On the national intangible cultural heritage protection this law regulates relations in the sphere of protection of national intangible cultural heritage of the Turkmen people; aimed at the realization of the right of citizens of Turkmenistan to access objects of national intangible cultural heritage and responsibility of everyone to care about preserving the national intangible cultural heritage.
 
Chapter i. General provisions article 1. The concept of national intangible cultural heritage under national intangible cultural heritage refers to spiritual values inherent in ethnic, social or religious group of Turkmen society, representing value with aesthetic, socio-cultural, historical and other viewpoints relevant to the preservation and development of national cultural identity of the Turkmen people.
As bearers of national intangible cultural heritage can serve individuals who possess a unique ability to create, store, and transfer to other generations of national intangible cultural heritage objects at constant traditional forms and unchanged through traditional means.
Bearers of national intangible cultural heritage can be combined both in Group and community, consisting of groups and (or) individual carriers, special interest (areas of manifestations of national intangible cultural heritage).
 
Article 2. Field demonstrations and objects of national intangible cultural heritage 1. On the territory of Turkmenistan national intangible cultural heritage can manifest in the following areas: 1) oral traditions and expressions, including language as a carrier of the intangible cultural heritage;
2) performing arts;
3) customs, rituals, and festivals;
4) knowledge and skills associated with traditional crafts;
5) knowledge and practices concerning nature and the universe.
2. the oral traditions and forms of expression include: national intangible cultural heritage: 1) oral folklore, including destany, epics, legends, fairy tales;
2) ritual and neritual′naâ poetic lyrics;
3) congratulations, conspiracies, riddles, proverbs, sayings;
4) other objects that match this field manifestation of national intangible cultural heritage.
3. the performing arts include objects of national intangible cultural heritage: 1) traditions and manifestations of art music (vocal, instrumental, dance and other melodies);
2) creativity represented a syncretic verbal-musical form (lullabies, laments, ritual wedding songs, songs from the ceremonial calendar cycle, songs with instrumental accompaniment, songs without instrumental accompaniment and other songs);
3) traditions and manifestations of choreographic art or choreography practice (dance, dance space);
4) art Bakhshi, musicians-instrumentalists (dutarči, gidžakči, tujdukči and other musicians), Bakhshi-destanči, which is the means of expression is a syncretic language (verbal, musical, drama);
5) national children's games, national sports games;
6) other objects that match this field manifestation of national intangible cultural heritage.
4. the customs, rites, celebrations include objects of national intangible cultural heritage: 1) national traditions, rituals, ceremonies, gala events, traditional festivals, national holidays;
2) traditional cultural institutions (councils of respected people and elders, girly gatherings, collective assistance (geneš); 3) other objects that match this field manifestation of national intangible cultural heritage.
5. the knowledge and skills associated with traditional crafts include objects of national intangible cultural heritage: 1) technology, košmovalâniâ, manufacture of carpet rugs, embroidery;
2) jewelry making, pottery, wood, silk, cotton, wool, leather;
3) technology of preparation of national dishes;
4 fabrication technology) clothing and household equipment;
5) traditional architecture;
6) musical instrument manufacturing technology;
7) other objects that match this field manifestation of national intangible cultural heritage.
6. Knowledge and practices concerning nature and the universe are the following objects of national intangible cultural heritage: 1) national hunting, fishing;
2) agricultural experience, including the cultivation of local varieties of plants and crops;
3) livestock, including the experience of growing horses, sheep, cows, camels, dogs and other animals;
4) methods to get the paints out of local vegetable raw materials;
5) how to use medicinal plants;
6) methods of collection and water conservation;
7) clarification to folk omens about the weather, defining the direction of movement on land and in water;
8) other objects that match this field manifestation of national intangible cultural heritage.
 
