Chapter I General provisions article 1. Definitions of terms for the purposes of this law the following terms are used: System-school of education-educational subsystem, which includes Government, utilities, private pre-school educational establishments; other schools as centres of extra-school education in during off and off-hour time (comprehensive educational institutions regardless of the subordination, types and forms of ownership, including social rehabilitation school mìžškìl′nì educational-production enterprises, vocational and higher educational institutions of I-II levels of accreditation); groups, sections, clubs, cultural-educational, sports and health, research and retrieval of Association on the basis of the comprehensive educational institutions, educational and industrial enterprises, vocational and higher educational institutions of I-II levels of accreditation; clubs and associations in the community, regardless of the subordination, types and forms of ownership; cultural-educational, sports health, sports and other educational institutions, institutions; foundations, associations, whose activities are connected to functioning of extracurricular education; appropriate management of pozaškìl′noû education and research and teaching institutions;

-School of education-the aggregate knowledge, abilities and skills, receive trainees, students and listeners in an extracurricular educational institutions in time free from teaching in schools and other educational institutions;

out-of-school component system-school education that provides knowledge, forming the skills of interest, the needs of the individual in the creative self-realization and the intellectual, spiritual and physical development, the preparation of active professional and public activity, creates conditions for the social protection and organization of creative leisure activities according to the abilities, talents and health of pupils, students and trainees;

affiliates-school educational institution-is structurally separated subdivisions-school educational institution located outside the location of the primary-school educational institution and perform the same education as a primary-school educational institution as a whole or by individual it areas;

pedagogical workload of teaching staff of extracurricular educational institutions-time is intended for realization of educational process teaching staff-school educational institution;

educational activities-school educational institution-the process of providing knowledge, building skills from different directions-school education, the development of intellectual and creative abilities, physical qualities according to the inclinations and requests of the person;

students-persons who attend groups, clubs, associations, sections-school educational institution according to the interests, abilities and inclinations to get pre-professional training;

students-persons who attend classes and other creative Association-school educational institutions, training and educational activities in which organized in the form of cool-pupils or other system;

students-persons who conduct research, search and experimental work of various problems in science, engineering, art.

Article 2. Legislation on the legislation on the education of out-of-school education is based on the Constitution and consists of the law of Ukraine "on education", this law, international agreements of Ukraine, consent to be bound by the Verkhovna Rada of Ukraine, other regulatory legal acts.

Article 3. The task of the law of Ukraine "on-school education" the objectives of this law are: ensuring the rights of citizens to acquire extracurricular education;

determination of the basic principles of the State policy on extracurricular education;

creation of a legal framework for the further development of extracurricular education;

establishing the legal foundations for the activities of extracurricular educational institutions;

determination of the main directions, contents and forms of educational process in-school educational institutions;

determining the rights and obligations of participants in the educational process, establish responsibility for violation of legislation on-school education;

creation of conditions for the charitable activities of legal entities and natural persons for the purpose of development of extracurricular education;

Regulation of the relations between the public authorities and educational establishments, institutions and organizations that define the content, forms and methods of education-school pupils, students and trainees;

creating conditions for the social protection of teachers, pupils, students and trainees-school educational institutions.

Article 4. Out-of-school education education is a component of the system of continuous education, defined by the Constitution of Ukraine, law of Ukraine "on education", this law, and is aimed at the development of the abilities and talents of pupils, students and trainees, satisfaction of their interests, spiritual requests and needs in a professional determination.

Article 5. Structure-school education Structure-school education make up: the extracurricular educational institutions;

other schools as centres of extra-school education in during off and off-hour time, among which include: the comprehensive educational institutions regardless of the subordination, types and forms of ownership, including social rehabilitation school mìžškìl′nì educational-production enterprises, vocational and higher educational institutions of I-II levels of accreditation;

groups, sections, clubs, cultural-educational, sports and health, research and retrieval of Association on the basis of comprehensive schools, inter-school academic-industrial enterprises, vocational and higher educational institutions of I-II levels of accreditation;

clubs and associations in the community, regardless of the subordination, types and forms of ownership;

cultural-educational, sports health, sports and other educational institutions, institutions;

foundations, associations, whose activities are related to the functioning of the extra-curricular education.

