Chapter I General provisions article 1. The main terms and their definitions 1. In this law, the terms used in the following meaning: 1) the autonomy of the higher education institution-autonomy, independence and responsibility of higher education institution in making decisions concerning academic freedom, the Organization of the educational process, scientific research, internal management, economic and other activity, independent of selection and placement within the limits established by this law;

2) academic mobility-the ability of participants in the educational process to learn, teach, train or carry out scientific activities in another institution of higher education (research institution) on the territory of Ukraine or abroad;

3) academic freedom-autonomy and independence of the participants of educational process during proceedings of pedagogical, scientific-pedagogical, scientific and/or innovation activities carried out on the principles of freedom of expression and creativity, dissemination of knowledge and information, conducting scientific research and use their results and implemented taking into account the restrictions established by law;

4) accreditation of educational programs-evaluation of educational programs and/or educational activities of higher educational establishment under this program on the subject: according to the standard of higher education;

the ability to fulfill the requirements of the standard and to achieve changes in the program learning outcomes;

achieve the stated in the program learning outcomes;

5) higher education-a set of systematized knowledge, skills and practical skills, ways of thinking, professional, philosophical and civic qualities, the moral and ethical values, and other information, obtained in a higher educational establishment (research institution) in the relevant field of expertise for specific qualifications in higher education, that the complexity is higher than the level of secondary education;

6) higher military educational institution (the institution with specific conditions training)-institution of State-owned, which provides for certain levels of higher education training of cadets (students, students), postgraduate for further service as an officer (provision, petty) or a boss part to meet the needs of the Ministry of Internal Affairs, the national police, the armed forces of Ukraine, established in accordance with the laws of Ukraine military formations , central bodies of the Executive power with a special status, the security service of Ukraine, the Foreign Intelligence Service of Ukraine, the central body of the Executive power, which implements the State policy in the sphere of protection of the State border, the central body of the Executive power, which provides forming and implementing State policy in the field of civil protection;

{Point 6 of article 1, as amended by the law No. 766-VIII from 10.11.2015} 7) higher educational institution-a separate type of institution which is a legal entity of private or public law, acting in accordance with the published license for conducting educational activities at certain levels of higher education, conducts scientific, scientific-technical, innovation and/or methodological activities provides the Organization of the educational process and the receipt of persons of higher education , postgraduate education tailored to their vocations, interests and abilities;

8) branch of knowledge-the main subject area of education and science, which includes a group of related specialties, which is carried out by professional training;

9) European credit transferno-accumulation system (ECTS) is a system of transfer and accumulation of credits used in the European higher education area in order to provide recognition, qualifications and educational components and promotes academic mobility of job seekers higher education. The system is based on a determination of the applicant's workload higher education required for the attainment of learning outcomes, and are recorded in ECTS;

10) founder of the higher educational institution-State authorities on behalf of the State, the Council, on behalf of the local community (communities), physical and/or legal person the decision and at the expense of property of which the institution is established. The founder's rights provided for by this law, many also on the grounds stipulated by civil law;

11) seekers of higher education-persons enrolled in high school at a certain level of higher education with the purpose of obtaining the relevant degree and qualification;

12) qualification-official result evaluation and recognition, which obtained when the authorized institution has determined that the person has achieved competencies (learning outcomes) in accordance with the standards of higher education, which is confirmed by the corresponding document on higher education;

13) competence-a dynamic combination of knowledge, skills and practical skills, ways of thinking, professional, philosophical and civic qualities, the moral and ethical values, which determines a person's ability to successfully carry out vocational and further training activities and is the result of training at a certain level of higher education;

14) credit European credit transferno-accumulation system (hereinafter credit ECTS)-a unit of measurement of the volume of workload in the applicant's higher education needed to achieve certain (expected) results of studies. The size of one credit ECTS is 30 hours. The load of one academic year of full-time is usually 60 ECTS;

15) licensing-procedure for the recognition of the capacity of a legal entity to conduct educational activities for a particular specialty at a certain level of higher education according to the standards of educational activity;

16) educational activities-activities of higher educational institutions, which are carried out with the aim of obtaining higher postgraduate education and meet other educational needs of applicants for higher education and other persons;

