On publishing this law establishes the legal basis for regulating relations between publishers, manufacturers, distributors and consumers of printed products.
 
Chapter i. General provisions article 1. The basic concepts used in this law for the purposes of this Act, applies the following concepts: 1) publishing-industry economy, covering organizational and creative and productive and economic activity of legal entities and individuals engaged in the preparation, manufacture, production and distribution of printed materials;
2) printed products-designed for consumers, publications regardless of circulation and their method of manufacture, excluding periodicals, legal regulation which is carried out in accordance with the legislation of Turkmenistan about mass media;
3) Edition is a set of instances of the same products of polygraphic production (books, brochures, albums, posters, booklets, cards and other products), which passed the editorial-publishing training and provides information for the dissemination of information, printed with the same typesetting and produced printing, stamping or other means in accordance with national standards and other normative legal acts of Turkmenistan regarding the publishing, printing and technical design;
4) Publisher-natural or legal (publishing) a person carrying out publishing activities.
To the Publisher can be equated natural or legal (publishing company) for which publishing is not the main or not serves as the main source of income;
5) Publisher-specialized enterprise, whose main activity is publishing activity;
6) publishing organization, Enterprise, institution or organisation, the statutes of which along with the other activities envisaged publishing activity;
7) publishing-publishing activities on preparation and release in light of printed materials;
8) preparation of publishing printed products-editorial processing of copyright material, its technical and artistic editing, design and layout creation;
9) issue in light of the printed products-issue circulation printed products;
10) editorial-structural unit or employee (staff) publishers (or publishing organizations) engaged in editing and other training to produce printed products;
11) editing-Publisher copyright material improvements made to the Publisher based on the statement made by the author (the originator) order or upon the submission of the author (the originator), with the consent of the author (originator) scientific, literary, technical point of view and prepare it for publication with making cuts, changes, additions and amendments;
12) manufacturer of printed products-natural or legal (printing company) a person carrying out the printing activity;

16) distributor of printed materials-natural or legal person engaged in the dissemination of printed materials with the conclusion of the contract with the Publisher or on other grounds provided for by the legislation of Turkmenistan;
17) distribution of printed products-bring printed products to the consumer either through trading network, and in other ways through the application of different forms of its disposition (sale, subscription, distribution);
18) knigotorgovoe enterprise is specialized enterprise commercial network, exercising the implementation of printed matter;
19) consumer print products-individuals and legal entities, irrespective of their form of ownership;
20) customer printed products-natural or legal person who is ordering print products, assuming financial obligations;
21) storage of printed products-safety fondohranitelem free required copies of publications published in the territory of Turkmenistan;
22) keeper of collections-State Book Chamber of Turkmenistan;
23) UDC (Universal Decimal Classification) information classification system for organizing works of science, literature and art, the press, various types of documents and organization of files;
24) CIP (cataloguing in publication)-standard bibliographic description of the publications located on the backside of the cover sheet;
25) ISBN-international standard book number or brochures that at the international level, identifies any book or pamphlet a specific Publisher;
26) ISMN-international standard room printed music;
27) ISSN-international standard serials number.
 
Article 2. The legislation of Turkmenistan on publishing

1. the legislation of Turkmenistan on publishing is based on the Constitution of Turkmenistan, and consists of this law and other normative legal acts of Turkmenistan governing relations in the field of publishing.
2. If an international treaty to which Turkmenistan stipulates other rules than those stipulated by this law, the rules of the international treaty shall apply.
 
Article 3. The basic purposes and principles of the publishing industry in Turkmenistan 1. The main goals of publishing are: 1) meeting the needs of the individual, society and State in print;
2) contribute to the cultural development of the Turkmen people by increasing circulation and volumes of printed materials, as well as expanding the themes of books;
3) raising the cultural level of the citizens of Turkmenistan, accustoming them to universal values through the availability of foreign printed materials by publication in translation of outstanding works of world literature, art, science, and other popular publications;
4) creating opportunities for citizens to express themselves as authors regardless of nationality, race, sex, origin, property and official status, place of residence, language, attitude to religion, political beliefs, party affiliation or lack of affiliation with any political party.
2. Basic principles of publishing are: 1) humanism and universal values orientation, adoption and popularization of national values;
2) independence of publishers, manufacturers and distributors of printed materials;
3) popularization of reading and support for reading;
4) competitiveness of printed materials;
5) protection of intellectual property;
6) information security.
 