Article 6. Gain-school education 1. Trainees, students and listeners have the right for the extra-curricular education according to their abilities, talents, interests and Favorites.

2.-school education is acquired by citizens in during off and off-hour time in-school educational institutions and other educational establishments as centres of extra-school education, regardless of the subordination, types and forms of ownership, including social rehabilitation in schools, inter-school academic-industrial plants, vocational and higher educational institutions of I-II levels of accreditation.

Gain-school education is based on the principle of voluntary choice of the types of institutions and activities, and is carried out with the participation of parents or persons substituting them, labor collectives, public organizations, societies, foundations.

3. Foreigners and stateless persons who are in Ukraine on legal grounds, get-school education in the manner established for the citizens of Ukraine.

Article 7. Language teaching and education in adult education, Language teaching and education in adult education is defined by article 20 of the law of Ukraine "on the State language policy."

{Article 7 as amended by law No. 5029-VI from 03.07.2012} Article 8. Basic tasks-school education main tasks-school education are: education of the citizen of Ukraine;

free development of the personality and the formation of its socio-civic experience;

education in pupils, apprentices and students respect for the Constitution, the rights and freedoms of man and citizen, self-respect, responsibility before the law for their actions;

education in pupils, students and listeners of patriotism, of love for Ukraine, and respect for the folk customs, traditions, national valuables of Ukrainian people, as well as other Nations and peoples;

education in pupils, students and trainees a respectful attitude to the family and the elderly;

creation of conditions for creative, intellectual, spiritual and physical development of pupils, students and trainees;


the formation of the pupils, students and listeners of conscious and responsible attitude to their own health and the health of others, the skills of safe behaviour;

meet the educational and cultural needs of pupils, students and trainees that are not provided by other components of the structure of education;

meet the needs of pupils, pupils and students in professional samoviznačennì and creative self-realization;

Search, development and support of capable, gifted and talented pupils, students and trainees;

improvement of the physical development of pupils, students and trainees, training sports reserve for teams of Ukraine with different sports;

Organization of leisure of pupils, students and trainees, the search for new forms; Prevention of neglect, delinquency;

participants in the educational process of conscientious attitude to their own safety and the safety of others;

the formation of the healthy way of life of pupils, students and trainees;

implementation of informational and methodological and organizational-mass work.

Article 9. The basic principles of the State policy in the sphere of extra-school education 1. State policy in the sphere of extra-school education is carried out on principles: accessibility of extra-curricular education of Ukrainian citizens regardless of race, colour, political, religious and other beliefs, sex, ethnic and social origin, property status, place of residence, linguistic or other traits;

financing of the State and public-school educational institutions according to their structure;

voluntary choice of types of extracurricular educational institutions, forms of student learning and activities;

scientific, secular nature of education;

legal and social protection of students, pupils and students in their quest to free, diversified development of personality.

2. State policy in the sphere of extra-school education aims to: create conditions for trainees, students and listeners-school education;

maintaining and developing the network of State and public-school educational institutions without the right of their profile, subordination, merger, transfer of premises, equipment, equipment for rent;

Chapter II ORGANIZATION of EXTRACURRICULAR education article 10. Controls pozaškìl′noû. State control over the activities of extracurricular educational institutions 1. Central and local organs of executive power in the sphere of management which are extracurricular educational institutions that carry out activities in the sphere of extra-school education, management of the specified educational institutions regardless of the subordination, types and forms of ownership.

2. State administration pozaškìl′noû training exercise: the central body of the Executive power, which provides forming and implementing State policy in the field of education;

the central executive body that implements the State policy in the field of education;

Council of Ministers of the Autonomous Republic of Crimea;

regional, Kyiv and Sebastopol city, district State administrations and subordinate them to management bodies, in the field of management which are extracurricular educational institutions;

bodies of local self-government.