Article 3. Classification of objects of national intangible cultural heritage Objects of national intangible cultural heritage are classified as follows:

1) objects, which are characterized by vitality in communities (groups)-media of national intangible cultural heritage, and representative for their identification;
2) objects of artistic and ethnographic value perception in practice a small number of holders of national intangible cultural heritage preserved to a greater extent in the collective memory, threatened and may disappear if the measures are not taken for their conservation and restoration;
3) objects left in the life of communities (groups) are holders of national intangible cultural heritage, but having historical, scientific importance and complementary cultural diversity traditions of the Turkmen people.
Classification of objects of national intangible cultural heritage carried out by incorporating them in the national list of intangible cultural heritage in Turkmenistan and is carried out by a specially authorized State body for the protection of national intangible cultural heritage.
 
Article 4. Category of objects of national intangible cultural heritage 1. National intangible cultural heritage objects are divided into the following categories: 1) objects of national intangible cultural heritage of international importance, representing exceptional historical, scientific and artistic value for the designated world heritage and expected to be included in the representative list of the intangible cultural heritage of humanity (UNESCO), as well as the importance for the knowledge of the history and culture of the peoples of other countries;
2) national intangible cultural heritage objects of national importance, representing the historical, scientific and artistic value for the history and culture of Turkmenistan;
3) national intangible cultural heritage objects of local significance, representing the historical, scientific and artistic value for the history and culture of the velayats, cities with Mashhad, districts, cities, towns, etrap rights in settlements, etrap, gengeshliks.
2. Categories of national intangible cultural heritage objects are defined based on the results of their examination.
 
Article 5. Definition of national intangible cultural heritage protection 1. National intangible cultural heritage protection is defined as the system of legal, organizational, financial, logistical, informational and other measures taken by the State authorities within their competence measures aimed at ensuring the viability of national intangible cultural heritage, including identification, documentation, research, preservation, protection, promotion, enhancement, transmission, as well as, if need be, the revival of the various aspects of such heritage.
2. Study of national intangible cultural heritage includes the identification and documentation of national intangible cultural heritage objects, using traditional and modern means of registration in order to inventory and knowledge of these objects, the results of which are presented in the form of descriptions, audio and video recordings, photos and any other types of information on the availability of national intangible cultural heritage objects in the traditional cultural space.
A study of national intangible cultural heritage is carried out by representatives of institutions and organizations, both powers for its implementation in communities that are holders of national intangible cultural heritage, and involving community data.
A study of national intangible cultural heritage completes development of documentation on the national intangible cultural heritage objects, creation of scientific, educational, methodical and promotional activities aimed at ensuring the viability of national intangible cultural heritage, the transfer of knowledge about it to the younger generation and the training of professionals in the field of protection of national intangible cultural heritage.
3. the preservation of national intangible cultural heritage includes measures to ensure the viability of national intangible cultural heritage objects in their original form, and is carried out by authorised institutions in cooperation with the representatives of the communities that are holders of national intangible cultural heritage.
4. protection of national intangible cultural heritage includes the application of operational and long-term measures to promote recovery and viability of national intangible cultural heritage in danger of extinction.
5. transfer of national intangible cultural heritage to the younger generation is accomplished through educational measures, including training of specialists in this area, creating the conditions for the transfer of national intangible cultural heritage objects from their speakers to the younger generation, as well as through the issuance of scientific, popular scientific and educational publications.

6. revival of national intangible cultural heritage is ensured through measures for its revival and the transfer in case the object of national intangible cultural heritage, which is important for identifying community is endangered.
7. on Popularization and use of national intangible cultural heritage is ensured through social events, cultural exchange as well as through publications and audiovisual products, contributing to the preservation of the authenticity of the national intangible cultural heritage.
 
Article 6. Turkmen legislation on the protection of national intangible cultural heritage 1. The legislation of Turkmenistan on the national intangible cultural heritage protection is based on the Constitution and consists of this law and other normative legal acts of Turkmenistan, governing in the sphere of culture.
2. If the international treaties to which Turkmenistan is a party stipulates other rules than those contained in this Act, the regulations of the international agreements.
 