17) education (educational professional or educational-scientific) program-a system of educational components at the appropriate level of higher education within the specialty, which defines the requirements for the level of education of people who can start learning this program, list of academic disciplines and the logical sequence of their study, the number of ECTS credits is required for the execution of this program, as well as the expected learning outcomes (competencies) that must master the receiver corresponding to the degree of higher education;

18) person with special educational needs-a person with a disability who requires additional support to ensure the acquisition of higher education;

19) learning outcomes-the aggregate knowledge, abilities, skills, and other competencies acquired by a person in the learning process by a specific educational and vocational, educational and scientific program that can identify, qualify and measure;

20) specialization-a component of the specialty, which is determined by the higher education institution and provides relevant specialized educational professional or educational-scientific training program job seekers of higher and postgraduate education;

21) specialty-a component of the field of knowledge, which is carried out by professional training;

22) sustainable Fund (endavment) higher educational institution-the amount of money or other property for investment or capitalization for a term of not less than 36 months, passive income from which are used by the institution for the purpose of its statute activity in the order determined by the benefactor or authorized person;

23) quality of higher education level attained by a person of knowledge, abilities, skills, and other competencies that shows its competence in accordance with the standards of higher education;

24) quality educational activity-level organization of the educational process in higher educational establishment that meets the standards of higher education, provides the receipt of persons of quality higher education and promotes the creation of new knowledge.

Article 2. Legislation on higher education 1. Legislation on higher education is based on the Constitution and consists of the law of Ukraine "on education", "about scientific and scientific-technical activity", this law and other normative legal acts, international treaties of Ukraine concluded in accordance with the law.

2. If the international agreements of Ukraine, consent to be bound by the Verkhovna Rada of Ukraine, established other rules than those provided for in national legislation, apply the rules of international agreements.

3. the right to a higher education institution that define its autonomy, established by this law, may not be limited by other laws or regulations.


Article 3. State policy in the sphere of higher education 1. State policy in the sphere of higher education determines the Verkhovna Rada of Ukraine, and implement the Cabinet of Ministers and the central body of the Executive power in the sphere of education and science.

2. State policy in the sphere of higher education is based on the following principles: 1) promote sustainable development of society by preparing a competitive human capital and create conditions for education for life;

2) accessibility of higher education;

3) higher education obtaining independence from political parties, civic and religious organizations (except higher religious educational institutions);

4) international integration and integration of the system of higher education in the European space of higher education, subject to conservation and development achievements and progressive traditions of national higher school;

5) continuity of the process of obtaining higher education;

6) State support for training specialists with higher education for the priority sectors of economic activity, areas of fundamental and applied research, scientific-pedagogical and educational activities;

7) State support for educational, research, scientific and technical and innovation universities, academies, institutes, colleges, in particular by granting privileges to the payment of taxes, fees and other mandatory payments higher educational institutions that conduct such activities;

8) promoting public-private partnerships in the field of higher education;

9) openness of the structure and scope of the education and training specialists with higher education.

3. the formulation and implementation of State policy in the sphere of higher education provided by: 1) harmonious interaction between the national systems of education, science, business and the State in order to ensure sustainable socio-economic development of the State;

2) preservation and development of the higher education system and improving the quality of higher education;

3) expansion of opportunities for higher education and education for life;

4) create and ensure equal access to higher education, including ensuring persons with special educational needs special training and rehabilitation counselling and making them free access to the infrastructure of the institution taking into account the constraints of life due to health reasons;

5) development of the autonomy of higher education institutions and academic freedom of participants in the educational process. The autonomy of higher education determines the necessity of such self-organization and self-regulation, which are open to criticism, serve as public ìnteresovì, establishing the truth about the challenges facing the State and the society are carried out transparently and publicly;

6) definition of a balanced structure and volume of training specialists with higher education to meet the needs of the person, the interests of the State, local communities and employers;

7) ensure the development of scientific, scientific-technical, and innovation activity of higher education institutions and their integration with the production;

8) individuals enrolled in higher educational institutions, benefits and social guarantees in the manner prescribed by law;

9) proper government support for training specialists from a number of individuals with special educational needs based on creating for them free access to the educational process and to provide special training and rehabilitation support;

10) creating the conditions for implementation of the graduates of higher educational institutions of the right to work, ensuring guarantees of equal opportunities for the choice of the place of work, type of work activities in enterprises, institutions and organizations of all forms of ownership with regard to higher education and obtained in accordance with social needs;

11) introducing mechanisms to stimulate the enterprises, establishments, organizations of all patterns of ownership to providing workplace first graduates of higher educational institutions.