3. the central body of the Executive power, which ensures the formation of State policy in the field of education: forms the development programs-school education;

developing regulations on pre-school educational establishments, prepares proposals for standards of logistical, financial security-school education;

develops normative-legal acts concerning the definition of the social guarantees of pedagogical employees, specialists of extracurricular educational institutions regardless of the subordination, types and forms of ownership;

carries out other powers specified by laws and assigned to it the acts of the President of Ukraine.

The central executive body that implements the State policy in the field of education, with the participation of other central bodies of executive power in the sphere of management which are metholology: participates in the definition and implementation of the State policy in the field of extracurricular education;

provides educational and methodological guidance, control and State inspection of extracurricular educational institutions regardless of the subordination, types and forms of ownership;

carries out other powers specified by laws and assigned to it the acts of the President of Ukraine.

4. State control over the activities of extracurricular educational institutions regardless of the subordination, types and forms of ownership is carried out by the central body of the Executive power, which implements the State policy in the sphere of education, and the local bodies of education management.

5. The main form of State control over the activities of extracurricular educational institutions regardless of the subordination, types and forms of ownership is the State examination-school educational institution, which is held at least once every 10 years in the order established by the central body of the Executive power, which provides forming and implementing State policy in the sphere of education. The results State attestation of extracurricular educational institutions are published.

Extraordinary State certification of public-school educational institutions is made, as an exception, only the decision of the central organ of executive power, which provides forming and implementing State policy in the field of education or other central bodies of executive power in the sphere of management which are extracurricular educational institutions.

Extraordinary State certification of communal after-school educational institutions is made, as an exception, only by decision of the Council of Ministers of the Autonomous Republic of Crimea, regional, Kyiv and Sebastopol city, rayon State administrations and bodies subordinated to them in the management sphere of which are extracurricular educational establishments, bodies of local self-government.

Extraordinary State certification of private-school educational institutions is made, as an exception, only the decision of the owner (founder), or the central body of the Executive power, which provides forming and implementing State policy in the sphere of education, other central bodies of executive power in the sphere of management which are extracurricular educational institutions, the Council of Ministers of Autonomous Republic of Crimea, regional, Kyiv and Sebastopol city, rayon State administrations and bodies subordinated to them in the field of management which are extracurricular educational establishments, bodies of local self-government.

6. the Council of Ministers of the Autonomous Republic of Crimea, local executive bodies and local self-government bodies within their competence of: approves financing public-school educational institutions is not below the minimum standards defined in the prescribed manner by the central body of the Executive power, which provides forming and implementing State policy in the sphere of education, and provide financing of expenses on their content;

ensure the preservation and strengthening of material and technical base of extracurricular educational institutions, the development of their network, efficient use of fixed them land plots;

create the proper conditions for the choice of students, pupils and students the kinds of creative activities according to their interests and requests of parents or persons substituting them;

can enter additional pedagogical rates determine the contingent of pupils, students and trainees in the extracurricular educational institutions;

take steps to attract pupils, apprentices and students who are in need of social assistance and social rehabilitation, to the variety of forms-school education;

provide social protection of students, pupils and students, teachers, specialists and other employees extracurricular educational institutions;

duly organized training, certification of pedagogical employees extracurricular educational institutions regardless of the subordination, types and forms of ownership;

coordinate the activities of the pedagogical collectives of extracurricular educational institutions, public organizations, enterprises and families regarding the reception of students, pupils and students-school education;

exercising control over the activities of the pedagogical collectives of extracurricular educational institutions, summarize and spreading the experience of their work;

conduct State attestation of extracurricular educational institutions regardless of the types and forms of ownership;

contribute to the creation of pìkluval′nih and Trustees of charitable funds;

exercise other powers in accordance with the Constitution, the Constitution of the Autonomous Republic of Crimea, laws of Ukraine "about local government in Ukraine", "on education", this law and the regulations on them.

Article 11. Management and public self-governance-school educational institution 1. Management-of-school educational institution carries out its Director.

Collective management body-of-school educational institution is the pedagogical Council, the powers of which shall be determined by the provisions of the extracurricular educational institutions.

2. the body of public self-governance of-school educational institution is the general meeting (Conference) team-school educational institution.

