This Law defines the legal relationship of physical and legal entities in the field of fire safety in the territory of Turkmenistan.

CHAPTER I. GENERAL PROVISIONS

Article 1. Basic concepts used in this Law

In the present Law the following basic concepts:
1) Fire - uncontrolled burning, causing material damage, damage to life and health of citizens and the interests of society and the state;
2) Fire safety - the state of security of the person, property, society and the state from the fire;
3) fire safety requirements - special conditions of social and technical measures established in order to ensure fire safety legislation of Turkmenistan, regulation or authorized government agency;
4) violation of fire safety requirements - the failure or improper fulfillment of fire safety requirements;
5) fire-fighting mode - rules of human behavior, order production facilities and content organization (areas) to ensure prevention of violations of fire safety and fire-fighting;
6) fire safety measures - steps to ensure fire safety, including the implementation of fire safety requirements;
7) fire service - set by a regularly constituted authorities, fire departments, manpower and resources, including fire-fighting units intended for the organization of fire prevention and extinguishing of the associated primary rescue operations;
8) fire-fighting - fighting, aimed at the rescue of people, property and the liquidation of fires;
9) Priority rescue work associated with putting out fires - action fire service rescue and evacuation of people, property, ownership, provide first aid to victims of fires;
10) fire-technical products - special technical, scientific-technical and other products designed to ensure fire safety, including fire equipment, fire equipment, fire-fighting and fire-retardant material, special means of communication and control, programs for electronic computers and databases, as well as other means of preventing and fighting fires;

11) fire protection garrison - a set of deployed in a particular area management bodies, subdivisions of the State fire service, fire safety education, and other fire-fighting units, regardless of departmental affiliation.

Article 2. Legal basis of fire safety

1. The legal basis of fire safety consists of the Constitution of Turkmenistan, this Law, other laws of Turkmenistan, acts of the President of Turkmenistan and adopted in accordance with their regulatory legal acts regulating fire safety issues.
2. If an international treaty of Turkmenistan establishes rules other than those provided for in this Act, the rules of the international treaty.

Article 3. The system of fire safety and its main responsibilities

1. fire safety system - a set of forces and resources, and measures of legal, organizational, economic, social, scientific and technical nature, aimed at preventing and extinguishing fires.
2. The main duties of fire safety systems are:
1) legal regulation and the implementation of government measures in the field of fire safety;
2) Development and implementation of fire safety measures;
3) the realization of the rights, duties and determine the degree of responsibility in the field of fire safety;
4) A fire propagation and education of the population in fire safety measures;
5) facilitating the activities of volunteer fire company, volunteer fire units and the attraction of the population to ensure fire safety;
6) scientific and technical support for fire safety;
7) information support of fire safety systems;
8) implementation of state fire control, and other control functions for fire safety;
9) performance of works and rendering of services in the field of fire safety services;
10) licensing of works (services) in the field of fire safety and certification of products and fire safety services in accordance with the law;
11) fire insurance and the implementation of other measures of social and economic incentives to ensure fire safety in accordance with the law;
12) fire-fighting and urgent rescue operations related to firefighting;
13) accounting of fires and their consequences.

CHAPTER II. FIRE SAFETY

Article 4. Service conducting fire safety, and their main task


1. In Turkmenistan, fire safety is carried out following fire service:
1) Public service of fire safety;
2) departmental fire protection;
3) voluntary fire protection.
2. The main task of fire fighting services in the field of fire safety is the organization of the prevention and suppression of fires.

Article 5. The State Service of fire safety

1. State fire safety service is the primary fire services, part of the system of the Ministry of Internal Affairs.
2. State Fire Safety Service:
1) organizes the development of normative legal acts and the implementation of government measures in the field of fire safety;
2) organizes and carries out the unified state supervision in the field of fire safety;
3) Organizes and implements fire protection of settlements, economic and other facilities of enterprises, institutions and organizations, as well as other services and activities in the field of fire safety;
4) provides and carries out fire-fighting;
5) provides financial and logistical support of the government departments and the State Service for fire safety;
6) develop and organize the implementation of a unified scientific-technical policy in the field of fire safety;
7) supervises and coordinates the activities of other kinds of fire fighting services;
8) organizes and carries out activities to improve the level of work in sections of fire-applied sport in the fire service units;
9) provides training, retraining and advanced training for their units and other fire-fighting services;
10) provides for a fee in accordance with the law work for the examination of design and estimate documentation for construction and urban development, reconstruction and technical re-equipping of buildings and facilities;
11) carries on a fee basis of work on the test in order to fire safety of substances, materials, products, equipment and buildings;
12) participates in international conferences and exhibitions on fire safety; and other tasks as may be assigned
13) in accordance with the law on the State Service of fire safety. 3
. Control and coordination of fire safety in the operation of air, sea, river and rail vehicles, and floating marine and river resources and facilities made divisions of the State fire service.
4. The structure of the State Fire Security Service includes:

Fire Department of the Ministry of Internal Affairs of Turkmenistan, the fire departments of provinces and cities with the rights of velayat, fire safety units, departments and fire safety inspection by etrap, cities with the rights of etrap, militarized part of fire safety, sea and river of the special fire security, fire safety education and fire safety of the enterprise of the Ministry of internal Affairs.
Office management bodies of the State Fire Safety Service are:
1) Testing Center of fire safety;
2) training center for training and retraining of personnel of the State Service for fire safety;
3) fire-technical centers of excellence and the promotion of fire safety of fire-technical knowledge, organized in regional centers in the cities with the rights of velayat and other cities;
4) territorial subdivisions created in order to organize the fire prevention and extinguishing in settlements;
5) objects does division by the organization in order to prevent fires and extinguish them at the enterprises;
6) specialized units created in order to extinguish large fires, fires of oil and gas fountains;
7) Enterprise Fire Department, created in accordance with the legislation of Turkmenistan, in order to fulfill the tasks entrusted to the State Service of fire safety.
5. State fire safety service runs fire safety management, which is a structural subdivision of the Ministry of Internal Affairs of Turkmenistan.
6. In order to prepare specialists for the State Fire Security Service within the Ministry of Internal Affairs created educational fire safety facilities.
7. The procedure for the organization of the management bodies and divisions of the State fire service is determined by the Regulation on the State Service for Fire Safety of the Ministry of Internal Affairs of Turkmenistan, approved by the President of Turkmenistan.

Article 6. GosPozhNadzor

1. State fire control - a special kind of state supervisory activities carried out by officials of the management bodies and divisions of the State fire service in order to monitor compliance with the requirements of fire safety and suppression of their violations.

2. Head of Fire Safety Department is also the chief state inspector on fire supervision of Turkmenistan, his deputy is also the deputy chief state inspector on fire supervision of Turkmenistan. 3
. Heads of departments of fire safety of the Ministry of Internal Affairs of Turkmenistan and the state fire safety departments velayats and towns with the rights of velayat, fire squads are both senior state inspectors on the state fire supervision of Turkmenistan. Persons who are in the junior officers and supervisory roles of the State fire service, both are state inspectors on fire supervision.
4. Officials of the State fire service in the implementation of the state fire supervision are right:
1) Develop, negotiate and approve, independently or jointly with the executive authorities and local governments are required to fulfill regulations on fire safety;
2) implement the unified state fire supervision of compliance with fire safety requirements of the executive authorities and local authorities, enterprises, institutions and organizations, as well as officials and citizens;
3) submit to the executive authorities and local self-government proposals for the implementation of fire safety measures;
4) to conduct a survey and inspection areas, buildings, structures, premises of enterprises, institutions and organizations, and other objects at any time in order to monitor compliance with the requirements of fire safety and suppression of their violations;
5) to carry out fire-technical survey of apartments, private homes and other premises, land and summer houses, garages and other outbuildings;
6) to participate with the right to vote in the proceedings on siting (slopes) construction, as well as commissions on acceptance in operation of completed facilities construction (reconstruction);
7) to consider and agree to the terms of compliance with fire safety requirements of urban planning and design and estimate documentation of the owner and the customer for the construction, repair, reconstruction, expansion and technical re-equipment of enterprises, buildings, structures and other objects in the cases justified deviations from the applicable requirements fire safety, or in the absence of these requirements;

8) carried out in the organizations performing design and design and exploration work, spot checks with regard to compliance of the project and developed design and estimate documentation of fire safety requirements;
9) to give legal and natural persons binding orders to eliminate violations of fire safety requirements, fire safety works, goods and services;
10) to suspend in whole or in part the work of enterprises (individual productions), industrial sites, units, buildings, structures, premises, carrying out certain types of work in identifying violations of fire safety requirements, posing a threat of fire and safety, as well as case of default of these requirements during design, construction, major repairs, reconstruction, expansion, technical re-equipment of enterprises, institutions and organizations, buildings and other facilities;
11) to carry out fire-technical examination, fire-technical tests and research work;
12) produced in accordance with the legislation of Turkmenistan inquiry in cases involving fires and breaches of fire safety requirements;
13) to cause the management bodies and subdivisions of the State fire service officials and citizens on the pending cases and materials on the fire, to receive from them the necessary explanations, information, documents and copies thereof;
14) to impose in accordance with the law administrative penalty on citizens and officials, including the manufacturers (performers, sellers), for violation of fire safety requirements or untimely performance or evading execution of orders and regulations of officials of the State Service of fire safety;
15) in order to ensure fire safety during the holidays, sports, cultural and other events in the country to carry out fire-technical on-site inspections of these activities and to make provisions for the measures necessary for the implementation;
16) carried out in the order defined by the legislation of Turkmenistan, inspection and supervision of the implementation of fire safety requirements in the exploration, production of hydrocarbon resources and perform other types of petroleum operations in the territory of Turkmenistan.