4. the State promotes the development of universities as centers of independent thought.

Article 4. The right to higher education 1. Everyone has the right to higher education.

Citizens of Ukraine have the right to obtain free higher education in State and communal educational establishments on a competitive basis in accordance with the standards of higher education, if a certain degree of higher education of the citizen for the first time at the expense of the State or local budget.

Citizens of Ukraine are free in the choice of higher education institution, a form of obtaining higher education and specialty.

Citizens of Ukraine who have not completed training at the expense of the State or local budget for a certain degree of education, have the right to re-charge to get higher education in State and communal educational establishments for the same degree of education, provided reimbursement to the State or local budget funds spent for payment of services of training, in the manner established by the Cabinet of Ministers of Ukraine.

{The first part of article 4 update: new paragraph pursuant to law No. 367-VIII from 23.04.2015} right to higher education is guaranteed, regardless of age, citizenship, residence, gender, skin color, social and financial status, nationality, language, origin, health status, attitude to religion, convictions and other circumstances. No one may be restricted in the right to receive higher education, except in cases established by the Constitution and laws of Ukraine.

Is not considered as discrimination law for higher education set restrictions and privileges that are defined by the specific conditions of obtaining higher education, expected features of obtaining the qualification.

For the realization of the right to higher education for persons with special educational needs higher educational institutions creates them with the necessary conditions for obtaining the quality of higher education.

For the realization of the right to higher education for persons in need of social assistance in accordance with the legislation, full or partial financial assistance for their maintenance during the period of obtaining them higher education for each educational level.

Citizens of Ukraine have the right to obtain free higher education for the second specialty in State and public institutions of higher education, if for health reasons, they have lost the ability to perform service or responsibilities for the previously received qualifications which is confirmed by the conclusions of the medical social Expert Commission, and in other cases provided by law.

2. Aliens and stateless persons permanently residing in Ukraine, persons granted refugee status in Ukraine, individuals who need additional or temporary protection and persons to whom granted the status of a Ukrainian, and who are in Ukraine on legal grounds, have the right to receive higher education on a par with citizens of Ukraine. Obtaining of higher education noted categories of persons at the expense of the State budget is carried out within the ranges specified by the Cabinet of Ministers of Ukraine.

Other foreigners and persons without citizenship can acquire higher education funds of individuals (legal) persons, unless otherwise provided by international agreements of Ukraine, consent to be bound by the Verkhovna Rada of Ukraine, laws or agreements between higher education institutions of international academic mobility.

All persons who receive higher education in higher educational institutions, have equal rights and obligations.

Section II levels, DEGREES and QUALIFICATIONS of HIGHER education article 5. The level and extent of higher education 1. Training specialists with higher education is carried out according to the respective educational professional, educational and scientific, scientific programs on such levels of higher education: initial level (short cycle) of higher education;

the first (an undergraduate) level;

the second (master's) level;

the third (educational) level;

scientific level.

Initial level (short cycle) of higher education meets the fifth qualifying level of the national qualifications framework and provides for the receipt of general cultural face and professionally oriented training, special skills and knowledge, as well as a certain experience of their practical application in order to perform common tasks, which are provided for the initial posts in the relevant field of professional activity.

The first (an undergraduate) level of higher education meets the sixth qualifying level of the national qualifications framework and provides the receipt by a person of the theoretical knowledge and practical skills sufficient to successfully perform professional duties in the chosen specialty.

The second (master's) level of higher education meets the seventh qualifying level of the national qualifications framework and provides for obtaining person in-depth theoretical and/or practical knowledge, abilities, skills in the chosen specialty (or specialization), general principles of methodology of scientific and/or professional activities, other information sufficient for effective objectives innovation nature of the appropriate level of professional activity.

