On rail transport, this law defines the legal and organizational basis for the functioning and development of rail transport and regulate the relations associated with its functioning.
 
Chapter i. General provisions article 1. 15) rail-use-a set of production-technological complexes, which include railway-use, railway rolling stock, as well as other property and designed to meet the needs of specific users in the works (services) of railway transport, or for their own needs;
16) rail transport infrastructure of common usage-technological complex, including railways and other constructions, railway stations, power supply devices, communication networks, signalling, centralization and blocking, information systems and traffic control system and other buildings, structures, facilities and devices, to ensure the functioning of the complex.
 
Article 2. Turkmen law on railway transport 1. Turkmen legislation on rail transport is based on the Constitution and consists of this law and other normative legal acts of Turkmenistan.
2. If an international treaty to which Turkmenistan stipulates other rules than those stipulated by this law, the rules of the international treaty shall apply.
 
Article 3. The scope of this law 1. This law shall apply to relations associated with the operation of the railway transport, taking into account the provisions of part two of this article.
2. This law shall apply to the relations associated with the operation of railway transport-use part of its interaction with rail public transport.
 
 
 
 
Article 4. Basis operation of railway transport 1. Rail transport in general use (hereinafter referred to as the rail) is an integral part of the integrated transport system of Turkmenistan. Rail transport in conjunction with other modes of transport aims to timely and properly meet the needs of individuals, legal entities and the State in transportation by rail, to contribute to creating the conditions for the development of the economy of Turkmenistan.
2. functioning of the railway transport is carried out on the basis of the following principles: 1) the sustainability of rail transport;
2) accessibility, safety and quality of services provided;
3) competition and the emergence of a developed market for railway services;
4) coherence in the functioning of the integrated transport system of Turkmenistan.
3. Turkmenistan provides a solution to the challenges faced by rail, through effective regulation and supervision in the field of railway transport, as well as through participation in the development of railway transport.
 
Article 5. Ownership of the railway transport railway transport Assets may be in the State and other forms of ownership, in accordance with the legislation of Turkmenistan.
 
CHAPTER II. State regulation in the FIELD of RAILWAY TRANSPORT Article 6. Basis for State regulation in the field of railway transport 1. Article 7. State authorities

                  Regulation in the field of railway transport bodies exercising State regulation in the field of railway transport are the Cabinet of Ministers of Turkmenistan, authorized government authority in the field of railway transport (hereinafter referred to as the authorized body) and other State bodies within their competence.
 
Article 8. Competence of the Cabinet of Ministers of Turkmenistan Cabinet of Ministers of Turkmenistan in the field of railway transport: 1) defines a unified State policy;
2) alleges: (a)) the national programme for the development of railway transport;
(b)) rules on railway transport;
ç) Charter of railway transport of Turkmenistan;
(d)) position on labour discipline of railway employees;
(e)) of the dangerous goods list and requirements for their transport;
ä) list of goods to be convoyed by paramilitary guard, and their protection;
f) list of protected objects of railway transport;
3) adopts the normative legal acts of Turkmenistan;
4) determines: (a) establish and use) the manner of rights-of-way;
b) procedure for establishing protective zones of railway tracks and other rail transport facilities;
5) agrees a list of public rail transport enterprises subject to decentralization and privatization on presentation of the authorized State body in the field of Economics and management development;
6) exercise any other powers established by the legislation of Turkmenistan.
 
Article 9. Competence of the authorized body of the authorized organ in the field of railway transport: 1) implements a unified State policy;
2) participates in the development of the national programme for the development of rail transport;
3) organises rail;

5) prepares and submits for approval by the Cabinet of Ministers of Turkmenistan: a) draft regulation on rail transport;

(e)) of the dangerous goods list and requirements for their transport;

11) provides: a) the coordination of the activities of railway transport of various forms of ownership;
b) State control in the field of railway transport, including checking the technical condition of the railway tracks, railway rolling stock and containers, as well as compliance with the security requirements of handling execution when loading cargo in wagons and containers and unloading of wagons and containers;
ç) any other powers established by the legislation of Turkmenistan.
 
