This Act governs public relations in the area of the museum, defining legal, economic, social establishment and the activities of museums of Ukraine and the peculiarities of scientific formation, study, accounting, storage, conservation and use of the Museum Foundation. Ukraine, its legal status.

This Act extends to all types of museums and reserves in part of their museum activities, as well as accounting, storage and use, conservation, conservation, restoration of museum items, museum collections and museum values.

Section I
GENERAL PROVISIONS

Article 1. Basic terms and definitions

In this Act, the following terms are used in this way:

Guarding museums-a system of legal, organizational and financial and economic activities that provide the inviolability of the museum building and the museum assembly;

the subject matter is a cultural value whose special features are the basis of which it is appropriate to make it to the Museum Fund of Ukraine and acquire the status of a museum subject with the aim of preserving, studying and public representation;

Article 2. Museum on the right and main activities of museums

The museum on the right represents national museum policy, museum studies, and museum practice.

Article 3. National Museum of Politics

National museum policy is the set of basic areas and the activities of the state and society in the field of museum business.

The main areas of national museum policy are:

Preservation and public support for the Museum Fund of Ukraine;

Budget funding (including on pre-trial facilities) and prioritized and technical support for the development and implementation of state, regional and local museum development programmes;

Ensuring the protection of museums;

Support for fundamental and applied scientific research related to museum business;

Promoting international cooperation in the field of museum business.

Article 4. Legislation of Ukraine on museums and museum proceedings

Ukraine ' s legislation on museums and museum business is based on Constitution of Ukraine and consists of this Act and other regulations.

If the international treaty, consent to the binding of the Verkhovna Rada of Ukraine, is set by other rules than those provided by the legislation of Ukraine on museums and museum proceedings, the rules of the international treaty are applied.

Article 5. National, regional and profile organizations of the museums of Ukraine. Participation in international organizations

Museums of Ukraine have the right to join in national, regional and profile organizations (unions, associations, etc.) to join international museum organizations and foundations.

MUSEUMS OF MUSEUMS. CREATION AND MATERIAL BASE OF MUSEUMS

Article 6. Types of museums

According to its profile, museums are divided into natural (anthropological, biological, botanical, geological, zoological, mineralogical, paleontological), historical (historical, historical, historical, historical, historical, and archeological history). ethnographic, literary, artistic (visual, ornamental, folk, contemporary art), arts (theatre, musical, museum of cinema), scientific and technical, complex (regional, ecomusions), industry, etc.

Article 7. Creation of museums

Museums may be based on any form of property prescribed by the laws. The founders of the museums may be the relevant bodies of the executive branch, the local government, the legal and physical persons.

The decision to create museums accept their founders.

To create the museum, the founders must provide:

The formation of a museum gathering;

Museums are legal entities other than those created and operate within businesses, institutions, organizations and educational institutions.

The founders of the museum can create branches and departments of the museum that are not legal entities.

Land areas, other natural resources needed for the creation of the museum, are provided for use in the established law.

Museums can create and operate in all organizational legal forms.

Article 8. Statute of the Museum

The museum operates on the basis of a charter, which is approved by its founder or founder.

The statutes (position) of the museum are defined by:

the name of the museum, its status, the composition of the founders, their rights and duties;

Organizational structure, basic tasks and areas of activity;

Sources of funds and their use, composition of the property of the museum, order of its reorganization and liquidation, conditions of preservation of the museum assembly in the event of liquidation of the museum;

other conditions of the museum.

Article 9. State registration of museums

State registration of museums regardless of the form of property is conducted under their location in accordance with the law.

The museum, established with businesses, institutions, organizations, educational institutions, registration is not subject. The order of accounting for such museums determines the central body of the executive branch, which ensures the formation of public policy in the areas of culture and arts.

Article 10. Liquidation and reorganization of museums

The elimination of museums is carried out by the decision of the founder and by the decision of the court in cases provided by the current legislation.

