Information System Order for Payment of Unemployment Insurance Benefits

(SIPAC Order)

On 26 October 2016 (State 1 Er January 2017)

The Swiss Federal Council,

Having regard to art. 96 C , para. 3, and 109 of the Unemployment Insurance Act of 25 June 1982 1 ,

Stops:

Section 1 General provisions

Art. 1 Purpose

This order governs the operation and use of:

A.
The unemployment insurance benefit payment information system (SIPAC);
B.
The SIPAC sub-systems.
Art. 2 Purpose of SIPAC

The purpose of SIPAC is to provide for the counting and payment of unemployment insurance benefits by unemployment funds.

Art. 3 Structure of the SIPAC

The ACIS consists of the following sub-systems:

A.
The data entry system and information relating to insured persons necessary to determine the rights arising from unemployment insurance and benefit-counting, including a data bank by unemployment fund (SIPAC-GB);
B.
The consolidation system of data entered into the various SIPAC-GB data banks, ensuring coordination between unemployment funds and other social insurance (SIPAC-BCD);
C.
The electronic records management system for persons receiving unemployment insurance benefits (SIPAC-GED);
D.
The payment and accounting system for unemployment insurance benefits as well as the accounting management of the Unemployment Insurance Compensation Fund (SAP).
Art. 4 Content of SIPAC

1 The data that can be processed in SIPAC are set out in the Annex.

2 The bodies connected to the SIPAC can only deal with the data they need to carry out their legal tasks. Access rights are set out in the appendix.

Art. 5 SIPAC responsible body

The SIPAC is under the responsibility of the compensation body for unemployment insurance.

Section 2 Rated bodies

Art. 6

The following bodies are connected to SIPAC:

A.
Unemployment funds: for the payment, counting and accounting of unemployment insurance benefits;
B.
Cantonal labour authorities: for the seizure of unemployment insurance benefits.

Section 3 Data processing

Art. 7 Data Transfer with Other Unemployment Insurance Systems

1 The data mentioned in the Annex may be exchanged with the Information System for Placement and Labour Market Statistics (PLASTA).

2 The data referred to in the Annex can be entered into the SECO information system for the analysis of labour market data (LAMDA).

Art. 8 Transfer of data with other bodies

1 The data mentioned in the annex may be exchanged with the Central Compensation Agency (CoC) in order to notify the payment of contributions to social insurance and family allowances.

2 The data mentioned in the annex may be delivered:

A.
The Swiss National Accident Fund (CNA): for electronic accident reporting (SUNET);
B.
Cantonal insurance for daily allowances: for the notification of deductions from sickness benefits;
C.
To the Fondation Substitutive Institution LPP: for the consultation of the LPP contribution accounts (LPP Portal);
D.
Cantonal aid institutions in favour of unemployed persons: for the payment of benefits to insured persons at the end of the law.
Art. Retention and destruction of data

The data of the insured person shall be destroyed no later than ten years from the last relevant transfer for the benefit.

Section 4 Data Protection and Data Security

Art. 10 Data Protection

1 The bodies connected to the SIPAC shall ensure compliance with the relevant data protection provisions.

2 The compensation body for unemployment insurance grants access rights to the SIPAC and its subsystems and the processing rights of the data recorded there; it ensures that the provisions of the legislation on the protection of Data are respected.

Art. 11 Data security

1 The bodies connected to the SIPAC shall take the prescribed security measures to prevent unauthorized third parties from accessing the data.

2 The unemployment insurance compensation body shall take the necessary measures to ensure that the data and programmes of the SIPAC, which have been subtracted, lost or involuntarily destroyed, can be reconstituted.

Section 5 Financing

Art. 12

The Unemployment Insurance Compensation Fund is responsible for the costs of the ACIS.

Section 6 Final provisions

Art. 13 Repeal of another act

The Order of November 28, 1983 on Unemployment Insurance Information and Payment Systems 1 Is repealed.

Art. 14 Entry into force

This order shall enter into force on 1 Er January 2017.
