On road traffic safety (Gazette of the Mejlis of Turkmenistan, 2012, no. 1, art. 35) (with amendments and additions as the laws of Turkmenistan dated 01.03.2014 № 47-V, 03.05.2014, no. 83-V and 12.01.2016, no. 325-V) Chapter i. General provisions article 1. The scope of this Law this law determines the legal framework for ensuring road traffic safety in the territory of Turkmenistan, governs the relations that arise in the field of road safety and aims to ensure the protection of life, health and property of citizens, protect their rights and legitimate interests, as well as the environment Wednesday.
 
Article 2. The basic terms used in this Act for the purposes of the present law, the following terms are used: 1) pedestrian-a person outside of transport and not on the road conducting any work;
2) driver-a person driving any vehicles, the driver Pack, mounted animals or herds on peregonŝik road. Person training transport management equates to the driver;
3) trailer-vehicle is not equipped with a motor and designed for movement, consisting of motor vehicles;

6) a passenger is a person in the vehicle, other than the driver, as well as the person entering the vehicle (push) or outside of the vehicle (leaving);
7) traffic-the totality of social relations emerging in the process of moving people and goods on the roads or vehicles without such;
8) traffic participant-person accepting direct participation in road traffic as a driver, pedestrian, passenger vehicle;
9) traffic-a set of organizational-legal, organizational and technical measures and administrative actions to manage the traffic on the roads;
10) accident is an event that occurs while the vehicle is in motion along the way and with his participation that caused death or injury, causing material damage to vehicles, goods, facilities;
11) road safety condition of road traffic, reflecting the degree of protection of its participants from road accidents and their consequences;
12) ensuring road traffic safety activities aimed at preventing the causes of accidents, reducing the severity of their consequences.
 
Article 3. Turkmen legislation on road safety 1. Turkmen legislation on road safety is based on the Constitution of Turkmenistan, the universally recognized norms of international law and consists of this law and other normative legal acts of Turkmenistan.
2. If an international treaty to which Turkmenistan stipulates other rules than those stipulated by this law, the rules of the international treaty shall apply.
 
Article 4. The basic principles of road safety, the basic principles of road safety are: 1) the priority for the life and health of persons involved in road traffic over the economic results of economic activities;
2) priority of State responsibility for road safety on the responsibility of persons involved in road traffic;
3) observance of the rights and legitimate interests of citizens, society and the State in ensuring road traffic safety;
4) program-target approach to road safety;
5) integrated use of technology and designs, the use of which is regulated by the applicable standards in Turkmenistan;
6) preventing changes in traffic management to increase road capacity or other purposes at the expense of reducing the level of road safety.
 
Chapter II. The MAIN DIRECTIONS of the State policy in the field of ROAD SAFETY, Article 5. The basic directions of ensuring road traffic safety 1. Road safety is carried out through the establishment of the authority and responsibility of the Cabinet of Ministers of Turkmenistan, local authorities and other public authorities.
2. The main directions of State policy on road safety are: 1) the coordination of the activities of State bodies, local authorities and other legal and physical persons in order to prevent accidents and reduce the severity of their consequences on the territory of Turkmenistan;
2) Regulation of the automotive, urban land electrical transport and highways;

3) design and approval in the prescribed manner of the normative legal acts on road safety issues (rules, standards, technical regulations and other normative documents);
4) operate on traffic organization;
5) logistical and financial support for the activities on road safety;
6) training and retraining of drivers of vehicles and training citizens of traffic rules and road safety requirements;
7) conducting of complex of actions on health safety;
8) implementation of mandatory certification of objects, products and services of transport and road management;
9) licensing activities related to traffic safety;
10) implementation of socially-oriented policy in the field of insurance;
11) implementation of public monitoring of the implementation of the Turkmenistan legislation, regulations, standards, technical regulations and other normative documents in the field of road safety.
 