5. Officials subdivisions of the State fire service in the implementation of state fire control at the facilities owned by foreign natural and legal persons or organizations with foreign investment shall enjoy the rights set out in this Article.
6. Fire-technical surveys of premises of diplomatic missions, consular offices and international organizations located in Turkmenistan living quarters of their employees who are not Turkmen citizenship, as well as new construction sites (buildings, facilities) foreign construction companies, enjoying the right of extraterritoriality may be conducted by officers officials of the State fire service units only on the basis of a written official request of these institutions and organizations in the Ministry of foreign Affairs of Turkmenistan, as well as in the presence of their representatives and representatives of the Ministry of foreign Affairs of Turkmenistan.
7. The relevant service of the Ministry of National Security, the Ministry of Defence of Turkmenistan and the State Border Service of Turkmenistan in accordance with their competence to carry out fire control within their organizations and facilities.
8. Fire safety inspection in forest, mountain, steppe and grassland areas, as well as in underground facilities and blasting operations carried out by state bodies authorized by the Cabinet of Ministers of Turkmenistan.

Article 7. The personnel of the State fire service

1. Citizens of Turkmenistan received the service in the State Fire Safety Service, which are assigned in accordance with established procedure special titles, are employees of the State Fire Security Service. The employees of the State fire service are civil servants or employees.
2. The employees of the State fire service serve in accordance with the Regulation on the service in the internal affairs of Turkmenistan and other normative legal acts of Turkmenistan.
For civil servants and employees of the State fire service subject to the rights, duties and privileges established by the Law of Turkmenistan "On the organs of Internal Affairs of Turkmenistan," the Turkmen labor laws and other normative legal acts of Turkmenistan.

Article 8. Guarantees of the legal and social protection of the personnel of the State fire service

1. The personnel of the State Service for fire safety and their family members are protected by the state. The personnel of the State fire service are guaranteed the legal, social protection and benefits established by the Law of Turkmenistan "On the organs of Internal Affairs" and other normative legal acts of Turkmenistan.
2. The employees of the State fire service and living together with their family members are provided with living quarters khyakimliks provinces, cities of districts (hereinafter - the local executive authorities) and gengesh, as well as enterprises, which created the State fire service units, in the manner and the grounds stipulated by the legislation of Turkmenistan. 3
. 4. The damage caused to the property of the employees of the State fire service in connection with the performance of his duties, shall be compensated in full for the expense of the State budget and funds of enterprises, which created the State fire service units.

5. Employees of the fire service that protects enterprises from fires with harmful and dangerous working conditions, provide legal, social security benefits and guarantees established by the legislation of Turkmenistan for employees of these enterprises. Compensation for these purposes expenses are due to the transfer of funds from the protected objects.
6. Additional payment to employees of the State Service of fire safety during the service to work in hazardous and dangerous working conditions (related to firefighting), established by the Cabinet of Ministers of Turkmenistan.

Article 9. The right to occupational risk

1. If the actions of fire service personnel related to fire extinguishing, there are signs of acts falling under administrative or criminal responsibility, its actions are not an offense if they were committed in the state of occupational risk.
2. Professional risk is recognized as valid in cases where the fire officer fire fighting has taken all possible measures to prevent the negative consequences and the legitimate objective could not be achieved by actions, not related to the risk, committed action, conjugate risk objectively stemmed from information about current events and actual circumstances, which he possessed. 3
. Citizens who risked their own lives the line of duty fire-fighting or carrying out rescue operations, in accordance with the established procedure, a one-time payment of their risk can be made at the expense of the Ministry of Internal Affairs of Turkmenistan.
4. Local executive authorities and local self-government within its authority may grant bonuses to employees and civil employees of fire services for the risk of fire fighting and rescue operations.


Article 10. Insurance
1. Employees and civilian employees of the State fire service, in accordance with applicable laws are subject to mandatory state personal insurance in case of death (death), wounds, bruises, burns, injuries, diseases of the period of service (charges) in the State Fire Security Service.

2. Payment of the sum insured employees and civil employees of the State fire service, reparations and payment of a lump sum in case of death (death) or injury during the performance of their duties, or before the expiration of one year following separation from service (charges) as a result of injury, concussion, burns, disease, obtained during the performance of official duties, shall be in accordance with the law. 3
. In determining the insured person a disability related to military service to them (charges), before the expiry of one year after dismissal from service, as well as in case of severe (lung) injuries is paid the sum insured in the amount established by the legislation of Turkmenistan.
4. Insurance is carried out at the expense of funds allocated from the centralized budget of Turkmenistan Ministry of Internal Affairs of Turkmenistan, as well as funds of enterprises, which created the State fire service units, in the amount established by the legislation of Turkmenistan.
5. At the departmental staff and volunteer fire departments, as well as other persons who directly participated in extinguishing a fire, subject to the guarantees of legal and social protection and privileges established by the legislation of Turkmenistan.

