About the principles of domestic and foreign policy

(Information of the Verkhovna Rada of Ukraine (VR), 2010, No. 40, pp. 527)

The law defines the principles of domestic policy of Ukraine in the spheres of statehood, development of local government and to stimulate the development of regions, formation of civil society institutions, national security and defence, in Economic, social and humanitarian spheres, in the environmental sphere and the field of technological security as well as to the foreign policy of Ukraine.

Article 1. The task of the interior and foreign policy

1. Internal and external policies define the principles and priorities of public policy in the respective spheres.

Article 2. Basic principles of internal and foreign policy

1. The principles of domestic and foreign policy are based on unconditional Constitution of Ukraine , ensuring human rights and citizens ' rights and citizens and guarantees of rights and freedoms declared by the Constitution of Ukraine on the universally recognized principles and norms of international law, ensuring social orientation of the economy of Ukraine and the sustainable social and economic development of Ukraine, strengthening democratic principles of public and public life, ensuring the rule of law, economic and political independence of the state, protection of its national interests, the approval of Ukraine as a full and the authoritative member of the global community.

2. The internal policy is based on the following principles:

Priority protection of national interests;

the rule of law, ensuring the realization of the rights and freedoms of the person and citizen, respect for the dignity of each person;

Equality of all entities of ownership before the law, to protect competition in the sphere of economic activity;

Exercise of governmental power on the basis of its division into legislative, executive and judicial;

Openness and transparency of the processes of preparation and adoption of decisions by the authorities and local governments;

To ensure the sustainable development of the economy in market-based income and its social cohesion;

Providing a balance of public, regional and local interests;

Freedom, social justice and creative self-realization, participation of citizens in the administration of public and public affairs;

social partnership and civil solidarity.

3. The foreign policy is based on the following principles:

Sovereign equality of states;

to refrain from the threat of force or its application against the territorial integrity or political independence of any foreign state;

Respect for the territorial integrity of foreign powers and the inviolability of state borders;

Resolving international disputes by peaceful means;

Respect for human rights and fundamental freedoms;

Non-interference in the internal affairs of states;

Mutually beneficial cooperation between states;

The conscientious fulfillment of the international obligations;

the priority of universally recognized norms and principles of international law before norms and principles of national law;

The application of the Armed Forces of Ukraine only in cases of acts of armed aggression against Ukraine, any other armed conflict on its territorial integrity and integrity of state borders, combating international terrorism and piracy or in others The cases stipulated by the international treaties of Ukraine are the duty of the Verkhovna Rada of Ukraine;

The application of international sanctions, countermeasures, and the measures of diplomatic protection in accordance with international law in cases of international contraventions that harm Ukraine, its citizens and legal entities;

Timely and adequate measures to protect the national interests of the real and potential threats to Ukraine, its citizens and legal entities.

Article 3. Policy principles for the development of statehood

1. The main areas of policy for the development of statehood are:

the development of democracy by improving the mechanism of public administration, the exercise of parliamentary control;

Improvement of the system of elections to the Verkhovna Rada of Ukraine and local governments;

Modernization of the public service system with regard to European experience on the principles of professional and political neutrality;

strengthening of the openness and transparency of the process of preparation and adoption of state decisions and implementation of any action related to the formation and use of budget funds, staffing assignments in the central executive branch Authorities, courts, law enforcement agencies;

Ensuring fair and affordable litigation;

ensuring compliance with international standards of judges ' independence;

Strengthening the opposition of corruption and shadow economic activity, ensuring the unconditional adherence to the principles of law in front of senior state officials, politicians, judges, law enforcement officers and force structures;

Fight crime by improving coordination of law enforcement, to optimize their structure, to ensure their activities.

Article 4. Internal policy principles in the areas of local government development and stimulating the development of regions

1. The main areas of domestic policy in the areas of local government development and the promotion of the development of regions are:

The approval of local government as a foundation of the people's birth, the extension of the authority of local councils by decentralization of functions of government bodies, harmonization of public, regional and local interests;

Reforming inter-budget relations in favor of local government, creating conditions for the development of the economic independence of the regions;

Improvement of the administrative territorial system on the principles of economic self-sufficiency and the availability of administrative (managerial) and social services to consumers of these services;

Strengthening the material base of the local government and raising the level of their resources;

The strengthening of the responsibility of representatives of local government, rural, village, city heads in front of territorial communities elected;

Development and implementation of projects of inter-regional economic ties and transboundary cooperation aimed at improving the competitiveness of the regions as the basis of their dynamic development;

Strengthening the economic integration of regions using the benefits of territorial division and labour cooperation;

Creating effective mechanisms for ensuring the active participation of territorial communities and local governments in the formation and implementation of public regional policies;

To achieve the high functional capacity of the core capacity of the regions, primarily through the creation of a system and technology of attracting investment for the preparation of highly professional management personnel.