The third (educational) level of higher education meets the eighth qualifying level of the national qualifications framework and provides the receipt by a person of theoretical knowledge, abilities, skills and other information sufficient for the production of new ideas, solve complex problems in the field of professional and/or research and innovation activities, adopting the methodology of scientific and educational activities, as well as conduct their own scientific research, the results of which are scientific novelty, the theoretical and practical value.

Scientific level higher education meets the ninth qualifying level of the national qualifications framework and provides for the acquisition of competencies with the development and implementation of methodologies and techniques of research, creation of new strategic knowledge and/or advanced technologies, solving the important scientific or applied problems, which has national or international importance.

2. Obtaining a higher education at every level of higher education involves the successful completion of the respective person education (educational professional or educational-scientific) or scientific programs that are the basis for the award of an appropriate degree of higher education: 1) junior Bachelor;

2) Bachelor;

3) master;

4) doctor of philosophy;


5) doctor of Sciences.

3. Junior Bachelor is educational-professional degree, which is taken at the initial level (short loop) higher education and awarded to the institution as a result of successful implementation of jobseeker which higher education educational-professional programs, the amount of which is 90-120 ECTS.

The person has the right to acquire a degree of junior Bachelor of availability in secondary education.

4. Bachelor degree education is that it is taken on the first level of higher education and awarded to the institution as a result of successful implementation of jobseeker which higher education educational-professional programs, the amount of which is 180-240 ECTS. The volume of educational-professional programs for Bachelor's degrees on the basis of the degree of junior Bachelor's degree is determined by the higher education institution.

The person has the right to obtain a Bachelor's degree if the complete general secondary education.

5. the Master is the educational degree that is taken on the second level of higher education, and given the higher educational institution (scientific institution) as a result of successful implementation of jobseeker which higher education relevant educational program. A master's degree is for educational and vocational or educational-scientific program. The volume of educational-professional programs of preparation master is 90-120 ECTS credits, the amount of educational-scientific program – 120 ECTS. Educational and scientific program master necessarily include research (research) component of the volume of not less than 30 per cent.

{The first paragraph of part five article 5 amended by law No. 848-VIII from 26.11.2015} Person has the right to obtain a master's degree if the degree of the Bachelor's degree.

Master's degree in medical, pharmaceutical or veterinary route is taken on the basis of complete secondary education and awarded higher education institution (scientific institution) as a result of successful implementation of jobseeker which higher education relevant educational programs, the amount of which is 300-360 ECTS.

{Paragraph three part five article 5 amended by law No. 848-VIII from 26.11.2015} scientific institutions of National Academy of Sciences of Ukraine and the national academies of Sciences can make preparation of masters in their own educational and scientific program in accordance with the received license to appropriate educational activities. Scientific institutions can also make training masters in educational research program, consistent with higher education institution. In this case, the scientific component of such a program is carried out in a scientific institution and educational component-in high school.

6. Doctor of philosophy-it's educational and at the same time the first degree that is taken on the third level of higher education based on the master's degree. Ph.d. awarded a specialized scientific Council for higher education or research institution as a result of successful implementation of jobseeker which higher education relevant educational and scientific programs and public protection of dissertations in the specialized scientific Council.

The person has the right to acquire a Ph.d. during postgraduate (post graduate courses). Persons who are professionally engaged in scientific, scientific-technical or scientific-pedagogical activity at the main place of work, have the right to obtain the degree of doctor of philosophy outside of the monograph, in particular during the stay in the creative leave, subject to the successful implementation of appropriate educational and scientific programs and public protection of dissertations in the specialized scientific Council.

Normative term of training PhD graduate (post graduate courses) is four years. The scope of the educational component of the educational-scientific training programs PhD is 30-60 ECTS.

Scientific institutions can carry out training of doctors of philosophy for its own educational and scientific program in accordance with the received license to appropriate education or educational scientific program, some elements of which are provided with other scientific institutions and/or higher education institutions.

7. Doctor of science is the second academic degree that is acquired by a person at the scientific level of higher education on the basis of the degree of doctor of philosophy and provides entry into the highest competencies in the field of development and implementation of methodology of research, conducting original research, obtaining scientific results which provide the solution of important theoretical or applied problems, have the national or global importance and published in scientific journals.

