Law on Books and University Publications

Based on the Constitution
It was approved by the People's Assembly at its complex session at 9.3-1422 A.H., 31-5-2001.

The following are issued:

Article 1
The following expressions in the application of this Law shall mean the following:
Ministry of Higher Education
Minister: Minister of Higher Education
Directorate: Directorate of Books and Publications
Higher institutes: institutes affiliated to the ministry or to universities.
Middle institutes: intermediate institutes of the Higher Council of Middle Institutes.
A university book is a book composed or translated according to the provisions of this law and adopted with the full coverage of one or more decisions or parts of it.
University Reference: Book an author or translator by one or more members of the faculty that contains more extensive information than any university book or university book group in a specific field of competence
General reference: Author or translator that contains more extensive information than any other book on one or more topics such as gazetteers and encyclopedias.

Article 2
a. Every decision shall be for the first period of leave at universities, in higher institutes and in the intermediate institutes, one or more of which is approved by the Rapporteur.
The Board of the competent section is responsible for providing the books necessary for the teaching of the decisions of the Section and should propose that those who see it appropriate from the faculty, universities or other scientific centres be entrusted with the writing of books that he or she deems appropriate or translated for the coverage of the decisions. According to the rules set forth in this law, the University Council shall issue a decision to determine which bodies may be accepted for university books if it is non-Syrian damp upon the proposal of the competent council.
c. A book may be taught in colleges or higher institutes and sold to students only upon decision of the UNU Council or the Higher Institute, based on the recommendation of the Committee of Publication, Translation and Publication at the University and the recommendation of the College Board or the High Institute Board and the opinion of the competent section council. .
d. The Council of the University or the Council of the Higher Institute of the Ministry, together with the beginning of each academic year, shall write a committee called the Committee of Copyright, Translation and Publishing Commission to study proposals from colleges and higher institutes related to the adoption of university books and to recommend the appropriate recommendation to the Council. University.
e. A book may be taught in middle schools or sold to students only on the basis of a decision of the head of the Higher Council of Intermediate Institutes, based on the recommendation of the Directorate of Middle Institutes of the Ministry, upon the proposal of the competent institute.
Translated books shall treat the treatment of books made in all prescribed by this Act, and the Council of Higher Education shall establish the rules that it deems appropriate for the preference of the writing or translation in the application colleges designated by the Board.
(g) Each book shall have one or more scientific or more scientific proofs and proofreaders proposed by the relevant Board of the Section and the College Board and issued by calling them read from the Council of the University.

Article 3
The Higher Education Council and the Higher Council of Middle Institutes, in their respective fields, shall issue a decision containing the rules and general foundations relating to the writing, translation, dissemination and distribution of books in accordance with the provisions of this Law. These rules shall include, in particular, the following:
a. To encourage the movement of authorship, translation and dissemination in all branches and disciplines and to propose the necessary facilities and incentives in this field.
b. The development of plans to write, translate and publish books and academic references and books of the higher institutes and the books of the intermediate institutes, all in their respective areas.
c. Establish the necessary rules to cover the author or translator for the rest of the decision and in such a way that the book fits the number of weekly hours specified for teaching in the study plans and curricula.
d. Development of rules for the estimation of rewards for writing or translation of the book, for scientific review and for linguistic scrutiny, and appreciates the reward by effort (in writing or translation) in addition to other expenses required by preparing the book from fees, formats and others, including an obligation The author has to correct drafts of his book while printing.
e. Development of plans for book directors and publications to organize or participate in book fairs within the Syrian Arab Republic and beyond.
f. Development of general rules for the printing of single or joint books, between universities and higher institutes or between intermediate institutes.
g. Endorse the names of general references and foreign language books that students require in their study and coordinate the printing of copies or provide them with students.
h. Development of general rules for determining the financial cost of university books and references which are printed or distributed.
i. Development of general rules for determining the sale prices of books and references to students and others.
j. The establishment of free quota distribution rules for indigent students as defined in article 12, paragraph (d), of this Law.
The Higher Education Council and the Higher Council of Intermediate Institutes have established specialized committees to achieve the required goals.