Article 7. The goals and objectives of this law 1. The objectives of this law are: 1) the protection of national intangible cultural heritage as part of the national cultural heritage;
2) the development of respect for the national intangible cultural heritage of communities, groups and individuals;
3) ensuring recognition of values of national intangible cultural heritage at the local, national and international level.
2. The objectives of this law are: 1) the preservation and revival of national intangible cultural heritage, cultural identity of Turkmen people;
2) ensuring equal access of all categories of the population to the national intangible cultural heritage;
3) popularization of best samples of national intangible cultural heritage;
4) development of institutional, legal and financial mechanisms for the protection of national intangible cultural heritage;
5) training and skills development in the field of protection of national intangible cultural heritage;
6) legal protection in the approaches to the preservation of national intangible cultural heritage;
7) to attract attention at the local, national and international level to the importance of national intangible cultural heritage objects and their mutual recognition.
 
Article 8. Subject of regulation of this Act subject to the present law are: 1) the relations arising in the field of protection of national intangible cultural heritage of the people of Turkmenistan;
2) the procedure for the formation and conduct of National intangible cultural heritage list;
3) General principles of State protection of national intangible cultural heritage of the people of Turkmenistan.
 
Article 9. The scope of this law 1. This law shall apply to the national intangible cultural heritage, which is consistent with existing international legal instruments on human rights and the requirements of mutual respect among communities, groups and individuals, as well as sustainable development.
2. this law cannot be used (fully or partially) by natural or legal persons to obtain property rights or copyright in any object (or its part) of national intangible cultural heritage, with the assistance of the normative legal acts of Turkmenistan governing intellectual property rights or copyrights.
 
Article 10. Principles of State policy in the field of protection of national intangible cultural heritage the State policy in the sphere of national intangible cultural heritage protection is based on the following principles: 1) recognition of the importance of national intangible cultural heritage as a factor for ensuring the identity of the Turkmen people, cultural diversity and a guarantee of sustainable development;
2) account of the close relationship between national intangible cultural heritage objects and objects of national historical and cultural heritage;
3) striving to ensure the safety of national intangible cultural heritage;
4) recognition of the importance of the role of communities, groups and, in some cases, individuals in the creation, preservation and transmission to future generations, the revival of national intangible cultural heritage objects;
5) the need for increased awareness, especially among young people, of the importance of national intangible cultural heritage and its protection;
6) recognition of the invaluable role of national intangible cultural heritage as a factor conducive to the rapprochement and understanding between people both within the State and around the world.
 
Article 11. The main directions of State support in the field of protection of national intangible cultural heritage to the main areas of Government support in the field of protection of national intangible cultural heritage include:

1) adoption of common policies aimed at enhancing the role of national intangible cultural heritage in society, and the inclusion of the protection of that heritage into the programme of socio-economic development of Turkmenistan;
2) adoption of the necessary legal, administrative, material, technical and financial measures to ensure the protection of national intangible cultural heritage present on the territory of Turkmenistan;
3) identification of national intangible cultural heritage objects available on the territory of Turkmenistan, with the participation of communities, groups and relevant public organizations;
4) inventory of national intangible cultural heritage objects available on the territory of Turkmenistan-National list of intangible cultural heritage of Turkmenistan and its regular updating;
5) promotion of scientific, technical and arts studies, as well as the development of research methodologies with a view to the effective protection of national intangible cultural heritage, in particular the national intangible cultural heritage objects at risk;
6) definition of a specially authorized State body for the protection of national intangible cultural heritage, including documentation on the national intangible cultural heritage objects;
7) promote training activities in the field of protection of national intangible cultural heritage;
8) providing access to the national intangible cultural heritage while respecting the practice of defining how to access those or other aspects of such heritage;
9) promote awareness and inform the public, in particular young people, on the national intangible cultural heritage protection;
10) introduction into the educational system of appropriate training programmes in the field of protection of national intangible cultural heritage;
11) carrying out capacity-building activities in the field of protection of national intangible cultural heritage related to the management and scientific research, as well as informal ways of transferring knowledge about him;
12) promotion of education on the protection of natural spaces and places, the existence of which is necessary for the expression of the value of national intangible cultural heritage;
13) ensuring the widest possible participation of communities, groups and individuals that are holders of national intangible cultural heritage protection national intangible cultural heritage, as well as actively involving them in the management of such heritage.
 