3. in the pozaškìl′nomu educational institution may operate methodical associations, departments, divisions, covering the participants of educational process and specialists of certain professional area.

1.-school educational institution in its organizational-legal forms can be public, municipal or private ownership.

2. the status of the State-school educational institution is based on the State property.

The status of public-school educational institution is based on communal property.

Status of private-school educational institution is founded on private property.

3. Extra-curricular educational establishments may operate in the form of malls, complexes, palaces, houses, clubs, stations, rooms, studios, schools of Arts, primary specialised art educational institutions (schools of aesthetic education), sports schools, children and youth sports schools of Olympic reserve, physical culture and sports clubs at the place of residence, fitness clubs, persons with disabilities, specialized children and youth sports schools of Olympic reserve, stadiums, libraries, children's flotilìj, galleries, offices, health institutions carrying out-school education.

4. Extracurricular education establishments can be complex and specialized.

Comprehensive extracurricular educational institutions organize work with pupils, pupils and students in different directions-school education (art-aesthetic, tourist-local, eco-naturalìstičnim, scientific-technical, research-experimental, physical culture and sports or sporting, military-patriotic, library-bibliographic, social rehabilitation, health, humanitarian). The complex of extracurricular educational institutions include palaces, houses for children and youth, children's and youth creativity.

Profile extracurricular educational institutions organize a specific direction of extra-curricular activities. To the profile of extracurricular educational institutions include centres, tourist-local history, scientific and technical, ecological and naturalistic, sports-recreational, artistic and aesthetic creativity, military-patriotic, stations for young tourists, naturalists, technicians, school of Arts, primary specialised art schools, children's and youth sport schools, health establishments, tourist base.

5. List of types of extracurricular educational institutions approved by the Cabinet of Ministers of Ukraine.

6. Creative Association-school educational institution are classified according to three levels: initial level-creative Union of zagal′norozvivaûčogo, that contribute to detecting abilities, talents of pupils, students and trainees or their interest in creative activities;

main level-creative associations who develop persistent interests of pupils, pupils and students, give them the knowledge, practical skills, meet the needs of professional orientation;

a higher level of professional associations by interests for capable and gifted pupils, students and trainees.

Article 13. Charter-school educational institution 1. -School educational institution is a legal entity and operates on the basis of the Charter.

{The first Paragraph of article 13 as amended by law No. 2555-VI dated 23.09.2010} Charter-school educational institution is developed in accordance with the Constitution of Ukraine, law of Ukraine "on education", of this law, the regulations on pre-school educational establishments.

2. The regulation on the extracurricular educational institutions approved by the Cabinet of Ministers of Ukraine.

-School educational institution on the basis of the regulation on the extracurricular educational institutions is developing a Charter, which is approved by the owner (the founder) and is registered with the local executive authority in the manner established by legislation of Ukraine.

Extracurricular educational institutions operate on the basis of their own statutes, approved: the central body of the Executive power, which provides forming and implementing State policy in the field of education or other central executive bodies, in consultation with the central body of the Executive power, which provides forming and implementing State policy in the field of education, based on the State property and are in the area of their control;

Council of Ministers of Autonomous Republic of Crimea, which is based on communal property and are in the area of it management;

regional, Kyiv and Sevastopol city, district administrations, based on communal property and are in the area of their management.

The Charter of a private-school educational institution agrees with the appropriate executive authority, approved by the founder (owner) and is registered in the order established by legislation of Ukraine.

Article 14. Creation, reorganization and liquidation of-school educational institution 1. The order of creation, reorganization and liquidation of extracurricular educational institutions approved by the Cabinet of Ministers of Ukraine.

2. State and municipal pre-school educational establishments operate after signing the Charter.

3. Private pre-school educational institutions carry out their educational activities after signing the Statute and a license issued in accordance with the legislation of Ukraine.

