On the basis of the provisions of the Constitution

as adopted by the People ' s Assembly at its meeting held on 1/3/1438 H, adopted on 1 December 2016 M

Issue:

Article 1

Amend article No. /38 of Act No. /26/2007 regulating vegetation quarantine as follows:

a. Any person who distributes, possesses, sells, offers to sell, transports or distributes any plant or plant products, pests, breeds, breeds or other items imported or retained in contravention of the provisions of this Act shall be liable to a fine of 250,000 LS.

b. Any person who obstructs or threatens the work of the plant protection technician during the exercise of his or her functions under the provisions of this Act shall be liable to a fine of 50,000 LL.L.50/L.S. 50,000.

(c) Anyone who assaults any technician in the exercise of his or her duties under this Act shall be liable to a penalty of three months to six months ' imprisonment and a fine of 50,000 Syrian pounds.

d. Any person who has not reported plants, plant products, items subject to regulations and imported useful organisms shall be liable to a fine of 300,000 Syrian pounds/L.C.s at entry points of the Syrian Arab Republic.

e. Any person who has given false information to obtain documents under the provisions of this Act shall be liable to a penalty of six months to one year ' s imprisonment and a fine of 75/000 LL.S. 75,000.

f. Any person who has forged or destroyed any document issued under the provisions of this Act shall be liable to a penalty of six months to three years ' imprisonment and a fine of 150/000 LL.S. 100 thousand L Syrian pounds.

g. Any person who follows any research, examination or other action provided for in this Act or who violates the regulations, regulations, instructions and decisions of the Ministry in accordance with the provisions of this Act shall be liable to a fine of 100,000 / LL.S. 100 thousand.000.

Article 2

Amend article 40 of Act No. 26/2007 as follows:

a. The Ministry may reconcile the offences set forth in article 38(a)(d)(g) of this Act if the offender pays 80% of the fine set forth in article 38(a) of this Act prior to the transfer to the court, and if the offender makes the same reconciliation after the assignment to the court, the offender must pay the full amount of the fine.

b. The fine payable under the terms of paragraph (a) above shall be paid to the State Treasury Fund on the basis of a book issued by the Ministry at the request of the offender or his legal agent.

c. The legal proceedings against the offender in the event of reconciliation shall be discontinued.

d. The fines prescribed under the provisions of this Act amount to civil compensation.