Article 12. The rights of citizens of Turkmenistan in the field of protection of national intangible cultural heritage 1. Citizens of Turkmenistan guarantees the preservation of national intangible cultural heritage for the benefit of present and future generations in accordance with this law.
2. Every citizen has the right to access to the national intangible cultural heritage and the right to use them in the order established by this law.
3. Every citizen has the right to freely obtain information on the national intangible cultural heritage in the order established by this law, within the limits of the data contained in the national list of intangible cultural heritage.
4. every citizen has the right to take part in the study, preservation, transmission, revival, popularization and use of national intangible cultural heritage on the conscious and voluntary basis, if such activity does not contradict the legislation of Turkmenistan.
5. Turkmen citizens have the right to assist a specially authorized State body for the protection of national intangible cultural heritage preservation, promotion and use of State protection of national intangible cultural heritage in accordance with the legislation of Turkmenistan.
6. Turkmen citizens, bearers of intangible cultural heritage, have the right to: 1) exercise their cultural identity with the help of national intangible cultural heritage objects;
2) participate in accordance with the provisions of this law on the protection of national intangible cultural heritage;
3) apply the rules of customs in relations with stakeholders, interested in studying, preservation, promotion and transfer of national intangible cultural heritage objects;
4) propose individual objects of national intangible cultural heritage for inclusion in the representative list of the intangible cultural heritage of humanity (UNESCO).
 
CHAPTER II. STATE REGULATION in the field of protection of NATIONAL INTANGIBLE CULTURAL HERITAGE Article 13. Regulatory agencies in the field of protection of national intangible cultural heritage

State regulation in the field of protection of national intangible cultural heritage is exercised by the Cabinet of Ministers of Turkmenistan, the authorized body of State administration in the field of culture, specially authorized State body for the protection of national intangible cultural heritage, local executive authorities and bodies of local self-government.
 
Article 14. Competence of the Cabinet of Ministers of Turkmenistan in the field of protection of national intangible cultural heritage of the Cabinet of Ministers of Turkmenistan: 1) defines the State policy in the field of protection of national intangible cultural heritage;
2) implements regulation of activity of bodies of State regulation in the field of protection of national intangible cultural heritage, referred to in article 13 of this Act;
3) defines the specially empowered State Agency for the protection of national intangible cultural heritage;
4) takes State programmes aimed at research, preservation, protection, transfer, rebirth, popularization and use of national intangible cultural heritage;
5) establishes rules and regulations for ownership, use and disposal of objects of national intangible cultural heritage;
6) establishes the procedure for identification, public accounting, identification, documentation, conduct propaganda the use of the national intangible cultural heritage;
7) cooperates with foreign States and international organizations in the field of protection of national intangible cultural heritage;
8) exercise other powers in accordance with the legislation of Turkmenistan.
 
Article 15. Competence of the authorized body of State administration in the field of culture for the protection of national intangible cultural heritage Empowered Government authority in the field of culture: 1) implements the State policy in the field of protection of national intangible cultural heritage;
2) develops normative legal acts in the field of protection of national intangible cultural heritage;
3) develops State programmes aimed at research, preservation, protection, transfer, rebirth, popularization and use of national intangible cultural heritage;
4) coordinates the activities of the relevant bodies of State administration, scientific and educational institutions, public associations on the issues of research, preservation, protection, transfer, renewal, promotion and use of national intangible cultural heritage;
5) promotes scientific, technical and arts research facilities of national intangible cultural heritage in danger of extinction;
6) defines the procedure for the formation and maintenance of a National list of intangible cultural heritage;
7) carries out international cooperation in the field of protection of national intangible cultural heritage;
8) exercise other powers in accordance with the legislation of Turkmenistan.
 
