The Medical Association Act

President

Based on the Constitution

As approved by the People's Assembly at its meeting held on 5.5-1433 A.H., 28-3-2012,

The following are issued:

Article 1

a. The expressions in this Law shall mean the meaning set forth beside each of them:

Ministry: Ministry of Health

Minister: Minister of Health

General Conference: General Conference of the Medical Association of the Syrian Arab Republic.

Union: Medical Association of the Syrian Arab Republic.

Captain: Captain of the doctors in the Syrian Arab Republic.

Council: Union Council.

Section: The union branch in each province of the Syrian Arab Republic.

The Council of the Branch: Council elected from the subsidiary body of the branch.

Advisory Body: Advisory Body composed of the Union Council and the heads of the branch.

General body: subsidiary body.

Joint Committee: Joint Committee from members of the Ministry of Health and the Union Council.

Member: Syrian Arab physician affiliated with one of the union branches and registered in the annual schedule issued by the syndicate.

Order: Rules of Procedure of the Union.

Doctors in Military Medical Services: Medical Officers Volunteer and Medical Officers and Contractors in accordance with Law No. 50 of 2004 in the Ministries of Defense, Interior, Army and Armed Forces.

b. The profession of medicine is a scientific profession that aims to achieve a general social humanitarian service that is intended to prevent, treat and rehabilitate the members of society from disease and to rehabilitate them.

c. " By virtue of this law, everyone who received medical leave from a medical school in the Syrian Arab Republic or equivalent of other medical certificates after possessing a Syrian general secondary school certificate or equivalent, is considered a doctor.

A Chapter I

Doctors Union and its objectives

Article 2

a. Doctors in the Syrian Arab Republic, working in the following sectors (health-higher education-military-private medical services), are registered in the union table, one of which is the city of Damascus.

b. The Union has legal personality and administrative and financial independence and it has to establish branches " in the governorates according to the provisions of this law.

Article 3

The Medical Association is a scientific social organization founded on the provisions of the Constitution of the Syrian Arab Republic.

Article 4

The Union works in cooperation with the official and popular authorities of the Syrian Arab Republic to achieve the following objectives:

1. Strive to achieve healthy development in the Syrian Arab Republic and participate in the development of health projects that lead to inclusive development.

2. Support the health sector and strengthen its role to ensure health assurance for the total community members.

3. Raising the profession of medicine and advancing its scientific level to meet the requirements of development and achieve social justice.

4. To contribute to the study of regulations on the profession as well as legislation on public health and medical services and development plans in the health field.

5. To contribute to the planning and upgrading of school curricula in medical schools and other faculties with medical and health institutes in the Syrian Arab Republic to serve the basic needs of health, social and scientific activities.

6. Establish educational and training courses for physicians.

7. Establish scientific libraries in the union center and its branches.

8. Reactivate scientific research, translate and publish books and medical studies, and issue magazines and bulletins to raise the scientific and professional level of members.

11. Union representation in the examinations of the certificate of general medicine and jurisdiction and the examination of equivalence of certificates.

10. Participating in planning and overseeing health programs in different media.

11. Establish and supervise specialist medical linkages.

12. Strengthen social and cultural ties between members.

13. Encourage collaborative medical work and strive to provide working ways for physicians.

14. Raise together the moral and physical doctors and defend their rights relating to the occupation and provision of economic and social services to ensure that they benefit from old age pension, disability, death compensation, termination of service, assistance in case of illness, emergency accidents and construction. Clubs, residential and cooperative societies and guarantee funds according to laws and regulations in force.

15. Maintain Arab medical heritage and highlight its impact in presenting civilization and defining the world.

16. Holding meetings, seminars and conferences, participating in and participating in the Syrian Arab Republic, Arab and international medical federations, establishing contacts and cooperating with international health organizations, Arab and international medical unions, and working with them to support them. Article 5

The guild is doing all work that meets its objectives set forth in the previous article within the limits of the laws and regulations in force.

Chapter II

Union registration, loss of membership and recovery

Article 6

A member of the registration student is required to be:

1. A qualified medical fit for the profession.

2. With Syrian Arab nationality.

3. A doctor's title is under the provisions of this law and registered in the Ministry.

4. Not guilty of a felony or misdemeanor offence contrary to the duties of the profession.

5. Unwritten off his name from the guild for a reason.

Article 7

a. Volunteer doctors in military medical services are entitled to union.

b. Volunteer doctors of the army, armed forces and doctors performing flag service shall enjoy all the rights and duties stipulated in this law to be contrary to military laws and regulations.

c. In the event of their return to the Syrian Arab Republic, doctors are entitled to join the union in accordance with article 6 of the present law.

