Decision n O 1/2004 of the Committee on Inland Transport Community/Switzerland of 22 June 2004

Concerning the system of charges on vehicles applicable in Switzerland for the period from 1 Er January 2005 at the opening of the Lötschberg base tunnel but no later than 1 Er January 2008

The Committee,

Having regard to the Agreement of 21 June 1999 between the European Community and the Swiss Confederation on the carriage of goods and passengers by rail and road 1 And in particular his art. 51, para. 2,

Whereas:

(1) According to s. 40 Switzerland has seen since 1 Er January 2001 a charge for the use of its public roads (a charge on the traffic of heavy goods vehicles). Royalties applicable as of 1 Er January 2005 are to be determined and differentiated according to three categories of emission standards (EURO).

(2) For this purpose, the agreement stipulates the weighted average of the royalties, the maximum royalty for the category of the most polluting vehicles and the maximum difference in charges from one category to another.

(3) The weights shall be determined on the basis of the number of vehicles per EURO standard category circulating in Switzerland. The Joint Committee shall examine the relevant censuses and determine the amounts of the three categories of charges on the basis of these weightings.

(4) The Joint Committee examined the censuses made available by Switzerland.

(5) It is important for the Joint Committee to decide on the weighting, the distribution of the categories of EURO standards between the three categories of charges and the level of charges for the three categories of charges.

(6) In the Final Act 2 Switzerland stated that it will set the fees valid until the opening of the first basic tunnel or up to 1 Er January 2008 at the latest, at a level below the maximum amount allowed by the agreement. It is therefore appropriate to limit the validity of this decision to that period.

Decides:

Art. 1

Of the total kilometres driven during the months of December 2003, January 2004 and February 2004 by vehicles of more than 3.5 tonnes on Swiss territory, 9.79 % were carried out by vehicles of the EURO 0 standard category; 8.47 % by vehicles Vehicles of the EURO 1 category; 41.09 % by vehicles of the EURO 2 standard category; and 40.65 % by the EURO 3 standard category.

Art. 2

The benefit fee for a vehicle whose total effective weight in charge does not exceed 40 tonnes and which runs a distance of 300 km, shall be

346 Swiss francs for the royalty category 1;

302 Swiss francs for royalty category 2;

258 Swiss francs for the royalty category 3.
Art. 3

The category of charge 1 shall apply to vehicles of the EURO 1 emission class and to all vehicles admitted to traffic before the entry into force of the EURO 1 standard. The category of charge 2 shall apply to vehicles of the EURO 2 emission class. The category of charge 3 shall apply to vehicles of the EURO 3, EURO 4 and EURO 5 emission classes.

Art. 4

This Decision shall enter into force on 1 Er January 2005.
