Based on the provisions of the Constitution.

Issue:

Article (1)

a. The decision of the Prime Minister on the proposal of the Minister of Defence and the competent minister may be rescinded by a decision of the President of the Council of Ministers, based on article 74 (4) Legislative Decree No. 30 of 2007 Its amendments, if they enter the service of “mandatory or reserve” within thirty days of the date of the communication of the instrument containing termination of its services or if its recruitment status is settled under orders issued by the General Command of the Army and the Armed Forces.

b. A permanent worker shall be granted special leave without pay from the date of his or her entry into the compulsory science service until the date of separation.

c. The permanent or temporary worker shall be granted full pay leave from the date of his or her entry into the reserve science service until the date of separation.

d. The period of interruption between the date of separation of the employee and the date of his or her entry into the science service or the settlement of his or her conscription status shall be special leave without pay and such leave shall not be included in the calculation of the actual service and in his or her eligible advance for promotion or pension.

e. The worker who has joined the service of science in accordance with the provisions of this Law shall be accorded all the rights and benefits of such persons who are in the service of science.

Article (2)

The provisions of this Act shall apply to all terminations issued prior to the date of their issuance on the basis of the provisions of article 74 of the Science Service Act of Legislative Decree No. 30 of 2007 and its amendments.