Article 5. Internal policy frameworks for the formation of civil society institutions

1. The main areas of domestic policy in the formation of civil society institutions are:

To establish civil society as a guarantee of the democratic development of the state;

The completion of the political reform, the strengthening of the interaction of the public authorities and the bodies of local self-government and the associations of citizens, the introduction of public control over the activities of the authorities;

Ensuring the independent activities of the associations of citizens, strengthening their influence on the adoption of public important decisions;

Enhancing the role and responsibility of political parties, promote the political structuring of society on the basis of multi-party institutions, creating conditions to ensure a broad representation of the interests of citizens in representative bodies;

Conduct regular consultations with the public on important issues of the life of society and the state;

Conducting all-Ukrainian and local referendums as effective forms of popular use, participation of the people in the adoption of public important decisions.

Article 6. National security and defence policy

1. The main areas of domestic policy in national security and defence are:

ensuring vital interests of human and citizen, society and state, timely detection, prevention and neutralization of real and potential threats to national interests in foreign policy, defence, socio-economic, Energy, Food, Environmental and Information Areas;

Strengthening the defense capacity of the state, strengthening the responsibility of the state authorities of all levels for the unreliable training and security of the state;

Reforming the Armed Forces of Ukraine and other military formations to ensure their maximum effectiveness and ability to respond promptly to potential threats to Ukraine, providing special attention to the cover of the airspace and the marine space of the state, The comprehensive support of the Armed Forces of Ukraine;

Providing a gradual transition to the implementation of the Armed Forces of Ukraine on a contractual basis, primarily for the specialties defining units of the units;

Providing equipment with the Armed Forces of Ukraine with latest types of military equipment and arms, restoring the capacity of the defense and industrial complex to implement the latest technologies as the basis of cooperation with states-partners, and Implementation of their own closed cycles of the creation of military equipment and armaments;

Improving the system of democratic civil control over the Military Organization of the State and the law enforcement agencies, to ensure their compliance with the requirements of European institutions;

Completion of the formation and development of the domestic defense and industrial complex; the implementation of the practice of state order for weapons and military equipment for the Armed Forces of Ukraine, other constituent entities of the Military Organization of the State.

Article 7. Internal policies in the economic sphere

1. The main areas of domestic policy in the economic sphere are:

Ensuring the competitiveness of the national economy, achieving its growth rates, ensuring macroeconomic stability and low inflation;

development of the domestic market, improving the efficiency of its functioning and improving the mechanisms of government regulation, ensuring the balance of supply and demand in individual markets;

Conduct a consistent anti-inflationary policy and ensuring price and currency and exchange stability;

to conduct a stable, rational and equitable tax policy that involves a reduction in the tax burden on the economy with the expansion of the tax base;

Ensuring the economic balance of the development of regions, coherence of the areas of their development with national needs;

The guarantee of the state of inviolability of all forms of property as the backbone of the market system;

creating favorable conditions for the development of entrepreneurship, simplifying the business and exit of it, reducing state intervention in economic activity, simplifying the system of permits, reducing pressure on business The control bodies;

The transition to the European model of market surveillance, quality and safety of products;

The introduction of European approaches in the sphere of delegation of the functions of the State;

The development of competition as a major factor in improving the efficiency of the economy, ensuring the effective regulation of natural monopolies, malnutrition of monopolitics at the state and regional levels;

Detimization of the economy, creating favorable conditions for the activities of economic agents in the legal legal field;

Investment and innovation activities, in particular, by attracting businesses and population funds, approving an effective investment risk insurance system, stimulating the conjugation of the savings of citizens to invest in the economy, Providing an innovative component of investment;

Introduction of economic incentives to encourage modernization of national production, direct investment in the latest technology, the formation of national innovation infrastructure and public industrial modernization programs;

The development of mechanisms of public-private partnership to attract investment in the modernization of industrial and social infrastructure;

The transition from fiscal to investment-oriented privatization model, ensuring the transparency of decision-making and the relationship between privatization of state property with the strategy of developing the economy of Ukraine and its individual industries;

Ensuring effective management of state property facilities, the introduction of a transparent and effective implementation mechanism by the state of its owner;

Achieving a high level of energy security, diversification of energy supply sources, increase their own extraction, improving the efficiency of energy efficiency, the introduction of energy and resource-generated technologies;

The transfer of Ukrainian gazo, oil and electrical networks to the conditions of functioning in the states of the European Union;

The formation of the land market infrastructure, providing the design of the legal documents on land ownership;

Reformation of housing and utilities, ensuring the availability of utilities and enhancing their quality, participation of residents to manage housing facilities.

