About the national Red Crescent Society of Turkmenistan (statements of the Mejlis of Turkmenistan, 2012, no. 3-4, art. 108) this law defines the legal framework, as well as the principles, tasks, rights and obligations of the national Red Crescent Society of Turkmenistan.
 
Chapter i. General provisions article 1. The basic concepts used in this law the following concepts: 1) International Red Cross and Red Crescent movement-the organizational form of the constant interaction between the International Committee of the Red Cross, acknowledged they Red Cross or Red Crescent societies and the International Federation of Red Cross and Red Crescent societies, with a view to improving the implementation of their humanitarian activities;
2) International Committee of the Red Cross is an international organization whose goals and objectives are of a purely humanitarian nature and is to protect the lives and dignity of people affected by armed conflicts, and to assist them;
3) International Conference of the Red Cross and Red Crescent movement is an International Conference of representatives of the constituent parts of the International Red Cross and Red Crescent movement and the representatives of the States parties to the Geneva Conventions of August 12, 1949 year (hereinafter referred to as "the Geneva Convention) and the protocols additional thereto of June 8, 1977 year (hereinafter additional protocols);
4), the International Federation of Red Cross and Red Crescent societies is an international non-governmental humanitarian organization established for the purpose of international coordination of humanitarian activities of Red Cross and Red Crescent societies and consisting of all the societies of the Red Cross or Red Crescent societies, recognized by the International Committee of the Red Cross.
 
Article 2. The Red Crescent Society of Turkmenistan 1. The Red Crescent Society of Turkmenistan (hereinafter-the company) is acknowledged only in Turkmenistan independent public organization, carries out its activities in accordance with the legislation of Turkmenistan and on the basis of the principles of the International Red Cross and Red Crescent movement throughout the country.
2. the society is an organization that is a member of the International Red Cross and Red Crescent movement, and a member of the International Federation of Red Cross and Red Crescent societies.
3. in order to fulfil the goals and objectives of this Act and the bylaws, the Society creates its local offices (branches).
4. the names "Gyzyl Ýarymaý Türkmenistanyň Milli jemgyýeti (national Red Crescent Society of Turkmenistan), «TGÝMJ» (NOKPT) and" Gyzyl Türkmenistanyň Ýarymaýy (Red Crescent) are equivalent.
5. the company provides assistance to public authorities in the humanitarian activities in the country.
 
Article 3. The legislation of Turkmenistan about society 1. The legislation of Turkmenistan on the society is based on the Constitution and consists of the Turkmenistan law "on public associations", this law and other normative legal acts of Turkmenistan, regulating the activity of the society.
2. If an international treaty to which Turkmenistan stipulates other rules than those stipulated by this law, the rules of the international treaty shall apply.
 
Article 4. The legal status of the company 1. The society is a voluntary, self-governing, non-profit association based on voluntary membership and established in the manner prescribed by the legislation of Turkmenistan, at the initiative of citizens on the basis of common interests for the implementation of activities for the protection of human life and health, social assistance, assistance to victims of emergencies, to cooperate in solving problems arising from the Geneva Conventions and their additional protocols, to promote international humanitarian law and the fundamental principles of the International Red Cross and Red Crescent movement as well as health education.
2. the company is a legal entity, it is liable for its obligations with all property belonging to him. Organizational-legal form of the company-a public organization.
3. The company may open in the manner prescribed by the legislation of Turkmenistan, the Bank, monetary and other accounts in banking institutions of Turkmenistan to conduct transactions on those accounts to use in their activities a seal, stamps and other props indicating its name.
4. the company is entitled to cooperation with national societies of the Red Crescent and Red Cross foreign States and with international humanitarian NGOs, as well as the conclusion of treaties with them in the manner prescribed by the legislation of Turkmenistan.
5. the legal capacity of a legal entity as Society begins from the moment of State registration in the Ministry of Adalat Turkmenistan and entering into the unified State Register of legal entities.
6. A company may have the flags, emblems and other distinguishing signs. The symbolism of the Society shall be approved at the Congress of the society.
 
Article 5. Membership in the Society
 

1. Unless otherwise prescribed by the legislation of Turkmenistan, Turkmen citizens supporting the higher purpose of Red Cross and Red Crescent societies, irrespective of nationality, race, sex, origin, property and official status, place of residence, language, attitude to religion, political beliefs, party affiliation or lack of affiliation with any political party can be members of the society. This right shall be exercised freely, without receiving any prior permission.
2. The procedure and conditions of membership and the termination of the membership, including exit and exclusion from membership, shall be determined by the Charter of the company.
 
Article 6. Actors of society 1. Actors of society may be citizens and legal entities-public associations in Turkmenistan, supporting objectives, main activities or specific shares.
2. Participation in the activities of the society and its branches (branches) is carried out on the basis of a contract (Agreement) on cooperation, signed between the company and its relevant offices (branch offices) and by each member individually, in accordance with the Charter of the company.
 
Article 7. Articles of Association 1. Society independently develops and maintains its own Charter, structure and regulations of their offices (branches), and organises its activities, organizes meetings, conferences, meetings and other relevant activities.
2. the articles of Association shall be approved at the Congress of the Society in accordance with the legislation of Turkmenistan.
3. The Charter of a company must include: 1) the name, aims and objectives of the company;
2) procedure and conditions for the creation of a society, membership in the society and termination of membership, the rights and duties of members;
3) territory within which Society operates;
4) the organizational structure of the company, its management and control and audit bodies;
5) the procedure for the formation and powers of the Society's governing bodies, their terms of Office;
6) location of a permanent governing body of the company;
7) appointment governing bodies of society and decision-making;
8) sources of money and other assets, rights and obligations of the company and its structural divisions of asset management;
9) procedure for amendments to the articles of Association;
10) method of payment of membership fees;
11) procedure for liquidation, reorganization, termination of the activities of the society, as well as the distribution of property remaining after his elimination.
4. the statutes may contain other provisions relating to the activities of the Society, which do not contradict the legislation of Turkmenistan.
 
Article 8. The basic principles of Society 1. The society operates, excluding any discrimination on grounds of nationality, race, sex, origin, property and official status, place of residence, language, attitude to religion, political beliefs, party affiliation or lack of affiliation with any political party of the person and the citizen, and is guided by the fundamental principles of the International Red Cross and Red Crescent Movement (hereinafter referred to as "movement), as humanity, impartiality, neutrality, independence, voluntary, unity, universality.
2. State agencies of Turkmenistan, other legal persons irrespective of their organizational-legal forms and forms of ownership, as well as individuals are obliged to respect the commitment of Society to the principles specified in paragraph 1 of this article.
 
Article 9. The society's goals and objectives 1. The company was established to provide humanitarian, medical, social, rehabilitative and other assistance to people in need of such assistance.
2. the company independently, as well as in collaboration with State bodies of Turkmenistan in accordance with the legislation of Turkmenistan, performs the following tasks: 1) contributes to the public authorities in the humanitarian activities;
2) assists public authorities of Turkmenistan in implementing international obligations arising from the Geneva Conventions and the additional protocols thereto;
3) participates in the implementation of measures aimed at the implementation of State and national public health programmes, including the alleviation of the suffering of people and assistance to various segments of the population, as well as its programmes in education, health and social protection on the territory of Turkmenistan;
4) involved in providing assistance to victims in emergency situations on the territory of Turkmenistan;
5) through the International Committee of the Red Cross, the International Federation of Red Cross and Red Crescent societies, national Red Cross or Red Crescent Society of foreign States assists people affected by emergencies in foreign countries;
6) promotes the knowledge of international humanitarian law, principles and purposes of the movement;
7) ensures the fulfillment of other tasks arising from the principles and purposes of the movement, the relevant legislation of Turkmenistan, as well as the Charter of the company.
 
Article 10. The basic directions of activity of the company to meet its objectives of Society in accordance with the legislation of Turkmenistan:

1) participates in sanitary propaganda, training, provision of first aid, methods of caring for the sick at home, creates relevant services and leads the training of specialists for this activity, participates in the training of people, members of the civil defence Association;
2) involved in organizing blood donation by propaganda among the people of blood donation for medical purposes;
3) involved in the provision of medical and social assistance to people in need;
4) in accordance with the legislation of Turkmenistan carries out activities for implementation through the pharmacy network Society of medical products and medicines needed to treat patients, provides medical and social services to various segments of the population;
5) optionally creates special services to assist refugees and the various segments of the population;
6) creates a search service with a view to implementing the missing, provides informational assistance to restore links between family members, razlučënnymi with each other as a result of armed conflicts, emergency situations and in times of peace, assists in reuniting families;
7) organizes the reception, storage and distribution of humanitarian assistance from the International Committee of the Red Cross, the International Federation of Red Cross and Red Crescent societies, national Red Cross and Red Crescent societies of foreign States and other sources;
8) to assist people affected by emergencies in Turkmenistan or foreign countries, organizes the collection of charitable donations among the population and legal entities of Turkmenistan;
9) to assist people affected by emergencies, and cooperates with the International Committee of the Red Cross, the International Federation of Red Cross and Red Crescent societies, national Red Cross and Red Crescent societies of foreign States, assists these organizations in carrying out humanitarian activities in the territory of Turkmenistan and beyond;
10) in accordance with the Geneva Conventions, creates a logistical base and provides training for the Organization of the work of the inquiry service;
11) undertakes activities to promote among the population of Turkmenistan knowledge about international humanitarian law and the fundamental principles of the movement;
12) assists public authorities in the implementation of international humanitarian law in the educational system of Turkmenistan at various levels;
13) in the manner prescribed by the legislation of Turkmenistan, participates in the elaboration of decisions of public bodies in accordance with the fundamental principles of the movement;
14) within its field of competence, take initiatives on public life and making proposals thereon to the public authorities;
15) participates in the implementation of international and regional programmes;
16) carries out publishing and research activities;
17) in accordance with the legislation of Turkmenistan, perform other functions assigned to it by the Geneva Conventions and the additional protocols thereto, as well as by the present law and the Charter of the company.
 
Article 11. International cooperation Society 1. In order to implement the activities corresponding to their own goals and objectives, as well as the main activities envisaged by the present law, the company cooperates with the International Committee of the Red Cross, the International Federation of Red Cross and Red Crescent societies and other international humanitarian organizations, as well as national Red Cross and Red Crescent societies from foreign countries.
2. the company is involved in international humanitarian action, carried out in accordance with the law and international treaties to which Turkmenistan is a party, documents and programmes adopted within the movement.
 
Article 12. The emblem of the Society 1. The society's emblem represents the image of the Red Crescent on a white background with the inscription "Gyzyl Ýarymaý Türkmenistanyň Milli jemgyýeti (national Red Crescent Society of Turkmenistan).
2. The emblem of the society (reduced size) as the distinguishing sign may: 1) be installed on the buildings (except the roof) and premises used by society, on their vehicles, as well as in places where any property of the company;
2) used by the society in carrying out its activities, commemorative, mass events (awareness of the activities of the Association society, propagation of knowledge about international humanitarian law and motion);
3) played in the order established by the legislation of Turkmenistan produced Society information and other printed materials, as well as in products manufactured by it or at its request;
4) applied on humanitarian goods sent to society;
5) used by members of the society, its employees and, with the permission of the Society, participants in its activities.
 
Article 13. The use of the emblem of the Red Crescent Society
 

The use and protection of the emblems of the Red Crescent and Red Cross, distinctive signals, as well as the titles "Gyzyl Ýarymaý (Red Crescent) and Haç Gyzyl (Red Cross) shall be determined in accordance with the legislation of Turkmenistan, which regulates the use and protection of the emblems of the Red Crescent and Red Cross.
 
CHAPTER II. SOCIETY INTERACTION WITH STATE AUTHORITIES OF TURKMENISTAN. STATE SUPPORT of Article 14. Interaction between society with State authorities of Turkmenistan 1. Society within the framework of its Charter interacts with governmental authorities of Turkmenistan.
2. the company, in collaboration with State bodies of Turkmenistan may conclude agreements and treaties which define the main directions and methods of cooperation.
3. Society and its structural departments involved jointly with State bodies and public organizations of Turkmenistan in activities appropriate to its aims and objectives, as well as the main activities foreseen by this law.
4. Not allowed interference by State bodies and their officials in the activities of society, as well as the intervention of society in the work of State bodies and their officials, except the cases stipulated by the legislation of Turkmenistan.
 
Article 15. Ownership Society 1. The society owns and manages its assets and cash. Ownership Society is protected in accordance with the legislation of Turkmenistan.
2. The property of the Society can be buildings, structures, facilities, housing, vehicles, equipment, inventory, property for cultural, educational and sanative purposes, money, stocks, other securities and other property necessary for the material of a specific Charter of the company, as well as the results of intellectual activity.
3. The property of the society in accordance with its statutory goals can also be subordinated institutions, publishers, the media created and purchased at the expense of own and other means.
 
Article 16. The sources of the assets of the company 1. Sources of education funds and other assets of the company are: 1) membership fees;
2) voluntary cash and property contributions and other donations, bequests, gifts of Turkmen citizens, foreign nationals and stateless persons as well as legal persons;
3) revenues from ongoing Society exhibitions, lotteries, auctions and other events;
4) gains from the implementation of programmes, projects, publications and implement your own periodical materials, printed products, related to the activities of the society;
5) income from non-commercial activities of the society, service delivery and execution of works, publishing, cultural and educational and educational activities;
6) other revenues not prohibited by the legislation of Turkmenistan.
2. in accordance with the legislation of Turkmenistan may exercise a non-profit business, revenues from which are not distributed among members of the society and its activities, and are only used for the realization of statutory goals of society.
3. Company is not liable for the obligations of its members and participants in its activities and members of the public and members of his activities is also not liable for the obligations of the company.
4. the company may establish enterprises, and purchase equipment for the conduct of a non-profit business. Activities of the society should be linked to the implementation of the goals and objectives of the society.
5. Cash and other company assets may not be distributed among its members and shall be used only for the purposes and objectives of the Charter.
 
Article 17. State support of Society 1. State agencies of Turkmenistan in accordance with the legislation of Turkmenistan may provide society with financial, material and other support to enable him to carry out the tasks provided for in this Act.
2. Government support may take the form of targeted financing of some social programs of the company; the award of contracts for the execution of works and provision of services; implementation of various government programs.
3. citizens, organizations and officials within the authority established by law, support the society in carrying out its tasks, its employees and persons performing his errands.
4. Prohibits any interference with the activity of the company under this Act.
 
Article 18. Order of payment of taxes and Society order of society and subordinate entities taxes, customs and other duties determined by the legislation of Turkmenistan.

Article 22. Suspension and termination of reorganisation of society Suspension, reorganization and termination of the activities of the society are carried out in accordance with the legislation of Turkmenistan.
 
CHAPTER III. Final clauses article 23. Responsibility for violation of this Act, the violation of this law entails responsibility in the manner prescribed by the legislation of Turkmenistan.
 
Article 24. The entry into force of this Act, this Act shall enter into force on the day of its official publication.
