Based on the Constitution

It was approved by the People's Assembly at its meeting held in the date of 20-6-1431 A.H., 2-6-2010, my birth.
The following are issued:

Section I
General provisions

Article 1

The following words and expressions shall be intended to apply the provisions of this Law to the meaning of each of them:
Ministry of Agriculture and Agrarian Reform
Minister: Minister of Agriculture and Agrarian Reform
Higher Committee: Higher Committee for Transformation to Modern Irrigation
Technical Committee: Technical Committee formed in the Ministry of Agriculture and Agrarian Reform
Subcommittee: Problem Committee in the Governorate
Director: Director of the National Project for Transformation to Modern Irrigation

Article 2

a. The purpose of this law is to regulate and implement the planned plan to transform irrigation into irrigated land in the Syrian Arab Republic in order to rationalize the use of water and conserve water resources in accordance with the stipulated time schedule.
(b) The shift to modern irrigation is mandatory in areas approved by the High Commission.

Article 3

A High Commission for Transformation to Modern Irrigation is formed under the chairmanship of the Prime Minister and the membership of each of the following:
Minister of Agriculture and Agrarian Reform
-Minister of Finance
-Minister of Industry
-Minister of Irrigation
-Head of State Planning
-President of the General Union of Peasants
-Associate Minister of Agriculture and Agrarian Reform
The director of the National Project for Transformation to Modern Irrigation is a member and rapporteur.
a. Its mission
-Adoption of the annual plan of the National Programme for the Transformation of Modern Irrigation and the tracking of its implementation and taking the necessary decisions to address the difficulties encountered in implementation.
-Approval of areas in which irrigated areas are converted into modern irrigation based on the proposal of the Technical Committee and the Subcommittee.
b. The working mechanism of the High Committee shall be determined by decision of the Prime Minister.
c. The Higher Committee uses the opinion of experts in its work to have an advisory opinion.

Article 4

a. A technical committee headed by the Associate Minister of Agriculture and Agrarian Reform and membership of each of the following:
-Minister of Irrigation for Technical Affairs.
-General manager of the Agricultural Cooperative Bank.
-Head of the competent office of the General Federation of Peasants.
-Director of Statistics and Planning in the Ministry.
A representative of the Ministry of Irrigation, in order to be designated by the Minister of Irrigation.
-Representative of the Ministry of Industry, with the rank of manager designated by the Minister of Industry
The director of the National Project for Transformation to Modern Irrigation is a member and rapporteur.
-Director of the National Project Financing Fund for Modern Irrigation.
b. Mission
-The study of the plan laid down by the subcommittees and the identification of implementation preferences and the lifting of them to the Higher Committee.
-Follow up on the implementation of the annual plan of the National Programme for Transformation to Modern Irrigation and to propose what is appropriate to address the difficulties encountered in implementation.
-Follow up on the implementation of the annual fund plan to fund the project and address implementation difficulties.
c. The working mechanism of the Technical Committee shall be determined by decision of the Minister.

Article 5

a. In each governorate, a subsidiary committee headed by the Governor and members of each of the following:
-Member of the Agriculture Sector Executive Office.
-President of the Conservative Peasant Union.
-Director of Agriculture and Agrarian Reform in the Governorate.
-Water resources manager in the county.
-Industry manager of the county.
-Director of planning in the county.
-Director of the National Project for Transformation of Modern Irrigation in the Governorate as a member and rapporteur.
-Director of the Agricultural Bank's Cooperative Branch in the county centre.
b. Its mission:
-Setting the annual plan for the shift to modern irrigation in the province.
-Identify areas whose irrigated areas must be subject to modern irrigation according to available settings.
-Follow up on the implementation of the annual plan of the National Programme for Transformation to Modern Irrigation after it is approved by the Higher Committee.
c. The mechanism of work of the SPT shall be determined by decision of the Minister.

Article 6

a. The Minister shall issue a decision setting out the date of commencement of the process of converting to modern irrigation in the area where the High Commission has endorsed and connects with it:
1. A chart showing the boundaries of the area in which modern irrigation works, real estate figures, fixed and liberated parts of real estate, and unspecified and liberated areas within the said area are to be carried out.
2. Table of landlords, real estate figures and property parts they own in the area.
3. Table of land occupants in undefined and edited sites and legal document in the works.
The minister's decision is published in the official gazette and announced in one of the capital's widespread daily newspapers and in the bulletin board of the Governorate Center, the Directorate of Agriculture and Agrarian Reform, the district and the district, the centers of the ties, the extension units and the concerned peasant associations that enter their circle. c. Publication and advertising is a personal notification to the rights holders of all estates referred to.
d. The Minister's decision shall not accept any method of appeal or review.
Water resources investors located within the areas identified by the Minister's decision to review the branches of the National Project Directorate for Transformation to Modern Irrigation within three months of the date of publication of the decision to implement their obligations under the provisions of this Law.
The Minister's decision shall be issued before 1-8 every year and shall continue to be carried out until 31.7 of the following year.

Article 7

It is contrary to the provisions of this law whose land lies within the region whose irrigated areas are subject to conversion to modern irrigation, and has refrained from implementing its obligations under the provisions of this law unless there is a technical or legal excuse accepted by the minister based on the suggestion of the subcommittee. The following actions are taken against him:
a. The offence is punishable by a monetary fine of 1,000 Syrian pounds per dunum in the first year.
b. If the contrary in the second year does not comply with what is required under the provisions of this Act and continues in violation, agricultural subsidies shall be denied.
In case it continues in violation of a third year, it is deprived of the "irrigated" agricultural regulation of irrigated areas within the area specified by the minister's decision and does not renew the license to invest the water source, which tells its land within the same area only after its commitment to the provisions of this law.

Article 8

Article 17 of Legislative Decree No. 91 amends 29-9-2005 and becomes as follows:
Professional and related workers are given their work with the design and installation of modern irrigation systems, according to a special order issued by a decree issued by the Prime Minister on the proposal of the Minister of Agriculture and Agrarian Reform in agreement with the Minister of Finance.

Article 9

This Act is published in the Official Gazette and operates on the date of its promulgation.