Article 8

a. The registration application is submitted to the branch council in the county where the doctor wishes to work with the documents proving the required conditions.

b. The Council shall decide on the application within two weeks of the date of submission to the Council, which shall not consider the application admissible.

c. If the application is accepted or considered acceptable, the doctor shall register the registration student in the union records after the payment of the legal fees to its funds.

Article 9

a. The decision of the branch of the branch to reject the registration application is required to be exempt. The student of registration is entitled to object to this decision before the union council within two weeks of the date that the decision is written in writing.

b. The Bar Council shall dismiss the objection within one month from the date of its registration in the Chamber of the Syndicate and considers that the failure to separate it during this term amounts to an implicit decision to accept the objection.

c. The decision of the Bar Council is subject to appeal in cassation before the Civil Chamber of the Court of Cassation.

Article 10

The acceptable physician is divided before the head of the following right:

??? I swear to God, I am doing my job with honesty and honor and for keeping the secret of the profession and respecting its laws and regulations."

Article 11

During the month of April, the Union Branch Board publishes a schedule "in the names of all the fees placed on them for the previous year and prior to it, in alphabetical order, in each branch, and no doctor whose name is not present in this schedule shall not practice medicine unless he or she is paid." The fee is published and published in a later table on its expenditure if it is paid after the publication of the schedule and the pharmacist may not release any prescription for a doctor who has not been published in this table or a later schedule, and every irregulars requiring liability in accordance with the legal provisions regarding the profession.

Article 12

A registered member may request the transfer of his or her registration to any branch in which he or she wishes to proceed with a request to the Council of that branch upon payment of the fees incurred to the former branch until the date of the transfer request and does not have the right to work in the new section unless his registration is transferred to that branch.

Article 13

The member loses his membership and deletes his name from the union record and the schedule of doctors in one of the following cases:

a. In case of death.

b. If he/she is not registered in the Ministry under the Medical Professions Act or removed from the record of occupation by virtue of the provisions of this Act.

c. If the payment of all charges is delayed for more than one year, thirty days shall be given to the author of an alert book from his union branch with payment.

And. Excluded from this:

1. 2. Those who leave the territory of the Syrian Arab Republic to work for more than five years will have to pay three times the duties of workers inside the Syrian Arab Republic, while retaining their membership in the Union, provided that they continue to practice and without access to The Common Fund and Reports Rent.

Article 14

a. The persons who lost their membership under paragraphs (b-c-e) of the preceding article may ask for re-registration when the reasons for their loss are removed, and in this case, the duty fees are doubled on the new affiliate, and their period of loss is not recognized in the calculation of the pension and in the extended period. required to take over union functions and apply to the request for re-registration with respect to the deadlines and methods of appeal applicable to the registration application.

b. Taking into account the reasons for the loss of membership, registration is done for doctors from military medical services after the payment of due fees on the new affiliate and does not count the period of loss of pension account and the duration required for union duties.

Chapter III

Provisions of the medical profession

Article 15

The medical profession is required to be affiliated with the union and is registered in the ministry and is licensed to practise the profession in accordance with the laws and regulations in force.

Article 16

Non-Syrian doctors may engage in occupation in the Syrian Arab Republic with the following conditions.

1. Conditions 1, 3, 4 of Article 6 of this Law.

2. Do not be deprived of occupation for a professional reason.

3. Get work leave from the Ministry of Social Affairs and Labor.

4. Obtain annual leave by occupation, issued by the Ministry after the approval of the Union Council.

5. That their regimes allow reciprocity.

6. Obtain permission from the Ministry of the Interior.

Chapter IV

Doctor's duties.

Rule 17

1. To comply with the provisions on the occupation provided for in the Medical Professions Act and the prescribed limits for the treatment of treatment wages and medical examinations.

2. To adhere to the medical literature and the traditions of the profession and to preserve the sanctity of the human message of the medical profession.

3. To keep secrets that he is informed of because of his profession and avoid disclosing it except in the circumstances that the laws in force have to do.

4. To take into account the rules of cooperation and mutual respect in its peaceful relations.

5. Failure to do any work contrary to the dignity of the profession and that the doctor does not accept the practice of the profession in violation of the regulations and laws in force and has to abide by the scientific methods and methods recognized.

6. The failure of the doctor to carry out any diagnostic or remedial action is related to his competence only in cases of recovery and may not declare another jurisdiction that is not included in the ministry's license and shall not use the methods of publicity and improper promotion under the authority of the Mushki Board.

