The Ministry of Foreign Affairs presents its compliments to the Embassy of Switzerland and has the honour to acknowledge receipt of its note as of 1 Er November 1975 with the following content:

" The Embassy of Switzerland presents its compliments to the Ministry of Foreign Affairs and, with reference to art. 1, para. 4, of the Convention between Switzerland and France of 28 September 1960 1 Concerning the juxtaposed national inspection offices and the checks on the road, has the honour to inform the Commission of the following:

The Swiss Federal Council became aware of the Arrangement concerning the juxtaposition of controls in grazing traffic at the Franco-Swiss border. This arrangement, adopted in Dijon on 2 and 3 May 1974, by the Joint French-Swiss Commission under Art. 27, para. 1, of the said Convention, reads as follows:

" Arrangement concerning the juxtaposition of controls in grazing traffic at the French-Swiss border

Given the Convention between Switzerland and France of 28 September 1960 2 , relating to the juxtaposed national inspection offices and the roadside checks, it was agreed that:

Art. 1

1-The juxtaposition of Swiss and French controls on grazing traffic may be carried out in Swiss territory or in French territory in accordance with the procedure laid down in Art. 2 and 3.

2-The controls referred to in para. 1 above shall apply to livestock and the persons who lead or accompany them, to the means of transport used for this purpose, to provisions, to equipment, and to milk products.

Art. 2

For the exercise of controls, the zone may be set up on the official location (parts of the road, service buildings and other installations) of a Swiss or French customs office, or on any other appropriate location Competent authorities according to Art. 3 will have determined.

Art. 3

1-The Directorate of Arrondissement of the competent Swiss Customs and the Regional Directorate of French Customs shall, in agreement with the veterinary services concerned, lay down the arrangements for the application of this Agreement.

2-In particular, before the start of the summer or winter season, they determine the crossing points of the border, the areas referred to in Art. 2, as well as the duration and schedule of controls.

Art. 4

This arrangement may be terminated by both parties with six months' notice. The denunciation shall take effect on the first day of the month following the due date of the notice."

The Swiss Federal Council has approved the provisions of this Agreement.

The Embassy proposes, therefore, that the present note and that which the Ministry of Foreign Affairs wishes to address to it in reply constitute, in accordance with Art. 1, para. 3, of the aforementioned Convention of 28 September 1960 1 , the agreement between the two governments on the confirmation of the arrangement concerning the juxtaposition of grazing traffic on the Franco-Swiss border. It suggests that this arrangement should enter into force on 1 Er November 1975."

The Ministry of Foreign Affairs has the honour to make known to the Embassy that the provisions of this Arrangement collect the approval of the French Government.

In those circumstances, the above-mentioned note of the Swiss Embassy and the present note shall constitute, in accordance with Art. 1, para. 3, of the Convention of 28 September 1960 2 , the agreement between the Government of France and the Swiss Federal Council on the confirmation of the arrangement concerning the juxtaposition of controls in grazing traffic at the French-Swiss border, an arrangement which will enter into force on 1 Er November 1975.

The Ministry of Foreign Affairs takes this opportunity to renew to the Swiss Embassy the assurances of its high regard.