4. The founders of-school educational institution can be: Central and local bodies of executive power;

the bodies of local self-government;

enterprises, institutions, organizations of Ukraine and their associations irrespective of property forms and subordination, including religious organizations, statutes (regulations) which are registered in the order established by the legislation;

5. State and municipal educational establishments of pre-school are generated in accordance with the Central, local bodies of executive power or bodies of local self-government taking into account socio-economic, national, cultural and educational needs of the availability of the necessary educational-methodological and material-technical base, teaching staff and compliance with sanitary norms, rules and standards.

The decision about the creation of a private-school educational institution shall be made by the founder (owner) in the presence of the necessary educational-methodological and material-technical base, teaching staff and compliance with sanitary norms, rules and standards.

6. Extracurricular educational institutions regardless of the subordination, types and forms of ownership have equal rights and bear the same obligations on adherence to the requirements of the legislation.

Extracurricular educational establishments have the right to open branches in the villages, towns, cities of Ukraine.

7. reorganization and liquidation of extracurricular educational institutions municipal ownership is carried out by decision of the session of the local Council, State and private ownership-by the decision of the founder (founders).

{Article 14 amended part 7 according to law No. 76-VIII from the 28.12.2014} Partition III ORGANIZATION of EXTRACURRICULAR education in POZAŠKÌL′NOMU SCHOOL Article 15. Main directions of out-of-school education education in extracurricular educational institutions can be carried out according to the following directions: art and aesthetic, which provides development of creative abilities, talents and trainees, students and listeners of practical skills, mastery of the knowledge in the field of national and world culture and art;

tourist local history, which is aimed at engaging students, pupils and students to the activities of the study of the history of his native land and the environment, world civilization, geographical, ethnographic, historical objects and phenomena of social life, mastering practical skills and skills in tourism and local history;

ecological-naturalistic, which presupposes the pupils, pupils and students knowledge about the environment, the formation of ecological culture of personality, the acquisition of knowledge and experience of solving environmental problems, to practical conservation work and other biological areas, the formation of knowledge, skills in the areas of agriculture: floriculture, forestry, gardening, mushroom, beekeeping;

Science and technology, which ensures the acquisition of pupils, pupils and students of technical and technological skills, the expansion of the scientific worldview, the preparation of active research work, mastering modern techniques and technologies;

research-experimental, which promotes the involvement of pupils, students and trainees to research, experimental, design and inventive work in different fields of science, technology, culture and art, as well as the creation of conditions for creative self improvement and identifying, developing and supporting young talents and talents;

Sports-sports or sports, which provides development of physical abilities of pupils, students and trainees, the necessary conditions for a full-fledged recovery, training, meaningful recreation and leisure, physical culture and sports training sports reserve for the national teams of Ukraine, acquiring skills of healthy way of life;

military-patriotic, which provides an appropriate level of training of pupils, students and trainees to military service, education of patriotic feelings and civil liability;

Library-bibliography, which aims to deepen the educational interests of students, pupils and students, enhance their information culture, acquisition of skills and abilities to navigate the growing flow of information;

social rehabilitation, which provides social formation and development interests, abilities, propensities, self-actualization needs of pupils, students and trainees, training them to active professional and public activity, organizing them in meaningful leisure and recreation;


the Spa, which provides the necessary conditions for full recreation and provides student students, pupils and students of knowledge about a healthy way of life, their health improvement, acquisition and consolidation of skills to strengthen personal health and hygienic culture of personality;

the humanities, which provides development of abilities, talents, practical skills of pupils, students and trainees, mastering the knowledge of basics Sciences social-humanitarian cycle.

Article 16. Planning activity-school educational institution 1. -School educational institution operates under the annual plan of work, agreed with the founder (owner), implements the main directions of its activities, taking into account the features of the socio-economic development of the region, the interests of pupils, students and trainees, the needs of the family, other educational institutions, youth and children's public organizations.

2. Educational process in-school educational institutions regardless of the subordination, types and forms of ownership is made by typical training plans and programs approved by the central body of the Executive power, which provides forming and implementing State policy in the sphere of education, other central bodies of executive power in the sphere of management which are extracurricular educational institutions.

Extracurricular educational institutions may plan the work of the groups, sections, departments, offices for other educational plans and programmes subject to the approval of their respective local bodies of executive power.

