As approved by the People's Assembly at its meeting held in the date of 9.1-1436 A.H., 2-11-2014,

The following is issued :

Article 1

Loans and credit contracts documented by a written bond between the bank and the client from the executive security provided for in article /273 / The Code of Trial Assets.

Article 2

a. Direct executive action by the Bank to the Implementation Service shall be discontinued only by the decision to discontinue the execution of the competent court, even if the executor of the law denies the authority or signature.
b. If the matter of the subject matter of which a suspension was issued, the court sentenced the debtor to a fine of not less than one fifth of the uncontested bond, not exceeding one third, for compensation, and the payment shall be distributed equally between the creditor and the public treasury of the State.
c. If the Court decides to discontinue the execution of the proceedings in the executive proceeding, the applicant shall be charged with the payment of insurance (10 %) of the minimum amount provided for in the preceding paragraph, and this insurance shall be calculated from the principal of the fine in the event of its judgement.

Article 3

The movable and immovable property seized by the banks shall be auctioned according to the following:
a. The Chief of Implementation shall decide after the date of notification in Article (379) of the Trial Assets Act has expired and upon the request of one of the relevant persons to raise the reserved money by auction, and the Sheriff shall place the reserved money on the reserved money, using three experts to designate each party as an expert, and designated The Head of Implementation is the third expert, and in the event that any party does not nominate its expert for any reason that the President of the Implementation will name it.
b. Bidding at the sale session shall be carried out with the call of the implementing officer and shall begin with the estimated value and expenses.
c. The Chief of Implementation decides to make a definitive referral to the highest offer.
d. The increase in a record organized by the implementing officer or who is assigned by the Chief of Implementation.
e. If no buyer decides to make a definitive referral to the barrier at its request, and if multiple applicants are referred to the former employer, the applicant shall not make the final reference to the barrier.
If the barrier does not apply for sale at the session and is requested by other creditors, the head of the implementation shall determine the deterministic referral to the applicant with the estimated value.
If the sale is not sold on the first day, it is postponed until the following day, as indicated in the list of conditions of sale and its procedures for the sale session on the first day, and the President decides to refer the case to the highest bidder at any price, and if the offers are to be transmitted to the owner of the exhibition, The former.
h. The decision of referral is not made at the bottom of the auction list and in the record of the file.

Article 4

The provisions of this Act apply to executive actions that exist or to be established between the bank and its debtor The contracts entered into between them prior to its entry into force.

Article 5

The provisions of the Law on the Assets of Trials shall be applied in what is not provided for in this Law.

This law is published in the Official Journal.
