Based on the Constitution

As approved by the People's Assembly at its meeting held on the date of 5-9-1433 A.H., 25-7-2012,
The following are issued:

Article 1

A court dealing with the consideration of terrorism cases is based in Damascus and, if necessary, more than one room may be created by a decision of the Supreme Judicial Council.

Article 2

a. The Court shall be composed of three judges, each with the rank of a President and two members, one of whom is military, and is designated by decree on the proposal of the High Judicial Council.
b. The investigating judge is called by decree on the proposal of the High Judicial Council and is empowered to add to his powers the powers of the referral judge provided for in the laws in force.
c. The public right to the Court is represented by its own public prosecution called the President and its members by decree on the proposal of the High Judicial Council.

Article 3

a. The updated Tribunal shall be competent to hear terrorism offences and for offences referred to it by the Special Prosecutor of the Tribunal.
b. The Court shall not examine the rights and compensation of the damages resulting from the offences in the proceedings in which it is adjudicated.

Article 4

The jurisdiction of the Court extends to all civilian and military persons.

Article 5

The sentences handed down by the court are subject to appeal to a special chamber formed by a decree in the Court of Cassation.

Article 6

The court's absentia sentences are not subject to a retrial in the event of arrest unless he or she has surrendered voluntarily.

Article 7

With the retention of the right of defence, the Court does not comply with the assets provided for in the legislation in force in all the roles and proceedings of the prosecution and the trial.

Article 8

The cases of terrorism that are pending before the other courts are transferred to the updated court in their current case.

Article 9

This Act is published in the Official Journal and is considered effective from the date of its promulgation.