7. A doctor may give an opinion or advice that is contrary to the opinion of another colleague in order not to offend the collegiality or professional ethics of the profession.

8. To adhere to the use of reports and trade union prescriptions and, in such a case, to be referred to the Musilic Council.

9. To perform therapeutic medical work and oversee it directly and the union has the right to prosecute offenders and request that their work be closed by the Ministry and that the closure is carried out through the public prosecution.

10. Inform the guild in writing " when accepting any position or membership in any organization, union or association of physicians, whether Arab or international.

Rule 18

Doctors shall have recourse to the competent branch council if there is a professional dispute to resolve it in friendly ways and if it cannot be resolved in the branch council, at the request of one of the parties to the Union Council.

Chapter V

General Conference of Unions and Powers

Rule 19

a. The General Conference of the Union is the highest authority and consists of:

1. Members of the elected and former union council.

2. Members of branch boards.

3. complementary members.

b. The mandate of the General Conference continues for five years.

Rule 20

In the event that an integral member loses his or her membership for any reason, the following member shall be dissolved in the number of votes.

Rule 21

a. The General Conference of the Union of Mile:

1. Election of members of the Council of the Union and the Controller of the Treasury, and the captain or council member may not be elected for more than two consecutive sessions

2. Adopt the trade union policy and plan of action and follow up on its implementation.

3. Discuss and approve the annual report of the Syndicate Board and the endorsement of the final account for the following year after viewing the report of the Inspector of Accounts and approving the budget for the following year proposed by the Union Council.

4. Appointment of an inspector of legal accounts or more.

5. Identify trade union fees in the financial system, as well as determining the percentage of each branch's contribution to the budget.

6. Withdraw confidence from the Captain and the Syndicate Council or one of its members by a two-thirds majority of the members of the Conference.

7. Dissolve the differences that lie between the Union Council and the branch councils.

8. Confirmation of the rules of procedure, financial and personnel system and regulations relating to the cooperation and retirement funds and other central regulations proposed by the Union Council. These regulations are considered to be in force only after ratification by the Minister. These regulations are ratified within 30 days. Rule 22

a. The General Conference shall convene at the invitation of the Captain in the following cases:

1. In an election cycle within 30 days from the date of the end of the election of the branches of the branches and the complementary members, to elect a new assembly.

2. At a regular session and within 60 days of the end of the fiscal year for the approval of the final accounts, the approval of the budget and the approval of the annual report, based on the decision of the Union Council.

3. In an extraordinary session based on the decision of the Union Council or at the written request of at least one third of the members of the Conference to determine in that request or decision the purpose of this invitation.

b. The General Conference meeting is invited to announce it at the headquarters of the syndicate and branches.

Rule 23

The meeting of the General Conference of the Union shall be chaired by the Captain or his deputy, and in the event of their absence, the meeting will be chaired by the Council's largest

Rule 24

a. The meetings of the General Conference shall be considered lawful only in the presence of the absolute majority of the members of the Conference if the Conference is not invited for the second time in fifteen days "and the second meeting shall be lawful", regardless of the number of attendees, and the date of the second meeting may be determined by the first invitation and decisions are made Most of the votes present and if you are likely to be the one in which the President is likely to be present.

b. Extraordinary General Conference meetings, at the request of one third of the members of the Conference, shall be considered legal only in the presence of two thirds of the members of the Conference. If that majority is not available at this meeting, the invitation shall be declared null and void.

c. The ordinary, ordinary and extraordinary meetings of the General Conference shall be considered legal only in the presence of a representative of the Ministry to be invited to assets at least three days in advance of the meeting, and if one or both of them is not present, despite being informed of the date, the meeting will be considered legal.

Rule 25

The General Conference shall elect from among its members nominated members of the Union Council by secret ballot and by the proportional majority of the members present.

Rule 26

The Captain issues the decisions of the General Conference and publishes these resolutions by declaring them at the headquarters of the syndicate under a record organized by the Secretary-General, after having ratified the minister within a period of not exceeding 30 days from the date of the office of the Ministry of the Ministry. Otherwise, a provision would be considered in a way that does not conflict with the laws and regulations in force.

Chapter VI

Union Council and Terms of Reference

Rule 27

a. The union has a board of eleven members " from doctors representing the sectors listed in Article II of this law at the rate of at least one member from each sector.

b. The candidate for membership of the union council is required to be a Syrian citizen and the length of the profession is less than ten years.

c. The term of the union council lasts five years.

