This Act establishes basic legal, organizational, financial institutions of functioning of the higher education system, creating conditions for strengthening cooperation of public bodies and business with higher education institutions in the principles of higher education institutions, a combination of education with science and production to prepare competitive human capital for the country ' s high-tech and innovative development, self-realization of personality, ensuring the needs of society, labour market and the state in Qualified professionals.

Section I
GENERAL PROVISIONS

Article 1. Basic terms and definitions

1. In this Act, the terms are used in this way:

1) the autonomy of the higher educational institution-independence, independence and responsibility of the higher education institution in decision-making on the development of academic freedoms, the organization of educational process, scientific research, internal governance, -Economic and other activities, self-selection and the development of personnel within the limits established by the Act;

(2) Academic mobility is the ability of participants to learn, teach, to participate or conduct scientific activity in another higher educational institution (scientific institution) in the territory of Ukraine or outside of it;

3) academic freedom-independence and independence of participants of the educational process during the failure of pedagogical, scientific and pedagogical, scientific and/or innovative activities carried out on the principles of freedom of speech and creativity, dissemination of knowledge and information, conducting scientific research and the use of their results and is implemented with the provision of constraints established by law;

4) accreditation of educational program-evaluation of educational program and/or educational activities of the higher educational institution by this program on the subject:

The standard of higher education;

the ability to fulfil the requirements of the standard and achieve the stated results of the study;

The achievement of the stated results in the program;

5) higher education is a set of systematic knowledge, skills and practical skills, ways of thinking, professional, worldview and civil qualities, moral values, other competence gained in a higher educational institution (scientific) ) in the relevant field of knowledge according to a particular qualification on the levels of higher education, which is higher than the level of full general secondary education;

7) The higher educational institution is a separate kind of institution that is a legal entity of private or public law, acting under the issued license for educational activities at certain levels of higher education, conducts scientific, scientific, innovative and innovative. (11) Higher education-persons who study in a higher educational institution at a specific level of higher education with the aim of achieving appropriate degree and qualifications;

12) Qualification is the official result of evaluation and recognition obtained when an authorized institution has established that a person has achieved competence (study outcomes) according to the standards of higher education that is attributed to the relevant document on Higher education;

13) competence-a dynamic combination of knowledge, skills and practical skills, ways of thinking, professional, worldview and civil qualities, moral values that determine the ability of a person to successfully exercise professional and further Teaching activities and is the result of learning at a particular level of higher education;

(14) The credit of the European Credit Transfer System (further-credit ECTS) is a unit of measurement of the amount of the educational load of the higher education required to achieve the outstanding (expected) results of the study. The volume of one ECTS loan is 30 hours. The load of one academic year in the daytime form of training is usually 60 ECTS credits;

(15) Licensing is a procedure for recognizing the capacity of a legal person to carry out educational activities at a particular level on a particular level of higher education according to the standards of educational activities;

16) educational activities-activities of higher educational institutions to be done with the aim of providing higher, post-graduate education and the satisfaction of other educational needs of the recipients of higher education and other persons;

Article 2. Ukrainian legislation on higher education

1. Legislation of Ukraine on higher education is based on Constitution of Ukraine and consists of the laws of Ukraine "On Education" , "On scientific and scientific and technical activities" , this Act and other regulations, international treaties of Ukraine, in accordance with the law of order.

2. If international treaties of Ukraine, consent to the binding provided by the Verkhovna Rada of Ukraine, have established other rules than those envisaged by national legislation, rules of international treaties apply.

3. The rights of the higher educational institution governing its autonomy established by this Act cannot be restricted to other laws or regulations.

Article 3. Public Policy in Higher Education

1. The State policy in the field of higher education defines the Verkhovna Rada of Ukraine, and the implementation of the Cabinet of Ministers of Ukraine and the central body of the executive branch in the field of education and science.

2. The public policy in the field of higher education is based on the principles of:

1) to promote sustainable development of society through the preparation of competitive human capital and creating conditions for education during life;

(2) Accessibility of higher education;

(3) Independence of higher education from political parties, public and religious organizations (other than higher spiritual educational institutions);

(4) International integration and integration of the Higher Education System of Ukraine into the European Higher Education Space, provided the preservation and development of achievements and progressive traditions of the national high school;

5) the continuity of the process of gaining higher education;

6) the public support of training professionals with higher education for the priority areas of economic activity, the direction of fundamental and applied scientific research, scientific and pedagogical and pedagogical activities;

(7) public support for educational, scientific, scientific, technical and innovation activities of universities, academies, institutes, colleges, in particular through the provision of payment of taxes, fees and other mandatory payments to higher education institutions; The operation of such activity;

(8) Promoting public-private partnerships in higher education;

9) openness to the formation of structure and volume of educational and professional training of specialists with higher education.

3. The implementation and implementation of public policy in the field of higher education is provided by:

1) the harmonic interaction of national systems of education, science, business and the state with the aim of providing sustainable socioeconomic development of the state;

2) the preservation and development of the system of higher education and improving the quality of higher education;

(3) Extension of opportunities for higher education and education during life;

4) to create and ensure equal conditions of access to higher education, including providing individuals with special educational needs special training and creation for them free access to higher education infrastructure. The institution with regard to the limits of life-based activities;

5) the development of the autonomy of higher educational institutions and academic freedom of the participants of the educational process. (8) to provide individuals who study in higher education, benefits and social guarantees in the order established by the law;

9) the proper public support for training professionals from the number of persons with special educational needs based on the creation of free access to the educational process and providing special training and rehabilitation escorts;

(10) creating conditions for the implementation of graduates of higher educational institutions of the right to work, ensuring equal opportunities for choosing the place of work, the kind of employment in enterprises, in institutions and organizations of all forms of ownership To be given higher education and in accordance with the public needs;

11) the introduction of mechanisms to stimulate enterprises, institutions, organizations of all forms of property to the first working place of graduates of higher education institutions.

4. The State promotes higher education institutions as centres of independent thought.

Article 4. Right to higher education

1. Everyone has the right to a higher education.

Citizens of Ukraine have the right to receive a higher education in public and communal higher education institutions in a competitive basis according to the standards of higher education, if a degree of higher education is awarded for the first time by a state or the local budget.

Citizens of Ukraine are free to choose a higher educational institution, forms of excellence of higher education and specialty.

Citizens of Ukraine, who have not completed the state or local budget for a particular degree of education, have the right to re-establish a higher education in public and communal higher education according to the same degree of education, conditions of reparation to the state or local budget of funds spent on the payment of training services, in Order established by the Cabinet of Ministers of Ukraine.

The right to higher education is guaranteed regardless of age, nationality, place of residence, sex, skin color, social and property, nationality, language, origin, health, attitudes towards religion, presence of criminal record, and from others. To implement the right to higher education with special educational needs, higher education institutions create the necessary conditions for excellence in higher education.

To implement the right to higher education, individuals who need social support in accordance with the legislation is made full or partial financial support for their maintenance during the period of higher education in each educational level.

Citizens of Ukraine have the right to receive a higher education as a second specialty in public and communal higher education, if they have lost the opportunity to perform official or post-office duties. 2. Foreign and non-citizens who are permanently residing in Ukraine, persons who are given refugee status in Ukraine, persons who need additional or temporary protection, and persons granted to the status of foreign Ukrainian and who are in the Ukraine at the legal basis, has the right to gain higher education along with the citizens of Ukraine. Other foreigners and persons without citizenship may receive a higher education for the funds of the physical (legal) persons unless otherwise provided by international treaties of Ukraine, whose obligation is given by the Verkhovna Rada of Ukraine, legislation or agreements between Ukraine. All persons who receive higher education in higher education have equal rights and responsibilities.

Chapter II
LEVELS, DEGREES AND QUALIFICATIONS OF HIGHER EDUCATION

Article 5. Levels and degrees of higher education

1. The training of higher education professionals is carried out on the appropriate educational and professional, educational-scientific, scientific programs at such levels of higher education:

Initial level (short cycle) of higher education;

First (Bachelor) level;

Second (master) level

Third (educational) level;

A scientific level

The initial level (short cycle) of higher education corresponds to the fifth qualifying level of the National Qualification Framework and provides for the degree of general cultural and professional oriented training, special skills and knowledge, as well as certain the experience of their practical application with the purpose of fulfilling the typical tasks envisaged for primary positions in the relevant field of professional activity.

The first (bachelor) level of higher education corresponds to the sixth qualifying level of the National Qualification Framework and provides for the benefit of the theoretical knowledge and practical skills and skills sufficient to successfully perform professional duties abroad. The second (master's) level of higher education corresponds to the seventh qualifying level of the National Qualification Framework and stipulates the acquisition of a special in-depth theoretical and/or practical knowledge, skill, skills by the chosen specialty (s). The third (educational and scientific) level of higher education corresponds to the eighth qualifying level of the National Qualification Framework and provides for the advancement of theoretical knowledge, skills, skills and other competences sufficient to produce new ideas, solving complex problems in the field of professional and/or research-innovation activities, ownership of the methodology of scientific and pedagogical activities, and to conduct its own scientific study whose results have a scientific novelty, Theoretical and practical.

The scientific level of higher education corresponds to the ninth qualifying level of the National Qualification Framework and provides for the acquisition of competence and implementation of methodology and methodology of research work, creation of new systems knowledge and/or progressive technology, the solution of an important scientific or applied problem that has a nationwide or world value.

2. The education of higher education at each level of higher education involves the successful execution of an appropriate educational (educational and educational or scientific) or scientific program, which is the basis for the awarding of the appropriate degree of higher education:

(1) A junior bachelor;

(2) Bachelor;

(3) Master

(4) Doctor of Philosophy;

(5) Doctor of Sciences.

3. Junior Bachelor is an educational professional degree achieved at the beginning level (short cycle) of higher education and awarded to a higher educational institution as a result of successful performance of the higher education of the educational and professional program, the volume of which is 90-120 of the ECTS credits.

The person has the right to obtain a degree in a bachelor's degree if it has full general secondary education.

4. The Bachelor is an educational degree which is awarded to the first level of higher education and is awarded to a higher educational institution as a result of successful completion of the higher education of the educational and professional program, which is estimated to be 180-240 of the ECTS credits. The volume of educational and professional programs for obtaining a bachelor's degree based on the degree of a junior bachelor's degree is determined by the higher educational institution.

The person has the right to earn a bachelor's degree if it has full general secondary education.

5. The Magister is an educational degree obtained at the second level of higher education and is awarded to a higher educational institution (a scientific institution) as a result of a successful performance of the higher education of the relevant educational program. A master's degree is awarded for educational and educational programs. The volume of educational and professional master training program is 90-120 credit cards, and the volume of educational and scientific programs-120 credits of the ECC. 6. Doctor of Philosophy is the educational and simultaneously the first scientific degree gained in the third level of higher education based on the degree of master ' s degree. Article 6. Higher education

1. The institution is the setting of compliance with acquired achievements of higher level education and knowledge volume, skill, other competence requirements of higher education standards.

2. The situation of persons who acquire the degree of a junior bachelor, bachelor or master, is carried out by an examination commission, which may include the representatives of employers and their associations, in accordance with the provisions of the examination commission, approved by the council of the higher educational institution (scientific institution).

3. The certification of persons who receive a PhD is carried out by a continuously acting or one-time specialized institution of higher education or scientific institution accredited by the National Agency for Quality Education, based on public protection of scientific advances in the form of a thesis. The degree of Doctor of Philosophy has the right to choose a specialized example.

4. The certification of persons receiving a Doctor of Science is carried out by a constantly acting specialized institution of higher education or scientific institution accredited by the National Agency for Quality Education, on the basis of public protection of scientific achievements in the form of a thesis or published monograph, or a collection of articles published in domestic and/or international peer-reviewed publications, whose list is approved by the central body of the executive branch in the field of education and science.

5. Disertations of individuals who acquire a PhD, and a thesis (or scientific reports in case of protection of scientific achievements, published in the form of monographs or of a collection of articles published in domestic and/or international peer reviewed) (a) of persons who receive a PhD, and their opponents ' reviews are published on official websites of relevant higher education institutions (scientific institutions) according to the legislation.

Article 7. Documents on higher education (scientific degrees)

1. A paper on higher education (scientific degree) is issued to the person who successfully fulfilled the relevant educational (scientific) program and has passed the certification process.

2. The following types of documents on higher education (scientific degrees) are set on the appropriate steps:

A diploma in junior college

Bachelor's degree

Master's diploma

The Doctor of Philosophy;

-Doctor of Science.

3. In the diploma of a junior bachelor, a bachelor, a master ' s name is indicated by the name of a higher education institution (scientific institution) issued this document (in the case of higher education in a separate unit of the higher education institution (scientific institution)- The name of the unit is also the name of such a unit, as well as qualification, consisting of information about the achievements of the degree of higher education, specialty and specialization, and in certain cases-professional qualification.

4. 6. A paper on the higher education of a state model is issued by a higher education institution only by an accredited educational programme. 7. 8. 10. Information on the issued diplomas is provided by higher education institutions, in addition to higher military institutions, to the Unified State Electronic Database on Education.

Article 8. The only public electronic base on education

1. In the field of higher education, a public electronic base on education includes the Register of Higher Education Institutions, the Register of Documents on higher education and the Register of certificates of external evaluation.

2. The Register of Higher Education institutions contains information about each higher educational institution issued to him with licenses and certificates of accreditation. The Higher Education Registry Information is open and published according to the requirements Law of Ukraine "On access to public information", including in the form of open data.

3. The Register of documents on higher education contains information about:

1) documents of the state model issued by higher educational establishments (scientific institutions) of Ukraine, except information on graduates of higher military educational institutions and military training units of higher education institutions;

2) own documents on higher education issued by higher education institutions of Ukraine;

(3) The documents issued by the foreign higher educational institutions recognized by the central body of the executive power in the field of education and science;

4) documents issued by foreign higher education institutions recognized by the higher educational institution of Ukraine.

Physical and legal persons have access to Reester Documents on higher education in the volume sufficient to verify the authenticity of a document on higher education.

4. The Register of certificates of external independent evaluation contains information on the certificates of external independent evaluation. These information is available to test their authenticity during the reception of higher education institutions.

5. The Office of the Unified State Electronic Database on Education is the central body of the executive branch in the field of education and science.

6. The person has full access to all information provided to the Unified State Electronic Database on Education.

7. The free and free access of persons to the information contained in the Unified State Electronic Based on Education is carried out through the official website of the Central Executive Body in the field of education and science.

8. Position The Unified State Electronic Education Base is being developed by the Central Executive Body in the field of education and science and is approved by the Cabinet of Ministers of Ukraine.

Chapter III
STANDARDS OF EDUCATION AND HIGHER EDUCATION

Article 9. Educational Standards

1. The standard of educational activities is the set of minimum requirements for the personnel, educational and methodical, material and technical and information provision of the educational process of the higher educational institution and of the scientific institution.

2. Educational standards are developed for each level of higher education within each speciality with the need to create conditions for persons with special educational needs and are mandatory to perform all higher educational needs. institutions, regardless of the form of property and submission, as well as scientific institutions that provide the preparation of the doctors of philosophy and the doctors of sciences.

3. Educational standards are being developed and approved by the central body of the executive branch in the field of education and science under the consent of the National Agency for the Quality of Higher Education.

Article 10. Higher education standards

1. The standard of higher education is the set of requirements for the content and results of educational activities of higher educational institutions and scientific institutions for each level of higher education within each specialty.

2. Higher education standards are developed for each level of higher education within each speciality according to the National Qualification Framework and used to determine and evaluate quality content and results of educational activities higher. Educational institutions (academic institutions).

3. The standard of higher education determines the following requirements for the educational program:

1) the volume of the ECTS credits required for the benefit of the appropriate degree of higher education;

4. Chapter IV
MANAGEMENT IN THE FIELD OF HIGHER EDUCATION

Article 11. Higher education system

1. The system of higher education is as follows:

1) higher education institutions of all forms of ownership;

(2) Levels and degrees (qualifications) of higher education;

(3) The areas of knowledge and specialty;

4) educational and scientific programs;

5) standards of educational activities and standards of higher education;

(6) The bodies exercised by the management in the field of higher education;

(7) Participants in the educational process.

Article 12. Management in the field of higher education

1. The Office of Higher Education within its authority is exercised by:

1) The Cabinet of Ministers of Ukraine;

2) the central body of the executive power in the field of education and science;

3) by industry authorities, to the scope of which the higher education institutions are owned;

4) by the authorities of the Autonomous Republic of Crimea, the authorities of local self-government, to the scope of which the higher education institutions belong;

5) by the National Academy of Sciences of Ukraine and the national industry academies of sciences;

6) founders of higher educational institutions;

7) public authorities in the field of higher education and science;

(8) National Agency for Quality Education.