Article 11. The financial and logistical support to fire safety sphere

1. Financial support in the field of fire safety is planned and carried out by state bodies within their competence earmarked indicating separately in the respective budgets.
2. Financing of controls and fire departments of the State Security Service (except for units that are created on a contractual basis), fire-technical educational institutions and institutions of fire safety is carried out at the expense of the State budget. If necessary, in accordance with the law and may be involved in additional funds from other funding sources. 3
. The object division of the State Fire Safety Service by it on a contractual basis with companies are maintained at the expense of these enterprises, and, if necessary - and at the expense of additional funds from other funding sources.
4. Specialized units of the State Fire Safety Service by it on a contractual basis with companies are maintained at the expense of these enterprises.

5. Logistics Management of fire safety and fire units of the State Security Service by the Ministry of Internal Affairs. Logistical support departmental and voluntary fire brigade in organizations carried out at the place of their formation (the owners).

Article 12. Property of the State Fire Security Service

1. Movable and immovable property necessary for the performance of the tasks entrusted to the State Service of fire safety, determined in the manner prescribed by law.
2. Purpose of the property business, which created divisions of the State fire service, can not be changed by the owner of the property without the consent of the parent department of the State Service of fire safety and the relevant local executive authority. 3
. Enterprises, which created divisions of the State fire service, providing them with premises, buildings, facilities, service rooms, equipped with means of communication, fire truck, fire-technical equipment, and other necessary equipment in accordance with established standards.

Article 13. The departmental fire protection

1. Local executive authorities, enterprises and organizations to ensure that fire safety can create controls and departmental divisions of fire protection.
2. The order of organization, reorganization, liquidation of the management bodies and units of departmental fire protection conditions for the exercise of their activities of service personnel are determined by the relevant provisions, consistent with the State Fire Security Service. 3
. Controls and departmental divisions of fire protection if the need arises, can be attracted to extinguish another fire.
4. Financial and logistical support to government departments and departmental fire protection is carried out at the expense of enterprises, institutions and organizations in which they are created.

Article 14. Voluntary fire protection

1. Voluntary Fire Brigade - a form of citizens' participation in the organization of fire prevention and extinguishing in the localities and enterprises.
2. Voluntary fire - the citizen directly involved on a voluntary basis (without entering into an employment contract) in the activities of fire protection units for the prevention and suppression of fires.

. The establishment, reorganization, liquidation and registration of voluntary fire units and create units (brigades, teams), a voluntary fire brigade established by the State Fire Safety and field offices service.
4. Financial and logistical support units (brigades, teams) voluntary fire protection is carried out at the expense of enterprises, institutions and organizations, which established these units (squads, teams), as well as other sources of funding.

Article 15. Fire-technical Commission

1. To ensure reliable protection of objects from the fires in the ministries, departments, enterprises, institutions and organizations created fire-technical Commission.
2. The purpose, tasks, rights and duties of fire-technical committees determined by the Regulation on fire-technical committees, approved by the Cabinet of Ministers of Turkmenistan.

CHAPTER III. POWERS OF EXECUTIVE AUTHORITIES, LOCAL GOVERNMENT, AND OTHER BODIES OF

FIRE SAFETY
Article 16. Powers of the Cabinet of Ministers of Turkmenistan in the sphere of fire safety

The Cabinet of Ministers in the field of fire safety Turkmenistan:
1) develop the main directions of a uniform state policy, strategic and tactical measures for its implementation;
2) develop national programs and submit them to the President of Turkmenistan for approval;
3) organize and supervise the execution of this Act and acts of the President of Turkmenistan in the field of fire safety;
4) provides as part of the state budget of Turkmenistan for financing activities in the field of fire safety plans and supervises the execution of the State budget in terms of fire safety costs;
5) establishes the list of divisions of fire services for fire safety of settlements, maintained at the expense of the state budget of Turkmenistan, as well as industries, businesses, institutions, organizations, and facilities where the expense of own funds on a mandatory basis is created Fire Service;
6) approve the nomenclature, the volume of manufacture and supply of fire-technical products for state needs;
7) organizes the development and approve the national standards, norms of fire safety rules and other regulations on fire safety and supervise their implementation;

8) provides the creation, reorganization and liquidation of authorities, fire departments of the State Security Service, the structural units, fire-technical, scientific-research institutions and educational institutions of fire safety, maintained at the expense of the state budget of Turkmenistan, as well as the expense of others funds allocated in accordance with the legislation of Turkmenistan;
9) establishes the general principles of fire safety, its social and economic incentives, including part of the production and procurement of fire-technical products, as well as public participation in the fight against fires;
10) organizes the development of science and technology, the coordination of basic research and development in the field of fire safety;
11) establishes the general principles of licensing and certification in the field of fire safety;
12) organize the creation of the state of information management systems as well as systems of statistical registration of fires and their consequences;
13) establishes the general principles of organization of fire service and civil defense mobilization tasks governments and departments of the State Service of fire safety;
14) organizes the training, retraining and advanced training of personnel for the departments of the State Service of fire safety;
15) submits for approval to the President of Turkmenistan proposals of the Ministry of Internal Affairs on the establishment of insignia and uniforms of fire services;
16) carry out international cooperation and governs the activities of foreign organizations and individuals to prevent and extinguish fires on the territory of Turkmenistan.