A PhD is awarded a specialized scientific Council for higher education or research establishments on the results of public protection of scientific achievements in the form of a thesis or published monographs, or set of articles published in national and international peer-reviewed professional publications, a list of which is approved by the central body of the Executive power in the sphere of education and science.

Article 6. Certification seekers of higher education 1. Certification is examining the compliance of higher education applicants learned of the level and volume of knowledge, skills, and other competencies requirements of higher education.

Certification is carried out openly and publicly. Seekers of higher education and other persons present at the certification, including during the thesis, can freely carry out audio and/or vìdeofìksacìû the process of certification.

2. certification of persons who acquire Bachelor degree or junior master, Bachelor, is conducting by the Commission, which may included representatives of employers and their associations, in accordance with the regulations on the test Commission, approved by the Academic Council of higher education (research institution).

{The first paragraph of part two article 6 amended by law No. 848-VIII from 26.11.2015} higher educational institution on the basis of the decision of the examination Commission awards the person who successfully performed the educational program at a certain level of higher education, the appropriate degree of higher education and assigns the appropriate qualifications.

Certification of persons who acquire a master's degree, can be carried out in the form of a single State qualifying exam on specialities and in the order specified by the Cabinet of Ministers of Ukraine.

3. the Certification of persons who receive a Ph.d. is constantly acting up or off a specialized scientific Council for higher education or scientific institution, accredited by the National Agency for quality assurance in higher education, on the basis of public protection of scientific achievements in the form of a dissertation. A competitor of the degree of doctor of philosophy, has the right to choose the specialized scientific Council.

4. certification of persons who get a PhD, is constantly operating a specialized scientific Council for higher education or scientific institution, accredited by the National Agency for quality assurance in higher education, on the basis of public protection of scientific achievements in the form of a thesis or published monographs, or aggregate articles published in domestic and/or international peer-reviewed professional publications, a list of which is approved by the central body of the Executive power in the sphere of education and science.

5. Thesis of persons who get a PhD and dissertation (or scientific reports in the case of protection of scientific achievements, published as monographs or a collectively articles published in domestic and/or international peer-reviewed professional journals) of persons who get a PhD, as well as reviews of the opponents are published on the official Web sites of the respective higher education institutions (academic institutions) in accordance with the legislation.

6. To protect the allowed thesis (research report), Jobseeker which degree. Detection in submitted to the defence of the thesis (research report) academic plagiarism is grounds for refusal must be of the appropriate degree.

Detection of academic plagiarism in the protected dissertations (research reports) is grounds for cancellation of the decision of the specialized scientific Council on awarding the degree and the issuance of a corresponding diploma. If the thesis (research report), which revealed the academic plagiarism, has been protected continuously the specialized academic Council, Scientific Adviser (consultant), the official reviewers who provided positive findings of scholarly work, and the Chairman of the respective specialized scientific Council are deprived of the right to participate in the work of specialized academic councils for a period of two years, and higher educational institution (research institution) is deprived of accreditation appropriate permanent specialized scientific Council and to create a single specialized academic Council for a term of one year. If the thesis (research report), which revealed the academic plagiarism, was in razovìj the specialized academic Council, the Scientific Director, members of this Council and the official reviewers who provided positive findings of scholarly work, are deprived of the right to participate in the work of specialized academic councils for a period of two years, and higher educational institution (research institution) loses the right to create a single specialized academic Council for a term of one year.

Cancellation of the decision of the specialized scientific Council to award scientific degree in the case of academic plagiarism is carried out by the National Agency for quality assurance in higher education at the request of the Committee on ethics in the order determined by the Cabinet of Ministers of Ukraine and may be appealed in accordance with the legislation.

Article 7. Documents on higher education (degree) 1. Document on higher education (degree) is issued to a person who has successfully performed the appropriate education (scientific) program and passed the attestation.

2. Set the following types of documents on higher education (degree) for the respective degrees: Diploma of junior Bachelor;

the Bachelor's degree;


a master's degree;

Diploma of doctor of philosophy;

Diploma of doctor of science.