Article 10. Licensing of separate types of activity carried out in railway transport Licensing of separate types of activity carried out on the railway transport is carried out in accordance with the legislation of Turkmenistan.
 
Article 11. Article 12. Tariffs and fees for rail transport 1. Tariffs for the carriage of passengers, baggage and cargo, the payment for work, and rail transport services shall be established in accordance with the legislation of Turkmenistan.

3. Tariffs for carriage by rail in international traffic shall be established in accordance with international treaties to which Turkmenistan is a party.
 
Article 13. Features of State land management of railway transport 1. Land required for the operation of railway transport, railway transport enterprises are available for permanent use in the manner prescribed by the legislation of Turkmenistan.

2. Land rail transport must be used in accordance with the land, urban, environmental, sanitary, fire protection and other laws of Turkmenistan.
3. Dimensions of land, including stripes, are determined by the design and estimate documentation.
The procedure for establishing and using rights-of-way shall be established by the Cabinet of Ministers of Turkmenistan.

3) enterprises of railway transport within the protective zones have the right to work on repair and maintenance of railway transport objects, as well as for the Elimination of consequences of accidents, with prior notification to the owners, users or occupiers of land and subsequent reimbursement of damage in accordance with the legislation of Turkmenistan.
 
Article 14. Design, construction, renovation and maintenance of railway transport design, construction, renovation and maintenance of railway transport are carried out at the expense of the authorized body, railway transport, the State budget of Turkmenistan in cases stipulated by national programmes in Turkmenistan, and by other means not prohibited legislation of Turkmenistan.
 
CHAPTER III. The main requirements for the enterprises of RAILWAY TRANSPORT and RAILWAY TRANSPORT OBJECTS Article 15. The main requirements for the enterprises of railway transport 1. Enterprises of railway transport obligated to: 1) have a license to carry out activities subject to licensing in accordance with the legislation of Turkmenistan;
2) own railway rolling stock for transportation;
3) have qualified employees with relevant training;
4) provide a safe travelling conditions, trains and other railway vehicles, including the shunting operations, transport of goods and passengers, occupational safety, health and lives of the passengers, the environment Wednesday.
2. Economic and other legal relations between the enterprises of railway transport is carried out in accordance with the Charter of the railway transportation of Turkmenistan and on the basis of agreements governing the rights, duties and responsibilities of the parties.
 
Article 16. The basic requirements for rail 1. Article 17. The basic requirements for railway rolling stock and containers 1. Intended for the carriage of passengers, cargo, Luggage by rail rolling stock and containers must meet the mandatory requirements set out in accordance with the legislation of Turkmenistan.
2. railway rolling stock with railway tracks-use on the railways and with rail tracks public-use railway lines is set by the authorized body.
 
CHAPTER IV. MANAGE TRANSPORTATION PROCESS. ORGANIZATION Of RAILWAY COMMUNICATION
 

Article 18. Organization of transportation process management in railway transport 1. Transportation process management on the railway transport is carried out by the notified body or by agreement with them the relevant railway transport enterprise in accordance with this law and the Statute of the railway transport.
2. Organs of State power and administration, public associations and other organizations, individuals are not entitled to interfere in organizing transportation process management in railway transport, except for the cases stipulated by the legislation of Turkmenistan.
 
Article 19. Regulation of relations arising in the interaction of rail transport and other transport modes to regulate relations arising in the interaction of railway transport and other modes of transport, in accordance with the legislation of Turkmenistan and the Charter of railway transport in Turkmenistan.
 
Article 20. Framework for the implementation of the transport of passengers, baggage and cargo 1. Carriage of passengers, baggage and cargo by rail in domestic and international services, including transit communication, is carried out in accordance with the rules of the railway transport, railway transport Charter of Turkmenistan and the international treaties of Turkmenistan.