Article 4. State policy in the field of publishing 1. State policy in the field of publishing aims to: 1) the realization of the constitutional right of citizens to receive information;
2) management and development of the publishing industry;
3) development and support of national publishing, expanding markets for printed products;
4) strengthening material-technical base, legal and scientific basis of publishing;
5) enforcing the rights of publishers and authors and fulfil their obligations;
6) development of public-private partnership in the field of publishing, creation of competitive market conditions for the development of entrepreneurship in the field of publishing;
7) promotion of international cooperation in the field of publishing.
State policy in the field of publishing, in accordance with those directions is carried out by tax, customs, currency, as well as other types of regulation.
2. Government support in publishing is done in the following areas: 1) edition of works considered classical historical and cultural heritage of the Turkmen people and national cultural heritage of Turkmenistan;
2) refill market and library holdings publications in the State language, providing the necessary literature on Kazakh authorities, institutions, education, culture, science, and business organizations;
3) a translation into the world's most widely spoken languages, publishing and promoting the dissemination of books and other printed products, reflecting the national-cultural and historical and cultural values of the Turkmen people, with a view to their promotion globally, and creating a positive international image of Turkmenistan;
4) edition of the translation into the State language works belonging to the world of classical literature, and other printed products abroad, connecting citizens of Turkmenistan to universal values;
5) strengthening and modernization of material and technical base of publishers, printers and network dissemination of printed materials;
6) education publishing industry support fund to finance activities aimed at the development of material-technical and scientific base subjects of publishing;
7) establishing relationships with publishers in other countries, accession to international conventions and conclusion of international agreements in the field of publishing.
Government support in publishing is carried out on the basis of State orders for print products, the procedure for the formation and implementation of which shall be approved by the Cabinet of Ministers of Turkmenistan.
 
Article 5. Freedom publishing 1. The subjects of the publishing industry are creative and (or) production autonomy in determining the subjects of specialization, choosing the sponsors printed materials, determining print runs, prices and trade discounts (margins) on printed materials, establishing forms of ties between them, with manufacturers and suppliers of paper, as well as other organizations involved in the logistics of component parts of the publishing industry.
2. Not allowed from the publishers requirements prior approval of materials, removal or correction of individual parts of the text on the part of public officials or public associations if they are not authors of these materials.
Censorship is prepared for publication manuscripts and materials is not allowed.
 

Article 6. Inadmissibility of abuses of freedom of publishing not allowed the manufacture and distribution of publications, which contain information constituting a State secret or other secret protected by law, call for violent change of the constitutional order, propaganda of war, violence and pornography, racial, ethnic or religious exclusivity or intolerance, human honor and dignity infringement, defamation, incitement to commit other criminally punishable acts.
Not allowed in publishing: 1) manufacture or distribution of printed materials, containing information related to unfair advertising as well as advertising using Turkmenistan national symbols šaržirovaniâ (State coat of arms, national flag, national anthem) in any form;
2) disclosure of information, as well as the advertising of goods, services, which may be detrimental to citizens, enterprises, institutions, organizations or the State;
3) production and distribution of printed materials containing ideas of religious extremism, separatism and fundamentalism, conducive to incitement of religious, national and ethnic and racial hatred;
4) realization of printed materials without the permission of its owner (s), as well as in cases of infringement of the legislation of Turkmenistan in the field of intellectual property.
 
CHAPTER II. The SUBJECTS and the object of PUBLISHING Article 7. Actors publishing 1. Actors are publishing authors, publishers, manufacturers, customers, and distributors of print products.
2. subjects of publishing take ownership relations and industrial relations with the subjects of other activities that are regulated by contracts concluded in accordance with the legislation of Turkmenistan.
 