3. diploma of junior Bachelor, Bachelor's degree, master's degree shall include the name of the institution of higher education (research institution) that issued this document (in case of obtaining higher education in a secluded section of institution of higher education (research institution) is also the name of this unit), as well as qualification, which consists of information about an entity a degree of higher education, profession and specialization, and in certain cases professional qualifications.

4. diploma of doctor of philosophy, doctor of Sciences shall include the name of the institution (Scientific Institute), which was carried out, the name of the institution of higher education (research institution), in the specialized academic Council which (which) is protected by the scientific achievements, as well as the name of the qualification, which consists of information about an entity degree, industry knowledge and/or specialty.

In the title of the qualifications are Ph.d. and industry knowledge (PhD in the field of biology, etc.). If the dissertation research performed in the related fields of knowledge, the degree of doctor of philosophy and doctor of science conferred by the leading industry indicating the interdisciplinary nature of the work.

5. An integral part of the Bachelor, master, PhD is an addition to the diploma of the European type, which contains structured information about completed studies. In the Diploma Supplement contains information on the results of the training of the person consists of information about the names of disciplines, estimation and obtained the number of ECTS, as well as information on the national system of higher education of Ukraine.

An integral part of the diploma of junior Bachelor is a supplement to the diploma.

6. document on higher education State standard appears to be the only institution accredited educational program. The neakreditovanoû educational program for higher education institutions produce and publish their own documents on higher education in the order and according to the model, specified by the Academic Council of higher educational establishment.

7. documents on higher education State standard for persons who are studying for public order, are higher educational institutions and are issued at the expense of the State budget, and for people who are studying at the expense of individuals or legal entities, the cost of higher education is included in the cost of training. The marginal cost of documents on higher education State standard and a list of information that should be contained in the document about higher education, are established by the Cabinet of Ministers of Ukraine.

8. In the case of the receipt by a person of higher education agreed between higher education institutions, including foreign, educational programs higher education institutions have the right to produce and publish joint degrees on the model defined by the common decision of the scientists of the Councils of these universities.

9. in case of acquisition of a person of higher education simultaneously in two directions (specializations) higher educational institution has the right to produce and publish a double diploma for the model specified by the Academic Council of higher educational establishment.

10. information about issued diplomas introduced higher educational institutions, in addition to the higher military educational institutions, to a single State electronic base of education.

Article 8. The only State electronic base of education 1. In higher education the only State electronic base of education includes a Directory of higher education institutions, registry documents about higher education and register of certificates of external independent evaluation.

2. Directory of higher education institutions provides information about every institution, issued him a license and certificates of accreditation. The information in the register of higher education institutions are public and are published in accordance with the law on access to public information ", including in the form of open data.

3. The register of documents on higher education provides information about: 1) documents issued by government institutions (academic institutions) of Ukraine, in addition to information about the graduates of military schools and military educational departments of higher educational institutions;

2) own documents about higher education, issued by the higher educational institutions of Ukraine;

3) documents issued by foreign institutions, recognized the central body of the Executive power in the sphere of education and science;

4) documents issued by foreign institutions, recognized higher educational institution of Ukraine.

Physical and legal persons have access to a register of documents on higher education to the extent sufficient to verify the authenticity of the document about higher education.

4. The register of certificates of external evaluation contains information about certificates of external independent evaluation. This information is available to verify their authenticity at the time of admission to higher educational institutions.

5. Administrator of Unified State electronic base of education is the central body of the Executive power in the sphere of education and science.

6. the person has full access to all information about myself, the United State electronic base of education.

7. Free and free access to information contained in a single State electronic base of education is carried out through the official Web site of the central body of the Executive power in the sphere of education and science.

8. the provisions of the uniform State electronic base of education developed by the central body of the Executive power in the sphere of education and science and is approved by the Cabinet of Ministers of Ukraine.

Section III STANDARDS for EDUCATIONAL ACTIVITIES and HIGHER EDUCATION Article 9. Standards education 1. Standard educational activities – is a set of minimum requirements for employment, educational and methodical, material-technical and information support of the educational process for higher education and research institutions.

2. Standards of educational activities developed for each level of higher education within each specialty with taking into account the need to create conditions for persons with special educational needs and are obligatory for execution by all institutions, regardless of ownership and subordination, as well as scientific institutions, which provide training of doctors of philosophy and doctors of Sciences.

