Section I
GENERAL PROVISIONS

Article 1. Term Definition

The following terms are used for the purposes of this Act:

Article 2. Ukraine's legislation on extracurricular education

Ukraine ' s legislation on off-school education is based on Constitution of Ukraine and consists of Law of Ukraine "On education", of this Law, international treaties of Ukraine, consent to the duties provided by the Verkhovna Rada of Ukraine, other regulations.

Article 3. Tasks of the Law of Ukraine "On out-school education"

The tasks of this Act are:

To ensure the rights of citizens to obtain a non-school education;

The definition of basic public policy principles for extracurricular education;

Establishment of a normative framework for further development of off-school education;

The establishment of the legal establishments of off-school educational institutions;

Defining basic areas, content and forms of educational and spiritual process in extracurricular colleges;

The determination of the rights and duties of the participants of the educational and spiritual process, establishing responsibility for violations of the non-school education legislation;

Establishment of conditions for charitable activities of legal and physical persons for the purpose of developing out-school education;

Regulation of relations between government authorities and educational institutions, institutions and organizations that determine the content, forms and methods of extracurricular education of the pupils, pupils and listeners;

creating conditions for the social protection of pedagogical workers, pupils, pupils and listeners of off-school educational institutions.

Article 4. Off-school education

Out-school education is a component of the continuous education system defined by Constitution of Ukraine , Law of Ukraine "On Education", this Act, and aims to develop abilities and propositions of pupils, pupils and listeners, the satisfaction of their interests, spiritual requests and needs in a professional definition.

Article 5. Structure of extracurricular education

The structure of the extracurricular education is:

Off-school educational institutions;

Other educational institutions as centres of off-school education in extracurricular and post-school hours, which include: general educational institutions regardless of subordination, types and forms of property, including social rehabilitation schools, Interschool educational and production facilities, vocational technical and higher I-II levels of accreditation;

groups, sections, clubs, cultural and educational, sports and educational, scientific-search associations based on public educational institutions, interschool educational combinations, vocational and higher educational establishments I-II levels Accreditation;

Clubs and associations for the place of residence regardless of subordination, types and forms of ownership;

Cultural and educational, cultural and educational, sports and other educational institutions, institutions;

funds, associations whose activities are related to the functioning of the extracurricular education.

Article 6. School Education

1. Vikhovans, pupils and hearers have the right to gain off-school education according to their abilities, gifts, preferences and interests.

2. Post-school education is acquired by citizens in extracurricular and post-school educational establishments and other educational institutions as the centres of off-school education regardless of subordination, types and forms of property, including in schools Social rehabilitation, interschool-production combinations, vocational and technical and higher education levels I-II levels of accreditation.

Extracurricular education is based on the principle of voluntary choice of the types of establishments and activities, and is carried out with the participation of parents or persons who replace them, labor groups, public organizations, societies, foundations.

Article 7. Language of education and education in off-school education

Language learning and education in extracurricular education is defined Article 20 The Law of Ukraine "On the Principles of State Language Policy".

Article 8. Primary tasks of extracurricular education

The main tasks of the extracurricular education are:

Education of the citizen of Ukraine

The free development of the personality and formation of her social and public experience;

upbringing in the students, pupils and listeners of respect for Constitution of Ukraine rights and freedoms of man and citizen, the sense of self-dignity, responsibility before the law for their actions;

Nurturing, students and listeners of patriotism, love of Ukraine, respect for the popular customs, traditions, national values of the Ukrainian people, as well as other nations and peoples;

Nurturing students, pupils and listeners of respectful treatment of the family and the elderly;

Creating conditions for creative, intellectual, spiritual and physical development of pupils, pupils and listeners;

The formation of pupils, pupils and listeners of conscious and responsible treatment of their own health and health of the surrounding, the skills of safe behaviour;

Satisfaction of the educational and cultural needs of the students, pupils and listeners who do not provide for the other constituent structures of education;

Satisfaction with the needs of the students, pupils and listeners in professional self-determination and creative self-realization;

search, development and support of capable, gifted and talented students, pupils and listeners;

To improve the physical development of pupils, pupils and listeners, preparation of a sports reserve for teams of Ukraine from various sports;

The organization of leisure activities, students and listeners, the search for its new forms; prevention of carelessness, offender;

In the participants of the educational and spiritual process of conscious treatment of their own safety and security of the surrounding;

The formation of a healthy lifestyle of the pupils, pupils and listeners;

Implementation of information-methodical and organisational media.

Article 9. The basic principles of public policy in the field of extracurricular education

1. The public policy in the field of extracurricular education is carried out on the principles of:

the availability of off-school education to citizens of Ukraine regardless of race, skin color, political, religious and other beliefs, gender, ethnic and social origin, property, place of residence, language or other features;

Funding public and communal off-school educational institutions according to their structure;

Voluntary selection of the types of extracurricular educational institutions, forms of extracurricular training and activities;

-Science, education, education;

The legal and social protection of the pupils, pupils and listeners in their pursuit of free, heterogeneous personality development.

2. The public policy in the field of non-school education is aimed at:

Creating conditions for the acquisition of pupils, students and listeners of off-school education;

The preservation and development of a network of public and communal non-school educational institutions without the right of their reprofiling, revocation, merging, transmission of premises, equipment, and rental equipment;

Chapter II
EDUCATIONAL ORGANIZATION FOR EXTRATERRESTRIAL EDUCATION

Article 10. The Office of the School of Education. State control of the activities of off-school educational institutions

1. Central and local executive bodies, in the field of management of which are out-of-school educational institutions and which conduct activities in the field of non-schooling, undertake the management of enrolled educational institutions independently of Subordination, types and forms of property.