Article 4
a. In the Ministry and in each of the universities in the Syrian Arab Republic, a Directorate of the Directorate of Books and Publications is responsible for printing and publishing books and references distributed and sold to students or others in accordance with the rules and foundations set out in this law.
Each of the Directorates shall be competent to:
1. Directorate of Books and Publications of the Ministry: It prints books and references to the high level associated with the Ministry and the intermediate institutes of the Higher Council of Middle Institutes, books, magazines and publications issued by the Ministry.
2. Directorate of Books and Publications at each university: print books, university references and other books and other publications required by students in their study.
b. The accounts of each of the updated directorates under paragraph (a) of this article are maintained in accordance with the principles of business accounting and are discretionary and an independent final budget and are subject to the following regulations:
1. The consolidated accounting system issued by Decree No. 287 (287) is dated 25-1-1978.
2. Financial regulations issued by Decree No. 26/T of 26 /3974 and its amendments.
3. Order No. (195) of the Decree No. 25.74-1974 and its amendments.
4. The incentive system for production allowances and incentive awards issued by Decree No. 1715, date 9-8-1977 and its amendments.
c. The nominal capital of each of the updated directorates under paragraph (a) above shall be determined as follows:
-Directorate of Books and Publications of the Ministry (100) million L.C.
-Directorate of Books and Publications at Damascus University (150) million L.C.
-Directorate of Books and Publications at Aleppo University (100) Million L.C.
-Directorate of Books and Publications at the University of October (75) Million L.S.
-Directorate of Books and Publications at the Baath University (50) million L.C.
d. The nominal capital elements of each of the books and publications specified under paragraph (c) above consist of the following:
-The net worth of assets transferred from the universities of Damascus, Aleppo and November under the provisions of paragraph (e) of this article.
-the value of their respective investments.
-The appropriations allocated by the State for each of them.
e. To be formed by decision of the Minister for the Ministry of Books and Publications in the Ministry and by decision of the President of the competent university, in agreement with the Minister of Finance, to agree with a competent committee to determine its mission to:
1. Inventory of assets to be transferred to each of the updated directorates under paragraph (a) of this article and the inventory value of assets is based mainly on the inventory process.
2. Prepare a budget for each of the updated directorates under paragraph (a) of this article in accordance with the results of the preceding item (1).
The resources of each of the updated directorates under paragraph (a) of this article shall consist of:
-Athman selling books and publications.
-Subsidies that are allocated to them in the state budget when required.
-Subsidies, donations and trusteeship in accordance with the laws and regulations in force.
Each of the updated Directorates under paragraph (a) of this article shall use its resources to finance its investment plans and to cover its current expenses and other requirements of its activity, including the rewards of writing.

Article 5
a. University books and references in universities and higher institutes are written or translated by the following categories:
1. Members of the faculty at universities or higher institutes of university books with their theoretical and practical parts.
2. Members of the technical body (business manager, business supervisor, Chargé d' affaires) This is for the practical scientific part of the decisions. As for the theoretical part, it should be shared with at least one of the members of the faculty.
3. Ministry of Higher Education teachers
4. Delegates from public teaching staff at the university, contractors to teach, or lecturers in the university from the scientific qualification campaign required for appointment to the faculty of the university.
b. A university book is required to be written or translated into:
1. He taught at least five years of study, if he is a faculty member and at least ten years, if he is a teacher of the Ministry of Higher Education, or of other categories.
2. He went on teaching him to the Rapporteur, the subject of the book, or part of it, at least two years.
3. Does not decide for a faculty member-alone or in common with others-more than a university book every two years and counts for the duration of the two years from the date of the decision of the University of the University to adopt the latest university book written by him, and excludes from this requirement the literature in decisions that do not have university books. The terms of the time required for the approval of the faculty of the faculty members are not applied to the book, which is written by the assistant professor for appointment to a professor position if he has not been put in the course of his work as an assistant professor in accordance with the rules of procedure.

Article 6
The books for the intermediate institutes are written or translated by the following categories:
a. Members of the faculty at universities who have the conditions set forth in Article V.
(b) Middle school teachers who have spent at least five years teaching the subject matter of the book at the Mediterranean Institute, should share with the author a faculty member of the university in which the stipulated conditions are fulfilled.

Article 7
The Council of Higher Education shall determine the names of the decisions of the foreign language sections for which written books are allowed, with the participation of three members of the faculty in the section in which the conditions set out in article 5 of this Law are available. At least one of them is a professor or assistant professor.

Article 8
Taking into account the provisions of articles II, V and VI of this Law, and with the beginning of each academic year, the Board of the College or the Institute shall issue a decision specifying the names of decisions to be examined in the classroom, the name of the book or books adopted for each decision and the name of the authors, on the basis of a recommendation Board of sections and based on the suggestions of teaching staff in colleges and institutes, whatever their capacity, as follows:
a. Continue to teach previously approved books as assets to cover the decision, until the expiration of their approval, in accordance with the preceding articles.
b. To write or compile a book, individually or in partnership with other members of the faculty of the university.
c. Adoption of a decision book in one of the universities of the Syrian Arab Republic, or others, in accordance with the established rules.
d. Adoption of foreign books for the teaching of courses in foreign language sections.