Article 21. The main provisions of the carriage of passengers 1. The passenger must have a Travelcard and the carrier shall ensure that its sale to the specified passenger destination trains along the route, deliver the passenger and his baggage at destination, giving him a seat on the train, according to the ticket.
2. The passenger who travel documents for travel or shipment is entitled to make use of the services provided by the carrier for domestic and international rail communications.

Article 22. The basic provisions on the carriage of goods 1. Under a contract of carriage of goods by rail transport company carrying the goods undertakes to deliver to destination and give it to the recipient or authorized the person (hereinafter referred to as the recipient of the goods), and the sender undertakes to pay for transportation services in accordance with the established procedure.

Article 23. Organization of railway communication 1. Rail links between railway stations and provided enterprises of railway transport.
2. Organization of trains is carried out on the basis of a consolidated schedule of trains.
Master schedule of trains is approved in the manner determined by the notified body on the basis of proposals of enterprises of railway transport.
3. the public authorities and users management of railway transport services has the right to revert to the authorized body of the proposals on the improvement of train schedules.
 
Article 24. Railway stations, sidings served 1. Railway stations are intended to service the transport of goods, passengers and luggage on domestic and international rail communications and are located in the cities and other settlements.
2. Between railway stations provides for patrols and served.
3. use of roving railway station, and stops are carried out in accordance with the rules of the railway transport.
4. Railway stations and sidings have names. Naming of railway stations and their raz″ezdam change is carried out in accordance with the legislation of Turkmenistan.
5. Decision to open railway stations, trips and stopping points, ending their operation is accepted by the notified body in consultation with the relevant local authority of executive power.
 
Article 25. Railroad crossings 1. At the intersection of the lines of railway roads are equipped with railroad crossings.
Order equipment and operation of railway crossings is set by the notified body in consultation with the authorized State bodies of management in road construction and in the area of internal affairs.
2. opening and closing of the existing new railway crossings are made on the basis of the decision of the authorized body, agreed with the appropriate body of the local executive authorities.
 
Chapter v. SAFETY in RAILWAY TRANSPORT, CARGO SECURITY, RAILWAY TRANSPORT OBJECTS, organization of work in special CONDITIONS, Article 26. Organization of safety and operation of railway transport and other technical means 1. The authorized agency organises the provision of safety and operation of railway transport and other technical devices by: 1) implementation of the legal and technical regulation in the field of safety and operation of railway transport and other related transportation process in railway transport of technical means, including the establishment of the classification, the order of the official investigation and accounting of accidents and other events related to the violation of the rules of safety and operation of railway transport;
2) public policy development in the field of safety and operation of railway transport and operation of transport and other technical means, related to the transportation process.

Article 27. Fundamentals of safety and operation of railway transport 1. 3. Minimum distances from the specified objects to the railroad tracks and buildings, structures, crossings of railways, power transmission lines, oil and gas pipelines and other terrestrial and subterranean structures, as well as the construction and content of the objects when they are crossing the railroad tracks and the approximation of these railway lines are established regulations of the relevant State authorities in agreement with the competent authority.

7. 9. Violation of traffic safety in railway transport and the operation of transport and other technical means, related to the transportation process responsible persons bear responsibility stipulated by the legislation of Turkmenistan.
 
Article 28. On rail transport, environmental, fire protection, industrial safety, occupational safety, uniformity, sanitary-epidemiological welfare of the population in railway transport operation to ensure environmental, fire and industrial safety, occupational safety, uniformity, as well as the provision of sanitary-epidemiological welfare of population carried out by the enterprises of railway transport in accordance with the legislation of Turkmenistan.
 
Article 29. Protection of cargoes, railway transport objects and ensuring public order in railway transport 1. Cargo security in transit and railway stations is provided by rail transport company carrying out transportation, independently or under contract with the departmental guard of the authorized body or other organizations except provided by shippers or consignees of the protection and maintenance of the goods.

