Law 23 of 2005
The Law on the Retirement of Engineers in the Syrian Arab Republic

President
Based on the Constitution.

As approved by the People's Assembly at its meeting held at the date of 10-5-1426 A.H., 16-6-2005, my birth.

The following are issued:

Chapter I
Definitions and objectives

Article 1

Definitions: The following terms shall mean the meaning set out alongside each of them:
a. Syndicate: Union of Engineers of the Syrian Arab Republic.
b. Treasury: Engineer Retirement Treasury.
c. Law: Engineers' Retirement Treasury Act in the Syrian Arab Republic.
d. General Conference: General Conference of the Treasury.
e. Board of Directors: Treasury Board.
and-retired engineer: Engineer assignee in retirement under the provisions of this law.
g. Stakeholders: The family of the deceased engineer who shall be entitled to a pension or compensation in accordance with the provisions of this Law.
h. Full pension: the monthly amount established by the General Conference of retired engineers after the engineering profession for 30 years in special engineering work.

Article 2

The Pension Treasury aims to achieve pensions, compensation and subsidies for engineers in accordance with the provisions of this law.

Article 3

The Pension Treasury has legal personality and is represented by the President of the Board of Directors or from acting on a legal basis.

Chapter II
Treasury management -- General Conference

Article 4

The General Conference of the Treasury consists of members of the General Conference of the Union, members of the Governing Council and members of the oversight committee at the previous session.

Article 5

a. The General Conference shall be competent for the following:
1. To endorse the policy of the Treasury and ensure its implementation, especially in the area of investment of its funds.
2. Adoption of the rules of procedure, the financial and accounting regulations of the Treasury, the system of investment of its funds and the issuing of regulations by decision of the Minister of Housing and Construction.
3. Election of the Board of Directors, and determination of the number of full-time members.
4. Election of the Oversight Committee.
5. Discussion and approval of the annual report on the work of the Governing Council during the year.
6. Discussion and approval of the Governing Council's workplan for the following year.
7. To ratify the closing account for the past year, after viewing the report of the Inspector of Accounts and the report of the Oversight Committee.
8. Discussion and approval of the proposed budget estimates proposed by the Governing Council for the following year.
9. Appointment of legal auditors.
10. Identification of fees and fines imposed on engineers provided for in paragraphs (A), (b), (c), (d), (d) and (f) of article 16 of this Law, and the pension proceeds provided for in article 54, paragraph (c), of this Law.
11. To determine the minimum pension proceeds provided for in paragraph (d) of article 46 of this Law, which an engineer must supply to the Treasury for each set of special office groups defined in the Engineering Profession Regulation Act.
12. Identification of fines imposed in accordance with the provisions of this Act.
13. Identify the full pension based on a reasoned proposal from the Board of Directors.
14. Withdraw confidence from the Board of Directors or one of its members and the Supervisory Committee or one of its members in accordance with the provisions of the withdrawal of trust from the members of the Union Council provided for in the Engineering Profession Regulation Act.
b. The President of the Governing Council shall issue the resolutions of the General Conference and follow up on their implementation through the Governing Council and the branches of the Association.

Article 6

The General Conference of the Treasury meets on the dates of the meetings of the General Conference of the Union, in accordance with the provisions of the Law on the Organization of the Profession of Engineering in the Syrian Arab Republic.

Article 7

The President of the Governing Council shall preside over the meetings of the General Conference of the Treasury or the Treasurer in the event of his absence and the oldest members of the Board of Directors are present.

Governing Council

Article 8

a. The Treasury Department shall be in charge of a board of directors consisting of a Chairman and six members elected by the General Conference from among its members.
b. The Governing Council shall elect from among its members a Secretary for the ser and the Khazana.
c. The meetings of the board of directors shall be chaired by the Chief Engineer, in his capacity as Chairman of the Board of Directors, and in the event of his absence, the meetings will be chaired by the Secretary and, in the absence of their sad absence, the oldest members of the Board are present.
d. The membership of the Board of Directors shall not be combined with membership of the Union Board and the membership of the branch boards.
e - -Membership of the Board shall not be renewed for more than one time.

Article 9

The Secretary of the secret or the Khazen Oakley may be discharged completely and full-time and paid for his or her compensation and compensation in accordance with the provisions of the union board members provided for in the Engineering Profession Regulation Act.

