On introducing changes and additions into certain legislative acts of Turkmenistan



 

I. to make changes and additions in the following legislative acts of Turkmenistan: 1. paragraph 3 of article 6 of the Turkmenistan law "about licensing separate kinds of activity" adopted June 25, 2008 year (statements of the Mejlis of Turkmenistan, 2008 г., no. 2, p. 34; 2009 г., no. 2, p. 33; 2010 г., no. 2, p. 34; 2011, no. 3, art. 62; 2012 g., no. 1, art. 11, no. 3 Article 85; 2013, no. 2, art. 28; 2014 g., no. 1, art. 49, no. 4, art. 148; 2015, no. 3, art. 107, no. 4, art. 145), shall be amended as follows: «3) approves the regulation on licensing of separate types of activity (hereinafter referred to as the licensing provisions) on the list established under section 20 of this Act. In the provisions on licensing can be subject to limitations of individual activities. 
 
2. the code of administrative offences, Turkmenistan approved the law of Turkmenistan on August 29, 2013 year (statements of the Mejlis of Turkmenistan, 2013, no. 3, p. 52, no. 4, p. 76; 2014 g., no. 1, p. 45, no. 2, article 79, no. 4, p. 162; 2015, no. 1, p. 10, no. 3, p. 104, no. 4, arts. 124 and 143; 2016 g. No. 1, art. 6): after article 173 complement clause to read as follows: article 1731. Violation of the rules of sowing or cultivation of plants containing nicotine or other substances harmful to human health 1. Sowing or cultivation of annual and perennial plants containing nicotine and other substances harmful to human health, in violation of the rules established by the legislation of Turkmenistan if it is committed with the aim of obtaining raw materials (raw tobacco) for tobacco production, attracts a fine of two to five sizes of the base unit with the confiscation of these plants or not. 
2. Repeated committing the offences provided for in paragraph 1 of this article within one year after the application of measures of administrative penalty-attracts a fine of five to ten sizes of the base unit with the confiscation of these plants or without cause or administrative detention for up to 10 days. "; 
in the first part of article 451 "172-173" with numbers "172-1731.
 
3. the law of Turkmenistan "on protection of health of citizens from exposure to tobacco smoke and the effects of the consumption of tobacco products, adopted December 18, 2013 year (statements of the Mejlis of Turkmenistan, 2013, no. 4, p. 90; 2015, no. 1, p. 34): article 9, paragraphs 2, 3, 5 and 8 shall be amended as follows:" 2) protects the health of citizens from exposure to tobacco smoke and the effects of tobacco consumption; 
3) carries out activities in the sphere of prevention of consumption of tobacco products in accordance with the legislation of Turkmenistan "; 
«5) develops, approves (adopts), cancels the normative legal acts in the field of health protection of citizens from exposure to tobacco smoke and the effects of tobacco use, amend ";" 8) monitor and evaluate the effectiveness of the implementation of measures aimed at prevention of exposure to tobacco smoke, as well as information on the results of monitoring "; 
After paragraph 8 shall be amended with paragraph reading: "81) operates in conjunction with the competent authority in the field of certification certification of tobacco product in accordance with the procedure established by the legislation of Turkmenistan"; 
paragraph 3 of article 11 shall be amended as follows: «3) principal State service "Türkmenstandartlary" together with the authorized body-part holding tobacco certification on conformity to requirements of normative documents; " 
first part of article 14 shall be amended as follows: "1. The importation of tobacco products is carried out by persons with appropriate license issued in accordance with the legislation of Turkmenistan, with the exception of the fourth part of the present article. 
II. The present law shall enter into force on the day of its official publication.