Article 8. Publisher status 1. The Publisher has the right to: 1) to receive from the State bodies, public associations and citizens orders for the preparation and production of printed materials, publishing and other services on the profile of their activities;
2) independently create and approve thematic plans release of printed matter;
3) set their editorial publishing and other structural subdivisions of indicators that enforce a thematic plan and contractual obligations;
4) acquire property and non-property rights of the author, including the use of his works in other countries;
5) publish and republish copyrighted works, within the time limit prescribed in the publishing contract;
6) use the output of them printed to ensure statutory activities, independently distribute printed materials or use the arpp;
7) conduct operations on purchase and sale of printed products for profit;
8) provide mediation services when contracting with foreign legal entities and foreign nationals on the use of works of authors from Turkmenistan in other countries and foreign authors in Turkmenistan;
9) make proposals for the nomination of published works of science, literature and art of the State, public, international awards;
10) to participate in the work of international organizations, publishers represent their products at national and international competitions, exhibitions and fairs;
11) to exercise other rights stipulated by this law and other normative legal acts of Turkmenistan.
2. The Publisher shall: 1) strive to meet consumer demand for printed products;
2) arrange materials in accordance with requirements of normative documents;
3) promote universal humanistic values, the development of science and culture, meet the spiritual needs of Turkmen society;
4) respect the copyrights, the requirements of normative documents and normative-legal acts of Turkmenistan, regulatory publishing;
5) control the timely mailing of the manufacturer required copies of publications;
6) be in the prescribed manner the State statistical reporting, information on issued light publications;
7) be responsible for the release of its printed products and reimburse any losses if the publishing contract provides otherwise;
8) to abide by the rules of the Turkmenistan law "on mass media" at address as the founder of the periodical printed publising body;
9) carry other duties stipulated by this law and other normative legal acts of Turkmenistan.
3. The Publisher shall be entitled to intellectual property created during the design and production of printed materials, which is indicated by the sign of the Publisher (the Latin letter "c" in a circle) with the indication of the name or names of the Publisher, and year of release.
The Publisher is obliged to get permission from the author or owner of rights to intellectual property in case when publishing involves the reproduction of the publications containing the original object of intellectual property.
4. Publishers, specializing in promotional products, Government support is not available.

5. The Publisher may also exercise the manufacturer and/or distributor of printed materials.
Article 9. Printed product manufacturer 1 status. Manufacturer of printed materials to exercise its rights and bears responsibilities in accordance with the legislation of Turkmenistan.
2. the manufacturer of printed products can carry out its production based on orders received from publishers.
Printed product manufacturer adopts an order for printing production only from the customer, has the index of UDC, ISBN, ISMN or ISSN assigned to the State Book Chamber of Turkmenistan.
Conditions and terms of execution of orders are set by agreement between the parties.
3. the manufacturer of printed materials is responsible according to the legislation of Turkmenistan, to the employer for an accurate reproduction of the original publishing, meeting quality requirements of each instance of publication circulation, ordered State and interstate standards, technical regulations and other normative documents in the field of printing.
4. the manufacturer of printed matter may not, without the permission of the customer transfer to another person made publication circulation or part of it, the original copy of the publication, layout, photoforms or printed form as well as additional or print Reprint Edition, except for the cases stipulated by the legislation of Turkmenistan.
5. the manufacturer of printed materials has the right to print and reproduce their own work.

Article 10. Distribution status of print products 1. Distributor of printed materials has the right to: 1) retail and wholesale sale of printed matter;
2) independently form their production plans, define the scope of its activities, to pick up materials on thematic focus;
3) receive from natural and legal persons order for distribution of printed materials, coordinate order with publishers and vendors of printed materials;
4) establish productive relations with foreign publishers, manufacturers or distributors of printed products to its import or export.
2. Distributor of printed materials must: 1) carry out their activities in accordance with the legislation of Turkmenistan;
2) be in the prescribed manner the State statistical reporting on the export from Turkmenistan and Turkmenistan.
 