Chapter III. The COMPETENCE of STATE BODIES in ensuring road safety Article 6. Competence of the Cabinet of Ministers of Turkmenistan in the field of road safety, the Cabinet of Ministers of Turkmenistan in the field of road traffic safety promotion within its competence: 1) generates and conducts on the territory of Turkmenistan a uniform State policy in the field of road safety;
2) approve state programs on traffic obespečeniûbezopasnosti and supervises their implementation;
3) approves the rules of the road and other normative legal acts on the issues of security and organization of road safety;
4) coordinates the activities of ministries and departments in the field of road safety, compliance with environmental safety requirements;
5) establishes uniform requirements to the technical condition of vehicles and roads, road safety on the roads and railway crossings;
6) establishes the General requirements concerning the training of voditelejtransportnyh funds, as well as the training of the population rules of safe behaviour on the roads;
7) establishes a unified State accounting system of indicators of accidents, road traffic injuries, number of vehicles, drivers, offences in the sphere of road traffic, transport-road performance, as well as other indicators that reflect the status of road safety and security, how to use accounting information and formation of reporting information in this field;
8) determines the order of licensing activities related to traffic safety;
9) exercise other powers in accordance with the legislation of Turkmenistan.
 
Article 7. The competence of executive bodies of local authorities in the field of road safety, local executive authorities in the field of road safety: 1) implement the State programme for road safety;
2) claim to territorial road safety programmes and monitor their implementation;
3) organise medical road safety, as well as medical assistance to victims of road accidents;
4) take measures to prevent road-transportnogotravmatizma, training of the population rules of safe behaviour on the road, promoting road safety and compliance with environmental safety requirements;
5) provide construction and maintenance in a serviceable condition of streets, sidewalks and traffic signs and other traffic control devices within the administrative-territorial units, as well as the urban electric transport;
6) in consultation with the organs of Internal Affairs carries out compliance content objects outdoor advertising and information requirements of road safety rules.
 
Article 8. The competence of the bodies of internal affairs in the field of road safety, internal affairs bodies within its competence in the field of road safety: 1) implement State policy in the field of road safety;
2) fulfillment of State and regional programs in the sphere of road safety;
3) carry out maintenance of the accounting system of indicators of accidents, road traffic injuries, number of vehicles, drivers, offences in the sphere of road traffic, road safety-sensitive activities and to their welfare;
4) shall exercise State supervision over the observance by natural and legal persons of the traffic rules, standards, technical regulations and other normative legal acts;

5) overseeing the implementation of the activities for the training and retraining of drivers of vehicles, take examinations for citizens for the right to drive motor vehicles and issue them permits for vehicles;
6) registering automototransport means and trailers for it, intended for traffic on roads of common use;
7) organize and conduct State technical inspections of registered motor vehicles and trailers;
8) Regulation of traffic;
9) monitor compliance with traffic rules by all road users;
10) impose requirements on the implementation of the road traffic regulations of the enterprises, establishments, organizations which are the owners of the vehicles and use them;
11) apply to violators of the established rules of road safety measures prescribed by normative legal acts of Turkmenistan;
12) prohibit the use of vehicles which are detrimental to road safety and/or the environment Wednesday on its appearance, technical condition or other reasons;
13) with a view to monitoring compliance with traffic regulations check documents, offering drivers the right to drive vehicles, waybills and other documents for the carriage of goods;

18) participate in the conclusion of international treaties of Turkmenistan in the field of road safety.
 
Article 9. Competence of the authorized body in the sphere of road construction for road safety within the competence of the authorized body in the sphere of road construction for road safety concerns: 1) development of regulatory legal acts on safety of road transport;
2) providing the content in good condition road subordinate to the safe movement of vehicles thereon;
3) providing road users neobhodimojinformaciej about the State of the road surface, hydrometeorological and other conditions, availability of service facilities and the location of the nearest health facilities and communications;
4) arrangement and equipment of roads with road signs and other means of regulating traffic, service objects, system of hotlines, support and organization of their work and content to meet the needs of road users and their security;
5) identifying dangerous for traffic stations, roads and the adoption of measures to improve traffic management in these areas;  
6) the development of common rules of the road and railway crossings;
7) participate in determining the routes of vehicles carrying heavy, bulky, dangerous and special cargoes;
8) realization of other powers in accordance with the legislation of Turkmenistan.
 
