuance The certificate of compliance.

In conclusion (the report) of the certification audit is indicated by naming (surname, name, parent for physical person) and requisition of a person whose assessment of the production was carried out, surname, name, by parent of the certificate authority, revisit its athestat, detailed description of the production, description and results of carried out measures in the process of compliance assessment, the audit findings of the certification authority.

The conformity assessment of organic production and/or raw materials is conducted once every two years.

4. The conformity of production of organic products (raw materials) is carried out by the body in conformity assessment.

5. The validity assessment of the five working days from the day of the audit conclusion (report) of the certification audit is required to make a decision on the issuance or failure to issue a compliance certificate.

6. In the case of the decision-making body, the decision to reject the issuance of the person's correspondence over three working days from the day of adoption of such a decision is sent by a written message containing the reason for the refusal.

The basis for failure is:

(a) To verify that the requirements of this Act and the detailed rules of production and the circulation of the organic produce (raw materials) are not met;

The failure of issuing a certificate of correspondence with the sub-reason not predicted by this article is prohibited.

In the case of a failure of issuing a certificate from a clause provided by the paragraph "a", a person may advance to a transitional period in the order stipulated by the Act.

After eliminating the reasons for the "b" clause of this part, the person may re-address the relevant statement.

7. In case of a decision on issuing a certificate of correspondence, the identity of the person is given the certification of the installed sample in the three-day term from the day of adoption of such a decision, and the products can be labeled as an organic product.

8. The certificate is issued if all ingredients of live or unrecycled agricultural products are organic and produced according to the requirements established by this Act.

9. The certificate is issued if the recycled agricultural products have been completely made in accordance with the requirements of this Act and at least 95 percent of its ingredients are organic.

10. In the case of organic production (raw materials) with the application of traditional products (raw materials) and transition period products in the order defined by the Article 17 of this Act, the certificate is issued if 95 per cent of the ingredients of live or unrecycled agricultural products are organic and are produced according to the requirements established by this Act.