Dr. The Union Council shall elect from among its members a captain, a deputy and a trustee for the ser and brother of Khazna.

Rule 28

The rules of procedure of the union determine the modus operandi of the union council and the distribution of work among its members.

Rule 29

The competence of the Bar Council includes all matters relating to the profession and, in particular, the following:

1. Implementation of General Conference resolutions.

2. Maintain the principles and traditions of the profession, work to achieve its goals and raise its level, defend the union's rights and the professional rights of its members, and cooperate with Arab and foreign physician associations and international health organizations in a manner consistent with the union's objectives.

3. Department of labor in the guild.

4. Propose the various central regulations of the union.

5. Management and investment of union funds and property and collection of their due fees.

6. Move the accounts of the branches in fulfilment of their obligations to the union by a specific mandate from the General Conference for a specific branch and in specific cases.

7. Request to invite the General Conference of IGAD.

8. Oversee the work of the branch councils and monitor their good implementation of the provisions of this law and the resolutions of the General Conference.

9. Develop an annual action plan for the union and follow up on its implementation.

10. The standardization of the curriculum and the interaction between the branches of the union.

11. Preparation and implementation of the draft annual budget after approval.

12. Encourage the practice of the profession on a cooperative and collective basis and propose a special order for it.

13. Formation of union, professional and scientific committees that require them to achieve their objectives.

14. Regregulate relations between the Union Council and branch councils and resolve the differences that lie between branch councils.

15. Access to the decisions of public bodies and councils and give the necessary guidance on them and cancel what is contrary to them.

16. Organization of an annual table each year in accordance with the provisions of article 11 of this Law.

17. Request the public body's invitation to any branch of the union to meet when necessary.

19. To propose the wages of private hospitals and medical, laboratory and radial works and to raise them to the ministry for approval.

20. Establish a weekly holiday system and annual leave for doctors after the Minister's approval.

Rule 30

a. The meetings of the Council shall be lawful only in the presence of the absolute majority of its members.

b. Decisions shall be made by a majority of the votes of the members of the audience and if the votes are to be heard, the chair is likely to be the speaker.

Rule 31

a. The captain represents the syndicate and chairs the meetings of its board, implements its decisions, signs contracts approved and has the right to litigation in the name of the union.

b. He would be acting on behalf of the captain in the absence of his deputy and in the absence of the deputy secretary, and he has the powers of the captain who depuures for him in the event of his absence.

c. The Captain, the Secret Secretary and the Khazen residence in Damascus.

Rule 32

a. If the captain or his deputy, the secret or the Khazen, becomes vacant, the council meets to elect the alternative.

b. If a vacancy is vacated by more than three members of the Union Council for any reason, the General Conference shall be invited to elect a replacement, within a maximum of thirty days of the date of the vacancy.

Chapter VII

guild branches

Rule 33

A union branch occurs in every province with no fewer than 500 registered doctors.

A union division can be created in every region that increases the number of doctors from 500 to a doctor within the scope of the branch's work following the approval of the union branch.

Chapter VIII

Branch General Authority

Rule 34

The branch of the branch consists of the total number of doctors registered in the branch. The branches of more than 500 members are composed of their public bodies, of the total representatives of the electoral units, members of the current elected branch council, members of the General Conference and members of the branch council. In order to take advantage of their experience, the candidate for the public body is required to have no less than five years of occupation.

Rule 35

The General Authority of the Branch shall have the following powers:

1. Election of the members of the Branch and shall not elect the President of the Branch or a member of the Council for more than two consecutive sessions.

2. Election of members who are complementary to the General Conference by one complementary member per fifty of its members shall not exceed a total of 10 members.

3. To discuss and approve the annual report of the work of the Council of the Branch and to submit proposals and recommendations related to the profession for presentation to the General Conference or the Union Council.

4. To ratify the closing account for the following year after viewing the report of the Inspector of Accounts and approving the draft budget for the following year to be submitted to the Union Council as a prelude to its submission to the General Conference.

5. Appointment of the Inspector of Legal Accounts or Akther.

6. Withdraw confidence from the head of the branch, the branch council or a member of the branch board with a majority of two-thirds of its members.

Rule 36

The plenary is convened by the President of the Branch in the following cases:

1. At an election cycle at least fifteen days prior to the expiration date of the mandate of the Branch to elect a new subsidiary council and members.

2. At a regular session within 30 days " following the end of the financial year for the approval of the final accounts, the approval of the draft budget for the coming year and the discussion and approval of the annual report of the Branch.