Article 16. The competence of a specially authorized State body for the protection of national intangible cultural heritage a specially authorized State body for the protection of national intangible cultural heritage: 1) carries out the State control over compliance with legal and physical persons of the Turkmenistan legislation in force on the protection of national intangible cultural heritage;
2) implements public programs aimed at research, preservation, protection, transfer, rebirth, popularization and use of national intangible cultural heritage;
3) carries the identification, study, accounting, preservation, documentation, promotion and use of objects of national intangible cultural heritage;
4) leads a national list of intangible cultural heritage;
5) creates expert, scientific-methodical and other Councils in the area of protection of national intangible cultural heritage;
6) organizes and carries out an examination of national intangible cultural heritage objects;
7) monitors the State of objects of national intangible cultural heritage;
8) exercise other powers in accordance with the legislation of Turkmenistan.
 
Article 17. The competence of the local authorities and local self-government bodies in the field of protection of national intangible cultural heritage of local executive bodies and local governments on their territory and within the limits of their competence: 1) ensure compliance with the legislation of Turkmenistan on the national intangible cultural heritage protection;
2) shall facilitate the identification, tracking, conservation, popularization and use of objects of national intangible cultural heritage;

3) include in the plans of economic and social development activities for the Organization, study, and conservation of identified on their territory national intangible cultural heritage objects and their financing;
4) attract scientific organizations in the field and the public to initiate the study, preservation and promotion of national intangible cultural heritage;
5) provide consultation with a specially authorized State body for the protection of national intangible cultural heritage activities to identify, study, accounting, maintenance and use of objects of national intangible cultural heritage of all types;
6) assist holders of national intangible cultural heritage in view the identified objects of national intangible cultural heritage to be included in the national list of intangible cultural heritage;
7) address issues of suspension, as well as the prohibition of work (activities), endangering national intangible cultural heritage objects, on presentation of a specially authorized State body for the protection of national intangible cultural heritage, and other interested organizations and citizens;
8) exercise other powers in accordance with the legislation of Turkmenistan.
 
Article 18. Participating scientific organizations, higher educational institutions and cultural institutions in the protection of the national intangible cultural heritage 1. Scientific organizations, higher educational institutions: 1) are involved in the identification of national intangible cultural heritage objects;
2) conduct scientific work in the field of protection of national intangible cultural heritage;
3) acted as experts in order to determine the scientific value of national intangible cultural heritage objects;
4) carry out activities to promote the national intangible cultural heritage;
5) include research plans and curricula of the study and teaching of national intangible cultural heritage;
6) provide scientific advice on the national intangible cultural heritage protection;
7) to perform other duties stipulated by the legislation of Turkmenistan.
2. cultural institutions: 1) are accounting and investigation of national intangible cultural heritage, using traditional and modern methods and technologies;
2) serve as experts for the cultural value of national intangible cultural heritage objects;
3) carry out activities to promote the national intangible cultural heritage;
4) based on the results of the studies will organize the files in the order established by the legislation of Turkmenistan, create databases, collections of objects of national intangible cultural heritage;
5) give advice on the national intangible cultural heritage protection;
6) are involved in activities for the protection of national intangible cultural heritage in danger of extinction;
7) contribute to the continuity of generations in the national intangible cultural heritage protection;
8) perform other duties stipulated by the legislation of Turkmenistan.
 
Article 19. The participation of NGOs and citizens in protecting the national intangible cultural heritage 1. Public associations, the statutes which provide for as focus research, preservation, protection, transfer, rebirth, popularization and use of national intangible cultural heritage, participating in the national intangible cultural heritage protection in the order established by this law.
2. Other public associations and citizens: 1) are assisting the organs of State regulation in the field of protection of national intangible cultural heritage, scientific organizations, higher educational institutions and cultural institutions in the protection of the national intangible cultural heritage in accordance with the legislation of Turkmenistan;
2) organize public control and patronage for the preservation and use of objects of national intangible cultural heritage;
3) awareness-raising among the public on the safety and use of objects of national intangible cultural heritage.
 