Article 10

The provisions of the guild council meetings stipulated in the Engineering Profession Organization Act shall be applied to the meetings of the Board of Directors.

Article 11

In accordance with the provisions of this Law, the Governing Council shall manage the work of the Treasury in the following matters:
a. Implementation of General Conference resolutions.
b. Proposal of the rules of procedure, finance, accounting and investment system and presentation to the General Conference.
c. Collection, preservation and investment of funds.
d. Proposal to determine the full pension for the General Conference.
e. Report of the assignment of the engineer to retirement, the liquidation of his pension rights and the rights of his or her heirs, and shall be suspended and dropped in accordance with the provisions of this Law.
f. Subsidies and determination of their cases and amounts in accordance with the provisions of article 27 of this Law.
g. Appointment of staff to manage treasury work.
h. Approve the disbursement of expenditures required by the Treasury Department within the budget allocation.
i. Taking decisions in all other matters relating to the Treasury, and in a way that does not contradict this law and the resolutions of the General Conference.

Article 12

The internal system of the Treasury determines the functions of the branches of the union and its powers relating to the treasury, and the board of directors is entitled to delegate these councils with some of its powers.

Article 13

a. The draft budget for the coming year and the closing budget for the coming year shall be established by the Governing Council in each year and submitted to the General Conference for discussion and ratification.
b. If exceptional circumstances prevented the approval of the Treasury budget for the coming year, the Governing Council would continue to collect and spend on the basis of the previous budget until the General Conference had met and approved the budget.

Oversight Committee

Article 14

a. A Treasury Oversight Committee shall be elected by the General Conference at its election session from among its members consisting of three members.
b. The rules and powers of the oversight committee shall be determined by the rules of procedure of the Treasury.
c. The Governing Council should report all its decisions to the Oversight Committee, and the Oversight Committee has access to the minutes of the meetings of the Governing Council in order to ascertain the good application of the provisions of this Law and the resolutions of the General Conference.
d. The Committee has the right to veto the decisions of the Governing Council in accordance with the provisions of this Law.
e. The membership of the oversight committee shall not be renewed for more than one session.
The membership of the Committee shall not be combined with the membership of the Union Council and the branch councils.

Article 15

The General Conference may withdraw the trust from the Supervisory Committee or one of its members in accordance with the provisions of the withdrawal of confidence from the members of the Union Council provided for in the Engineering Profession Regulation Act.

Chapter III
Treasury resources

Article 16

Treasury resources comprise:
a. The registration fee in the treasury when the engineer is registered in the guild.
b. Annual fee.
c. Registration fee.
d. Draw the engineer's transition from one branch to another.
e. Due process for engineers in accordance with the provisions of this Act.
and-the fines imposed in accordance with the provisions of this Act.
(g) The proceeds and investments of Treasury funds.
h. Grants, subsidies, commandments and endowment approved by the Governing Council in accordance with the laws and regulations in force.
i. The assistance that the General Conference of the Union decides to submit from the guild to the Treasury Fund.
All other legitimate resources.

Rule 17

The Treasury has its own accounting, and its money is restricted in its name.

Rule 18

Cash and names shall be deposited in one or more of the approved banks appointed by decision of the Governing Council.
The deposit, exchange or withdrawal may be made only by the signature of the Chairman of the Board of Directors and the Khazen together, or of those acting on their behalf in the absence of such a deposit.

Rule 19

a. Treasury funds may be disposed of only by decision of the Governing Council.
b. The person shall not be held by the Accountant or the Treasurer in an amount more than a higher amount determined by the Governing Council within the limits of the financial regulations.

Chapter IV
Duration of work, pensions and compensation

Rule 20

The architect's affiliation with the union is the date of his affiliation with the Treasury.