3. State control for compliance with the mandatory requirements of railway transportation enterprise by conduct scheduled and unscheduled inspections.

5. The reason for holding the unscheduled checks are: 1) the expiry of the execution of railway transport enterprise instruction on Elimination of revealed violations of mandatory requirements issued by the notified body;
2) flow to the authorized agency appeals and petitions of citizens, including sole proprietors, legal persons, information from authorities, from the media about the facts of accidents and accidents related to violations of the rules of operation of infrastructure facilities of the railway transport, the regulations for the carriage and handling of cargo, passengers and baggage, if such violations pose a threat of harm (harm) life , health, environment, security of the State Wednesday, the property of individuals and legal persons or resulted in causing such harm (harm);

Advance notice of railway transport enterprise on carrying out unscheduled checks are not allowed.
6. Verification of the fulfilment of the mandatory requirements of the railway transport enterprises are conducted by officials of the authorized body on the basis of planned (RAID) quests in accordance with the order (Decree) of the head (Deputy head) of the authorized body.
7. the officers of the authorized body, carrying out checks in accordance with part six of this article, shall have the right to: 1) ask the authorities, railway transport and receive from them based on the motivated requests in writing to the information and documents required in the course of the audit;
2) upon presentation of i.d. and a copy of the order (orders) of the head (Deputy head) of the authorized body on appointment verification visit used by enterprises of railway transport in carrying out its work, the rail transport infrastructure, rolling stock and other vehicles and equipment associated with the transportation process, surveys, research, testing, measuring, investigation, examination, and other monitoring activities;
3) grant enterprises of railway transport instruction on Elimination of revealed violations of mandatory requirements on the conduct of activities to ensure prevention of harm (harm) of life, health, environment, security of the State Wednesday, the property of individuals and legal persons, prevent emergencies;
4) make up protocols on administrative offences, to consider cases on administrative offences, and take measures to prevent such violations;
5) addressed to public authorities, materials associated with violations of the mandatory requirements for the resolution of questions regarding the institution of criminal proceedings on grounds of crimes;
6) present in the order established by the legislation of Turkmenistan, actions for damages (harm) caused as a result of violations of the mandatory requirements.

8. the State Fire supervision, State environmental supervision, state sanitary-epidemiological supervision, State supervision in the field of industrial safety, state metrological supervision, State construction supervision, State supervision over compliance with labour legislation in carrying out activities in railway transport are carried out by authorized State bodies in accordance with the legislation of Turkmenistan.
 
Article 31. Organization of the work of the railway transport in emergency situations 1. Railway transport enterprises should take immediate measures to eliminate the consequences of accidents, natural disasters (floods, fires drifts and others), causing disruption to rail transport.
Rail transport enterprises to ensure immediate action at their own expense must include specialized units for dealing with emergencies, have a stock of material and technical means, a list of which shall be determined by the notified body in consultation with the interested State bodies of power and control, or enter into contracts with external specialized organizations.
2. procedure of the participants in emergency situations shall be determined by the notified body. When the consignor, consignee must immediately send its representatives to the scene of the accident.
3. the public authorities and management, providing, in accordance with the legislation of Turkmenistan, protection of population and territories against emergency situations, provide enterprises of railway transport assistance in eliminating the consequences of such situations, which threaten people's lives and health, safety and security of cargo and baggage.
4. The authorized body of the railway transport enterprises are included in the unified State system of prevention and liquidation of emergency situations.
 