CHAPTER III. STATE PROTECTION of NATIONAL INTANGIBLE CULTURAL HERITAGE Article 20. The notion of State protection of national intangible cultural heritage 1. National intangible cultural heritage objects are subject to State protection in order to prevent their disappearance, damage or destruction of material carriers on which they commit a breach of the established procedure for their use, movement and prevent other actions that might harm the national intangible cultural heritage objects, as well as in order to protect them from other negative impacts.

2. State protection of national intangible cultural heritage includes: 1) State supervision over compliance with the legislation of Turkmenistan on the national intangible cultural heritage protection;
2) State registration of objects with object traits of national intangible cultural heritage, in accordance with the present law;
3) examination of national intangible cultural heritage objects;
4) establishing responsibility for the damage or destruction of tangible media where the registered object of national intangible cultural heritage.
 
Article 21. The main principles of State protection of national intangible cultural heritage the main principles of organization of State protection of national intangible cultural heritage are: 1) the adoption of the public targeted programmes aimed at research, preservation, protection, transfer, rebirth, popularization and use of national intangible cultural heritage;
2) Organization and activities specially authorized State body for the protection of national intangible cultural heritage;
3) formation and maintenance of a National list of intangible cultural heritage;
4) establishing the order of inclusion of an object of national intangible cultural heritage in the national list of intangible cultural heritage of Turkmenistan, an exception object of national intangible cultural heritage list, move the object of national intangible cultural heritage, change the category of an object of national intangible cultural heritage;
5) exercise of State control over the conservation and use of national intangible cultural heritage;
6) classification of objects of national intangible cultural heritage particularly valuable objects of national intangible cultural heritage;

8) establishment of the procedure of examination of national intangible cultural heritage objects;
9) the State of international cooperation in the field of protection of national intangible cultural heritage;
10) scientific and methodological support in the field of protection of national intangible cultural heritage;
11) conclusion and execution organization of international treaties in the field of the protection of the intangible cultural heritage of humanity.
 
Article 22. State control in the field of protection of national intangible cultural heritage 1. State control in the field of protection of national intangible cultural heritage is carried out in the manner prescribed by a specially authorized State body for the protection of national intangible cultural heritage in accordance with this law.
2. Organs of State regulation in the field of national intangible cultural heritage protection in cases of violation of this Act have the right to sue in court.
 
Article 23. State programmes for the conservation of national intangible cultural heritage 1. For the study, preservation, protection, transfer, renewal, promotion and use of national intangible cultural heritage protection of State programmes are being developed for national intangible cultural heritage.
2. State programmes of national intangible cultural heritage protection aimed at identifying, fixing and examination of national intangible cultural heritage objects, creating conditions for their updating and playback, stimulation of oral knowledge transfer mechanisms, improving the public prestige of national intangible cultural heritage through its promotion and incorporation of national intangible cultural heritage study in educational programs.
3. The procedure for the formation, financing and implementation of State targeted programmes of national intangible cultural heritage protection is set by the legislation of Turkmenistan.
 
CHAPTER IV. NATIONAL LIST of INTANGIBLE CULTURAL HERITAGE of TURKMENISTAN Article 24. The concept of national intangible cultural heritage list, Turkmenistan 1. National list of intangible cultural heritage in Turkmenistan is a public information system, which includes a data bank, consisting of regularly updated information and documents on the legal status, the description of cultural value, conditioning and on the assessment of the safety of objects of national intangible cultural heritage.

2. The information contained in the national list of intangible cultural heritage of Turkmenistan, are the main source of information about the objects of national intangible cultural heritage, about the place of their existence and storage, the formation and maintenance of other information systems or data banks using (adapted) this information.
3. National list of intangible cultural heritage of Turkmenistan is formed by the inclusion of national intangible cultural heritage objects in respect of which it was decided to include them in the list, as well as through exceptions to this list of national intangible cultural heritage, in respect of which it was decided to delete them from the list, in the order established by this law.
 