Article 17. Powers and duties of local authorities in the field of fire safety

1. Local executive authorities in the field of fire safety:
1) regularly analyze the state of fire safety, take decisions on these issues, develop plans and implement measures to ensure fire safety in the relevant territory;
2) make proposals for financing units of the State fire service, they create the necessary material and technical base;
3) set in the case of increasing the fire danger in the respective territories of fire-fighting mode, and additional fire safety requirements agreed with the State Fire Safety Service;

4) contribute to the establishment and operation of enterprises and organizations, specializing in the implementation of fire works and services, the manufacture of fire-fighting equipment;
5) verify and conduct inspections of fire state of settlements, the housing sector and related areas, attracting businesses, institutions and organizations in the implementation of measures to ensure fire safety;
6) create the Commission for the fire protection and environmental measures to enhance fire safety and extinguishing fires in the forest, mountain, steppe and grassland areas and organize their work;
7) organize the work of public fire inspectors from among the citizens for the fire safety of residential settlements sector;
8) organize training of population in fire safety measures and take action for the active participation of citizens in ensuring fire safety;
9) are attracted to the order established by the legislation of Turkmenistan, population, labor groups and military units to take part in fighting fires, creating freelance firefighters formation (team squads, computing, freelance groups fire inspectors, educational centers, youth clubs fire), conduct inspections of their work (with the exception of military units);
10) provide the organization of fire safety departments in accordance with established standards of equipment communications facilities, buildings, objects, office cabinets, fire truck, fire-technical inventory and other necessary equipment for fire fighting services;
11) organize voluntary fire form to ensure fire safety of settlements, economic and other facilities, provide them with responsibility for the successful implementation of them and other fire services in their tasks, logistics, for keeping them in constant combat readiness, for the content of in good condition entrusted to them equipment and supplies.
2. Local executive authorities are obliged:
1) organize the development and ensure the implementation of fire safety measures in the subordinate organizations and in their respective territories;
2) to provide the necessary assistance to units of fire services in the performance of their tasks;
3) involve all the forces and means to extinguish any fires;
4) to organize the establishment of volunteer fire fighting groups to prevent and fight fires in settlements;
5) to create conditions for attracting people to the prevention and extinguishing of fires;

6) organize the development with the relevant units of the ministries and departments, local authorities joint plans for fire protection and environmental measures to enhance fire safety and extinguishing fires in the forest, mountain, steppe and grazing areas;
7) arrange for fire fighting propaganda and training of population in fire safety measures.

Article 18. Duties of local authorities in the field of fire safety

Local governments within their competence in their respective territories in the field of fire safety are required:
1) organize the development and ensure the implementation of fire safety measures;
2) create security equipment and fire extinguishing equipment items of fire protection;
3) discuss the state of fire safety and to take action accordingly;
4) to extinguish any fires involve all the forces and means;
5) organize the work in homes authorized public on fire safety;
6) to promote the activities of the fire service;
7) organize training of population in fire safety measures.

Article 19. Rights and duties of enterprises, institutions and in the field of fire safety organizations

1. Enterprises, institutions and organizations have the right:
1) to make proposals on the establishment, reorganization and liquidation in the prescribed manner the fire service units, which are maintained at the expense of their own funds, on the basis of contracts concluded with the Fire Safety Department of the Ministry of Internal Affairs;
2) submit to state authorities proposals for fire safety;
3) to carry out work on the causes and circumstances of fires that have occurred in their territories;
4) establish measures of social and economic incentives to ensure fire safety at the expense of own funds at their disposal;
5) to receive in the prescribed manner information on fire safety, including the governing bodies and departments of the State Fire Security Service.
2. Enterprises, institutions and organizations are obliged to:
1) to comply with fire safety requirements, and comply with the instructions, regulations and other legal requirements of officers subdivisions of the State Service of fire safety;
2) Develop and implement fire safety measures;
3) to fire propagation, as well as to train their employees in fire safety measures;

4) at the conclusion of the contract (agreement), to include the fire safety issues;
5) keep in good repair the system and means of fire protection, fire equipment and fire-technical equipment, as well as the primary means of extinguishing fires, prevent their misuse;
6) establish and maintain in accordance with the Fire Service units regulations, including on the basis of contracts with the Fire Safety Department;
7) to assist the fire service units in extinguishing fires, establishing the causes and conditions of their emergence and development as well as to identify those responsible for violation of fire safety requirements and occurrence of fire;
8) submit to the established procedure when extinguishing fires on the territories of institutions necessary forces and means, fuels and lubricants, as well as food and recreational facilities for the products of staff of divisions of fire services involved in the execution of combat operations to extinguish the fires, and forces , attracted to extinguish fires;
9) provide officials of the State fire service in the exercise of their duties access to the territory, buildings, structures and other objects of the organizations;
10) provide at the request of officials of the State fire service, information and documents on the state of fire safety in the organizations, including the fire danger of their products, as well as occurring on their territories fires and their consequences;
11) immediately inform the fire service department of any fires, failures of existing systems and fire protection, to change the state of the roads and driveways;
12) to promote the activities of voluntary fire-fighting services.

