As approved by the People's Assembly at its meeting held on 6.12-1427 A.H., 26-12-2006 AD,
Following is the following:
Article 1
Article 101 of the Judiciary Act is amended Legislative Decree No. 98 of 15-11-1961 Its amendments are as follows:
a. Judges are sentenced to retirement upon completion of 70 solar years, and their service may not be extended and they shall not be deprived of retirement for any reason.
b. The High Council of Judges may decide to terminate the service of the judge upon its sixty-fifth completion, or beyond it, if the Council finds that it is no longer able to fulfil the obligations of the judicial function.
The service in this case is terminated by decree and the rights of the judge whose service is terminated in accordance with the laws in force.
Article 2
The proceeds of the Common Fund for Judicial Close benefit in accordance with article II of Legislative Decree No. 94 of 3.10-2005, a judge whose service is terminated on the basis of paragraph 1 of article 101 of the The Judiciary Act Amended by Article 1 of this Law as well as the judge who resigns upon completion of 65 or after it has been passed.
Article 3
This law is published in the Official Journal and is considered effective from the date of its promulgation.