Article 25. Documents submitted for a decision on the inclusion of an object of national intangible cultural heritage in the national list of intangible cultural heritage of Turkmenistan for a decision on the inclusion of an object of national intangible cultural heritage in the national list of intangible cultural heritage of Turkmenistan the applicant (individual or legal entity) represents in a specially authorized State body for the protection of national intangible cultural heritage: 1) application form (or recommendation) for the inclusion of an identified object of national intangible cultural heritage in the national list of intangible cultural heritage;
2) expert opinion the object of national intangible cultural heritage;
3) information on the name of an object of national intangible cultural heritage;
4) timing information about identifying and (or) the object of national intangible cultural heritage;
5) information about the whereabouts of an object of national intangible cultural heritage or territory of their existence;
6) information about object category of national intangible cultural heritage;
7) assignment information (scope) of an object of national intangible cultural heritage;
8) a description of the object of national intangible cultural heritage, including its cultural and historical value, giving the grounds for its inclusion in the national list of intangible cultural heritage of Turkmenistan and subject to mandatory conservation.
 
Article 26. How to enable the national intangible cultural heritage objects in the national list of intangible cultural heritage, Turkmenistan 1. The right to inclusion of national intangible cultural heritage in the national list of intangible cultural heritage in Turkmenistan belongs to the authorized body of State administration in the field of culture.
2. Objects, which represent the value of national intangible cultural heritage and for which issued expert opinion included in the national list of intangible cultural heritage of Turkmenistan as a national intangible cultural heritage objects, refer to identified objects of national intangible cultural heritage from the day of receipt of the specified conclusion.
3. Data about objects of national intangible cultural heritage entered into special documents.
A list of such documents, forms, recommendations on filling them out is determined by the order of formation and implementation of National intangible cultural heritage list. These documents are part of the list and are subject to indefinite storage.
 
Article 27. Maintenance of National intangible cultural heritage list, Turkmenistan 1. Maintenance of a National list of intangible cultural heritage of Turkmenistan includes assignment of registration number of national intangible cultural heritage object in this list, monitoring data about objects of national intangible cultural heritage, which in the above list, documentation maintenance of this list, and is vested in the specially empowered State Agency for the protection of national intangible cultural heritage.

4. monitoring data about objects of national intangible cultural heritage, included in the national list of intangible cultural heritage of Turkmenistan, is carried out by a specially authorized State body for the protection of national intangible cultural heritage and its territorial structures in order to modify data about objects of national intangible cultural heritage, which in the national list of intangible cultural heritage.
5. Article 28. An exception object of national intangible cultural heritage from the national list of intangible cultural heritage of Turkmenistan Exception object of national intangible cultural heritage from the national list of intangible cultural heritage in Turkmenistan is carried out by the authorized body of State administration in the field of culture based on the conclusions of the examination object of national intangible cultural heritage to establish that this object has lost its value as the object of national intangible cultural heritage.
 
Article 29. Especially valuable objects of national intangible cultural heritage 1. The Cabinet of Ministers of Turkmenistan may decide to recognize the object of national intangible cultural heritage, included in the national list of intangible cultural heritage in Turkmenistan, a particularly valuable object of national intangible cultural heritage.
2. The object of national intangible cultural heritage, included in the representative list of the intangible cultural heritage of humanity (UNESCO), is recognized as a particularly valuable object of national intangible cultural heritage of Turkmenistan as a matter of priority.
 
Chapter v. EXAMINATION of NATIONAL INTANGIBLE CULTURAL HERITAGE Article 30. Objective examination of national intangible cultural heritage 1. Objects in the field of expertise of national intangible cultural heritage are objects that have signs of national intangible cultural heritage in accordance with this law.
2. examination of national intangible cultural heritage held in order to: 1) justification for the inclusion of an object of national intangible cultural heritage in the national list of intangible cultural heritage;
2) definitions categories of national intangible cultural heritage;
3) justification of an exception object of national intangible cultural heritage from the national list of intangible cultural heritage.
 