Article 8. Domestic politics in the social sphere

1. The main areas of domestic policy in the social sphere are:

providing assured Constitution of Ukraine rights and freedoms of citizens on the basis of the introduction of European standards of social protection, improving the quality of social services;

Granting citizens throughout the life of social safeguards on the basis of the improvement of the social standards system and the benefits;

Achieve effective demographic development;

improve the social protection of children, the adoption of spiritually and physically healthy, materially secured and socially advantaged family;

promote youth in implementing creative opportunities and initiatives, bringing it to active participation in the social, economic and humanitarian development of the State;

providing affordable housing for citizens, primarily of the low-income, with limited physical capabilities, youth, budget workers, the formation of a powerful state order for the construction of social housing, the revival of the available mortgage Credit;

The transformation of public policy in employment and labour market, including through the development of partnerships between employers and hiring workers, owners of businesses, institutions, organizations and professional unions;

Providing public guarantees for the implementation of the social rights of workers of enterprises, institutions, organizations of all forms of property, ensuring youth as the first working place;

Improvement of the pension system, creating conditions for the decent life of elderly people, stimulating the development of a non-governmental system of pension insurance;

Article 9. Internal policy principles in the environmental sphere and technology sector

1. The core areas of internal policy in the environmental sphere and the area of technological security are:

Ensuring the constitutional rights of citizens on a safe environment, creating environmentally and technogenically safe living conditions, strengthening educational activities to inform the population about environmental norms and standards;

conservation of the environment, improving national environmental policy, stimulating the development of eco-safe technologies;

Providing comprehensive protection of the population and rehabilitation of the territory from the negative impact of the Chernobyl disaster, overcoming the effects of the Chernobyl disaster;

Take action on safe handling of radioactive waste, withdrawal from the exploitation of Chernobyl Nuclear Power Plant and the conversion of an object "Cover" to an environmentally secure system;

Article 10. Internal policies in the humanitarian sphere

1. The main areas of domestic policy in the humanitarian sphere are:

implementation of public language policy based on norms of national and international law, ensuring comprehensive development and functioning of the Ukrainian language in all areas of public life throughout Ukraine, the guarantee of free development, The use and protection of Russian, other native languages of citizens of Ukraine;

Establishment of adequate conditions for the buildup of educational potential of Ukraine, ensuring equal access for citizens to quality education regardless of the place of residence, property and financial capabilities;

enhancement of the education system, providing a quality preschool, full general average, vocational, higher education in public and communal educational institutions, increasing the prestige of the work of pedagogical and scientific teaching workers, Support for gifted youth;

Enhancing the role of higher education and science as the basis for becoming an effective "knowledge economy" in Ukraine;

The reform and development of the domestic system of higher education and science, ensuring their integration into European and world educational and scientific space, the introduction of the principles and standards of the Bologna Process in higher education institutions of Ukraine;

ensure effective protection in accordance with international standards of intellectual property law, including copyright and related rights;

Promote the cultural development of citizens of Ukraine, creating conditions for the creative potential of human and society, ensuring equal opportunities for all citizens of Ukraine in the pleasure of cultural and spiritual needs;

The revival of the spiritual values of the Ukrainian people, the protection and multiplication of its cultural gain, the preservation of the national cultural heritage, the support for the development of culture and art, the revival and preservation of the cultural identity of the regions;

Protection, modernization and development of the national cultural industry (book edition, cinematography, art);

creating conditions for the consolidation of society based on the national system of spiritual values, in the middle of which a person, its development, law and liberty, the maximum of its needs;

restoring a full dialogue between the representatives of various social and ethnic groups, cultures and religious denominations;

providing conditions for the formation of a tolerant society, guaranteeing freedom of conscience and religion;

Article 11. Foreign policy

1. Ukraine as a European state carries out an open foreign policy and seeks equal mutually beneficial cooperation with all the necessary partners, based primarily on the need to guarantee security, sovereignty and protection territorial integrity of Ukraine.

