The Federal Department of Foreign Affairs presents its compliments to the Embassy of the Principality of Liechtenstein and,

For the execution of the Federal Orders of 18 June 1993 3 Concerning the maintenance of the levying of a charge on the traffic of heavy goods vehicles and of the charge for the use of national roads and orders 4 Related thereto,

Whereas there is no customs border between Switzerland and Liechtenstein and, therefore, no border control,

Wishing to avoid as far as possible obstacles to road traffic and to be able to collect the royalties also in the territory of the Principality of Liechtenstein,

Has the honour, on behalf of the Swiss Federal Council, to propose to the Embassy of the Principality of Liechtenstein the following rules:

1.
Swiss customs offices in the territory of the Principality of Liechtenstein are entitled to levy the levy on heavy goods traffic and the charge for the use of national roads.
2.
In addition, the Motor Vehicle Control of Liechtenstein also collects the levy on heavy goods traffic and the charge for the use of national roads. The Federal Directorate-General for Customs and Motor Vehicle Control of Liechtenstein rules and deals directly with each other. The Motor Vehicle Control shall be deducted from the amounts to be paid to the Customs Branch for:
4 per cent of the heavy goods traffic charge, 10 per cent of the fee for the use of national roads.

Vehicles registered in the Principality of Liechtenstein are free from the charge on heavy goods traffic for races between Liechtenstein and the station of Buchs and return, if they bring goods to the railway or if they Will look for it.
4.
The following shall be exempt from the charge on heavy goods traffic:
(a)
Police and fire service vehicles and ambulances;
(b)
Vehicles of PTT undertakings and transportation companies where they are used exclusively on the automotive routes of PTT or only within the limits of Concession I;
(c)
Agricultural vehicles;
(d)
Vehicles with short term liechtensteine plates;
(e)
Vehicles with professional liechtensteine plates;
(f)
The replacement Liechtenstein vehicles, if the charge has been paid for the original vehicle;
(g)
Motor vehicles whose energy is supplied by an electric battery;
(h)
Housing trailers for forwarves and circuses;
(i)
Motor vehicles with caterpillars.
5.
Only half of the fee set out in Article 1 shall be encumbered. E Paragraph, of the Order of October 26, 1994 5 On the charge on heavy goods traffic:
(a)
Motor carts;
(b)
Trailers used to transport things for forwarts and circuses;
(c)
Trailers used to transport things, designed to be transported by rail with so-called average containers and which use the road only for the initial and terminal journey.
6.
Are exempt from the levy for the use of national roads:
(a)
Vehicles of the fire and police services if they are reported as such, ambulances as well as civil protection vehicles with blue control plates and the international distinctive sign of civil protection;
(b)
Vehicles equipped with liechtensteinese professional plates for running during working days;
(c)
Vehicles engaged in rescue operations (fire, accident, failure, etc.);
(d)
Fixed trailers, motorcycle trailers and side-cars;
(e)
Light articulated vehicles on which the charge on heavy goods traffic is levied;
(f)
Vehicles running errands during official examinations for driving licences.

The Department would be grateful to the Embassy if it confirmed the Government's approval of the above. In this case, the present note and the response of the Embassy would constitute an agreement between the two Governments which would enter into force on the date of the reply and would be applicable retroactively as of 1 Er January 1995. It would replace the exchange of notes of 6/19 December 1984 6 And would be denounced at all times. It would cease to be in force three months after receipt of the denunciation.

The Department also takes this opportunity to express to the Embassy of Liechtenstein the assurance of its high regard.

The Embassy of the Principality of Liechtenstein presents its compliments to the Federal Department of Foreign Affairs and has the honour to acknowledge receipt of its note of 22 December 1995, by which the Department sent the Embassy, The intention of the Princely Government, the Swiss note, initialled by Ambassador Mathias Krafft, on the charge on heavy goods traffic and the motorway sticker.

The Government of the Principality of Liechtenstein has decided to approve the regulation on the levying of a levy on heavy goods vehicles and a charge for the use of national roads. The renewed regulation by exchange of notes therefore comes into force on the date of this reply from the Embassy and is applied retroactively as of January 1995.

The Embassy of the Principality of Liechtenstein takes this opportunity to renew to the Federal Department of Foreign Affairs the assurance of its high regard.