CHAPTER IV. FIRE SAFETY

Article 20. Normative legal regulation in the field of fire safety

1. Normative legal fire safety regulation is the adoption by public authorities of regulations on fire safety.
2. Guideline for fire safety regulation - is the establishment of the authorized state bodies in the regulations binding requirements of fire safety. 3
. Normative documents on fire safety related standards, norms and fire safety rules, regulations and other documents containing the requirements of fire safety.

4. Normative documents on standardization, which are accepted by the authorized state bodies for standardization and install or have installed fire safety requirements must be coordinated with the Ministry of Internal Affairs.
5. The procedure for the development, introduction and application of other regulatory documents on fire safety established by the Ministry of Internal Affairs in consultation with the National Centre of Trade Unions of Turkmenistan, as well as the relevant ministries and agencies.
6. Procedure for harmonization of departures from fire safety requirements, as well as additional fire safety requirements are not regulated by the normative legal acts, established by the Ministry of Internal Affairs.

Article 21. Development and implementation of fire safety measures

1. fire safety measures are developed in accordance with this Law, other normative legal acts of Turkmenistan and normative documents on fire safety, as well as on the experience of fire fighting, evaluation of fire hazard substances, materials, products, equipment, engineering works, structures, buildings and facilities .
2. Producers of (suppliers) substances, materials, products and equipment without fail indicate in the technical documentation of fire danger indices of these substances, materials, products and equipment as well as fire safety measures when handling them. 3
. In the development and implementation of fire safety measures for enterprises, buildings and other facilities, including in their design, should be required to provide for solutions to ensure the evacuation of people in fires.
4. In accordance with the list of critical, explosive objects in mandatory developed plans extinguishing fires, designed to ensure the safety of people.

Article 22. Fire fighting

1. The procedure for the organization of fire extinguishing fire safety garrisons established by the State Fire Safety Service.
2. Procedure for attraction of resources for fire suppression determined by the State Fire Safety Service and approved khyakims provinces, of districts, cities and archyn gengeshes.
3
. Fire may develop into an emergency if the forces and means of fire services, as well as essential services deployed in a certain area is not enough to eliminate it. At the same time the forces and means of fire services of other areas may be involved for liquidation of emergency situations and their consequences in the manner prescribed by the legislation of Turkmenistan.
4. In the forest, mountains, steppe and grassland areas of the organization of fire extinguishing by the Commission for the fire protection and environmental activities of local executive body established to enhance the fire safety and fire-fighting, with the participation of the authorized state body in the field of nature protection.
5. Check units of fire services to put out fires, and their elimination is carried out unconditionally.
Fire fighting units of the fire service is free of charge, unless otherwise stipulated by the legislation of Turkmenistan.
6. To call the fire service units in the telephone network of settlements set a single number - "01".
7. When extinguishing fires carried out the necessary actions to ensure the safety of people, the rescue of property and assets, including:
1) unhindered access to the distribution space (the possible spread) of fire and dangerous manifestations, including all residential, public, industrial and other facilities where people may be in need of assistance;
2) creation of conditions preventing the development of fires and ensure their elimination, including an autopsy, disassembling and cracking walling, manufacturing dismantling and demolition of buildings, opening closed doors and windows for inspection and fire, in order to avoid the development of the fire, and as the implementation of other activities related to the implementation of these works;
3) Use free of charge of communications, transport and equipment, regardless of their affiliation, except for diplomatic missions, consular offices, other official representative offices of foreign states and international organizations;

4) exercise of the right to demand from enterprises, institutions and organizations engaging in their possession logistics, lubricants and people (employees) to extinguish fires, as well as the submission of information necessary for the effective conduct of rescue operations; and to extinguish fires long and protracted, lasting more than four hours, - provide members of fire extinguishing Food and rooms for relaxation, heated at a low temperature and protect from heat stroke;
5) limit or deny access to the site of the fire, as well as to restrict or prohibit the movement of vehicles and pedestrians on adjacent territories and Bind them off place;
6) organized evacuation from the field of fire of people, property and assets.
8. The direct management of the fire extinguishing performed by the Head extinguish a fire - who arrived at the scene of the fire by a senior official of the State Fire Safety Service (unless otherwise specified), which operates on the principles of unity of command personnel of the State fire service, participating in the implementation of the fighting fire fighting, as well as forces involved to extinguish the fire.

10. If necessary, the head of the fire extinguishing takes other decisions, including restricting the rights of officials and citizens in the said territory.
11. Notes extinguishing head binding on all officials and citizens on the territory where the acts to extinguish the fire. No one except the authorized officials of the fire service, is not entitled to interfere with the actions of the head of fire extinguishing or cancel his order to extinguish the fire.
12. The material damage caused when extinguishing fires shall be compensated in accordance with the legislation of Turkmenistan. The personnel of the State Service for fire safety and other participants in fire fighting, operating in conditions of extreme need and occupational risk, are exempt from the compensation of the damage.