2. The State of Office of the Extraordinary Education Education shall be carried out by:

The central authority of the executive branch, which provides the formation and implementation of state policy in the field of education;

The central body of the executive branch, which implements state policy in the field of education;

The Council of Ministers of the Autonomous Republic of Crimea;

organs of local government.

3. The Central Executive Body, ensuring the formation of public policy in the field of education:

Forms programmes for the development of off-school education;

Develops the provision of off-school training facilities, prepares proposals for normative technical, financial support for off-school education;

To develop regulatory and legal acts regarding the definition of social guarantees to pedagogical staff, school specialists regardless of subordination, types and forms of property;

Exercises other powers defined by the laws and acts of the President of Ukraine.

The Central Executive Body is implementing state policy in the field of education, involving other central executive bodies, in the field of management of which are outside school institutions:

Participates in the definition and implementation of public policies in the field of extracurricular education;

Provides educational and methodological leadership, control and public inspection of off-school educational institutions regardless of subordination, types and forms of ownership;

Exercises other powers defined by the laws and acts of the President of Ukraine.

4. State control over the activities of off-school educational institutions regardless of subordination, types and forms of ownership is carried out by the central executive body implementing state policy in education, and local governance bodies Education.

5. The main form of public control over the activities of off-school educational institutions, regardless of subordination, types and forms of property is the state certification of the extracurricular institution, which is not less common than once in 10 years in order, established by the central body of the executive branch, which provides for the formation and implementation of state policy in the field of education. 6. The Council of Ministers of the Autonomous Republic of Crimea, local executive bodies and local government bodies within their competence:

Approve the amount of funding of communal off-school educational institutions not below the minimum regulations defined in the prescribed order by the central executive body, which ensures formation and implementation of state policy in the field of education, And provide funding for the costs of maintenance;

Ensure the preservation and strengthening of the material and technical base of the extracurricular institutions, the development of their networks, the efficient use of the fixed land areas;

Create proper conditions for the choice of pupils, pupils and listeners of creative activities according to their interests and requests of parents or persons who replace them;

can introduce additional pedagogy rates, identify the contingent of students, pupils and listeners in off-school establishments;

Take steps to attract students, pupils and listeners who need social care and social rehabilitation, to different forms of off-school education;

provide social protection for students, pupils and listeners, pedagogy workers, specialists and other staff of off-school educational institutions;

Organize in an established order to increase the qualifications, the certification of pedagogical workers of non-school educational institutions, regardless of subordination, types and forms of ownership;

Coordinated by the activities of pedagogical groups of off-school educational institutions, public organizations, businesses and families regarding the recipients of the students, students and listeners of off-school education;

Supervising the activities of pedagogical groups of out-of-school educational institutions, generalize and disseminate their work experience;

Conduct state certification of off-school educational institutions regardless of the types and forms of ownership;

Contribute to the establishment of the care and guardians of trustees, charitable foundations;

Article 11. Management and public self-management of the extracurricular institution

1. The training of the extracurricular institution is exercised by its director.

The collegiate management body of the extracurricular institution is the pedagogical council whose powers are determined by the application of off-school educational institutions.

2. The public self-government of the extracurricular institution is the general assembly (conference) of the extracurricular educational institution.

3. In the extracurricular institution there may function methodical associations, departments, branches covering participants of the educational and spiritual process and specialists of a specific professional direction.

Article 12. Off-school curriculum

1. A post-school curriculum for its organizational and legal forms may be a public, communal or private property form.

2. The status of the state has an off-school curriculum based on the state ownership form.

3. 4. Post-school educational institutions may be complex and profile.

5. List of non-school educational institutions is approved by the Cabinet of Ministers of Ukraine.

6. Creative associations of the extracurricular institution are classified by three levels:

Basic level-creative associations that develop sustainable interests of learners, pupils and listeners, give them knowledge, practical skills and skills, meet the needs of professional orientation;

Article 13. Statute of the extracurricular institution

1. The post-school educational institution is a legal entity and operates on the basis of a statute.

The charter of the extracurricular institution is developed according to Constitution of Ukraine , Law of Ukraine "Education", of this Act, Non-school educational establishments .

2. Non-school educational establishments are approved by the Cabinet of Ministers of Ukraine.

Non-school educational institutions operate on the basis of their own statutes approved by:

Article 14. Creation, reorganization and liquidation of the extracurricular institution

1. The order of creation, reorganization and elimination of off-school educational institutions is approved by the Cabinet of Ministers of Ukraine.

2. State and communal non-school educational institutions carry out their activities after the registration of the charter.

3. Private non-school educational institutions carry out their educational activities following the registration of the statute and for the existence of a license issued in the established law of Ukraine.

4. The officers of the non-school educational institution may be:

Central and local executive bodies;

Organs of local government;

enterprises, institutions, organizations of Ukraine and their union regardless of property forms and subordination, including religious organizations, statutes (provisions) of which are registered in the established legislation;

5. Chapter III
SCHOOL OF EXTRACURRICULAR EDUCATION IN THE EXTRACURRICULAR INSTITUTION

Article 15. Primary areas of non-school education

Article 16. Planning for the activities of the extracurricular institution

Article 17. Duration and mode of operation of the extracurricular institution