Article 10. Competence of the authorized organ in the field of road transport road safety within the competence of the authorized organ in the field of road transport road safety concerns: 1) development of technical conditions and methodology for testing and certification, registration of vehicles admitted to road traffic, and services in the field of road safety;
2) accumulation, generalization and analysis of information on registration and technical testing of vehicles in order to improve the networks and stations that provide such services;
3) elaboration of binding norms in the Organization and implementation of transport, monitoring their observance;
4) development of specific rules in the field of road transport and to establish security measures in their implementation;
5) training and refresher training of drivers of vehicles, preparing and issuing permits to persons driving training, licensing and monitoring of driving schools, development of provisions for the training and retraining of drivers, training programmes and manuals;
6) exercise other powers in accordance with the legislation of Turkmenistan.
 
Article 11. Competence of the authorized organ in the field of health for road safety
 

The competence of the authorized organ in the area of health, traffic safety concerns: 1) development and establishment of norms of the psycho-physiological and medical examination of drivers and drivers of vehicles of candidates;
2) sampling and analysis of biological samples in order to determine the consumption of alcoholic beverages, drugs and other psychoactive substances, medicines, which may have a negative impact on the ability of the driver to drive a vehicle;
3) development of programmes for schools to educate drivers of road vehicles, road police surveillance officers and other specialized structures methods of first aid to victims of road accidents;
4) elaboration of identification mark, which must be affixed to the packaging of medicines, not advised drivers of vehicles;
5) the approval of the specification the contents of first aid kits and their certification;
6) providing emergency medical assistance to victims of road accidents;
7) monitoring the level of noise generated by vehicles involved in road traffic;
8) realization of other powers in accordance with the legislation of Turkmenistan.
 
Article 12. Competence of the authorized organ in the field of education for road safety within the competence of the authorized organ in the field of education on road safety includes: 1) development in coordination with the Ministry of Internal Affairs of Turkmenistan training road safety rules and ensure educational work in this direction in the preschool and secondary educational institutions, as well as the preparation and improvement of professional level of teaching staff engaged in such activities;
2) development in coordination with the Ministry of Internal Affairs of Turkmenistan, teaching and innovative learning guides for road safety regulations;
3) direction, coordination of education authorities to teach road safety rules and monitoring of their activities;
4) establishing, in cooperation with other competent bodies, the methodological norms and training examination, certification and improvement of professional level of trainers of trainers for the training of drivers of road vehicles and personnel transportation;
5) realization of other powers in accordance with the legislation of Turkmenistan.
 
Article 13. The competence of the Armed forces of Turkmenistan, other troops and military authorities for road safety 1. The competence of the Armed forces of Turkmenistan, other troops and military authorities for road safety include: 1) education, training, retraining of drivers (soldiers doing military service and other citizens), motor vehicles (including motorcycles, armoured and other technical means) for Turkmenistan's armed forces, other troops and military trainers and teaching staff of the schools for the training of drivers of vehicles under their control;
2) registration of vehicles and conducting their statistical accounting in accordance with the legislation of Turkmenistan; 
3) Organization and implementation of technical control of fleet vehicles; 
4) escort convoys of military vehicles;
5) realization of other powers in accordance with the legislation of Turkmenistan.
2. Education, training, retraining of drivers referred to in paragraph 1 of this article, for other troops and military bodies that are not part of the Armed forces of Turkmenistan, performing tasks in the field of defence in accordance with the plan for the defense of the country, in accordance with their intended purpose may be carried out by relevant bodies of the Ministry of defence of Turkmenistan or the State border service of Turkmenistan.
 
