Fifth Protocol annexed to the General Agreement on Trade in Services

Entry into force for Switzerland on 1 Er March 1999

27 February 1998 (State on 21 December 1999)

The Members of the World Trade Organization (hereinafter referred to as the "WTO") Including the Schedules of Specific Commitments and the List of Exemptions from Obligations under s. II of the General Agreement on Trade in Services concerning Financial Services shall be annexed to this Protocol 2 (hereinafter referred to as the "Members concerned"),

Having Conducted negotiations in accordance with the provisions of the Second Decision on Financial Services adopted by the Council for Trade in Services on 21 July 1995 (S/L/9),

Agree The following provisions:

1.
A Schedule of Specific Commitments and a List of Exemptions from Obligations under Art. II concerning the financial services annexed to this Protocol for a Member shall replace, on the entry into force of this Protocol for that Member, the financial services sections of the List of Specific Commitments and List of exemptions from obligations set out in s. II of this Member.
2.
This Protocol shall be open for acceptance, by signature or otherwise, of the Members concerned until 29 January 1999.
3.
This Protocol shall enter into force on the thirtieth day after the date of its acceptance by all the Members concerned. If it has not been accepted by all the Members concerned by 30 January 1999, Members who have accepted it before that date will be able, within 30 days, to take a decision on its entry into force.
4.
This Protocol shall be deposited with the Director-General of the WTO. The Director-General of the WTO shall promptly furnish to each Member of the WTO a certified copy of this Protocol and notifications of acceptances of the said Protocol in accordance with paragraph 1. 3.
5.
This Protocol shall be registered in accordance with the provisions of Art. 102 of the United Nations Charter.

Done at Geneva, on the twenty-seven February Mil nine hundred and ninety-eight, in a single copy, in the English, French and Spanish languages, the three texts being equally authentic, unless otherwise provided for in the Lists annexed to the present Protocol.