Article 31. Guidelines for the examination of national intangible cultural heritage objects examination of national intangible cultural heritage is based on the following principles: 1) scientific validity, fairness and the rule of law;
2) security compliance on a national intangible cultural heritage;
3) accuracy and completeness of information provided for the examination of an object of national intangible cultural heritage;
4) independence of experts;
5) transparency.
 
 
 
Article 32. The procedure for the examination of national intangible cultural heritage objects

The procedure for the examination of national intangible cultural heritage objects, requirements for the identification of individuals and entities that may be involved in as experts, list of experts submitted documents, the manner of their review, the procedure for conducting other studies within the framework of this examination shall be established by the authorized body of State administration in the field of culture.
 
Article 33. Expert opinion of national intangible cultural heritage 1. Expert opinion of national intangible cultural heritage should be in the form of an Act, which contains the results of studies conducted by experts in the manner prescribed by the present law.
2. In case of disagreement with the conclusion of the examination object of national intangible cultural heritage: 1) the specially empowered State Agency for the protection of national intangible cultural heritage on their own initiative or on application by an interested person has the right to appoint reexamination;
2) applicant (individual or legal entity) can appeal the decision in court.
 
Article 34. Reasons for inclusion of national intangible cultural heritage object in the representative list of the intangible cultural heritage of humanity (UNESCO) and the order of presentation of appropriate documentation 1. National intangible cultural heritage objects that represent outstanding universal cultural, historical, artistic, scientific or aesthetic value can be assigned to objects of the intangible cultural heritage of humanity in the manner prescribed by the Convention for the safeguarding of the intangible cultural heritage, adopted by UNESCO.
2. Expert opinion on the inclusion of an object of national intangible cultural heritage of national importance, situated in the territory of Turkmenistan, in the representative list of the intangible cultural heritage of humanity (UNESCO) and the documentation issued in accordance with the requirements of the UNESCO Intergovernmental Committee for the safeguarding of the intangible cultural heritage, are sent to Turkmenistan's National Commission for UNESCO in the procedure established by the Cabinet of Ministers of Turkmenistan.
 
CHAPTER VI. FUNDING for the PROTECTION of NATIONAL INTANGIBLE CULTURAL HERITAGE Article 35. Sources of funding for the conservation of national intangible cultural heritage 1. Sources of funding for the national intangible cultural heritage protection are: 1) the funds of the State budget of Turkmenistan;
2) extrabudgetary income;
3) other means not prohibited by the legislation of Turkmenistan.
2. in order to ensure the proper use of funds allocated for the financing of measures for the protection of national intangible cultural heritage can be generated extra-budgetary funds in accordance with the legislation of Turkmenistan.
 
CHAPTER VII. FINAL PROVISIONS Article 36. Responsibility for violation of this Act, the violation of this law entails a responsibility in accordance with the legislation of Turkmenistan.
 
Article 37. Settlement of disputes disputes arising on the protection of national intangible cultural heritage be settled in the manner prescribed by the legislation of Turkmenistan.
 
Article 38. Incentive measures in the field of protection of national intangible cultural heritage 1. For the special contribution in the field of protection of national intangible cultural heritage natural and legal persons may be encouraged, including meet state awards, in the manner prescribed by the legislation of Turkmenistan.
2. For holders of national intangible cultural heritage recognized by the community of national intangible cultural heritage media, community media culture and the scientific community, may be imposed an honorary title for distinguished service in the field of national intangible cultural heritage that is established and is awarded in accordance with the Turkmenistan law "on State awards of Turkmenistan".
 
Article 39. International cooperation in the field of protection of national intangible cultural heritage of international cooperation in the field of national intangible cultural heritage protection is carried out in accordance with the legislation of Turkmenistan and the international treaties to which Turkmenistan is a party.
 
Article 40. The entry into force of this Act, this Act shall enter into force on the day of its official publication.