Article 14. Competence of the authorized organ in the field of agriculture for road safety within the competence of the authorized organ in the field of agriculture to ensure road safety concerns: 1) development of regulatory legal acts in the field of training, certification and improvement of professional level of drivers self-propelled vehicles (tractors, agricultural machines) with trailers to them and issuing certificates for these vehicles;
2) regulating, coordinating and supervising the preparation and improvement of professional level of drivers self-propelled vehicles (tractors, agricultural machinery);
3) registration of self-propelled vehicles (tractors, agricultural machines) and trailers and doing their posting in accordance with the legislation of Turkmenistan;
4) Organization and implementation of technical control of self-propelled vehicles (tractors, agricultural machinery);
5) realization of other powers in accordance with the legislation of Turkmenistan.
 

Article 15. Competence of the authorized organ in the field of nature protection for road safety within the competence of the authorized organ in the field of nature protection for road safety are: 1) the development, together with other public authorities Wednesday environmental protection programmes for road users in accordance with international requirements and national standards;

6) exercise other powers in accordance with the legislation of Turkmenistan.
 
Article 16. The participation of NGOs in the activities of road safety 1. Public associations in order to ensure the safety of road users may, in the manner prescribed by the legislation of Turkmenistan, to make proposals for the implementation and improvement of the rules, standards, technical and other rules in the field of road safety, to undertake activities aimed at the prevention of violations of traffic rules.
2. Local executive bodies and local self-government bodies shall have the right to draw associations with their consent to undertake measures to ensure traffic safety.
 
Article 17. Licensing activities related to road safety 1. The activities of natural and legal persons related to road safety, is subject to compulsory licensing.
2. Activities and licensing are determined by normative legal acts of Turkmenistan about licensing separate kinds of activity.
 
Chapter IV. The BASIC REQUIREMENTS for ROAD SAFETY Article 18. The basic requirements for road safety in the design, construction and reconstruction of roads 1. Design, construction and reconstruction of roads in the territory of Turkmenistan shall be carried out with the aim of ensuring road traffic safety. Line built and reconstructed roads requirements of building codes, regulations and standards pertaining to road safety, verifies the public acts of acceptance of the road.
2. Responsibility for compliance with the requirements of road traffic safety in the design phase rests with the Executive Director of the project, and during construction and reconstruction-contractor.

Article 19. The basic requirements for road safety in the repair and maintenance of roads 1. Repair and maintenance of roads in the territory of Turkmenistan are carried out with the aim of ensuring road traffic safety. Line road rules, standards and technical regulations relating to road safety, verifies the acts of inspection tests or road surveys conducted with the participation of the local authorities.
2. The local executive bodies have a duty to ensure that the roads under their control, after repair, and during the operation of established rules, standards and technical regulations.
 
Article 20. Limiting or eliminating Road 1. Temporary limitation or cessation of movement of vehicles on the roads with the aim of ensuring road traffic safety can be carried out by authorized officials of the State bodies of executive power, bodies of local executive bodies and local governments in charge of roads, within their competence, in consultation with the organs of internal affairs.
2. the list of grounds for limiting or preventing temporary movement of vehicles on the roads in order to ensure traffic safety approved by the Cabinet of Ministers of Turkmenistan.
 
Article 21. State technical inspection of vehicles
 

1. Vehicles in service in the territory of Turkmenistan and duly registered by the competent authorities, specified in the present law, are subject to public inspection.
2. procedure of compulsory technical inspection of vehicles is determined by normative legal acts of Turkmenistan.
 
Article 22. Basic requirements to ensure road safety during the operation, maintenance and repair of vehicles 1. The technical condition of equipment and vehicles involved in road traffic, their maintenance and repair in order to content in good condition to ensure the safety of road traffic.
2. Responsibility for the maintenance of vehicles involved in road traffic, in technically serviceable condition is imposed on the owners of vehicles or persons operating vehicles.
3. rules and procedures of the maintenance and repair of vehicles installed factories-manufacturers of vehicles taking into account the conditions of their operation.
4. vehicles past maintenance and repairs, must comply with the requirements governing the technical condition of equipment and vehicles involved in road traffic, in part related to road safety, which is confirmed by the corresponding document, issued by the executor of maintenance and repair.
 