Rule 21

a. The periods spent by the engineer in the profession of engineering and objecting to the failure to be fixed are fixed according to the rules and rules defined by the internal system of the treasury.
b. The duration of the periods in which the engineer registered in the syndicate exercises engineering works in the Arab Republic of Syria is calculated in the areas specified in the occupation system.
c. The engineer is entitled to enter the following periods in the calculation of the duration of the operation:
1. The duration of the illness of the engineer shall be no more than three years, and shall be paid by the ailing engineer for pension proceeds to be determined by the General Conference by decision.
2. Duration of absence outside the Syrian Arab Republic with intent to study, specialize or send on an official mission no more than five years or intermittently, and to support the necessary supporting documentation.
3. The duration of the operation outside the Syrian Arab Republic has been extended in support of the necessary supporting documents. And no more than ten years. The General Conference shall, by decision, determine the retirement income of the engineer.
4. Duration of the occupation in the Syrian Arab Republic prior to the engineer's access to the nationality of the Syrian Arab Republic for the engineer to which the provisions of article 24, paragraph (a), of this Law apply and shall be determined by a decision of the General Conference, from which the retirement proceeds are not repaid that the engineer must repay.
d. Do not count in the duration of operation:
1. The period when an engineer's income is limited to a work that has nothing to do with the engineering profession.
2. The period in which an engineer is interrupted from work due to a judicial or disciplinary judgment.

Rule 22

The late architect of the payment of fees to the retirement treasury applies to the provisions of the Engineering Profession Act and the unionized union regulations relating to the delay in the payment of union fees.

Rule 23

a. The full pension shall be determined by decision of the General Conference upon the reasoned proposal of the Governing Council.
b. The full pension determination shall be taken into account in the formulation of the Treasury budget so that it does not exceed the total expenditure of eighty-five per cent of its resources.
c. By decision of the General Conference, the disposition may be made for the purpose of investment projects and other purposes to be decided by the Conference.

Rule 24

a. A engineer is entitled to request that he be referred to retirement if the following conditions are in place:
1. Be registered at the Engineers' Union.
2. To have an engineering profession in place at least 30 years of continuous or intermittent, or complete 65 years of age.
3. To be reimbursed by the Association of Engineers and the Treasury for all periods of operation of the engineering profession accepted in the retirement account.
4. Fifteen years of the nationality of the Syrian Arab Republic.
b. The Engineer shall be referred to retirement by decision of the Board of Directors, specifying the date of transmission and the amount of pension or compensation in accordance with the provisions of this Act.

Rule 25

The retired engineers deserve pension and compensation as follows:
a. Subject to the provisions of article 26 of this Law, a full pension of the 30 years of occupation shall be taken into account in accordance with the provisions of this Law.
b. If the occupation of the profession is no less than 15 years below the age of 30, a monthly pension equal to 30 parts of the full pension is guaranteed by a number of years in which the profession is a person.
c. The Engineer deserves a retirement referral for the age of 65 before completing 15 years in the profession of compensation equivalent to the full monthly pension, which is multiplied by the age of the profession.
d. The architect shall be granted retirement after the force of this law, which has increased the length of the profession for 30 years, and the full pension is entitled to one month's pension for each additional year of operation, up to a maximum of five years.

Rule 26

a. The retirement pension for an engineer who retires after the force of this law shall be determined by a public party, who receives a pension or lump sum compensation from the State Treasury on the basis of a reduction in the duration of the operation for which the engineer receives such pension or compensation by 50 per cent for a period of time. Prior to the operation of this Act, a twenty-five percent of the duration of the occupation after the operation of this law.
b. If the term of service of the engineer includes different types of occupation than the provisions of more than one article of this law, the pension payable to him shall be calculated on the basis of the collection of pension portions due from each of the cases mentioned in accordance with the provisions of the articles relating to them.

Rule 27

If a registered engineer in the guild is injured or exposed to a condition that prevents him from practising for a temporary period, the board is entitled, based on the study of his material condition, to grant him a monthly allowance not exceeding the full pension for a maximum of one year, which can be renewed for another year, taking into account The application of this article is the provisions of article 26, paragraph (a), of this Law.

Rule 28

a. The engineer registered in the union is entitled to request that he be referred to retirement for health reasons if he or she is incapacitated, ill or exposed to the table, and is unable to engage in the profession once and for all.
b. Taking into account the provisions of article 26 of this Law, the architect shall be entitled to retire in accordance with the provisions of paragraph (a) of this article for each year of a pension equivalent to one part of thirty part of the full pension. The pension for which he is allocated shall not be less than half the full pension.
c. If the health cause leads to death, or if the engineer dies after being referred to retirement for health reasons, the pension allocated under the provisions of this article shall be transferred to the owners of the benefit according to the provisions of this Law.