13. Employees, civil employees of fire services and other citizens can be presented to the state awards in the following cases:
1) for the courage, bravery and dedication shown during firefighting, rescue of people, the national spiritual and cultural heritage of the Turkmen people and property from fire ;
2) for his able leadership the work of fighting the fire service to extinguish fires and rescue people;
3) for bravery, courage and perseverance shown in the prevention of fires and explosions;
4) in other cases stipulated by the legislation of Turkmenistan.

Article 23. Production of fire-technical products

1. Fire-technical products are produced on the basis of state order and in the order of business. Production of fire-technical products governed by the laws of Turkmenistan.
2. The organization works to implement the government order is carried out in accordance with the legislation of Turkmenistan.

Article 24. Execution of works and provision of services in the field of fire safety services

In the field of fire safety works and services carried out and are in order to implement the requirements of fire safety, as well as to ensure the prevention and suppression of fires. To work in the field of fire safety services include:
1) Protection against fires settlements, enterprises and other projects on a contractual basis;
2) production, testing, procurement and supply of fire-technical products;
3) design and survey work;
4) carrying out scientific and technical advice and expertise;
5) the test substances, materials, products, equipment and structures for fire safety;
6) training of population in fire safety measures;
7) A fire propaganda, publication of specialized literature and promotional products;
8) flame retardants and tube-furnace operation;
9) installation, maintenance and repair of systems and fire protection;
10) Repair and maintenance of fire-fighting equipment, fire fighting primary means, quality of restoration of fire-extinguishing equipment;
11) construction, reconstruction, repair of buildings, structures, premises fire services and fire water reservoirs;
12) other works and services, to ensure fire safety, listed by the governing bodies of the State Fire Security Service.

Article 25. Fire propaganda and training in fire safety measures


1. Fire propaganda - targeted to inform the public about the problems and how to ensure fire safety, carried out through the media, through the publication and dissemination of literature and promotional products, thematic exhibitions, parades, conferences and other forms of public information provided by the legislation of Turkmenistan.
2. FIRE propaganda carried out the bodies of state power, local self-government units of the fire service and others. 3
. Training in fire safety measures implemented by employers.
4. Compulsory training of children in preschool educational institutions and persons enrolled in educational institutions, fire safety measures by the relevant institutions, special programs agreed upon with the Ministry of Internal Affairs.
5. Educational authorities and divisions of the State fire service can create squads of young firemen on the basis of provisions of the squads of young firefighters. Requirements for the content of programs and organization of training these people fire safety measures determined by the State Fire Security Service.
6. Fire Safety Education of the population of Turkmenistan is held in fire-technical centers of advanced fire safety experience, propaganda of fire and technical knowledge, as well as businesses and other organizations.

Article 26. Information provision in the field of fire safety

1. Information provision in the field of fire safety is carried out through the creation and use of the system of fire safety special information systems and data banks (hereinafter - information system) needed to perform assigned tasks.
2. The grounds and procedure for entering into the information systems of the fire safety information, as well as the conditions and the procedure for reviewing them, officials and citizens shall be established by the legislation of Turkmenistan and regulations on fire safety documents. 3
. Meteorological Services and other authorized state bodies shall immediately and free of charge to inform the State Service for Fire Safety of adverse events and forecasts for fire safety.
4. The media are obliged to immediately publish and transmit the necessary information on fire safety.

5. Executive authorities and local self-government should inform the public about the decisions taken by them to ensure fire safety and to promote fire-technical knowledge.

Article 27. Accounting for fires and their consequences

1. Turkmenistan has a single state system of statistical registration of fires and their consequences.
2. The official statistical accounting and the state statistical reporting on fires and their consequences perform statistical authorities. 3
. Ministries, departments, enterprises, institutions and organizations regardless of ownership and departmental affiliation, including public associations are obliged to submit to the established order in the state statistics bodies complete and accurate information about the fires that have taken place in their divisions and on the respective territories.
4. Rules state accounting of fires, the procedure and deadlines for submission of information about fires and their consequences are approved by the Ministry of Internal Affairs in consultation with the State Committee for Statistics of Turkmenistan and other relevant ministries and agencies.
5. Generalized information about fires on the relevant administrative-territorial units, as well as sectors of the economy are sent to the Ministry of Internal Affairs of Turkmenistan for the development and organization of the implementation of measures to enhance fire safety in the territory of Turkmenistan.

Article 28. Fire insurance

1. Legal entities, which list approved by the Cabinet of Ministers of Turkmenistan, including foreign legal entities which carry out their activities in the territory of Turkmenistan are obliged to insure against fire, property and civil liability for the harm (damage) that may be caused to life, health and property of third persons as a result of fires.
2. Provisions on compulsory state insurance of property against fire and civil liability of legal persons for damage that may be caused to life, health and property of third parties as a result of fires, approved by the Cabinet of Ministers of Turkmenistan. 3
. Because of insurance payments made deductions to finance measures to prevent fires. The list of activities, royalties dimensions are specified in the order of formation and an expenditure of insurance resources on the mandatory state fire insurance of property and civil liability of legal persons for damage that may be caused to life, health and property of third parties as a result of fires, approved by the Cabinet of Ministers of Turkmenistan.