Article 11. Customer printed products 1. Customers of any printed products can be natural persons and legal entities of Turkmenistan.
2. Authors (co-authors), compilers and translators can submit to the Publisher for publishing training and publication the following materials: 1) works of fiction, socio-political, promotional, informational, educational, scientific, and technical nature;
2) speeches, lectures, speeches, reports, sermons;
3) music with text and no text;
4) dramatic, dramatico-musical works;
5) works of applied art;
6) photographs, illustrations, maps and atlases, plans, sketches;
7) translations, annotations, reviews, summary content, other development works and does not prejudice the content of the original folk development without undermining the protection of works, subjected to translation, adaptation or other processing;
8) collections of works, collections of folklore adaptations, encyclopaedias and anthologies, compilations of regular data, other composite works on the assumption that they are the result of creative work in the selection, coordination, or streamline content without infringement of copyright in works included in them as constituent parts;
9) other works (works published at his own expense, sponsorship funds, charitable and other funds).
3. the customer determines the language, the print run, independently decide on its use or distribution.
4. The Publisher has the right to be a customer before the manufacturer and distributor of printed materials.
5. Conditions of service of the order for print products, the rights and obligations of the parties are defined by the Treaty, concluded in accordance with the legislation of Turkmenistan by the author (co-authors), their heirs or persons who the authors or their heirs have transferred their copyright ownership rights to the object of the order, or otherwise by the customer to the Publisher, manufacturer and distributor of printed materials.
 
Article 12. The specific terms of the relationship between the Publisher, author, manufacturer and distributor of printed materials Publisher, author, manufacturer and distributor of printed materials is entitled to stipulate special terms and their relationships, if not inconsistent with the law of Turkmenistan on publishing.

Article 14. Object publishing

4) material construction-book, sheet, complete, card issuance, booklets, posters, postcards, books and toys;
5) volume-books, brochures, greeting cards;
6) composition of the main text-monographs, collections;
7) frequency-non-recurrent, serials, periodicals, serials;
8) structure is a series of publications, odnotomnye, multi-volume editions, collected works, selected works.
The object of publishing can be other types of publications, referred to the printed product.
 
CHAPTER III. The ORGANIZATION PUBLISHING the article 15. The founders of the publishing house, printing and bookselling businesses and their status 1. The founders (co-founders) Publishing House, printing and bookselling enterprises may make the organs of State power and administration, public associations, other legal persons and citizens of Turkmenistan.
Foreign legal entities may be founders (co-founders) Publishing House, printing and bookselling enterprises in accordance with international treaties to which Turkmenistan is a party.
May not be the founder (co-founder): 1) a citizen who has not attained the age of 18 or who is serving a sentence in places of deprivation of liberty by a court sentence or recognized incapable by court;
2) public association, Enterprise, institution, organization, whose activities are prohibited in accordance with the legislation of Turkmenistan;
3) a foreign citizen or stateless person not living permanently in Turkmenistan.

Article 16. The form of ownership and organizational-legal forms of publishing Publishing (publishing), printing and bookselling businesses are based on various forms of ownership, stipulated by the legislation of Turkmenistan.
Publishing based on various forms of ownership are used any organizational-legal forms stipulated by the legislation of Turkmenistan.
 
Article 17. The State registration of subjects of publishing, Publisher, manufacturer and distributor of printed materials undergo State registration in accordance with the legislation of Turkmenistan.
 
Article 18. Licensing, publishing and printing publishing and polygraphic activity subject to licensing in accordance with the Turkmenistan law "about licensing separate kinds of activity" and other normative legal acts of Turkmenistan.
 
Article 19. State Register of publishers and manufacturers of printed materials of Turkmenistan 1. State Register of publishers and manufacturers of printed materials of Turkmenistan is the only database that contains information about publishers and manufacturers of printed matter in respect of which the decision on issuing the relevant licences.
2. The State Register of publishers and manufacturers of printed materials of Turkmenistan conducts the authorized State body in the field of publishing, in accordance with the Turkmenistan law "about licensing separate kinds of activity" on the basis of licences for publishing and printing activities.

4. 5. Publishers and manufacturers of printed materials should be excluded from the State Register of publishers and manufacturers of printed materials of Turkmenistan in the event of termination of a licence.

Article 20. Termination of activities of publishing the termination of activity of subjects of publishing it is possible on the following grounds: 1) on the decision of the founder;
2) in connection with the liquidation or reorganization of the Publisher, manufacturer, distributor of printed materials in the manner prescribed by the legislation of Turkmenistan;
3) on the basis of a court decision establishing a violation of article 6 of the present law or non-conformity of the validity of the information submitted for registration in the State Register of publishers and producers of printed products.
 