3. The standards of educational activities are developed and approved by the central body of the Executive power in the sphere of education and science, in consultation with the National Agency for quality assurance in higher education.

Article 10. Standards of higher education 1. The standard of higher education – is a set of requirements for the content and the results of the educational activities of higher educational institutions and scientific institutions for each level of higher education within each specialty.

2. The standards of higher education are developed for each level of higher education within each speciality in accordance with the national qualifications framework and are used for identification and evaluation of quality of the content and results of the educational activities of higher educational institutions (academic institutions).

3. The standard of higher education determines the following requirements to educational program: 1) amount of ECTS required for obtaining the relevant degree of higher education;

2) list of the graduate competencies;

3) normative content preparation for a degree of higher education, formulated in terms of learning outcomes;

4) form of certification of applicants for higher education;

5) requirements for the presence of the internal quality assurance system of higher education;

6) requirements professional standards (if available).

4. The higher educational institution on the basis of the educational-Professional (educational science) program for each specialty is developing a curriculum that defines the list and amount of academic disciplines in the ECTS, a sequence of study subjects, forms, training classes and their volume, the schedule of the educational process, forms the current and final control. For the concrete planning of educational process on each academic year consists of the working curriculum approved by the head of the institution.

5. Higher education institution within the licensed specialties can introduce specialization, the list of which is determined by the higher education institution.

6. The standards of higher education for each specialty is developing a central body of the Executive power in the sphere of education and science with regard to the proposals of governmental bodies, to the sphere of management which include higher educational institutions and industrial associations of employers and approves them in agreement with the National Agency for quality assurance in higher education.

Section IV MANAGEMENT in higher education Article 11. System of higher education 1. System of higher education are: 1) the higher education institutions of all forms of ownership;

2) level and degree (qualification) of higher education;

3) industry knowledge and specialty;

4) educational and research programs;

5) standards for educational activities and standards of higher education;

6) authorities exercising control in the field of higher education;

7) participants in the educational process.

Article 12. Management in higher education 1. Management in higher education within the limits of their authority is carried out: 1) the Cabinet of Ministers of Ukraine;

2) central body of the Executive power in the sphere of education and science;

3) industry-public authorities, to the sphere of management which include higher education institutions;

4) authorities in Autonomous Republic of Crimea, local authorities, to the sphere of management which include higher education institutions;

5) National Academy of Sciences of Ukraine and the national branch academies of Sciences;

6) the founders of higher educational establishments;

7) self-governance bodies in the area of higher education and science;

8) National Agency for quality assurance in higher education.

2. The Cabinet of Ministers of Ukraine through the system of executive bodies: 1) provides for the implementation of the State policy in the field of higher education;


2) organizes the development, approves and provides implementation of State programs in the development of higher education;

3) provides for the development and implementation of measures for the creation of material and technical base and other conditions necessary for the development of higher education;

4) issues within their powers of normative-legal acts on the issues of higher education;

5) directly or through authorized body exercising rights of the founder, provided by this and other laws of Ukraine in respect of higher educational institutions of the State form of ownership;

6) creates effective mechanisms for implementation of the rights provided by this law, higher educational institutions, scientific and scientific-pedagogical and teaching staff and students in higher educational establishments;

7) provides a broad participation of independent experts and representatives of the public, employers and persons who are studying in higher educational establishments, in the preparation and adoption of normative legal acts and other decisions regarding regulation of interaction between components of the higher education system and its functioning as a whole;

8) establishes special conditions of preparation of specialists for the priority growth areas in accordance with the targeted programs;

9) provides control over observance of the legislation on higher education.