2. The Cabinet of Ministers of Ukraine through the executive body system:

1) provides the implementation of public policy in the field of higher education;

2) organizes the development, approves and provides the performance of public education programs of the scope of higher education;

3) provides the development and implementation of measures to create a material and technical base and other conditions necessary for the development of higher education;

4) issues within their powers of legal and legal acts on matters of higher education;

(5) directly or through the authorized body authorize the rights of the founder, stipulated by this and other laws of Ukraine, regarding the higher educational institutions of the state form of property;

(6) Creates the effective mechanisms of implementation of the prescribed by the Law of Higher Education, scientific, scientific, pedagogical and pedagogical workers and persons studying in higher education;

7) provides a wide participation of independent experts and members of the public, employers and individuals studying in higher education, in preparation and adoption of normative action projects and other decisions relating to regulation. The interactions of the constituent systems of higher education and its functioning as a whole;

8) sets the special conditions of training for priority high-tech areas according to government target programs;

9) provides the exercise of control over the approval of legislation on higher education.

Article 13. The powers of the central authority of the executive branch in the field of education and science, other bodies, to the scope of which are higher education institutions

1. The Central Executive Body in Education and Science:

1) develops the strategy and programmes of the development of higher education and delivers them to the approval of the Cabinet of Ministers of Ukraine;

2) participates in the formation and implementation of public policy in the field of higher education, science, training of higher education professionals;

3) systematically tracking and analyzes the needs of the domestic labour market, make suggestions for the volumes and directions of state support for training professionals with higher education;

4) the failure of analytical activities in the field of higher education, determines the trends of its development, the impact of the demographic, ethnic, socio-economic situation, infrastructure of production and non-production spheres, and forms strategic areas of development higher education with regard to scientific progress and other factors, generalizes the world and domestic experience to the development of higher education;

5) supervide international cooperation on matters belonging to its competence;

(6) Provides the functioning of the Unified State Electronic Database on Education;

(7) Forms knowledge of knowledge and list of specialties The preparation of the National Agency for Higher Education, including the provision of the National Agency for Higher Education, and providing them to the approval of the Cabinet of Ministers of Ukraine;

(8) approve forms of documents on higher education (scientific degrees) of the state specimen;

9) publishes licences for educational activities on the basis of a positive peer review of the National Agency for the Quality of Higher Education, and redecorates and annoys them;

10) forms proposals and accommodates state order for training professionals with higher education in the order established by the law;

11) contribute to the employment of graduates of higher education institutions;

19) establishes the order of awarding the higher education institutions and scientific institutions of the ranks of scientific and scientific teaching staff, as well as the order of imprisonment of scholars;

(20) provides regulatory and legal acts on matters of higher education in cases provided by the Act;

21) for the publication of the National Agency for the Quality of Higher Education, approves a provision for the accreditation of educational programmes;

22) develops the order of conducting a license examination and delivers it to the approval of the Cabinet of Ministers of Ukraine;

23) elaborates on the order of implementation of the right to academic mobility and delivers it to the approval of the Cabinet of Ministers of Ukraine;

24) defines the regulation of the material and technical and financial support of higher educational institutions in the order established by the Cabinet of Ministers of Ukraine;

25) exercise other powers in accordance with the legislation.

2. State bodies, to the scope of which are higher education institutions:

1) participate in the implementation of public policy in the field of higher education, science, vocational training of specialists, in licensing of educational activities to be made by higher educational institutions;

2) form proposals and place a state order for training professionals with higher education in the order established by the legislation;

3) participate in the definition of the regulation of the logistical and financial support of higher education institutions;

4) undertake the distribution of graduates of higher educational institutions belonging to the scope of their management, for further passage of the service (for higher military educational institutions (higher education institutions with specific teaching conditions) and Employment in health care (for higher health education institutions) within public order;

5) analyse the quality of educational activities of higher educational institutions belonging to the scope of their management;

(6) directly or through the authorized body, implement the rights and obligations of the founder stipulated by this and other laws of Ukraine, regarding higher educational institutions belonging to the scope of their management;

(7) exercised other powers in accordance with the legislation.

3. The Office of the highest spiritual institution is carried out with regard to the peculiarities of its activities according to the legislation.