Article 11. Museum Territory

The territory, reserved for the museum, belongs to the land of historical and cultural purposes. Article 12. Using natural resources

Article 13. Funding for museums

Funding for museums depending on the form of property is carried out by funds under government budget, local budgets, charitable contributions of physical and legal entities, other sources not prohibited by legislation.

Budget appointments and funds received from additional sources of funding for museums are not subject to removal during the budget period, in addition to the cases prescribed by the law. The funds received from additional funding sources do not affect the amount of budget funding of state and municipal museums.

The amount of expenses for the protection of museums is necessarily defined in the state and local budgets and is included in the list of protected articles of expenditures of the general fund of budgets.

Additional sources of funding for museums are:

the funds coming from the economic activity, the provision of paid services, including visits to museums and exhibitions;

The funds received for the research and other types of work performed by the museum in order to order enterprises, institutions, organizations, associations of citizens and citizens;

Revenues from the implementation of souvenir products, items of folk art fields, publishing activities, from the provision of premises, facilities, equipment;

Film fees and photo shoots;

Grants, charitable contributions, voluntary donations, monetary contributions, material values received from the physical and legal entities, including foreign;

funds received by the state and municipal museums as an interest on the remainder of their own revenues received as services provided by them according to the main activities, charitable contributions and grants and posted on current accounts opened in banks. Public sector;

other sources, including currency revenues, according to the legislation of Ukraine.

Article 14. Logistical support for museums

The owners of the museums are obliged to provide their buildings (facilities) built on special projects, or other ordered premises, meet the requirements of the museums ' functioning as well as appropriate equipment and transport.

The premises of museums that are in state or communal property are passed to them on the right of operational management. It can be removed only by providing the museum to another equivalent building. In the event of the removal of the museum building, which is a cultural heritage site, the decision on its removal is accepted by the agreement with the central body of the executive branch, providing the formation of public policy in the areas of culture and arts.

Chapter III
MUSEUM FOUNDATION OF UKRAINE

Article 15. Museum Foundation of Ukraine

The Museum Fund of Ukraine is a national wealth, an integral component of the cultural heritage of Ukraine, protected by law.

Museum items of the Museum Fund of Ukraine are cultural values that are permanently stored in Ukraine and beyond or under international treaties are subject to return to Ukraine.

Museums, legal and physical persons are obliged to ensure the preservation of the Museum Fund of Ukraine and to promote it.

Status of the Museum Foundation of Ukraine are approved by the Cabinet of Ministers of Ukraine.

Article 15 - 1 . Museum Fund of Ukraine

Article 15 - 2 . Features of property rights on museum items, museum collections, museum collections, museum items of the museum fund of Ukraine

Article 16. Museum items of the museum fund of Ukraine as part of the State Register of National Cultural Heritage

Article 18. State of the Museum Foundation of Ukraine

The formation of the state portion of the Museum Fund of Ukraine is carried out by:

Article 19. Accounts of museum items and objects of museum value

Article 21. Preservation of the museum fund of Ukraine

In order to preserve museum items, museum collections, museum gatherings and objects of museum value owners or empowered bodies are required to create proper conditions, including a special scientific-justified mode of storage, and And restoration and restoration.

The requirements for the storage and accounting conditions of museum items, museum collections define the central body of the executive branch, which ensures the formation of public policy in the areas of culture and arts.

The destruction of museum items and objects of the museum fund of Ukraine is prohibited.

In the event of loss or destruction of museum items belonging to the state of the Museum Foundation of Ukraine, they can be removed from the stock-accounting documentation only by the decision of the central executive branch providing the formation of state policies in the areas of culture and arts on the basis of the findings of the expert-stock commission.