3. In an extraordinary session:

a. To implement the decision of the Union Council.

b. To implement the decision of the Council.

c. On the basis of a request by at least one third of the members of the plenary of the Branch and to clarify in the request the purpose of the meeting and the President of the Council of the Branch, at most of the date of receipt of the request, the invitation shall be invited at the latest.

4. The meetings of the General Authority shall be presided over by the head of the branch of the branch, or in the case of his absence, as the oldest member of the branch of the branch is present, and if the invitation is based on the decision of the Union Council, the meeting will be chaired by the Captain in case he is present.

5. The public body meeting of the branch is invited to announce it at the headquarters of the union branch and in one of the modern means of communication.

6. The provisions of paragraphs (a, b) of article 24 of this Law shall apply to meetings of the public body with the replacement of the term of the general branch of the General Conference, and the meeting of the general election body shall be considered legal only in the presence of a representative of the Department of Health in the governorate to be invited. " At least 15 days ahead of schedule, and if he does not attend despite being informed of the date, the meeting will be considered legal.

Chapter IX

Branch Council

Rule 37

a. The branch board consists of seven members of the physicians representing the sectors of which the branch consists of, referred to in article II of this Law, at the rate of at least one member from each sector.

b. A candidate for the Board of the Branch is required to have no less than ten years of operation.

c. The Council of the Branch shall elect from among its members a President and a Secretary of the Sr and Khacna.

-The head of the branch of the branch shall be discharged by decision of the Union Council on the proposal of the Branch Council and the General Conference shall set the rules of this full-time, full-time salary and compensation.

Rule 38

The mandate of the Branch Council lasts for five calendar years.

Rule 39

a. If the head of the branch falls vacant, the branch of the branch or the Khazen shall meet and elect the alternative.

b. A vacancy for more than two members of the Council shall be vacated for any reason that the public body is invited to elect a replacement and complete the term of the Council within a maximum of thirty days of the date of the vacancy.

Rule 40

The meetings of the Board of the Branch shall be lawful in the presence of an absolute majority and its decisions shall be issued by the majority of the members present and if the votes are likely to be held by the President of the meeting.

Rule 41

The branch councils should report a picture of their decisions and decisions of their public bodies to the Union Council within a week of their issuance.

Rule 42

The head of the branch has the following powers:

1. The Branch shall represent and preside over the meetings of the Board and its plenary, follow up on the implementation of its decisions and sign contracts approved by the Branch Council and have the right to litigation in the name of its branch.

2. On behalf of the head of the branch in the absence of the Secretary of the Secret and in the absence of the Secretary of the Khazen who has the authority of the head of the branch of the branch in his/her absence in the event of his absence.

Rule 43

The Board has the following terms of reference:

1. Implementation of General Conference and Union Council resolutions and instructions.

2. Implementation of the resolutions of the plenary.

3. Work management in the branch.

4. Provide the Union Council with the necessary information on the professional status and trade union in the area of work of the branch and to propose the achievement of the union's objectives.

5. The management and investment of the branch fund, the collection of funds and the collection of fees.

6. Propose the budget of the annual branch and prepare the closing account for the past year.

7. Invite the branch's plenary meeting.

8. To appoint branch council representatives in all areas of the Branch in accordance with the provisions of this Law.

9. Establish cooperation, savings and physician housing funds in accordance with the established regulations of the union.

10. Constraint and accept the doctors and the Association Council is informed of this.

11. care for and protect the rights of professional members and ensure that they perform their duties and monitor their behaviour.

12. Chapter in wage estimation disputes.

13. Chapter in every dispute or dispute that arises between physicians.

15. Provide suggestions that would upgrade the medical profession.

16. Strengthen the social and cultural ties between members of the Branch in accordance with the provisions of this Law.

17. The Council of the Branch shall be designated by decision of the members of the Public Body as its representative " in every public hospital.

Chapter X

In electing union institutions

Rule 44

a. At the turn of each election cycle, a decision of the Branch Council has taken place in electoral units for doctors in the branches, which are more than 500 members.

b. The Medical Electoral Unit is composed of a group of doctors enrolled in the branch so that there are no fewer than 100 doctors.

c. The doctors registered in the branch are distributed to the electoral units by decision of the branch council at the beginning of each election cycle and is endorsed by the Union Council.

Dr. The Medical Electoral Unit shall meet to elect its representatives to the Branch in the fifteen days prior to the opening of the candidature for membership in the Council of the Branch and the relevant membership.

e. The Medical Electoral Unit shall elect its representatives to the body of the branch by one representative per twenty members and force the number to 20 if the 15 is to be above and the increase shall be deleted if the number is not.