Article 23. The grounds and procedure for the prohibition of the use of vehicles 1. Do not operate the vehicle if you have a technical fault, endangering traffic safety.

3. Ban on operation of the vehicle is imposed by the authorized officials of internal affairs bodies in the manner prescribed by normative legal acts of Turkmenistan.
 
Article 24. The basic requirements for physical and juridical persons, whose activity is connected with the exploitation of vehicles 1. Natural and legal persons conducting activities on the territory of Turkmenistan, associated with the operation of vehicles shall: 1) organize for drivers of vehicles in accordance with the requirements of ensuring road traffic safety;
2) respect the normative legal acts of Turkmenistan regime of work and rest for drivers;
3) to create the necessary conditions to increase the level of qualification of drivers;
4) avoid to operate vehicles in the presence of technical malfunctions that threaten traffic safety;
5) to ensure the safety of vehicles and their correspondence to the technical condition of road safety requirements;
6) analyze and address the causes of traffic accidents and traffic violations involving vehicles belonging to them;
7) organize and conduct, with the involvement of medical professionals pre-driver physicals for drivers, drivers ' improvement skills of primary medical assistance for the injured in road traffic accidents.
2. legal persons carrying out activities for the carriage of passengers, baggage and cargo by road or ground transport, electric city in accordance with the legislation of Turkmenistan on road traffic safety, taking into account the features of transportation may establish special rules and present to drivers of vehicles with additional requirements in order to ensure road safety.

Article 25. Medical road safety 1. Medical road safety is mandatory medical examination and re-examination candidates for drivers and drivers of vehicles carrying out before-ride, poslerejsovyh and ongoing medical examinations for drivers of vehicles, providing medical assistance to victims of road accidents, training of road users, road police surveillance officers and other specialized structures, as well as population methods of primary care to people injured in road accidents.
2. The purpose of compulsory medical examination and re-examination is to identify the drivers of the vehicles and the drivers of medical contra-indications or restrictions to driver activities.
3. medical assistance to victims of road traffic accidents is: 1) primary care at the scene of an accident;

2) providing medical care at the scene of the accident coming in en route to a medical facility and a hospital.
4. the frequency of mandatory medical examinations, their conduct, list of medical contraindications, in which the driver is prohibited from driving, as well as the Organization of medical assistance for the injured in road traffic accidents shall be established by the Ministry of health and medical industry of Turkmenistan.
 
Article 26. Road safety organization 1. The road traffic safety in the territory of Turkmenistan is carried out on the basis of the integrated use of technology and management of their designs, the use of which is regulated by standards and provided for projects and traffic management schemes.
2. A single procedure for traffic on the territory of Turkmenistan establishes the rules of the road.
3. On the roads of Turkmenistan establishes the right vehicles.
 
Article 27. The rights and duties of road users 1. The rights of road users for safe traffic conditions on the roads of Turkmenistan are guaranteed by the State and by implementation of normative legal acts and international treaties of Turkmenistan in the field of road safety.
2. the implementation of road users of their rights should not limit or infringe the rights of other road users.
3. Users have the right to: 1) freely and to move freely on the roads in accordance with and on the basis of established rules, to receive from the competent bodies and officials accurate information on safe traffic conditions;
2) receive from officials of complete and reliable information on the reasons for the restriction or prohibition of traffic on roads;
3) on free medical assistance, rescue and other emergency assistance in case of traffic accident from organizations and officials, to whom the legislation of Turkmenistan has the responsibility to provide such assistance;
4) to compensation in the manner prescribed by regulations of the Turkmenistan, in cases of injuries, as well as in cases of damage to the vehicle, the load as a result of traffic accident;
5) appeal to the order established by the legislation of Turkmenistan, the illegal actions of officials exercising powers in the field of road safety.
4. Users are required to comply with the requirements of this Act and in accordance with it, other regulatory legal acts of Turkmenistan in order to ensure road safety.
5. pedestrians enjoyed an advantage in traffic, but this does not exempt them from fulfilling their responsibilities when participating in road traffic.
 