Article 21. Financing of publishing Entities publishing can be funded due to: 1) means the founder;
2) of sponsors;
3) donations of individuals and legal entities;
4) grants allocated by State and public organizations;
5) income subjects publishing business derived from entrepreneurial activities;
6) other means, not illegal legislation of Turkmenistan.
 
Article 22. Publishing contract 1. Publishing contract is an agreement concluded between the owner of the copyright or by the customer of print and the Publisher, on the basis of which the Publisher in Exchange for remuneration transferred the right to publish and distribute. 11) other conditions stipulated by the legislation of Turkmenistan.
 
Article 23. Article 25. Arrangements for the distribution of printed materials 1. The distribution of printed matter may be the founder, Publisher, producer, author, by agreement between them or on contractual or other legally trade enterprises, other legal entities and citizens.

3. There shall be no obstruction of the lawful dissemination of printed materials by State bodies, public associations, enterprises, institutions and organizations, officials and citizens.
 
Article 26. Print production output each instance produced printed materials must contain the following information: 1) the name and address of the Publisher;
2) date of deposit material in the set (day, month, year);
3) date signature of material in print (day, month, year);
4) volume of material in the printed sheets given to paper format 60х90;
5) volume of material, in particular publishing worksheets;

7) quantity;
8) order number printing company;
9) name and address of the enterprise;

CHAPTER IV. STATE REGULATION in the field of PUBLISHING, Article 27. Competence of the Cabinet of Ministers of Turkmenistan in the field of publishing, the Cabinet of Ministers of Turkmenistan: 1) defines the State policy in the field of publishing;
2) defines the conditions and procedures for providing State support to publishers, manufacturers and distributors of printed materials;
3) approve state programs development of publishing business in Turkmenistan;
4) exercise other powers in accordance with this law and other normative legal acts of Turkmenistan.
 
Article 28. Authorized bodies of State regulation in the field of publishing, authorized bodies of State regulation in the field of publishing are: 1) the authorized State body in the field of publishing;
2) State Book Chamber of Turkmenistan.
 
Article 29. Competence of the authorized State body in the field of publishing, the authorized State body in the field of publishing: 1) conducts a uniform State policy in the field of publishing;
2) develops, implements the State programme for the development of the publishing industry in Turkmenistan and co-ordinates their implementation;
3) prepares proposals on perfection of legislation and the conclusion of international treaties in the field of publishing;
4) adopt normative legal acts in the field of publishing;
5) carries out the State control over compliance with established procedure for mandatory distribution of copies of publications, as well as the execution of decisions concerning the purchase of printing equipment;
6) is responsible for licensing of publishing and polygraphic activity in Turkmenistan;
7) is conducting the State Register of publishers and manufacturers of printed materials of Turkmenistan;
8) carries out international cooperation in the field of publishing;
9) exercise other powers in accordance with this law and other normative legal acts of Turkmenistan in the field of publishing.
 
Article 30. Competence of State Book Chamber of Turkmenistan in the field of publishing 1. State Book Chamber of Turkmenistan provides publishing system operation State in your bibliography.
2. State Book Chamber of Turkmenistan shall act in accordance with the legislation of Turkmenistan and its Charter approved by the authorized State body in the field of publishing.
3. State Book Chamber of Turkmenistan is: 1) Centre of the State and accounting bibliography printed products released in the territory of Turkmenistan;
2) Center for information system of State bibliographic information;
3) State room required copies of free publications.
4. State Book Chamber of Turkmenistan performs the following basic functions: 1) carries out bibliographic processing of printed products, including assigns each publication (Team Editions) number of the State bibliographical registration;
2) leads accounting print products issued in the territory of Turkmenistan, generates quantitative system of publishing activities;
3) carries out organizational-methodical ensuring the functioning and development of the system of State bibliography;
4) forms and information system of State bibliographic information, generates other information and bibliographic resources in publishing;
5) disseminates State bibliographic information;
6) makes and releases in light State bibliographies;
7) forms and constantly increasing State Fund required copies of publications;
8) sets the index of UDC editions and international standard numbers (ISBN, ISMN and ISSN) for publications issued in the territory of Turkmenistan;
9) takes part in realization of the State policy in the field of publishing, including in the field of technical regulation and standardization in publishing;
10) provides information services, provides consulting and methodological support on publishing within its competence;
11) takes part in the Organization and implementation of the exchange of State bibliographic information.
5. Source of funding State Book Chamber of Turkmenistan are own funds.
6. the property of the State Book Chamber of Turkmenistan is owned by its founder-the authorized State body in the field of publishing.