{The second paragraph of part two article 16, as amended by the law No. 2626-IV from 02.06.2005} Experimental curricula consist of post-school educational institutions with regard to the standard educational plans.

Experimental curricula, educational programs, pedagogical innovation and technology is only possible by common decision of the central organ of executive power, which provides forming and implementing State policy in the field of education (other central bodies of executive power in the sphere of management which are extracurricular educational institutions) and National Academy of pedagogical sciences of Ukraine.

{Paragraph four of article 16, as amended by the law No. 5460-VI from 26.10.2012} article 17. Duration and mode-of-school educational institution 1. The duration of the classes in the pozaškìl′nomu school is determined by the curriculum and programs taking into account the Psychophysiological development and allowable load for the different age categories and is for pupils, apprentices and students: aged 5 to 6 years-30 minutes;

from 6 to 7 years-35 minutes;

other-45 minutes.

2. Mode of daily work set-of-school educational institution on the basis of the recommendations of the Central and local bodies of executive power in the sphere of which it is located.

-School educational institution provides safe conditions of training, education and labour.

3. The duration of the school year in the pozaškìl′nomu school established the central body of the Executive power, which provides forming and implementing State policy in the field of education or other Central and local bodies of executive power in the sphere of management which are extracurricular educational institutions, in agreement with the central body of the Executive power, which provides forming and implementing State policy in the sphere of education.

In holiday, holidays and days off-school educational institution operates under a separate plan.

Article 18. Article 20. Rights, obligations and social protection of pupils, students and trainees-school educational institution 1. 2. the State provides protection of the rights of pupils, students and trainees-school educational institution and organizes training and education of the minor children from needy and large families, disabled children, orphans and children deprived of parental care, in accordance with the legislation of Ukraine.

3. the reallocation of pupils, students and trainees-school educational institution at the expense of the training time to work and implementation of the educational process, is prohibited, except for the cases stipulated by the decisions of the Cabinet of Ministers of Ukraine.

4. the authorities shall establish the different types of moral incentive and material incentives to winners of village, district, municipal, regional, all-Ukrainian and international competitions, tournaments, competitions, exhibitions, competitions.

5. Out-of-school establishes different kinds of moral incentive and material incentives for pupils, students and trainees in accordance with its Statute.


6. Trainees, students and listeners of extracurricular educational institutions have the right to preferential or free visits to museums, historical and architectural monuments in the manner established by the Cabinet of Ministers of Ukraine.

7. Trainees, students and listeners of extracurricular educational institutions regardless of the subordination, types and forms of ownership have the right to free medical care in health care establishments identified by the relevant bodies of executive power.

8. Local Governments can provide reductions of students, pupils, trainees to the training and home in the manner and amount determined by local authorities, and include this relevant expenditures from local budgets.

{Part III article 20 amended by law No. 76-VIII from 28.12.2014} article 21. Teaching staff-school educational institution 1. Pedagogical employee-school educational institution shall be a person with high moral qualities, which has higher pedagogical or other professional education, an adequate level of professional training, pedagogical activities, ensures the effectiveness and quality of their work, the physical and mental health, which allows you to perform professional duties in-school educational institutions. Pedagogical employee-school educational institution may also be people's handyman with high moral qualities by ensuring proper performance of the educational process.

Pedagogical employees extracurricular educational institutions regardless of the subordination, types and forms of ownership is given to the annual basic leave lasting not less than 42 days in the manner established by the Cabinet of Ministers of Ukraine.

Teaching staff-school educational institutions have the right to a pension for the years of service you have pedagogical experience of not less than 25 years.

Pedagogical employees extracurricular educational institutions that work in rural areas and towns, as well as pensioners, who previously worked as pedagogical employees in these settlements and living in them, according to the legislation provides free use of housing with heating and lighting within the established norms if the size of the average monthly aggregate family income per capita during the previous six months does not exceed the magnitude of the income that gives the right to tax social privilege in a manner described by the Cabinet of Ministers of Ukraine. They have the right to obtain ownership of the land in the amount of average land share in accordance with the legislation of Ukraine.