Article 29. Tax incentives in the field of fire safety

Governments and departments of the State Fire Security Service in the exercise of its functions under the legislation of Turkmenistan, tax benefits are set by the tax legislation of Turkmenistan.
Article 30. Licensing


1. Activities in the field of fire safety, subject to licensing, the licensing procedure established in accordance with the Law of Turkmenistan "On licensing of certain activities" and other normative legal acts of Turkmenistan.
2. Implementation of individuals and legal entities activity in the field of fire safety without a license or in violation of the license conditions and entails responsibility in accordance with the law. 3
. Activities in the field of fire safety is carried out on the basis of licenses issued by the Ministry of Internal Affairs.
4. Compliance with fire safety requirements is mandatory for all licensed activities.


Article 31 Certification
1. Certification in the field of fire safety is carried out in accordance with the law.
2. fire safety certificate is an integral part of the certificate of conformity. 3
. The list of products in the field of fire safety, subject to mandatory certification is determined by the Cabinet of Ministers of Turkmenistan.
4. The procedure for organizing and conducting certification in the field of fire safety is determined by the Ministry of Internal Affairs in coordination with the Main State Service "Turkmenstandartlary".
5. Payment for certification is made by the manufacturer (seller, performer) products and services.

Article 32. Scientific and technical fire safety

1. Scientific and technical fire safety is carried out research, development, design, engineering and other scientific and technical organizations, as well as relevant institutions.
2. Funding for scientific and technical developments in the field of fire safety is carried out at the expense of the state budget of Turkmenistan, the budgets of local governments, as well as through other sources of funding. 3
. Research and development for the implementation of the State fire service tasks are performed at the expense of the State budget.

4. The executive authorities, enterprises in creating new technologies and products will organize the necessary scientific and technological developments in order to ensure the legitimate interests of the individual, society and state in the field of fire safety.

CHAPTER V. RIGHTS AND DUTIES OF CITIZENS AND RESPONSIBILITIES IN THE FIELD OF FIRE SAFETY

Article 33. The rights and duties of citizens in the field of fire safety

1. Citizens have the right to:
1) the protection of life, health and property in case of fire;
2) compensation for damage caused by fire, in accordance with the legislation of Turkmenistan;
3) I participate in establishing the cause of the fire, who inflicted damage to their health and property;
4) providing fire safety information, including the established procedure, by the management bodies and units of the State Service for fire safety;
5) participate in fire safety, including in the prescribed manner, in the work of the voluntary fire brigade.
2. Citizens must:
1) to comply with fire safety requirements;
2) be on the premises and buildings under their ownership (use), the primary means of fire extinguishing and fire fighting equipment in accordance with the fire safety rules and lists, approved by the relevant authorities;
3) detection of fires immediately notify their fire service;
4) before the arrival of the fire service units to take active measures to rescue people, material assets, property and extinguishing fires;
5) to assist the fire service units in fire fighting;
6) in the case of protracted and prolonged fires in forest, mountain, steppe and grassland areas to take an active part in their extinguishing;
7) carry out the instructions, regulations and other legal requirements of officers of the State service of fire safety;
8) to provide in accordance with the legislation of Turkmenistan, the possibility of officials of the State fire service to carry out inspection and testing of production belonging to them, business, residential and other buildings and structures in order to monitor compliance with the requirements of fire safety and suppression of their violations.

Article 34. Responsibility for violation of fire safety requirements

1. Responsibility for violation of fire safety requirements in accordance with the law are:
1) the owners of the property;
2) persons authorized to possess, use or dispose of property, including the heads of legal entities;

3) persons designated in the prescribed manner responsible for fire safety;
4) officials within their competence.
2. Responsibility for violation of fire safety requirements for the apartments (rooms) in the houses of the residential sector is assigned to the responsible tenant or tenants, unless otherwise provided for by the relevant agreement. 3
. The persons referred to in the first part of this article, other citizens for violations of fire safety requirements shall be liable in accordance with the law.
4. Legal and physical persons guilty of violation of fire safety requirements, must compensate the damage caused in the amount and procedure established by the legislation of Turkmenistan.

CHAPTER VI. FINAL PROVISIONS

Article 35. International cooperation in the field of fire safety

Turkmenistan fully supports efforts of the world community to ensure fire safety, develops and maintains cooperation with other states in the international fire safety system.

Article 36. Supervision of the execution of this Act

Supervision over the implementation of this Law shall be the Attorney General of Turkmenistan and his subordinate prosecutors.

Article 37. Responsibility for violation of this Act

Violation of this law entails responsibility established by the legislation of Turkmenistan.

Article 38. Entry into force of this Act

This Law shall enter into force on the day of its official publication.
