Based on the Constitution

As approved by the People's Assembly at its ongoing session, 18-03-1437 My run is 29-12-12-2015. The following are issued:

Article 1

Business owners involved in the public institution of social insurance and the categories in article 2, paragraphs (d, e), of this Act are exempt from the benefits and additional amounts provided for in articles 74, 77 of the Social Insurance Act No. 92 of 1959 and their consequential amendments due to their delay in payment of monthly contributions for their workers if they are paid within a year from the date of the enactment of this Act.

Article 2

To benefit from the provisions of this Act:

1. Business owners who have previously paid or paid their contributions in full within the exemption period specified by the provisions of this Act shall be reimbursed and the additional amount of the monthly claims due to them from the date of promulgation of this Act shall be reimbursed Until payment is made and prior to settlement.
2. Business owners who are responsible for the late work injury reimbursement if paid during the exemption period.
3. Business owners who applied for installment of the accumulated contributions of the public institution for social insurance after they paid the last instalment during the exemption period. They remain committed to paying the monthly claims of their workers.
4. Pensioners and beneficiaries who have received payments from the public institution for social insurance without a right if paid during the exemption period.
5. Workers at the head of their work, the beneficiaries of the inclusion of the service, the lifting of the percentage or the compensation of the late payment for reimbursement (installment or cash), including compensation, without the right to compensation if paid during the exemption period.

Article 3

The provisions of article 1 of this Law do not benefit from the business owners who have been sentenced to judicial decisions, which include the benefits, fines and additional sums sentenced to the benefit of the public institution for social insurance.

Article 4

business owners who benefit from the provisions of this Act shall submit all insurance forms provided for in Social Insurance Act No. 92 of 1959 Its amendments are not relevant to form No. 4 of the Public Institution for Social Insurance with retroactive effect following the enactment of this Act.

Article 5

The competent committee of the Ministry of Labor shall give effect to the provisions of article 225 of the Labour Act No. 17 of 2010 Considering the requests to halt the total, partial and temporary work of the affected facilities as a result of terrorist acts and to determine the date of closure from the date of the damage of those installations to documents determined by the Ministry of Labour during the exemption period, and the employer will pay the insurance contributions only until that date. Except for contributions from any factor that has been broken after the date of closure and of form No. 4 submitted for this purpose retroactively after the date of this Act.

Article 6

Contributions, benefits, fines and additional amounts paid to the public institution for social insurance are not received prior to the enactment of this Act.

Article 7

The contributions paid by the business owners to the value of the monthly claim are not repayment of the accumulated contributions of the social insurance public institution and the owners of the business owners to pay the accumulated contributions during the exemption period so that they benefit from the provisions of this law.

Article 8

Outstanding contributions differences, which arise after the expiration of the exemption period due to the audit of insurance files, are reimbursed only with benefits and fines.

Article 9

The Minister of Labour shall issue the executive instructions for this law.

Article 10

This Law is published in the Official Journal and is effective from the date of its promulgation.
