On the signing of the Agreement between the Federal Republic of Germany and the Swiss Confederation concerning the connection of motorways in the Basel region and Weil am Rhein 3 , you proposed, on behalf of the Swiss Federal Council, the following:

" On the occasion of the signing today of the Agreement between the Swiss Confederation and the Federal Republic of Germany concerning the connection of motorways in the Basel region and Weil am Rhein, I have the honour to propose to you The following arrangement for the removal and relief of entry fees for the construction, maintenance, modification and operation of other border crossing and border crossing sites:
1.
The deletions and concessions stipulated in Article 8 of the Agreement of 9 June 1978 between the Swiss Confederation and the Federal Republic of Germany concerning the connection of motorways in the Basel region and Weil am Rhein will also be Granted, from 1 Er January 1975, by the two Contracting States, on a reciprocal basis, for goods which will be used in the construction, maintenance, modification and operation of other works crossing the border, for means of Communication and public supply lines, as well as for inspection installations at other border crossings where juxtaposed national inspection offices are or will be erected in accordance with the Convention of 1 Er June 1961 4 Between the Contracting States on the establishment of juxtaposed national control offices and the checks in vehicles on the road. The competent administrations of the Contracting States shall provide mutual support in order to prevent the misuse of such deletions and relief.

The management of the competent Swiss customs district and the " Oberfinanzdirektion Freiburg i. Br. " Shall establish by common accord, on both sides of the border, the local boundaries of the areas necessary for the structures or installations of checks according to number 1; they shall regulate the details.
3.
This arrangement is denounced at all times; it ceases to be in force two years after its denunciation.
4.
This arrangement is also valid for the "Land" of Berlin if the Government of the Federal Republic of Germany does not submit to the Swiss Federal Council a contrary statement within three months of the entry into force of that Agreement.
I would be grateful if you could inform me of your agreement on the above; in this case, this letter which has received the approval of the Swiss Federal Council, and your reply constitutes an arrangement which enters into force at the same time as The Agreement between the Swiss Confederation and the Federal Republic of Germany, as soon as the two Governments have notified each other of the completion of the requisite constitutional procedures. '

I have the honour to inform you, on behalf of the Government of the Federal Republic of Germany, that it agrees with the above.

Your letter of this day and the present reply therefore constitute an agreement between the Federal Republic of Germany and the Swiss Confederation, which will enter into force as soon as the two Governments have notified the completion of the procedures Constitutional requirements.