And. The Union Council shall issue instructions governing the elections of the units.

Rule 45

The Union Council shall set the date for the elections to be held by representatives of the medical electoral units, members of the branch councils and members of the branch and call for such elections to be held by a decision of the Council of the branch and call upon the plenary body to elect members of the Council of the branch and the members of the branch.

Rule 46

a. The nomination shall be open for membership in the Council and for membership in question before the date set for the meeting of the plenary for fifteen days and shall continue within five days and shall not accept the application for nomination after the expiration of such deadline.

b. Filtering takes place under a book submitted by the candidate in particular to the President of the Branch and is registered in the branch office and shows the sector to which he or she belongs.

c. The Board shall scrutinize the applications for nomination and the head of the branch shall announce within three days of the closure of the nomination for the names of the candidates accepted on the bulletin board at the seat of the branch.

Dr. A candidate whose name has not been declared an objection to the Court of Appeal of the Branch Centre within forty-eight hours of the date of the declaration shall be entitled to an objection within twenty-four hours.

Rule 47

b. The nomination is carried out under a book submitted by the candidate in particular to the captain directly or through the head of his branch and registered in the syndicate's office.

c. The Syndicate Board checks the nomination applications, and the captain announces within three days of the closing of the nomination door, the names of the candidates in which the nomination requirements were available on the bulletin board at the headquarters of the syndicate and in its branches, the candidate whose name was not announced before the Court of Cassation, is entitled to the three days of the date of the nomination. The declaration is to be decided by the court within three days.

Rule 48

The nomination of a member of the boards of branches or membership who has been sentenced to ban from practising, criminal or criminal penalty for an act incompatible with the duties and honour of the profession shall be accepted only after a judicial review.

Rule 49

The electoral sectors contained in Article II of this Law and in other materials are:

1. Workers in the Ministry: The doctors working in accordance with the Basic Law of the Workers of the State or the Employment Law of the Ministry, its Directorates and Independent Public Bodies.

2. Workers at the Ministry of Higher Education: The doctors are members of the Education Authority, employees of the Ministry of Higher Education, and the owners of universities and affiliated institutions, as well as the contractors with full contracts to work in these bodies.

3. Staff in military medical services: volunteer doctors, workers and contractors in the Ministries of Defense, Interior, Army and Armed Forces.

4. Workers in the private sector: doctors from union members in the Syrian Arab Republic.

Rule 50

The sectors in paragraph (a) of Article (37) in provincial branches are represented by at least one member of each of these sectors.

Rule 51

At the start of each election, the branch council shall issue a table with the names of the doctors according to the sectors to which they belong.

Rule 52

The internal system of the union determines how the elections are conducted.

Chapter XI

Resolving the conference and the union councils and bodies

Rule 53

A decision may be made by the Cabinet of Ministers to dissolve the General Conference, the Union Council, the branch councils and the bodies composed of representatives of the electoral units in the event that any of these councils or bodies deviate from their duties and objectives.

Rule 54

a. In the event of the dissolution of the Union Council or the Branch Council, the Prime Minister shall invite the General Conference or the Branch General Authority within fifteen days of the dissolution order to elect a new union council or a new branch council in accordance with the "legal provisions in force".

b. In case the branch council dissolved, the union council would invite the branch's public body to elect a new council within fifteen days of the resolution of the resolution.

c. In the absence of a call by the General Conference or the Public Authority during the period mentioned in paragraphs (a) and (b) called by a decision of the President of the Council of Ministers, a temporary council or a branch exercising the same terms of reference as an observer for the retirement treasury shall be exercised within three months.

Chapter XII

Financial

Rule 55

The unions and their respective branches have an estimated annual budget and a closing account.

Rule 56

The section's imports consist of:

1. The union fees that get from the members.

2. Registration fee and re-registration.

3. Fees for fee estimate requests.

4. Government and private donations and subsidies in accordance with "laws and regulations in force".

5. Reuse of funds and real estate.

6. Cash fines imposed by the Board for the benefit of the branch fund.

7. All other completed fees from members established by the plenary.

8. The ratio assigned to the section of the proceeds of various medical reports.

Rule 57

Union imports consist of:

1. Government and private subsidies and donations in accordance with laws and regulations in force.

2. Rip her real estate and the benefits of her money.

3. Member transfer fees between branches.

4. Contribution of branches.

5. All other completed fees from members decided by the General Conference.

6. Fines of boiled councils.

8. The value of prescription drugs that require public and private hospitals to purchase from the union.

Rule 58

Specifies the amount of fees received in the preceding two articles and how they are collected and the resulting measures to be made by the redactions in the rules of procedure and financial regulations of the union.