2. The main areas of foreign policy are:

Ensuring national interests and security of Ukraine by maintaining peaceful and mutually beneficial cooperation with members of the international community in accordance with the general principles and norms of international law;

providing diplomatic and other means and methods provided by international law, protection of the sovereignty, territorial integrity and the inviolability of the state borders of Ukraine, its political, economic, energy and other interests;

the use of international capacity to establish and develop Ukraine as a sovereign, independent, democratic, social and legal state, its sustainable economic development;

creating favorable foreign policy conditions for the development of the Ukrainian nation, its economic potential, historical consciousness, national dignity of Ukrainians, as well as ethnic, cultural, linguistic, religious identity of citizens of Ukraine all Nationalities;

The establishment of the leading place of Ukraine in the international relations system, strengthening the international authority of the state;

promoting international peace and security in the world, participation in a comprehensive political dialogue to enhance mutual trust of states, overcome traditional and new security threats;

deepening cooperation with the Organization North Atlantic Treaty For the purpose of achieving the criteria needed to acquire membership in this organization;

Ensuring Ukraine's integration into European political, economic, legal space with the aim of gaining membership in the European Union;

Support for the development of trade and economic, scientific and investment cooperation of Ukraine with foreign powers on the basis of mutual benefit;

To ensure full economic development, improving the welfare of the people's integration of Ukraine's economy into the global economic system;

the expansion of international cooperation to attract foreign investment, the latest technologies and managerial experience into the national economy in the interest of its reform, modernization and innovation development;

Support for Ukraine's integration into world information space.

Article 12. Identify and implement the interior and foreign policy

1. The definition and implementation of the interior and foreign policy shall be carried out on the basis of close interaction and coordination of efforts by the Verkhovna Rada of Ukraine, the President of Ukraine, the Cabinet of Ministers of Ukraine, ministries, other central and local bodies The executive order is in this direction.

3. The authority to determine and implement an internal and foreign policy shall be carried out:

The Verkhovna Rada of Ukraine as the only body of legislative power in Ukraine is by defining the institution of internal and foreign policy, if necessary changes to this Act, the legislative regulation of the relations aimed at implementing the institution. internal and foreign policy in relevant areas, implementation of cadre policies within the limits of Constitution of Ukraine , the exercise of parliamentary control;

bodies of local government-by resolution within the Constitution and laws of Ukraine of local importance in the respective fields of domestic policy and in the sphere of foreign economic activities.

4. Implementation of the interior and foreign policy is involved in political parties, public organizations in the order stipulated by the law.

Article 13. Supervising the internal and foreign policy

1. Monitoring of the establishment of internal and foreign policy is carried out by the Verkhovna Rada of Ukraine, the President of Ukraine, the National Security and Defense Council of Ukraine, the Cabinet of Ministers of Ukraine, other state authorities within their borders. Article 14. Final Position

1. This Act will take effect from the day of its publication.

2. Take up to Law of Ukraine "On the Foundations of National Security of Ukraine" (Information of the Verkhovna Rada of Ukraine, 2003, No. 39, pp. 351) such changes:

1) paragraph 2 article 1 supplements words " in the areas of law enforcement, combat corruption, border activity and defence, migration policy, health, education and science, scientific and innovative policy, population cultural development, ensuring freedom of speech and information security, social policy and pension, housing and utilities, the market of financial services, protection of property rights, stock markets and the circulation of securities, fiscal and customs policies, trade and business activities, market banking services, investment policy, revision, monetary and monetary policy, protection of information, licensing, industry and agriculture, transport and communication, information technology, energy and technology energy conservation, the functioning of natural monopolies, the use of superpower, land and water resources, minerals, environmental protection and the environment and other areas of public administration in the emergence of negative trends the creation of potential or real threats of national interest ";

3. To know what has lost the situation, The Decree of the Verkhovna Rada of Ukraine of 2 July 1993 "On the Basic directions of foreign policy of Ukraine" (Information of the Verkhovna Rada of Ukraine, 1993, No. 37, art. 379).

4. The Cabinet of Ministers of Ukraine:

in a three-month period to prepare and amend the Verkhovna Rada of Ukraine's proposal to bring legislation into compliance with the Act;

To bring their legal and legal acts into compliance with the Act;

Provide a view and abolishment of ministries and other central executive bodies of their normative acts that are contrary to this Act.