Article 13. The powers of the central body of the Executive power in the sphere of education and science, other bodies, to the sphere of management which include higher educational institutions 1. The central body of the Executive power in the sphere of education and Science: 1) is developing a strategy and program of development of higher education and submit them for approval to the Cabinet of Ministers of Ukraine;

2) is involved in the formation and implementation of State policy in the sphere of higher education, science and training specialists with higher education;

3) systematically monitors and analyzes the needs of the domestic labor market, makes suggestions for scope and areas of Government support for training specialists with higher education;

4) conducts analytical and predictive activity in higher education, defines tendencies of its development, the impact of the demographic, ethnic, socio-economic situation, infrastructure, production and non-production sphere, forms the strategic directions of the development of higher education, taking into account scientific and technical progress and other factors, the process of the global and domestic experience of the development of higher education;

5) carries out international cooperation on issues relating to its competence;

6) ensures the functioning of the common State electronic base of education;

7) forms the list of disciplines and specialties that are candidates for higher education, in particular at the request of the National Agency for quality assurance in higher education, and presents them for approval by the Cabinet of Ministers of Ukraine;

8) approves the document forms of higher education (degree) State standard;

9) gives license for educational activities on the basis of the positive expert opinion of the National Agency for quality assurance in higher education, as well as reissue and cancels them;

10) generates and places the State order for training specialists with higher education in the manner prescribed by law;

11) promotes the employment of graduates of higher educational establishments;

12) approves the list of specialities, welcome to training which is carried out taking into account the level of creative and/or physical abilities of entrants;

13) on behalf of and within the limits set by the Cabinet of Ministers of Ukraine, sells the rights and obligations of the authorized body about based State higher educational establishments;

14) establishes the procedure of certification of pedagogical employees of universities for awarding them the qualification categories and pedagogical ranks in the manner prescribed by law;

15) forms a Certification Board that on the principles of transparency and openness are approved by the decision of the Academic Council of higher educational institutions (academic institutions) of scientific and scientific-pedagogical employees academic ranks, senior researcher, Associate Professor and Professor, organizes its work, considering the deprivation of these ranks, positions, and issues appropriate certificates, as well as considering an appeal on the decision of the Certification Board;

16) develops and approves the standards of higher education and standards for educational activities in consultation with the National Agency for quality assurance in higher education, publishes them on its official website;

17) approved in consultation with the National Quality Assurance Agency for higher education recognition obtained in foreign higher education institutions higher education degrees and research degrees and conducts the procedure for their acceptance, except as provided by this law;

18) at the request of the national quality assurance agency for higher education approved the procedure for the award of the degrees of specialized scientists in higher educational institutions (academic institutions) and submits it for approval to the Cabinet of Ministers of Ukraine;

19) establishes the procedure for the assignment of higher educational institutions and scientific establishments of academic ranks scientific and scientific-pedagogical employees, as well as the procedure for deprivation of academic ranks;

20) gives the normative legal acts on the issues of higher education in cases stipulated by this law;

21) at the request of the National Agency for quality assurance of higher education approves the regulations on accreditation of educational programs;

22) developing a procedure for conducting the license examination and submits it for approval to the Cabinet of Ministers of Ukraine;

23) develops the regulations on the implementation of the law on academic mobility and submits it for approval to the Cabinet of Ministers of Ukraine;

24) determines the standards of logistical and financial support of higher educational institutions in the manner established by the Cabinet of Ministers of Ukraine;

25) carries out other powers in accordance with the legislation.

2. State organs, to the sphere of management which include higher educational establishments: 1) involved in the implementation of the State policy in the sphere of higher education, science, training professionals in licensing educational activities that produced higher educational institutions;

2) form the suggestions and put the State order for training specialists with higher education in the manner prescribed by law;

3) involved in determining standards of logistical and financial support of higher educational establishments;

4) engaged in the distribution of graduates of higher educational institutions, which belong to the sphere of their management, for the passage of a service (for higher military educational institutions (institutions of higher education with specific conditions training)) and employment in health care institutions (higher educational institutions) within the State order;

5) analyse the quality of the educational activities of higher education institutions belonging to their management;

6) either directly or through authorized them authority implement the rights and obligations of the founder, provided by this and other laws of Ukraine in respect of higher educational institutions, which belong to the sphere of their management;

7) exercise other powers in accordance with the legislation.

3. Management of higher spiritual educational institution is carried out taking into account the peculiarities of its activity according to the legislation.

4. State organs, to the sphere of management which include higher military educational institutions (higher educational institutions with specific conditions of training), military training units of higher educational establishments have the right to their own acts establish specific requirements for:
