On health protection of citizens from exposure to tobacco smoke and the effects of the consumption of tobacco products (statements of the Mejlis of Turkmenistan, 2013, no. 4, p. 90) (with changes and additions made by the laws of Turkmenistan dated 28.02.2015 g. No. 200-V 29.01.2016 № 344-V and 26.03.2016, no. 382-V) this law determines the principles of the State policy in the field of health protection of citizens from exposure to tobacco smoke and the effects of tobacco use regulates the relations arising during the import, sale and consumption of tobacco products in Turkmenistan.
 
Chapter 1. General provisions Article 1. The basic concepts used in this law are used in this law the following concepts: 1) tobacco-born one and perennial herbs and shrubs that contain nicotine and other substances harmful to human health, cultivated for the purpose of obtaining raw materials (raw tobacco) for the production of tobacco products;
2) tobacco products are products made wholly or partly of tobacco fermentation (leaves) and (or) shag, with or without added sauces and (or) flavourings intended for smoking (smoking tobacco), sucking, chewing, snuffing (nekuritel′nye tobacco products) and (or) other methods of tobacco use;
3) tobacco smoke-smoke contained in the ambient air in a place where there is or has been carried out all tobacco products;
4) effects of tobacco-damage (harm) human life or health, Wednesday its Habitat as a result of tobacco consumption and exposure to tobacco smoke, as well as related medical, demographic, socio-economic impacts;
5) tobacco Organization (industry)-legal entities and individual entrepreneurs engaged in the manufacture, wholesale distribution and smuggling of tobacco products;
6) turnover-wholesale and retail of tobacco raw material and (or) tobacco products, as well as their storage, import and export;
7) Excise stamp-stamp with elements of protection, to be applied to each unit of tobacco product in accordance with the legislation of Turkmenistan, confirming that marked tobacco products are legal in origin;
8) tobacco control measures to be taken in order to reduce the trafficking of tobacco products, their advertising and promotion, eliminating or reducing their consumption patterns, combating illicit trade in tobacco products, as well as other measures aimed at protecting the health of citizens;
9) tobacco advertising is disseminated in any form and by any means information for an indeterminate number of persons, in order to generate and maintain interest in tobacco product, including information which without mentioning specific tobacco used their trademarks and their elements;
10) promotion of tobacco and tobacco products-a set of measures, actions taken by producers and/or sellers, intermediaries in order to increase demand, marketing, expanding the market for tobacco and tobacco products;
11) tobacco sponsorship-type contribution to the event, an event or a person, purpose, result or likely result of which is the promotion of a tobacco product or tobacco use either directly or indirectly;
12) illicit trade in tobacco products-prohibited by law activity related to production, sending, receiving, distribution, sale or purchase of tobacco products, including those intended to promote such activities;
13) ingredient-substance (except for tobacco leaf and other parts of tobacco), used in the manufacture of tobacco products, and is present in the finished tobacco product, including an altered form;
14) consumer packaging-the smallest unit packaging of tobacco products in which they are bought by the consumer: a) unit bundle of consumer packaging made of cardboard, paper or other material that contains a certain amount of tobacco products;
b) block-Group consumer packaging with a certain number of packs of cigarettes, wrapped in a polymer film, paper or paper tape;
ç) boxing-group consumer packaging with a certain amount of cigarette packs, stacked in a box made of cardboard that can be wrapped polymer film.
 
Article 2. The legislation of Turkmenistan in the area of health protection of citizens from exposure to tobacco smoke and the effects of the consumption of tobacco products 1. The legislation of Turkmenistan in the area of health protection of citizens from exposure to tobacco smoke and the effects of the consumption of tobacco products is based on the Constitution and consists of this law and other normative legal acts of Turkmenistan, regulating relations in the sphere of import, sale and consumption of tobacco products in Turkmenistan.
2. If an international treaty to which Turkmenistan stipulates other rules than those contained in this Act, the rules of the international treaty shall apply.
 
Article 3. The purpose of this Act
 

The purpose of this Act is to protect present and future generations of Turkmenistan from exposure to tobacco smoke and the consequences of tobacco use for their life and health, including the social, economic and environmental impacts, through the implementation of measures for the prevention and control of tobacco products, the dissemination of information on the harmful effects of tobacco consumption, morbidity and mortality.
 
Article 4. Principles of State policy in the field of health protection of citizens from exposure to tobacco smoke and the effects of tobacco use principles of State policy in the field of health protection of citizens from exposure to tobacco smoke and the effects of tobacco use are: 1) ensuring citizens ' rights in the field of health protection from exposure to tobacco smoke and the effects of tobacco consumption;
2) prevention of diseases associated with exposure to tobacco smoke and tobacco use;
3) informing the population about the dangers of tobacco use and the harmful effects of tobacco smoke on life and health, as well as about activities on tobacco control;
4) implementation of measures aimed at prevention of exposure to tobacco smoke and reduce the consumption of tobacco products;
5) implementation of international cooperation of Turkmenistan in the area of health protection of citizens from exposure to tobacco smoke and the effects of tobacco consumption;
6) for monitoring the rights of citizens in the field of health protection from exposure to tobacco smoke and the effects of tobacco use.
 
Article 5. Tobacco products 1. Type of tobacco product-the combination of smoking and tobacco nekuritel′nyh, similar to consumer properties and mode of consumption.
2. tobacco products include: 1) cigarettes-consisting of a line of tobacco bundle, wrapped cigarette paper glued on longitudinal seam with the filtering mouthpiece or without it;
2) cigars-composed of three layers: filling (mixture of cigar and tobacco raw materials), podvërtki (segment of the cigar leaf) and shirts (segment covering the cigar leaf), spirally covering stuffing and podvërtku;
3) cigarette-little cigar without podvërtki;
4) cigarillo (sigaritta)-a type of tobacco product, manufactured of cigar and other tobacco raw materials and multilayer design: filling of fragmentary, fine cigar and other types of raw tobacco, podvërtku or without it and wrapping of leaves of cigar tobacco, rebuilt or special paper. Cigarillos can have the filtering mouthpiece;
5) cigarette tobacco, consisting of tissue sleeves, part of which is filled with the cut tobacco;
6) bidis-view of smoking tobacco products consisting of a mixture of chopped tobacco leaves, tobacco stems and stalks, dried in tendu leaf script by — v. Klimchuk and tied with a thread;
7) (kreteks)-view of smoking tobacco products consisting of flavoured and cased mixture chopped clove and fine-cut tobacco production raw material, wrapped in cigarette paper or dried leaf of corn cob, with filter or without the filter.
8) tobacco for hookah-a mixture, sliced or torn raw tobacco with or without adding netabačnogo of raw materials and other ingredients intended for smoking using shisha;
9) tobacco pipes-type of smoking tobacco products intended for smoking using smoking pipes and consists of fine-cut, torn, curvy or compressed tobacco, with or without the addition of raw netabačnogo, sauces and flavorings, in which more than 75 percent of the net weight of the product make up the fibres of a width of more than 1 mm;
10) chewing tobacco-type nekuritel′nogo tobacco products made from pressed scrappy tobacco leaves, with or without the addition of netabačnogo raw materials and other ingredients designed for chewing;
11) tobacco snuff-tobacco product nekuritel′nogo type, made of fine-cut tobacco pneumatic dust with or without adding netabačnogo of raw materials and other ingredients designed to snuffing;
12) sucking tobacco (snus) nekuritel′nogo tobacco products entirely or partially made of purified tobacco dust and (or) fines fine-cut tobacco with or without adding netabačnogo of raw materials and other ingredients intended for sucking;
13) other tobacco products.
3. Types of tobacco products that do not contain tobacco: 1) herbal smoking blends-a mixture of netabačnogo raw materials consisting of dried herbal fees with a variety of synthetic additives (or without them), with plant extract with a weak psychotropic effect (entheogens) (or without them) combined with essential oils of natural origin;
2) electronic cigarette-electronic device for the simulation of smoking by generating steam, which can contain nicotine in the form of cigarettes and when inhaled, causes the taste of this smoke free.
 
Article 6. Types of harmful substances contained in tobacco products for harmful substances contained in tobacco products include: 1) nicotine alkaloid in tobacco leaf and tobacco smoke;
2) resin-dehydrated smoke condensate, does not contain nicotine;

3) carbon monoxide (co) is a product of incomplete combustion of carbon-containing substances from smoking tobacco products;
4) other substances harmful to human health.
 
Chapter 2. The State management in the area of health protection of citizens from exposure to tobacco smoke and the effects of the consumption of tobacco products, article 7. State administration bodies in the field of health protection of citizens from exposure to tobacco smoke and the effects of tobacco State administration bodies in the field of health protection of citizens from exposure to tobacco smoke and the effects of tobacco use are the Cabinet of Ministers of Turkmenistan, the authorized State body in the field of health protection of citizens from exposure to tobacco smoke and the effects of the consumption of tobacco products (hereinafter referred to as the authorized body), within their competence, other bodies of State power and administration local self-government bodies.
 
Article 8. Competence of the Cabinet of Ministers of Turkmenistan Cabinet of Ministers of Turkmenistan: 1) defines a uniform State policy in the field of health protection of citizens from exposure to tobacco smoke and the effects of tobacco consumption;
2) publishes the normative legal acts of Turkmenistan in the area of health protection of citizens from exposure to tobacco smoke and the effects of tobacco consumption;
3) defines the authorized body;
4) maintains an international cooperation programme in the field of health protection of citizens from exposure to tobacco smoke and the effects of tobacco consumption;
5) regulates the importation and implementation of tobacco products on the territory of Turkmenistan in the manner prescribed by the legislation of Turkmenistan;
6) exercise other functions referred to his competence, legislation of Turkmenistan.
 
Article 9. Competence of the authorized body Empowered body: 1) implements a uniform State policy in the field of health protection of citizens from exposure to tobacco smoke and the effects of tobacco consumption;
2) protects the health of citizens from exposure to tobacco smoke and the effects of tobacco consumption; 
3) carries out activities in the sphere of prevention of tobacco consumption, in accordance with the legislation of Turkmenistan; 
4) cooperates with State authorities, local self-government bodies and public associations on the implementation of a uniform State policy in the field of health protection of citizens from exposure to tobacco smoke and the effects of tobacco consumption;
5) develops, approves (adopts), cancels the normative legal acts in the field of health protection of citizens from exposure to tobacco smoke and the effects of tobacco use, making changes to them;
6) develops and implements measures on health protection of citizens from exposure to tobacco smoke and the effects of tobacco consumption;
7) provide in medical institutions of medical care to citizens in need of treatment of tobacco dependence and the consequences of tobacco use;
8) monitor and evaluate the effectiveness of the implementation of measures aimed at prevention of exposure to tobacco smoke, as well as information on the results of monitoring; 
81) operates in conjunction with the competent authority in the field of certification certification of tobacco product in accordance with the procedure established by the legislation of Turkmenistan; 
9) provides training and retraining in the field of health protection of citizens from exposure to tobacco smoke and the effects of tobacco consumption;
10) represents Turkmenistan in international organizations active in the field of health protection of citizens from exposure to tobacco smoke and the effects of tobacco consumption;
11) exercise other functions referred to his competence, legislation of Turkmenistan.
 
Article 10. The competence of other authorities, bodies of local self-government, other public authorities and administrative bodies of local self-government: 1) participate in the implementation of a uniform State policy in the field of health protection of citizens from exposure to tobacco smoke and the effects of tobacco consumption;
2) protect the rights of citizens from exposure to tobacco smoke and the effects of tobacco consumption;
3) interact with the notified body, in implementing activities in the field of health protection of citizens from exposure to tobacco smoke and the effects of tobacco consumption;
4) shall develop, adopt (take), register, cancel the normative legal acts in the field of health protection of citizens from exposure to tobacco smoke and the effects of tobacco use, amend them;
5) perform other functions in the field of health protection of citizens from exposure to tobacco smoke and the effects of tobacco use, referred to their competence, legislation of Turkmenistan.
 
Article 11. State regulation of turnover, advertising and limiting the consumption of tobacco products by other bodies of State power and administration and public management turnover, advertising and limiting the consumption of tobacco products is also:

1) by the State Customs Service of Turkmenistan-monitoring compliance with the legislation of Turkmenistan on the import of tobacco products across the customs border of Turkmenistan;
2) by the Ministry of trade and Economic Affairs of Turkmenistan in the part of the monitoring of the implementation of the requirements of this Act for the licensing of activities in the field of import and realization of tobacco products, compliance with the rules of trade in tobacco products;
3) principal State service "Türkmenstandartlary" together with the authorized body-part holding tobacco certification on conformity to requirements of normative documents; 
4) Ministry of Internal Affairs of Turkmenistan in the part of the monitoring of the rights of citizens to be protected from exposure to tobacco smoke in places where tobacco use is prohibited by this law, tobacco advertising, compliance with the legislation of Turkmenistan in the sphere of wholesale and retail trade in tobacco products;
5) other bodies of State power and administration within the limits of their competence.
 
Article 12. State regulation of prices for tobacco products 1. Measures for State regulation of the prices for tobacco products are implemented through setting minimum retail prices.
2. the minimum retail price of tobacco products is established by a public authority, authorized by the Cabinet of Ministers of Turkmenistan.
 
Article 13. State regulation of retail trade in tobacco products 1. On the territory of Turkmenistan retail sale of tobacco products is carried out in accordance with the legislation of Turkmenistan.
2. Retail sale of tobacco products on the territory of Turkmenistan is carried out in the presence of: 1) licenses for realization of tobacco products;
2) or a copy of the certificate of conformity issued in accordance with the established procedure;
3) marking, stipulated by the legislation of Turkmenistan for the attestation of conformity of these products with the established requirements;
4) excise stamps;
5) the document confirming the origin of tobacco products;
6) electronic cash registers or computer systems, unless otherwise prescribed by the legislation of Turkmenistan;
7) announcements in places of sale about the prohibition of sale of tobacco products to minors.
3. Information about the tobacco products offered for retail sale, the seller is brought to the attention of customers by posting in their list of top-selling sales of tobacco products, the text of which is made by letters of the same size in black on a white background, and which is in alphabetical order, with an indication of the prices of selling tobacco products without using any graphics and drawings.
Demonstration of tobacco products to the buyer of their sale can be carried out at its request after consulting with their list.
4. it is prohibited to retail sale of tobacco products: 1) via the mobile network (with vehicles, trailers, carts and other), hawking, with any makeshift stalls and stalls (streets, roads, courtyards, indoor);
2) via the retail trade network (in the absence of those shops and pavilions allowed sale of tobacco products in other places selling them or razvoznaâ sale of tobacco products);
3) with their calculations and field demonstration in their sales, except in the case provided for in paragraph 3 of this article;
4) on the territory and premises of sporting institutions, health care, education, culture (including the resort areas) and in catering in these facilities (including dietary canteens), as well as shopping facilities and catering specializing in product sales of baby food;
5) in the territories and in the rooms (except for duty-free shops) railway stations, bus stations, airports, sea and river ports, in premises intended for the provision of hotel services, temporary accommodation services, household services;
6) at a distance of less than one hundred meters from the border of educational institutions;
7) in specialized shopping sites, as well as divisions (sections) generic commercial sites engaged in trade in goods or children's assortment of sporting goods;
8) in self-service departments;
9), as well as unidentified to trade places;
10) using vending machines, and other electronic or mechanical devices;
11) without proper documents, confirming the quality of tobacco products when there is a mismatch between the tobacco marking requirements of normative documents;
12) through the Internet, using telecommunications or any other technology;
13) with any other goods or services;
14) electronic cigarettes;
15) without sustained on the WAD of data on the level of nicotine, tar, carbon monoxide or contain more than the maximum permissible norms;
16) with a special marking of duty-free shop;
17) from open consumer packages, weight per piece, excluding trade in cigars and cigarillos, individually packed;
18) sale of tobacco pipe and hookah without consumer packaging, without marking with excise stamps or financial control documents;
19) without marking with excise stamps;
20) cigarettes without filter;

21) without inflicted on the WAD of tobacco consumption warnings;
22) sucking and chewing tobacco and any kind of smoking mixtures.
5. sale of tobacco products to minors, as well as to minors is prohibited.
6. the sale of tobacco products, in a conspicuous place on or near the cash register with him should be placed an inscription reading: "the sale of tobacco products to minors is prohibited".
7. In the sale of tobacco products to persons whose age, judging by their appearance, less than eighteen years of age, persons who implement tobacco products must: 1) require passport (alternate document) in order to determine the actual age of the buyer;
2) refuse to sell tobacco products in that case has not been presented with a passport (substituting document).
8. Tobacco products sold in duty-free shop, subject to special markings on stock of duty-free shop.
Form marker type, as well as how its application on tobacco should be harmonized with the relevant State body authorized by the Cabinet of Ministers of Turkmenistan.
Workers in the duty-free shop, make notes about purchasing products in the travel documents of their clients.
Wholesale, retail, including the implementation of tobacco products in the duty-free shop is not allowed.
9. Tobacco, unidentified vvezënnye illegally on the territory of Turkmenistan, which do not conform to the requirements of the legislation of Turkmenistan on labeling, content of harmful substances, implemented without proper documents, excise marks, shall be seized and destroyed in the manner prescribed by the legislation of Turkmenistan.
 
Article 14. State regulation of the import and wholesale of tobacco products 1. The importation of tobacco products is carried out by persons with appropriate license issued in accordance with the legislation of Turkmenistan, with the exception of the fourth part of the present article. 
2. It is prohibited to import, wholesale and retail sale of cigarettes that do not meet the requirements of the normative documents on the contents in the smoke of one cigarette nicotine, tar, carbon monoxide and other noxious substances.
3. Tobacco products imported to the territory of Turkmenistan only if excise stamps, pasted a manufacturer of tobacco products directly on the Pack, with the exception of the fourth part of this article.
4. Tobacco products intended for personal use, may be imported into the territory of Turkmenistan without a license and excise stamps within the norms established by the legislation of Turkmenistan.
5. in the wholesale trade in tobacco products calculations are carried out in cashless order on the basis of bilateral treaties only through the accounts of participants, with the exception of cash calculations with shops-stores.
 
Article 15. Tobacco taxation Taxing tobacco products produced in accordance with the tax laws of Turkmenistan.
 
Chapter 3. Requirements for tobacco products Article 16. General requirements applicable to tobacco products 1. Tobacco, imported to the territory of Turkmenistan, shall comply with the normative documents of Turkmenistan.
2. It is not allowed to use as ingredients for tobacco substances circulation in Turkmenistan is prohibited in accordance with the legislation of Turkmenistan and international treaty.
3. Each unit of consumer packaging of tobacco products is subject to mandatory marking by excise labels.
 
Article 17. Excise stamp 1. Sample requirements of excise stamps for labelling tobacco products are established by the Cabinet of Ministers of Turkmenistan.
2. Excise stamps for tobacco products, is a form of strict reporting, the cost is set by the public authority, authorized by the Cabinet of Ministers of Turkmenistan.
3. manufacture of excise stamps, purchase them importer of tobacco products, their labeling of tobacco products, registration and destruction of damaged excise marks, as well as their identification shall be made in accordance with the procedure established by the Cabinet of Ministers of Turkmenistan.
 
Article 18. Requirements to the content of harmful substances in cigarette smoke 1. The content of harmful substances in the smoke of one cigarette, filter may not exceed the norms established by the legislation of Turkmenistan.
2. issues related to the phased reduction of hazardous substances in the smoke of one cigarette, governed by the notified body.
3. Information on the content of harmful substances in the smoke of one cigarette is applied to the package in accordance with requirements of normative documents.
 
Chapter 4.  The rights and obligations of natural and legal persons in the field of health protection from exposure to tobacco smoke and the effects of tobacco use Article 19. The rights and duties of citizens in the field of health protection from exposure to tobacco smoke and the effects of the consumption of tobacco products 1. Citizens in the area of health protection from exposure to tobacco smoke and the effects of the consumption of tobacco products have the right to: 1) favourable Wednesday their livelihoods and health protection from exposure to tobacco smoke and the effects of tobacco consumption;

2) in accordance with the legislation of Turkmenistan information on tobacco products and damage (harm) caused as a result of their consumption, measures taken to prevent exposure to second-hand smoke and reduce the consumption of tobacco products;
3) receipt in case you need medical care in a health institution for treatment of tobacco dependence and the consequences of tobacco use;
4) implementation of public monitoring of the activities carried out to prevent exposure to second-hand smoke and reduce the consumption of tobacco products;
5) introduction to bodies of State power and bodies of local self-government management proposals for the protection of health of citizens from exposure to tobacco smoke and the effects of tobacco consumption;
6) compensation (injury), caused their life or health due to violation of the physical and (or) legal entities of Turkmenistan's legislation in the field of health protection of citizens from exposure to tobacco smoke and the effects of tobacco use.
2. citizens of health from exposure to tobacco smoke and the effects of the consumption of tobacco products must: 1) comply with the legislation of Turkmenistan in the area of health protection of citizens from exposure to tobacco smoke and the effects of tobacco consumption;
2) take care of your health;
3) care about the health of their children and about the formation they have negative attitude to the consumption of tobacco products, as well as on the inadmissibility of their involvement in the process of consumption of tobacco products;
4) does not perform actions entailing a violation of the rights of other citizens to a favourable Wednesday their livelihoods and their health from exposure to tobacco smoke and the effects of tobacco use.
 
Article 20. The rights and obligations of legal entities and individual entrepreneurs in the field of health protection of citizens from exposure to tobacco smoke and the effects of the consumption of tobacco products 1. Legal entities and individual entrepreneurs in the field of health protection of citizens from exposure to tobacco smoke and the effects of the consumption of tobacco products have the right to: 1) in accordance with the legislation of Turkmenistan information on tobacco products and damage (harm) caused as a result of their consumption activities to prevent exposure to second-hand smoke and reduce the consumption of tobacco products;
2) participate in the formulation and implementation of measures to protect the health of citizens from exposure to tobacco smoke and the effects of the consumption of tobacco products, except for persons engaged in the production of tobacco products;
3) incentive measures (incentive) to the cessation of tobacco use.
2. Legal entities and individual entrepreneurs in the field of health protection of citizens from exposure to tobacco smoke and the effects of the consumption of tobacco products must: 1) comply with the legislation of Turkmenistan in the area of health protection of citizens from exposure to tobacco smoke and the effects of tobacco consumption;
2) ensure the right of workers to a safe Wednesday their livelihoods and health protection from exposure to tobacco smoke and the effects of tobacco consumption;
3) monitor compliance with the legislation of Turkmenistan in the area of health protection of citizens from exposure to tobacco smoke and the effects of the consumption of tobacco products in the territories and in premises used for its activities;
4) provide citizens with information on activities undertaken to prevent exposure to second-hand smoke and reduce the consumption of tobacco products.
 
Chapter 5. Requirements for information about tobacco products, article 21. Rules of application of information to consumers of tobacco products 1. Information to consumers of tobacco products provided for by the legislation of Turkmenistan, shall be applied: 1) on consumer packaging (Tutu, block, boxing);
2) on the sheet here (with the exception of cigarettes, bidis, cigarettes (kreteks)) consumer packaging, on which it is impossible to apply the information to consumers of tobacco products, as well as when implementing cigars and cigarillos (sigarit) per piece.
2. The information shall be presented in the official language.
May be applied in the Latin alphabet, the name of the manufacturer of the licensee and the names of tobacco products. Information relating to a registered trade mark or industrial design, applied on the language desk.
3. Ways and means of applying information should ensure her safety during transportation, storage and realization of tobacco products.
4. Information should be positioned in such a way as to not compromised the integrity of the inscriptions when opening the consumer packaging.
5. The consumer packaging of cigarettes and any external packing used in retail selling tobacco products, is one of the warning labels on the dangers of smoking, the text of which shall be approved by the authorized body.

6. the text of the warning labels on the dangers of smoking on the consumer packaging of cigarettes must be accompanied by an approved notified body drawings (pictograms), photographic images of the devastating effects of tobacco consumption and inhalation of tobacco smoke for the human body. Drawings (pictograms), images should be located at the top of each more square side of cigarette packs from both sides of consumer packaging and occupy not less than 65 per cent of the total area.
7. the texts of the inscriptions must meet the following requirements: 1) the text of the letters is applied on top of the picture (pictograms), images in bold, sharp, easily readable font. When the line spacing must not exceed the height of the font;  
2) text direction is parallel to the bottom or top of the packs or other consumer packaging of tobacco products. While the location of the text should save drawings (pictograms), images of the devastating effects of tobacco consumption and exposure to tobacco smoke on human organism;

8. Warning labels figure (pictograms), images on consumer packages may be changed by the decision of the authorized body once every three years.
9. For every unit of consumer packaging nekuritel′nyh tobacco products is applied one warning or notice message about the dangers of tobacco product consumption: "This tobacco product is harmful to your health.

11. The information required by the ninth and tenth parts of this article, shall be placed in a frame of black. This information is put in capital letters in black on a white background, in a bold, clear, easy to read font maximum large size. Line spacing should not exceed the height of the font. 12. In case of changes in the text, images, or format of the warning labels, drawings (pictograms), picture of the dangers of smoking tobacco products the manufacturer and/or importer within one year of making the appropriate changes on the consumer packaging of tobacco products.
13. After the entry into force of new requirements for the registration of consumer packaging of tobacco products throughout the year may be in circulation in consumer packages of cigarettes without drawings (pictograms), photos of the devastating effects of tobacco consumption for humans.
 
Article 22. Requirements for information on ingredients contained in tobacco products 1. The manufacturer or importer of tobacco products sold on the territory of Turkmenistan, is obliged to annually no later than 1 March of the year following the calendar year to otčëtnym, submit to the competent authority report on ingredients contained in tobacco products.
2. the form of the report on ingredients and claims to its contents are approved by the authorized body.
3. The authorized body shall have the right, at its discretion, provide the information contained in the reports on ingredients.
 
Chapter 6. Prevention of the illicit trade in tobacco products.
Ban on advertising, promotion, sale, promotion and sponsorship of tobacco products, article 23. Prevention of the illicit trade in tobacco products 1. In order to prevent illicit trade in tobacco products: 1) accounting of imported tobacco products to Turkmenistan in their wholesale and retail trade;
2) measures to detect and prevent the illicit trade in tobacco products in accordance with the legislation of Turkmenistan.
2. Accounting of imported across the State border of Turkmenistan of tobacco products, wholesale and retail sale of tobacco products are carried out based on information authorities responsible for labelling tobacco products excise stamps.
3. procedure for the exchange of information between public bodies exercising State regulation limiting turnover, advertising and consumption of tobacco products is determined by the Cabinet of Ministers of Turkmenistan.
 
Article 24. A ban on tobacco use in individual Territories, in the premises of enterprises, organizations and institutions to prevent the effects of tobacco smoke on human health tobacco use is prohibited: 1) in the premises of the State Executive and administrative bodies, local self-government bodies, enterprises, organizations and establishments, regardless of their form of ownership, military units and formations, shopping sites, catering, domestic service in hotels;

2) in the territories and in areas of cultural and educational institutions, physical culture and sports, health and Spa complexes;
3) in the premises of the railway stations, airports, sea and river ports in the ground outdoors at a distance of less than 15 (fifteen) meters from entrances stations, airports, sea and river ports, designed to provide services for the transport of passengers, trains, ships, aircraft and all forms of public transport, the passenger platforms, petrol stations;
4) in parks and squares, subways, in the borders of the territories occupied beaches and other places of mass visiting of citizens;
5) in elevators and common areas of apartment houses, playgrounds;
6) in other places, stipulated by the legislation of Turkmenistan.
 
