1 The Chief of the Land Forces set the boundaries of the area of instruction after agreement with the commands of the corps and the occupation by the force.
2 He appointed the commanders and command helper of the training regions.
3 It ensures coordination with civil interests and ensures optimum use and exploitation of the training infrastructure as a function of the environment. It lays down the directives relating thereto.
The following are responsible for designating the regions according to Art. 4, para. 4, of the OPATE, to the extent necessary after agreement with the relevant civil bodies of the Confederation and the cantons:
1 The Weapons Place Commander regulates military use and responds to the safety of training facilities.
2 The Weapons Place Commander shall lay down the order of place of arms in cooperation with the Chief Operating Officer.
The Chief Operating Officer manages the construction, development, facilities and land. It is responsible for the maintenance and safety of the operation and represents the interests of the landowner vis-vis third parties. The Chief Operating Officer shall take into account, as a matter of priority, the requirements of military training.
The Chief of the Land Forces establishes the limits of duties and responsibilities between the Weapons Place Commander and the Chief Operating Officer after agreement with:
1 Permanent specialists such as chaplains, doctors, psychologists, dentists can be assigned to the arms.
2 The specialists are subordinate, in the military field to the commander of the place of arms, in the technical field to the Federal Office which appoints them. Specialists regulate their technical service according to the directives of the Federal Office to which they are technically subordinate and after agreement with the commander of the place of arms.
1 School and course commanders take charge of the premises and their equipment at the time of entry into service on the basis of inventories. Requests and complaints relating to the state and equipment of the premises shall be announced to the Operations Directorate by the Company Commanders within 24 hours of the assumption of responsibility.
2 In the absence of the place of arms of more than five nights or six days, the company shall return the premises to the chief operating officer.
3 In the event of absence, instructors are required to provide their accommodation, on notice, when the latter are absolutely necessary due to occupation by another troop. They have the opportunity to leave their documentation under key, on the premises. The chief operating officer decides to return the premises after agreement with the commander of the place of arms.
4 The provision of accommodation in case of absence does not apply to school commanders, school administrators, or permanent training facilities.
1 The execution of the prison sentences during the service is the responsibility of the troupe.
2 The commander of the place of arms places office space at the disposal of the troops who are not stationed in the place of arms, to the extent that the conditions permit.
3 As far as the conditions permit, places of arrest of the places of arms may be made available to prisoners whose execution of the sentence is in the area of jurisdiction of the cantons. The cantons concerned are responsible for providing assistance to these soldiers and for their livelihood. The commander of arms places decides on exceptions in special cases, with the agreement of the superior body.
1 Military canteens and kiosks can be used on arms. The contracts to strengthen the Confederation's ownership of arms are concluded by the OFEFT and the OFEFA. The conclusion of contracts for the use of military canteens and kiosks for cantonal arms places is the responsibility of the cantons.
2 Contracts must be approved by the RFSP.
3 The Land Forces Chief regulates the operation and sets the maximum prices for non-alcoholic beverages in the framework of the leasing contracts. He ordered the sustenance of officers and senior NCOs on arms.
4 The fixing of the subsistence allowance is governed by the order of 29 November 1995 1 On the administration of the army.
1 The company's claims against the direction of the canteens and the booths must be sent without delay to the commander of the place of arms who processes them with the chief operating officer.
2 Managers' claims against the company must be made without delay to the chief operating officer who processes them with the commander of the place of arms.
3 Where no agreement can be reached, claims accompanied by the positions of the commander of the place of arms and the chief operating officer shall be addressed to the following bodies for decision:
1 The civilian use of a place of arms is governed by military requirements. It is subject to a tax.
2 The Chief Operating Officer may authorize the civilian use of a place of arms after agreement with the Training Division Group and the Weapons Place Commander. Civil events that involve a large part of the infrastructure or whose impact on the environment is important, require the authorization of the DDPS. Other authorities of the canton and the commune are reserved.
3 The Chief of the Land Forces shall issue the necessary guidelines after agreement with the General Secretariat of the DDPS.
1 The Confederation shall pay the allowance in proportion to the number of soldiers and days, also for beds which cannot be occupied due to the conversion of rooms of non-commissioned officers and the troop to work and theory for the Schools and courses. The allowance shall be paid on the basis of an Occupancy Report when three or more rooms are to be processed during a course.
2 The cantons' right to compensation falls during the course of third party events or during processing. The calendar year is 360 days.
3 In the absence of the troop of the barracks for five or more nights, the allowances shall continue to be paid. Where the absence is longer, no allowance shall be paid for the duration of the absence.
4 Discounts relating to the daily allowances shall be drawn up by the Directorate of Operations and presented with the invoices to the relevant command bodies concerned to attest to its accuracy.
The Confederation shall pay compensation for the cost of consumer material and other operating expenses in accordance with the regulations in the Annex.
Appropriate use of marksmanship and exercise spaces must be ensured. First of all, the places owned by the Confederation, then the places under contract.
The bodies responsible for the use and military administration of shooting and exercising places, in accordance with the order of 18 October 1995 1 On the military organisation, also lay down the requirements for civil use. They shall ensure, in order to do so, the cooperation of the security experts of the Armaments Group or the Infantry Training Centre in Walenstadt.
The Chief of the Land Forces is responsible for the enforcement of this Order.
Are repealed:
This order shall enter into force on 1 Er July 1996.