Article 9
The university book, due and printed, shall be adopted for a period of four years, which may be extended by one year, provided that the extension period does not exceed three years, and the competent section is required to teach the book for the duration of its adoption. The four years to which the university book is decided will start from the academic year in which the book is presented to students and enters the exams of that year, and in case of scientific necessity, which is estimated by the competent councils to modify some of the book's research, within the period adopted for teaching it and exporting it. Amendments to printed supplements.

Article 10
None of the updated directorates of this Act shall be entitled, however, to the author of the written and printed book, of copyright and publication.

Article 11
a. The author or translator shall be awarded a reward estimated by effort (in writing or translation) and depending on the costs of the writing, preparation and other expenses required by preparing the book from drawings, forms and others, including the author's commitment to correct the drafts of his writing during printing, as well as the auditors. Scientific and linguistic auditors are the appropriate reward in accordance with the provisions of this Act, and the author or translator does not benefit from the proceeds from the sale of the book by the Directorate internally or externally.
b. A committee consisting of five members, designated by the minister or the competent university president, will be based on the case and are added by two representatives of the competent section to appreciate the writing awards following the completion of printing of the book and the conduct of the rewards by decision of the minister or the head of the competent university, as the case may be, from the appropriations allocated for this. The objective is to balance the competent Directorate under article IV of this Law in accordance with the rules and general foundations of the Council of Higher Education, and to the Higher Council of the Middle-Institute, in its own.
c. The remuneration of the authors is excluded from the provisions of section (1) of section (c) of article 3 (3) of the Act on the discharging of the members of the educational body of the Ministry of Higher Education, promulgated in Legislative Decree No. 87 of 1975 and its amendments and from the maximum limits of compensation.

Article 12
a. The Minister or the President of the University shall be allowed to present educational institutions, public libraries, public libraries, administrative units, municipal and cultural centres, cultural centres, Governments and cultural institutions, Arab and foreign, with a number of university books, and written by the senior and middle institutes The teaching personnel in each of them or their translation, within a limit of not exceeding (5 %) of the printed copies of each book.
b. The author, translator, is given forty free copies of his new or modified book.
c. Gives the author, or translator, (2 %) of the total number of printed copies of his reprinted book without free modification provided that the copies are not exceeded for twenty copies.
d. Distribues no more than 5 % of printed copies of each book to indigent students free of charge.

Article 13
The Directorate allows the sale of books, printed references by them, for commercial libraries, or for any other side, and allows them to reprint books that are estimated to benefit from being printed on the basis of a decision by the Council of the League, on the basis of a reasoned proposal by the Directorate.

Article 14
None of the authors, who have earned an award, may print a book of books and university references, which are covered by the provisions of this Act, published, sold, sold for sale in violation of its provisions, and punished with the penalties provided for in article (712). From the Penal Code as punishable under Article (671) of the Penal Code, everyone who sold a book, from books and university references, is liable to a price greater than the price under the provisions of this Law.

Article 15
Members of the faculty at universities and higher and middle institutes are allowed to print and publish their books, both inside and outside the Syrian Arab Republic at their own expense, following the approval of the faculty or the competent institute, provided that students are not required for what this includes. Books.

Article 16
The updated Directorates under Article IV of this Law shall replace the Directorate of Books and Printed Publications prior to their issuance in each of the universities of the Syrian Arab Republic and shall be transferred to all other assets in cash and in kind, and all their rights and obligations with respect to their respective values. Effectiveness of this Act.

Article 17
The updated directorates under the provisions of this Law shall be exempted from all taxes, financial, customs and municipal charges and costs of all types and from all restrictions on importation, for all their imports, donations, grants or loans. It is equipment, tools, technical equipment, and scientific publications, as well as non-touristic modes of transport intended solely for shipment and distribution purposes.

Article 18
A committee, chaired by the minister and members of university presidents, is authorized to liquidate the work related to books whose accounts have not been liquidated till the date of the operation of this law in accordance with its provisions.

Article 19
The Minister of Higher Education issues the executive instructions for this law.

Article 20
Legislative Decree No. 168 shall be terminated in the date of 12-9-1963 and its amendments and other provisions in contravention of this Act where it is received.

Article 21
This law is published in the Official Journal.