Rule 59

Each branch contributes a percentage of its total imports to the trade union, and the General Conference determines this contribution and is entitled to amend it for some branches in light of its financial situation and needs.

Rule 60

The union's financial year and its branches begin on the first month of January and end in the last December of each year.

Chapter XIII

On the board.

Rule 61

In every branch of the union, a council is set up to try members for violating their professional or professional duties, or violating the provisions of this law, the rules of procedure, the practice or the commission of the occupation, or the commission of the profession, or if they are committed to the dignity and honour of the profession. A judicial offence or a heinous misdemeanor of acts or acts that are not related to their professional or professional duties.

Rule 62

The Board shall write in the branch by decision of the Minister in accordance with the following:

1. A judge whose rank is not less than the President of a court of first instance designated by the Minister of Justice.

2. A doctor from the Ministry does not less than ten years of occupation. The Minister calls him a member.

3. Three member physicians designated by the Branch shall be at least one of them from the Board of the Branch that the duration of the profession shall not be less than ten years.

Rule 63

The Council's decisions are resumed in the branch to the Central Council of the Union, based in the city of Damascus.

Rule 64

The Central Muslim Council shall be composed by decision of the Minister in accordance with the following:

1. A judge with the degree of counsel at least nominated by the Minister of Justice as President.

2. A doctor from the Ministry for the duration of the profession for ten years named by the Minister as a member.

3. Three doctors called by the Union Council to be at least one of them from the Bar Association to be less than ten years of occupation.

Rule 65

a. In each of his decisions referred to in Articles 62-64, the Minister refers to the President, the members of the Council and the Central Council, upon the proposal of the competent authority to name the original.

b. The dismember of the Board shall be dissolved in the absence of an authentic member.

Rule 66

The proceedings are brought before the Board of the Captain or the head of the branch either automatically, " or on the basis of a complaint, written news, or at the request of the doctor who sees himself in the position of the accused, who is not entitled to put this charge under the discretion of the Council and to the Council to proceed with the examination of the case. Within two months of the date of her residence and the date of the proceedings, without the complainant's right to submit his complaint to the judicial authority in the event of whether the complainant was a "punishable" offence in the present law.

Rule 67

The physician may be referred to the Board only after his or her statements have been heard by the Captain or the head of the branch or assigned by one of them. If the invited doctor fails to attend, the Chamber shall be referred to the Council without hearing his or her statements.

Rule 68

It is inevitably referred to the Council for trial to be tried in terms of each doctor who has sentenced him to a penalty or compensation in a penal or civil court for matters that affect his integrity, his competence, his competence, or the commission of a violation of the law of the profession, and every court has imposed a penalty sentence against the doctor. Rule 69

The following are the measures that the Council has the right to govern, one of which is:

1. Alert without registration or with registration in a book sent to the doctor.

3. A monetary fine that ranges from (500-30000) to a Syrian pound and has the status of civil compensation and shall be paid to the branch fund.

4. Prevention of a temporary occupation " for a period of not more than three years.

5. Prevention of a final occupation " and the removal of his restriction from the union and from the record of doctors.

Rule 70

a. The meetings of the Council are confidential and the judgments of the Council may not be published unless they are otherwise violated.

b. He should be assisted by a lawyer and a doctor to defend him.

c. The judgement of the Council shall be issued without information.

Rule 71

a. of the Council, or at the request of the complainants, to determine the hearing of the witnesses.

b. If a witness fails to attend, and if he or she attends and fails to testify or witness a false testimony, the Council requests the prosecution to carry out the legal act of the law.

Rule 72

a. To the scene, the President must request the response of the President and one of them, for the reasons laid down in the Act on the restitution of judges.

b. The Civil Chamber of the Appeals Tribunal shall decide to respond in accordance with the "assets relating to the restitution of judges".

c. If we are to accept the acceptance of the reply or the withdrawal, the representative of the Minister of Justice, the Minister, the Council of the Branch, or the Bar Council, as competent, shall not be appointed as a member, replacing the accepted member and withdrawing from the Council.

Rule 73

a. The decisions of the Board shall be issued by the slaughterhouse and the Javits or as a Javits.

Rule 74

The sentences handed down by the councils are implemented after they become concluded by the Ministry and the Public Prosecutor's Office.

Rule 75

If a doctor is convicted of a felony or misdemeanor, the prosecution service must inform the head of the union branch competent of the decision to move the public action and the conclusion of the final decision.