Rule 29

a. The final incapacity to engage in the profession is established by a report from a competent medical committee appointed by the Board of Directors, depending on the type of impairment or illness.
b. The retired engineer shall be reintroduced under the terms of Article 28 of this Law to the Medical Commission annually, and for five consecutive years to ascertain the continuation of the final deficiency.

Rule 30

The rules of procedure shall establish the basis and conditions for retirement and the date of commencement of the pension benefit. In the case of death, the date of commencement of the benefit is from the date of death, and in the case of the final disability from the date of its occurrence

Rule 31

a. The names of engineers referred to retirement are written off the table of active engineers and are registered in the schedule of retired engineers.
b. A retired engineer may not engage in an engineering profession except:
1. The occasional engineering consultancy called by public bodies.
2. The occasional engineering consultancy called by the private and joint sectors and its colleagues, and is done with the written approval of the board of directors at the proposal of the board of the union branch to which the engineer belongs.
3. The practice of retiring engineer for engineering outside the territory of the Syrian Arab Republic shall not be converted from the payment of his pension, provided that this period is not calculated within the duration of the practice.

Rule 32

Taking into account the provisions of article 31, paragraph (b), the pension shall be interrupted by a retired engineer who receives an engineering work for which he or she is paid, regardless of his or her type, in the State or in public or private institutions until he or she is separated from his or her work.

Rule 33

In terms of pension rights and personal grants, they are not allowed to be ceded to anyone, and their reservation is prohibited except for the payment of the legal scheme or for the required pension or union, within the limits of the legal ratios in withholding the wages of employees in the state.

Rule 34

The monthly pension of the Treasury is outdated by five years since it has not been claimed from its due date.

Chapter V
Transmission and loss of pensions

Rule 35

The pension rights allocated to an engineer under the provisions of this Act shall be transferred after his death to the owners of the benefit according to the following:
1. Husband, wife or wife.
2. Male boys who have not completed the age of 21 or who have completed this age and have not exceeded 27 years of age, and continue to pursue scientific achievement without interruption.
3. Male boys over the age of 21 who have an illness or a disability prevent them from earning, and their status is verified annually.
4. Unmarried girls, widows, divorced or abandoned girls, by judicial judgement, do not give alimony to the husband's husband.
5. Unmarried parents and sisters, widows, divorced or abandoned in the sense of the advanced clause (4) and deprived of adequate livelihood resources may claim their share in the pension of the deceased, provided that the parents have no other child to be able to do so. The spending on them and the sisters is a brother or a breadwinner capable of spending on them, and they can be obliged to support them.

Rule 36

a. The Governing Council verifies the availability of the conditions referred to in the preceding article in the methods it deems appropriate with the observance of civil status records.
b. The bug or impairment provided for in section 3 of the preceding article shall be established by a certificate of the Medical Commission made under article 29, paragraph (a), of this Law.

Rule 37

Taking into account the provisions of article 35 of this Law, 90 per cent of the pension received by the deceased engineer, or who was entitled to be liquidated on the day after the death of the rights holders in accordance with the provisions of this Law, shall be allocated equal shares to be allocated a single quota for each One of the boys is male or female, a couple of wives or wives, or wives, no matter how many, one share for sisters, no matter how many, one share for the parents, and the share is shared equally between partners, and the remaining 10 percent is truly acquired by the Treasury.

Rule 38

If the deceased engineer does not deserve the pension to be distributed to the owners of the benefit, the full compensation that he deserved while being liquidated the following day for his death, depending on the quotas specified in the preceding article 37.

Rule 39

a. A pension shall be interrupted for any of the due holders when one of the conditions to be granted is lost and shall be returned to it upon the removal of the reasons for loss of life.
b. The wife's pension shall be permanently interrupted upon marriage, and the pension that she has received shall be distributed to eligible children of the engineer who are deceased under the provisions of this Act.
c. A mother's pension shall be permanently interrupted upon marriage, and the pension to be charged to her grandchildren shall be distributed to the eligible deceased engineer children.
d. The pension of girls and sisters shall be interrupted upon their marriage and shall be returned to them if they become widows, divorcees or abandoned by virtue of a judicial judgement that does not result in alimony for the husband's husband. If they are married when the engineer dies, they do not benefit from his pension and then become widows, divorced or abandoned in the meaning of this article, they give their share of the pension after it is redistributed in accordance with the provisions of this law.