Article 25. Ban on advertising, promotion, sale, promotion and sponsorship of tobacco products 1. In order to reduce the consumption of tobacco products shall be prohibited: 1) tobacco advertising in any form and any type of media, as well as at retail locations;
2) distribution of tobacco products among the population, including free gifts;
3) application of discounts and prices of tobacco products by any means;
4) use of the trademark for the individualization of tobacco products, other types of goods, non-tobacco products, in the manufacture of such goods, as well as wholesale and retail trade in goods that are not tobacco, but on which the trademark is used, the employee for the individualization of tobacco products;
5) use and imitation tobacco products in the manufacture of other types of goods, non-tobacco products, while wholesale and retail trade in such products;
6) Organization and conduct of activities (including lotteries, contests, and games), the condition of which is the acquisition of tobacco or tobacco products are installed as prizes;
7) use of the trade names, trademarks and service marks, as well as commercial signs belong to the tobacco industry (the Organization), in carrying out charitable activities;
8) tobacco sponsorship.
2. Not allowed demonstration of tobacco products and their consumption in newly created audiovisual works, including television and movies, theatrical and entertainment performances, television, video-and kinoprogrammah, as well as their public performance, the message of the demonstration of tobacco products and their use, unless such action is an integral part of the artistic intent, their propaganda radio broadcasts.

Chapter 7. Promotion of knowledge about the dangers of tobacco use. Medical assistance Article 26. Promotion of knowledge about the dangers of tobacco products 1. In order to reduce the consumption of tobacco products, the prevention of diseases related to their consumption, forming responsible attitude towards health and negative attitude to the consumption of tobacco products is carried out by the promotion of knowledge about the dangers of tobacco use and the harmful effects of tobacco smoke on human beings.
2. information about the dangers of tobacco use includes: 1) about the benefits of the cessation of tobacco use;
2) on the adverse health, demographic, socio-economic and environmental effects of tobacco consumption.
3) tobacco Organization (industry).
3. Informing the population about the dangers of tobacco consumption is carried out by State authorities, local self-government bodies.
4. Educate the public about the dangers of tobacco use and the harmful effects of tobacco smoke is carried out within the family, in the process of education and training in educational and medical institutions, and employers in the workplace.
Educational and professional educational programmes should include topics related to the study of human exposure of tobacco use and the harmful effects of tobacco smoke.
5. The forms and methods of dissemination of knowledge about the dangers of tobacco use are determined by the notified body in consultation with stakeholders.
 
Article 27. Provision of medical assistance to persons in need of treatment of tobacco use and the impact of their consumption of 1. Individuals in need of treatment of tobacco use and the impact of their consumption patterns, turns out to be appropriate medical care.
2. medical assistance to such persons, including prevention, diagnosis and treatment, is carried out by health agencies of the public health system in accordance with the State program of providing medical care to citizens.
3. Medical care is provided by the physician in accordance with established standards of medical care and its delivery order with the provision of necessary information to the patient.
 
Chapter 8. Final provisions Article 28. Liability for violation of this Act
 

Persons guilty of violating this law bear responsibility, established by the legislation of Turkmenistan.
 
Article 29. Settlement of disputes disputes arising in the area of health protection of citizens from exposure to tobacco smoke and the effects of tobacco use, shall be settled in the manner prescribed by the legislation of Turkmenistan.
 
Article 30. The entry into force of this law 1. This law shall enter into force on the day of its official publication, except for provisions for which this clause establishes the dates of their entry into force.
2. The second part of article 12, paragraph 4, and paragraph 19 of part two of the fourth part of article 13, the third paragraph of article 14, the third paragraph of article 16, part of the ninth article 21 of this law shall enter into force on the expiry of twelve months from the date of entry into force of this Act.
3. Part three and para 3 of part of the fourth article 13, part one of article 21 of this Act become effective on January 1, 2015 year.
4. Part six article 21 of this Act enters into force twelve months after the approval by the authorized body of the list of pictures, icons and (or) picture of the dangers of smoking.
5. Normative-legal acts of Turkmenistan are subject to adjustment in accordance with this Act within six months from the date of its entry into force.