Rule 76

The decisions of the Board are recorded in a record of the branch and referred to in the doctor's file and notify the union.

Chapter XIV

Chapter in pay disputes

Rule 77

a. In the event of a dispute between the doctor and the patient or one of his relatives on the amount of wages, whether there is prior agreement to the administration, the stakeholder should not have submitted the dispute to the branch council prior to the review of the judiciary.

b. The Council must decide to separate the conflict within one month of its lifting.

c. The Council of the Branch shall reconcile the parties according to the prescribed limits for the medical remuneration of the parties, in accordance with a decision issued by the Council.

Dr. The Council must make its decision in this regard to the authors of the dispute in a recorded book.

Chapter XV

Appeal for union decisions and branches

Rule 78

Taking into account the provisions of this Act:

a. Decisions of the subsidiary organ of the Branch and the Board of the Branch to appeal to the Civil Appeals Tribunal of the Branch Centre and submit the appeal to the competent court according to the assets and dates of the planned appeal of the primitive rulings in the Civil Procedure Code and its decisions are issued by the study room after the appeal. b. One third of the members of the branch of the branch are entitled to challenge the validity of the branch's authority and the outcome of its elections or the validity of its decisions before the competent civil appeals court within fifteen days " from the date of commencement, the election or the issuance of the decision, and the appeal shall be decided by the court within fifteen days. Rule 79

Taking into account the provisions contained in this Law, the decisions of the Branch Council may be challenged before the Bar Council.

Rule 80

a. Decisions of the General Conference and the Union Council are subject to appeal in cassation with the Civil Chamber of the Court of Cassation, and the appeal is submitted to the Court of Cassation according to the origins and dates of the appeal in the law, and the Court of Cassation shall decide in cassation with a decision concluded.

b. One third of the members of the General Conference are entitled to challenge the validity of the general conference or the outcome of its elections or the validity of its decisions before the Civil Chamber of the Court of Cassation within the same period as referred to in the preceding paragraph and shall be decided by the Court within fifteen days " by a decision concluded.

Rule 81

If the competent court approved the challenge of the validity of the general authority of the branch or the General Conference, their decisions were invaled. If the contested election was upheld, the contested election was reinstated within 30 days of the date of communication of the result of the appeal to the competent branch council. Or the union council at once.

Chapter XVI

General and transitional provisions

Rule 82

Palestinian physicians residing in the Syrian Arab Republic registered with the General Authority for Palestine Refugees treat Syrian doctors.

Rule 83

If full-time union work under the provisions of this law is made by state or public sector employees, it is discharged by decision of the union council after its public authority and, in this case, continues to charge its salaries and the compensation it received from the one who was working for it. By decision of the General Conference, other compensation may be awarded by the Union Fund and shall be considered a period of completion in the syndicate of the actual services qualified for the deposit.

Rule 84

a. The syndicate's property and money and its branches are exempt from all taxes, duties, financial stamps and the municipality except for the investment projects carried out by the union.

b. No reservation may be made to the headquarters of the union or branch headquarters and their assets related to the profession. Otherwise, the reservation may be made after the head of the captain or the head of the branch of the branch of the branch of the branch is invited.

Rule 85

The boards of directors of the directors' retirement tanks are organized within three months of the date of loss of membership tables. " They include the names of the doctors of the Treasury who lost membership in the union and the duration of each of them for the profession, which is considered in the calculation of pension or compensation, and declares these tables in a painting. The declarations of each of the branches for a period of three months during which the members of the Treasury may object to the objection to these meetings of the Treasury Board and this Council shall decide on such requests within one month of the submission of the objection.

Rule 86

The right to a pension and to compensate for the end of the services due since the doctor was referred to retirement shall begin with the decision of the Pension Board.

Rule 87

a. If a doctor who lost his or her membership is returned to the union, his pension is paid on the basis of the inclusion of his former services to the new period of time spent in the profession after the payment of due duties.

b. The provision of the preceding paragraph shall not benefit from the provision of compensation until such compensation has been returned to the Treasury Fund.

Rule 88

The workers in the union are subject to the terms of their work for the provisions of the Employment and Social Insurance Act.

Rule 89

With the absence of such a law, the provisions of the rules of procedure and the rules of procedure shall continue to be amended within three months of the effective date of this Act.

Rule 90

The doctors registered in the union when this law entered into force are considered to be in the union.

Rule 91

Act No. 31 of 16-1988 shall be repealed and all provisions in contravention of this Act shall be repealed.

Rule 92

This law is published in the Official Journal.