Rule 40

If an entitlement person dies, its entire share falls into the treasury, except for the shares of the husband, wife, mother and father, who shall be redistributed to the eligible deceased engineer's children in accordance with the provisions of this law.

Rule 41

Two pension contributions receivable from the Treasury may be combined under the provisions of this Act, and the entitlement holders shall be entitled to their respective shares, but shall not exceed the total pension of a single engineer, taking into account the provisions of article 26 of this Law.

Rule 42

After his death, shops benefit from retirement and benefit owners from every increase in the pension for engineers.

Rule 43

a. Engineer loses his pension rights in the following cases:
1. An inventory of the nationality of the Syrian Arab Republic.
2. If he is sentenced to prevent him from practising the profession once and for all.
b. The pension rights in the two cases referred to in paragraph (a) of this article are transferred to the owners of the entitlement as if the engineer had died.

Chapter VI
Audit Methods

Rule 44

a. The pension rights and the award shall be determined upon written request to be submitted to the Board of Directors through the union branch, in which the name, title and place of residence of the caller shall be stated, and shall be accompanied by supporting documents established by the Rules of Procedure of the Treasury.
b. The Governing Council must decide on the request made to it within two months of its date of receipt, and may decide to extend this period if such an investigation is required to reach the summoned decision, and the extension shall not last longer than two months and the application shall be deemed admissible if the term has expired The Board has not decided.
c. The oversight committee or the recipient of the final decision of the Council expressly or implicitly has to object to it before the Governing Council within thirty days of the date it is communicated to it. In the event that an objection is rejected, it is entitled to appeal the decision to the Court of Appeal.

Chapter VII
Engineering stamps and pension proceeds

Rule 45

a. Engineers for the Treasury are charged with engineering stamps in the name of pension proceeds and are subject to engineering stamps.
b. The Board of Directors shall, under the supervision of the Ministry of Finance and in accordance with its rules on the preparation of stamps, classify and determine the form, value and quantity of engineering stamps and their printing.
c. Non-Governing Council officials may sell such stamps only under a licence issued for a return of 2 % of the value of engineering stamps, and the internal system of the Treasury determines how to organize and collect the engineering stamps established in this law.
d. Stamp engineering stamps and invalidate the date (day, month and year) with ink, ring, or signature, and if the annulment addresses several stamps, it should be clear that it is impossible to reuse these stamps. The neutralization of the stamp or stamps must go beyond the label.

Rule 46

a. Engineering stamps are attached to the following documents:
1. Engineering projects and engineering and technical reports are different except for projects prepared by a public authority for their interest or for the interest of other public bodies, and in a way that does not conflict with their laws, they are attached to one of their photographers, an engineering character of 6 % (6 %), according to the report. For the agreed unhappiness and apply the same ratio to the architect's experience and arbitration.
2. Engineering contracts, maintenance and engineering contracts with public, public, joint, cooperative and private sectors are placed on an engineering character of 0.003 (3 per thousand) of their value. An exception is the work prepared by a public authority for its own interest or for the interest of other public bodies.
3. To believe in each certificate, report or document submitted by the union member to the competent authorities, and each complaint to the syndicate, which is subject to an engineering character in the value of twenty-five Syrian pounds.
4. Requests for fees for fees, which are of an engineering nature of 3 % (three per cent) of the amount to be estimated.
5. Contracts for the work of university engineering professional units in the Syrian Arab Republic are attached to a copy of the contract or photographer by 2 % (two per cent) of the value of contracts and works.
b. The value of engineering stamps exceeds 500 L.S. (500 Syrian pounds), which will paste engineering stamps at 500 Syrian pounds and meet the rest under official receipts, and will be provided with the attached stamps and the receipt number and the date of the receipt.
c. In the judgement of engineers, for the provisions of this article, all companies and offices carrying out engineering works in the Syrian Arab Republic, whether through study, scrutiny, implementation, supervision or supply, shall be in the Syrian Arab Republic.
d. The General Conference shall determine the retirement income of engineers for work in the private sector and shall not be subject to ratification by the Association.

Rule 47

An employee of the State, user, agent or worker under contract with the State or public institutions shall pay the treasury a sum of 4.5 % (four and a half percent) of the full wages, fees and compensation, except for the relocation, representation and incentive awards. Productive incentives, family compensation and competition awards.