Article 22. The order of exportation beyond the borders of museum items, museum collections, museum collections belonging to the state of the Museum Fund of Ukraine, and the items of the museum's significance to the state of the museum fund of Ukraine

The import of museum items, museum collections, museum collections belonging to the State Museum Fund of Ukraine, and the museum's values subject to the state of the Museum Fund of Ukraine, is prohibited except in cases of temporary stay abroad for exhibiting on exhibitions, restoration or conducting scientific expertise on the basis of evidence for the right of withdrawal (temporary withdrawal) of cultural values according to Law of Ukraine "On the Visitation, Military and Return of Cultural Values" and by the agreement with the central body of the executive branch in the sphere of culture and tourism.

Article 23. Insurance of museum items, museum collections, museum collections of the Museum Fund of Ukraine and the museum's values subject to the museum fund of Ukraine

Article 24. Conservation and restoration of museum items in the museum fund of Ukraine

The conservation and restoration of museum items of the Museum Foundation of Ukraine undertake specialized agencies and organizations, restoration units of museums and individual restorers that have a qualification category in their respective specialty.

The order of their conservation and restoration is determined by the central body of the executive branch, which ensures the formation of public policy in the spheres of culture and arts.

The state promotes the restoration of museum items, the items of the museum's significance of the non-state part of the Museum Fund of Ukraine in the state restoration establishments.

In order to conduct the restoration of the restorers and the adoption of a suitable qualification category, an Classification Commission is formed. The position of an atheist commission and its personal composition is approved by the central executive body, which ensures the formation of public policy in the areas of culture and arts.

INTERNATIONAL ACTIVITIES OF MUSEUMS

Article 25. International activities of museums

The Museum of Ukraine participates in international cultural cooperation in the field of museum business on the basis of multilateral and bilateral agreements.

The participation of museums in international cultural cooperation is carried out in established order by:

Conducting joint scientific research on the development and implementation of international scientific programs;

Implementation of mutual exchange of museum information, exhibitions, the study of the international experience of the organization of the museum business;

Holding international conferences, congresses, symposia, exhibitions and participation;

Organization of joint training of museum workers, development of publishing activities;

To implement another joint action in accordance with the agreements if it does not contradict Ukraine's legislation and international treaties of Ukraine.

ADMINISTRATION AND SELF-GOVERNMENT OF MUSEUMS, GUARANTEES OF THE RIGHTS AND LEGITIMATE INTERESTS OF THEIR WORKERS

Article 26. Public administration of museums

The central body of the executive branch ensures the formation of public policy in the areas of culture and arts, within its own powers:

Ensures the formation and implementation of public policies in the sphere of the museum business;

Forms the requirements for the state statistical accounting of museums created in the territory of Ukraine;

Provides organizational and methodological leadership, contributes to the development of modern infrastructure business, development of the museum network, creates specialized organizational structures, scientific institutions for scientific and methodical and technology Provide museums;

To coordinate the work of the museum's only information system;

Exercises other powers defined by the laws and acts of the President of Ukraine.

The central body of the executive branch, which implements state policy in the areas of culture and arts, within its own powers:

Organize the training and improve the qualifications of museum workers;

Defines the needs of the state and regulations that guarantee the proper level of museum service and the access of citizens to the Museum Fund of Ukraine;

Supervise the activities of museums based on public and communal forms of property, by the state of accounting, storage, protection, use and movement of museum items of the Museum Fund of Ukraine, stored in museums regardless of Forms of ownership

Organizes scientific research in the field of museum business;

violates the presence of museum items and museum collections on the improvement of storage conditions;

Directs requests to obtain information about museum items and museum collections;

If necessary, it contributes to the transfer of museum items, museum collections and museum items belonging to the non-state part of the Museum Fund of Ukraine, for temporary storage to state museums;

Exercises other powers defined by the laws and acts of the President of Ukraine.

Other central and local executive bodies and local government bodies make the management of museums in the area of their administration.

Local government bodies and local governments are responsible for the logistical and financial provision of museums that are in the area of their administration.

The leaders of the state and municipal museums are appointed to the post by contract for five years at the results of the competition.