CHAPTER VI. Labour relations and DISCIPLINE of RAILWAY WORKERS Article 32. Labour relations and a guarantee of railway employees 1. Labor relations of employees of railway transport governed by labour legislation of Turkmenistan, the regulation on labour discipline of railway employees, the labour contract and the collective agreement (the agreement).
2. features of working hours and rest periods, working conditions of rail transport certain categories of employees whose work is directly connected with the movement of trains, are established taking into account the views of the Trade Union.
3. Employees of railway transport, which carry out production activities directly related to the movement of trains and shunting work on the list of occupations determined by the notified body are required pre-shift or pre-driver physicals, as well as on demand of employer-medical examination on determination of alcohol, narcotic drug or psychotropic substance.
In order to verify the professional level of the employees, determining competencies, identifying their compliance with specialty, profession, position held at the enterprises of railway transport should be certification of employees in accordance with the legislation of Turkmenistan.
4. employees of railway transport are entitled to free travel on rail transport at the expense of the relevant enterprises in the manner and under the conditions prescribed by the employment contract and collective agreement (the agreement).
5. Guarantees and compensations provided to employees of railway transport in the performance of their duties during their stay on the territory of a foreign State shall be established by the legislation of Turkmenistan and the international treaties to which Turkmenistan is a party.
6. For employees of railway transport, translated to another job as a result of an industrial injury or occupational disease or retired on disability employment injury, occupational disease or otherwise arising through no fault of the employee health damage, retain the right to benefits, established by the legislation of Turkmenistan, an employment contract, collective agreement (the agreement) for the employees of the railway transport and provided at the expense of the employers.
 
Article 33. Labour discipline in rail transport Discipline of employees of railway transport is regulated by labour legislation of Turkmenistan and the regulation on labour discipline of railway employees, approved by the Cabinet of Ministers of Turkmenistan.
 
CHAPTER VII. FINAL PROVISIONS
 

Article 34. Financial-reporting time in railway transport on the territory of Turkmenistan applies a single financial-reporting time-local.
 
Article 35. The language used on railway transport 1. In the activities of the railway transport is used, the national language of Turkmenistan.
2. information on railway stations, railway stations, trains and other places serving passengers, consignors and consignees, alongside the State language of Turkmenistan may be in foreign languages. In information provided to passengers at railway stations and railway stations should contain information about the departure time and arrival time of passenger trains, fares of passengers and the carriage of baggage, working hours of railway ticket offices and other units engaged in passenger service, as well as information on the services provided to passengers.
 
Article 36. Uniforms of railway employees 1. For rail transport workers directly involved in the movement of trains and maintenance of passengers while on duty provided for wearing uniforms.
Insignia and the order in which they are worn on uniforms shall be determined by the notified body.
2. purchase of uniforms is carried out at the expense of the respective employers.
 
Article 37. Turkmenistan's participation in international cooperation in the field of railway transport 1. Turkmenistan is participating in international cooperation in the field of railway transport in accordance with the universally recognized principles and norms of international law and international treaties to which Turkmenistan is a party.
2. Representation of interests of Turkmenistan in the field of railway transport is carried out by the authorized body and other State authorities and in accordance with the powers conferred upon the legislation of Turkmenistan.
 
Article 38. Railway transport insurance 1. Passengers who use the services of rail transport in the period of following the train, railway transport workers with the raz″ezdnym nature of the work, carrying out control and inspection functions on trains as well as employees of the militarized guard units for the period of performance of their duties shall be subject to compulsory State insurance.
2. railway transport Enterprise shall be entitled to insure its liability to reimburse for damage caused during carriage of passengers, cargo and baggage, as well as for damages to third parties.
 
Article 39. Mobilization and civil defense training in railway transport 1. Mobilization preparation and civil defense in rail transport carried out in accordance with the legislation of Turkmenistan.
2. manual mobilization preparation and civil defence of the railway transport is carried out by the notified body.
3. activities for mobilization training and civil defence are exercised in advance enterprises of railway transport.
Responsible for the proper implementation of these activities lies with the managers of these enterprises.
 
Article 40. Settlement of disputes disputes arising in the area of rail transport, are resolved in the order established by the legislation of Turkmenistan.
 
Article 41. Responsibility for violation of this Act, the violation of this law entails responsibility established by the legislation of Turkmenistan.
 
Article 42. The entry into force of this law 1. This law shall enter into force on the day of its official publication.