Chapter VIII
Implementation proponents

Rule 48

All public, public, cooperative and private workers shall not accept transactions or exchange of documents or receivables relating to documents and acts referred to in article 46 of this Law unless they have a label on which the planned engineering stamps are in the interest of the Treasury.

Rule 49

The penalties for engineering stamps are punishable by the following fines:
a. Sale of stamps without a licence: a fine of 1000 L.C. and stamps from their holder for the pension benefit.
b. The sale of stamps at prices above the prices mentioned in them: a fine of 1,500 Syrian pounds, and in case the violation is repeated, the license will be withdrawn from the contrary, in addition to the fine.
c. Non-attached stamps, incomplete character or non-avoidance of stamp: a fine of five times the value of the stamp or the missing part of it to be a minimum of 500 Syrian pounds.
d. Unlawful adhesion or avoidance: a fine that is equivalent to the value of the label or illegally procrastinization without the need for new stamps to be attached.

Rule 50

Any of those who have imitated or falsified or used engineering stamps that have been used are punishable by the penalties provided for in the Penal Code.

Rule 51

a. Fines controlled by the courts are in the interest of the retirement Treasury through the Implementation Service.
b. Dissenters shall be given a quota of 20 % (20 %) of each fine paid.

Rule 52

The holders of engineering stamps, signatories, holders, users and officials responsible for their adhesion shall be responsible for their adhesion when they are responsible for the solidarity and solidarity of the violation of the performance of their value with the fines.

Rule 53

The board of directors may assign a staff member or an engineer to monitor the adhesion of engineering stamps and the use of receipts in accordance with the provisions of this law. This person has the right to control the offences and submit them to the Board of Directors for investigation and follow up to the competent authorities, and shall prepare a seizure in violation of the President of the Board of Directors, who shall refer the seizure to the prosecution service for the prosecution against the contrary.

Chapter IX
General and transitional provisions

Rule 54

a. A civil engineer who has been in the Syrian Arab Republic after having obtained the engineering degree before or after the association has the right to enter the union ten years from the duration of that practice to the actual duration of the retirement pension.
b. An engineer shall be entitled to apply for use in paragraph (a) of this article within two years from the date of entry into force of this Law, or the date of registration in the guild if the registration is subsequently entered into force of this law.
c. The General Conference of the Treasury shall determine the outstanding pension proceeds that the engineer must pay to the Treasury in the case provided for in paragraph (a) prior to each Engineer registered in the Personnel Division or in the Division of Competent Offices, as well as to the working engineer outside the Arab Republic The Syrian taking into account the engineering age and the date of payment.

Rule 55

The provisions of this Law benefit the Palestinian Arab Engineers residing in the Arab Republic and the accepted members of the Association and officially registered with the General Authority for Palestine Refugees.

Rule 56

By decision of the General Conference, a decision may be made by the Governing Council to add certain percentages to the duties imposed in the interest of the treasury in emergency cases and to balance the imports of the treasury and its obligations to not exceed the rate of increase of 50 % of the fees imposed under this law. The decision of the General Conference is subject to increased fees for the approval of the Minister of Housing and Construction.

Rule 57

The Treasury, its funds and institutions, which occur under the provisions of this Act, are exempted. of any financial assignment, tax, insurance, character or assignment and financial and municipal guarantees of any kind.

Rule 58

a. The Governing Council and the Treasury Board shall continue to exercise their powers for a maximum period of three months during which the Governing Council invites the General Conference to approve the rules of procedure, the financial system and the accounting system and to elect the Treasury Board and the Oversight Committee in accordance with the rules of procedure. The provisions of this Act.
b. The mandate of the Governing Council and the elected oversight committee shall expire for the first time after the Act has entered into force at the end of the current union election cycle.
c. The rules of procedure, the financial system and the accounting system in force shall continue before the promulgation of this Act, in such a statement that it does not conflict with its provisions.

Rule 59

The work of Legislative Decree No. 125 of 1961 and its amendments shall be terminated, and the treasury defined in article 1 of this Law shall have all the rights and obligations of the Treasury updated in the Legislative Decree 125.

Rule 60

This Law is published in the Official Journal, and operates as of the first month following the date of publication.
