Based on the provisions of the Constitution
Issue:
Article 1.
The following expressions in the application of this Act are as follows:
1. Institute: Higher Institute of Business Management.
Minister: Minister of Higher Education.
3. Board of the Institute: Board of the Higher Institute of Business Administration.
4. Dean: Dean of the Higher Institute of Business Management.
University Regulation Act: Organization of University Act No. 01 of 1975 And his amendments.
EXECUTIVE REGULATION OF THE ORGANIZATION OF THE STUDIES ISSUED BY Decree No. 2059/1982 and its amendments.
Article 2.
In the Syrian Arab Republic, a scientific public body called the Higher Institute of Business Administration has legal personality and financial and administrative independence based in Damascus and linked to the Minister of Higher Education.
Article 3.
The Institute aims to contribute to the development of human resources and the rehabilitation of students and graduates from various disciplines in the areas of business management science at different levels and in all public, joint and private sectors.
Article 4.
In accordance with the provisions of its rules of procedure, the Higher Institute shall be granted the following scientific degrees:
a. 1. Preparatory certificate in the Administration.
2. Degree in management sciences.
3. Master in management sciences.
4. PhD in management sciences.
b. 1. Degree of qualification and specialization in business management.
2. Master in business management.
Article 5.
The Institute shall have a separate budget issued by a decision of the Minister on the proposal of the Board of the Institute, in agreement with the Minister of Finance, in which it enters into full income and expenditure, takes into account the balance between income and expenditure and constitutes an independent accounting unit.
Article 6.
The Institute ' s income consists of the following sources:
1. The tuition fees charged by the Institute by students affiliated with it and non-public interns in the State.
2. Income from the activities of the Institute.
3. Grants, subsidies, donations and guardianships accepted by the Board of the Institute in accordance with the laws and regulations in force.
4. Savings from the previous fiscal year budget.
5. The subvention in the general budget of the State shall take into account the services provided by the Institute to public bodies and employees.
6. Any other income permitted by the laws and regulations in force.
Article 7.
The Institute is administered by the Board and the Dean of the Institute.
Article 8.
a. The Board of the Institute shall be composed as follows:
b. The Board may draw upon its own experts in the administration and the economy.
c. The Board of the Institute shall meet at least once a month and the secretariat of the Institute shall act with the Secretary of the Institute.
Article 9.
The Board of the Institute shall exercise all the functions of the Council of the University, as provided for in the Law on the Organization of Universities and its implementing regulations, and shall carry out all acts leading to the purpose of establishing the Institute in a manner not inconsistent with the provisions of the laws and regulations in force. In particular:
a. Proposal of the internal regulations of the Institute.
b. Project budget proposal for the Institute.
c. Approval of the use and contracting of Syrian, Arab and foreign experts.
d. On behalf of the Institute, procuracy, reconciliation, arbitration and waiver of proceedings.
Article 10.
a. The Institute shall have a Scientific and Medical Council.
b. The Board of Scientific Affairs of Students shall consist of:

3. A representative of the Teachers ' Union designated by the Executive Office of the Trade Union among the teaching staff of the Institute | Member |
4. Representative of students of the Institute, designated by the Administrative Office of the National Union of Syrian Students | Member |
The Board is responsible for all the functions of the Student Affairs Board provided for in the University Regulation Act and its implementing regulations.
Article 11.
a. The Dean of the Institute shall be appointed by decree for a period of three years specifying his salary and compensation.
b. In the event that the Dean of the Institute is a member of the teaching staff of universities, he retains his or her original employment and legal promotions, as well as full-time compensation.
c. The Dean of the Institute shall be a maintenance contractor and a commissioner of the Institute and shall exercise the terms of reference given to the head of the University and the Dean of the College provided for in the Law on the Organization of Universities and its implementing regulations.
d. The Dean of the Institute is a member of the Higher Education Council.
Article 12.
a. The Institute shall have an agent assisted by the Dean of the Institute in the management of the Institute.
b. The Under-Secretary of the Institute and the heads of the scientific departments of the Institute shall be appointed from among the members of the teaching staff of the Institute, universities or higher institutes by a decision of the Minister for a period of two years on the proposal of the Dean to determine their compensation and the staff member shall retain his or her original employment and legal promotion, as well as full-time compensation.
Article 13.
The Higher Education Council shall equate the scientific qualifications required for appointment to the teaching staff of the Institute.
Article 14.
The Secretary of the Institute shall be appointed by a decision of the Minister on the proposal of the Dean of the Institute and shall exercise the terms of reference of the Secretary of the University and its Assistant Secretary as provided for in the Law on the Organization of Universities and its implementing regulations and shall grant representation compensation to the Secretary of the University.
Article 15.
The Institute meets tuition fees from affiliated students and non-public interns in the State.
Article 16.
The rules of procedure of the Institute shall be issued by a decision of the Minister on the proposal of the Board of the Institute. In particular, these regulations shall govern:
1. Identify the scientific sections and how their councils are constituted.
2. Study plan and postgraduate system.
3. General provisions for examinations at the Institute.
4. Conditions and rules for the admission of Syrian, Arab and foreign students.
5. Conditions and rules for the transfer of students to and from the Institute.
6. System of special training and rehabilitation programmes and conditions of acceptance.
Article 17.
a. Syrians, Arabs or foreigners are entitled to education and training at the Institute with the competence to do so.
b. The wages, compensation, rights and obligations of such contractors shall be determined in accordance with the grounds specified in the Financial Regulations.
c. These contracts shall be ratified in accordance with the provisions of article 149/c. Basic Law of State Workers No. /1/ of 1985 And his amendments.
Article 18.
The Institute ' s employees, who are not members of the educational body, are governed by the Law on the Organization of Universities and the Organic Law on State Workers No. /1/ of 1985.
Article 19.

a. The Institute has concluded scientific cooperation agreements with universities, institutes and high schools other than Syria, which include the establishment of specialized degrees in business or management sciences at the diploma level, qualification, specialization, postgraduate or doctoral level.
b. The cooperation agreements referred to in paragraph (a) shall not be in force until they are approved by the Higher Education Council.
c. The scientific cooperation agreements referred to in paragraph (a) include provisions for the management of scientific degrees, the system of study, the conditions for admission, enrolment and the expenses of students attending school or training at the host university if necessary, the recruitment of foreign professors and the rights and obligations of the parties. The system for the scientific degree is promulgated by the Minister at the suggestion of the Board of the Institute.
d. Remuneration and compensation of foreign university professors shall not be subject to the maximum wage and compensation specified in the laws and regulations in force
e. This takes into account the balance between expenditures and revenues in each scientific agreement.

The Institute may use visiting professors for a period of not more than six months by a decision of the Minister on the proposal of the Board of the Institute to determine its compensation. |
Article 20.
The numerical staffing of the Institute shall be determined in accordance with the attached schedule.
Article 21.
The Institute ' s scientific personnel or operators are not subject to the maximum compensation limits provided for in the laws and regulations in force.
Article 22.
The financial regulations of the Institute shall be promulgated by a decision of the Minister, on the proposal of the Board of the Institute in agreement with the Minister of Finance. In particular, they shall include:
1. The tuition fees charged by the Institute by associate students, who are not public servants in the State.
2. Fees for training courses completed by trainees participating in these courses from non-State actors.
3. Remuneration of the Institute ' s advisory services to others.
4. Amounts to be met as a result of other activities of the Institute.
5. Identify the bases of wages, compensation and remuneration for all categories, contractors and visiting professors of the Institute.
Article 23.
In the absence of a special provision in this Act or in the internal regulations of the Institute, the Universities Organization Act, its implementing regulations and Legislative Decree No. 87/ of 1975 are applied to the Institute.
Article 24.
A. Eliminate Legislative Decree No. /4/ Date 18-9-1999 Decree No. 1283/No. 9.10-1979, establishing the Higher Institute for Administrative Development of the University of Damascus, is reinstated. The employees and students referred to in article 22 of Legislative Decree No. /4/ dated 18-9-1999 are transferred to the Higher Institute of Administrative Development of the University of Damascus.
b. Taking into account the provisions of former paragraph (a), the Institute replaces the Higher Institute of Administration with all its rights and obligations and transfers to it all fixed assets of the Institute ' s facilities, buildings, mechanisms and other returns, as well as remunerated and remunerated returns of the Institute ' s re-employed returns to the Institute for the same period and for the same period.
c. Provisions for the 2001 State budget for the Higher Institute of Administration, updated by Legislative Decree No. /4/1999, are transferred to the Institute by a decision of the Minister of Finance.
Article 25.
This law is published in the Official Gazette.