7. State Book Chamber of Turkmenistan in accordance with the legislation of Turkmenistan, charges a service fee when ordering and assigning UDC index publications, implementation of the cataloguing in publication (CIP), the attribution of international standard numbers (ISBN, ISMN and ISSN), archive of publications and for other services related to the field of its activity.
8. Funds raised from activities which brings revenues used State Book Chamber of Turkmenistan to ensure its functioning and the development of material-technical base in accordance with the legislation of Turkmenistan.
 
Chapter v. RELATIONS with PUBLISHERS and organizations CITIZENS Article 31. Denial of publication no one can oblige the Publisher to publish the manuscript or other materials that they were dismissed, except in cases where the Court determined that the breach of contractual obligations.
 
Article 32. Author's Edition, natural and legal persons shall have the right to publish their manuscripts and other materials at its own expense and to distribute them if they do not comply with the requirements established by the legislation of Turkmenistan.
 
Article 33. Preferential publications children's, educational, regulatory and reference, reference and encyclopedic print products, as well as printed products for the blind and the disabled can be issued on preferential terms in accordance with the legislation of Turkmenistan.
 
Article 34. Advertising in print to publish advertisements in print is established by legislation of Turkmenistan.
Children's literature, textbooks, required the publication of national significance, the encyclopedia may be advertised in print, free of charge or on preferential terms, determined by the legislation of Turkmenistan.
 
CHAPTER VI. LIABILITY for VIOLATION of the LEGISLATION of TURKMENISTAN on PUBLISHING Article 35. Responsibility of subjects of publishing for violation of this law Violation this law subjects publishing entails responsibility in the manner prescribed by the legislation of Turkmenistan.
 
Article 36. Responsibility for infringing the freedom of publishing, violations of freedom of publishing, that is hindering the legitimate activities of publishers, manufacturers and distributors of print products, including through the implementation of censorship, entail liability in accordance with the legislation of Turkmenistan.
 
Article 37. Liability for violation of copyright, illicit reproduction of printed products, secure sign of the Publisher (the Latin letter "c" in a circle), or other violation of intellectual property rights the Publisher entail compensation of a person in breach of copyright, all losses incurred by the Publisher, including lost income.
Infringement of rights in a work by the production of printed materials without acquiring those rights in the order established by this law, entail liability in accordance with the legislation of Turkmenistan.
 
CHAPTER VII. International cooperation in the field of PUBLISHING, Article 38. International cooperation 1. International cooperation in the field of publishing is carried out in accordance with the legislation of Turkmenistan and the international treaties to which Turkmenistan is a party.
2. international cooperation in the field of publishing aims to: 1) strengthening cultural and scientific exchanges with other countries, actively participate in international book fairs and exhibitions;
2) strengthening of material and technical base of publishing and polygraphic activity by applying innovative technologies and attract foreign investment to this end;
3) establishment of a network of distribution of Turkmenistan abroad and foreign products in Turkmenistan;
4) satisfaction of cultural, scientific and educational needs of compatriots living abroad.
 
Article 39. Participation in foreign economic activity Subjects publishing business can participate in foreign economic activities, in accordance with the legislation of Turkmenistan.
 
Article 40. Cooperation with foreign investors Entities publishing jointly with foreign investors can arrange publishing and printing and bookselling company in accordance with the legislation of Turkmenistan and the international treaties to which Turkmenistan is a party.
 
Article 41. Export and import of printed products export from Turkmenistan, as well as entry into Turkmenistan from other States printed products are carried out in accordance with the legislation of Turkmenistan, the laws in force in the territory of a foreign State and international treaties to which Turkmenistan is a party.
 
CHAPTER VIII. FINAL PROVISIONS Article 42. The entry into force of this Act, this Act shall enter into force on the day of its official publication.