Article 28. Learning the rules of safe behaviour on the roads 1. Training of citizens rules of safe behavior on the roads is carried out in pre-school institutions, general education and vocational training institutions of various organizational-legal forms.
2. teaching citizens rules safe behaviour on the roads is carried out in accordance with programmes and methodical recommendations developed in the manner prescribed by normative legal acts of Turkmenistan.
3. the provisions on compulsory education rules citizens safe behaviour on the roads included in the appropriate State educational standards.
4. The internal affairs authorities and the media have an obligation to assist local authorities in carrying out activities to educate the citizens of rules of safe behavior on the roads.
 
Article 29. The basic requirements for the training of drivers of vehicles 1. To the exams for the right to drive motor vehicles allowed persons who have attained the age of 18, do not have restrictions to driver activities and trained in the amount stipulated by curriculums and training programmes for drivers of vehicles of the corresponding category.
2. To obtain the right to drive transportation vehicles of category "a" may prepare independently to the extent appropriate curricula and programmes.
3. Model programmes of training for drivers of vehicles of the relevant categories are developed in accordance with the procedure determined by the Cabinet of Ministers of Turkmenistan, in accordance with the relevant educational standards.
 
Article 30. Getting the right to drive motor vehicles 1. The right to drive transportation vehicles of persons who have passed the examinations under conditions provided by paragraph 2 of this article.
2. The right to drive transportation vehicles can be provided: 1) persons who have reached the age of 18, motorcycles, scooters, mopeds and other tools operate (category "a"); 

2) to persons who have reached the age of 18, cars, authorized a maximum mass not exceeding 3500 kg and which, in addition to the driver's seat, shall not exceed eight (category "B"), as well as to persons who have reached the age of nineteen years, authorized vehicles having a maximum mass exceeding 3500 kg, other than those in category "D" (category "c"); 
citizens performing military service conscripts the right to drive transportation vehicles of category "c" is available from the age of 18;
3) persons who have reached the age of 20 years of age who are entitled to drive vehicles belonging to the category "B" or "C", if you have experience of at least one year-cars, intended for the carriage of passengers and having more than eight seats in addition to the driver's seat (category "D");
4) persons entitled to drive vehicles belonging to the category "B", "C" or "D", if you have a driving experience of the management of the corresponding category of not less than one year-cars with trailers or semi-trailers and buses, the maximum authorized mass of the trailer exceeds 750 kg (category "e");
5) persons who have reached the age of 20 years of age-trolleybus and tram. 
3. the right to drive motor vehicles confirmed the relevant identity. On the territory of Turkmenistan there are national and international driving permits conforming to international treaties to which Turkmenistan is a party.
4. the procedure for the deposit of qualifying examinations for acquiring the right to drive motor vehicles and driving licences established by the Cabinet of Ministers of Turkmenistan.
 
Article 31. Grounds for termination of the right to drive motor vehicles.
 
1. Grounds for the termination of the right to drive motor vehicles are: 1) the expiration of the prescribed period of validity of the licence;
2) deterioration of the health of a driver that prevents the safe driving, confirmed by a medical certificate;
3) temporary restriction of the right to drive motor vehicles.
2. Offences entailing penalties as a temporary restriction of the right to drive motor vehicles, shall be established by the laws of Turkmenistan.
 
Chapter V final provisions Article 32. State control in the field of road safety 1. State control in the field of road safety organizuetsâ and osuŝestvlâetsâ in accordance with the legislation of Turkmenistan.
2. State control in the field of road safety is being carried out to ensure compliance with the legislation of Turkmenistan and established rules, standards, technical regulations and other normative legal acts of Turkmenistan in the part relating to road safety.
 
Article 33. Liability for violation of the legislation of Turkmenistan on road safety persons guilty of violating the legislation of Turkmenistan on road safety, shall bear responsibility in accordance with the legislation of Turkmenistan.
 
Article 34. The entry into force of this Act, this Act shall enter into force on the day of its official publication.
