Having regard to art. 43, para. 2, and 47, para. 2, of the Federal Act of 21 March 1997 on the Organisation of Government and Administration (LOGA) 1 , given art. 28 of the Order of 25 November 1998 on the Organisation of Government and Administration (OLOGA) 2 ,

Chapter 1 The Department

Art. 1 Objectives

1 The Federal Department of Finance (DFF) is endeavor to pursue a budgetary policy aimed at maintaining and strengthening Switzerland's international competitiveness in the long term, guided by the principles of efficiency, effectiveness, and efficiency. Equity and proximity to the citizen.

2 It ensures that the tax share and the share of the state are among the lowest in the Organisation for Economic Co-operation and Development (OECD).

3 The DFF has the following objectives:

Federal finances:

4 The DFF pursues these objectives, taking into account developments at European and global levels. In collaboration with the Federal Department of Foreign Affairs (DFAE), he defends the Federal Department of Economics, Training and Research (DEFR). 1 (External Economic Affairs), the Swiss National Bank (SNB) and the Federal Financial Market Supervisory Authority (FINMA), Switzerland's interests in international financial, fiscal and monetary affairs.

Art. 2 Principles Governing the Activities of the Department

The DFF observes the general principles governing administrative activity (Art. 11 OLOGA), respects the principle of subsidiarity of state activity and acts according to the following principles:

Collaborating with economic circles, social partners and the cantons;
B.
It takes into account the concerns of citizens;
C.
Promoting sustainable and administrable simple solutions;
D.
Ensures that procedures are expeditious and delivers benefits in accordance with client expectations;
E.
It practices a clear and open information and communication policy.
Art. 3 Specific skills

1 The DFF continues and judges the perpetrators of the criminal provisions of the Law of 22 June 2007 on Financial Market Surveillance (LFINMA) 1 And laws in the financial markets referred to in s. 1 LFINMA (art. 50, para. 1, LFINMA).

2 It executes, within its field of competence, the law of 14 March 1958 on liability 2 .

3 It instructs appeals against decisions of the Federal Department of Justice and Police, which are not based on the law of the personnel of the Confederation (art. 75, para. 2 of the Act of 20 Dec. 1968 on administrative procedure 3 ).


Art. 4 Provisions common to all administrative units

1 The administrative units of the DFF mentioned in chap. 2 have, within their field of competence, standing before the Federal Court.

2 Objectives set out in s. 5, 7, 8, 10, 12, 14, 16, 19, 21 and 25 guide the DFF's administrative units in carrying out the tasks and exercising the powers set out in the federal legislation.

Chapter 2 Headquarters Administrative Units

Section 1 General Secretariat, Delegated to Plurilingualism and Internal Oversight 3

Art. 5 General Secretariat 1

The General Secretariat (SG) shall assume the functions defined in Art. 42 LOGA and the following main tasks:

A.
Supports the Head of the Department in his duties as a member of the Federal Council and in the direction of the department;
B.
It plans, coordinates, monitors and takes the lead in dealing with the affairs of the department;
C.
Ensuring the collection and planning of information and communication at the departmental level;
D. 2
Provides logistical services and manages the use of departmental resources in agreement with offices;

It accompanies the drafting of legislation at the level of the department and develops legislative acts concerning the national regulation of the financial markets;
E.
Performing the tasks referred to in s. 3, the judgment of the appeals concerning matters of personnel within the DFF (art. 35 of the Act of 24 March 2000 on the personnel of the Confederation 4 ) As well as the General Legal Council at the department level;
F.
It provides DFF administrative units with support services in the area of translation;

It provides administrative services to the State Secretariat for International Financial Questions (IFC) and the Confederation Computer Steering Unit (UPIC).

Art. 6 1 Federal delegate to plurilingualism

1 The Federal delegate to plurilingualism is subordinate to the SG.

Art. 6 A 1 Internal Oversight

1 Internal supervision checks the administrative activity within the DFF on a mandate and in accordance with the instructions of the Head of the Department.

Section 2 State Secretariat on International Financial Issues 4

Art. 7 Objectives and functions

1 The IFC has the following objectives:

A.
It defends, in particular with the DFAE, the DEFR (external economic affairs), the SNB and FINMA, the interests of Switzerland in international financial, fiscal and monetary affairs;
B. 1
It promotes the international competitiveness and integrity of the Swiss financial centre, facilitates access to international financial markets, strengthens the stability of the Swiss financial sector and contributes to improving tax competitiveness by holding International context.

2 In this context, the IFC has in particular the following functions:

A.
It supports the DFF and the Federal Council in the coordination and strategic conduct of international financial, fiscal and monetary affairs, as well as international customs cases, provided that it is not business External economic policy under the Secretary of State for Economic Affairs (SECO);

Preparing international financial, fiscal and monetary affairs and laying the foundations for the policy of promoting the financial marketplace and the regulation of international financial markets;

Representing Switzerland in international organizations and bodies responsible for international financial, fiscal and monetary affairs;

It maintains, on behalf of the Confederation, relations with the SNB with regard to international monetary cooperation and the stability of financial markets and relations with FINMA with regard to the promotion policy Financial and regulation of international financial markets;

It maintains relations with professional associations and foreign authorities in its field of competence;

Providing information on financial affairs, tax matters and international monetary affairs.

Section 3 Federal Finance Administration

Art. 8 Objectives and functions

1 The Federal Administration of Finance (AFF) has the following objectives:

A.
It guarantees the overall view of the financial situation of the Confederation;
B.
Preparing the account and, taking into account the requirements of economic policy, the budget and the financial plan for the attention of the Federal Council;
C.
It ensures the effective management of the appropriations and expenditure and the economic use of the financial resources, and it intervenes in the preparation of the budget and the financial plan of the Confederation and in the treatment of the affairs of the Federal Council from the Federal Chancellery and departments when they have financial implications;
D.
Ensures results-based administrative management and systematic controlling of the services of the federal government, such as external administrative services;
E.
It ensures, through the use of modern cash and cash management, the solvency of the Confederation at all times, thereby enabling the Confederation to maintain a privileged position in the capital market.

2 In this context, the AFF carries out in particular the following functions:

A.
Prepare savings and remediation measures if they are necessary to ensure that the budgetary objectives can be met within the specified time frame;
B.
It draws up the bases and options for budgetary policy, in particular those necessary for the conduct of economic and monetary policy;
C.
It represents, after consulting the IFC and SECO, Switzerland in international organisations and bodies responsible for financial and monetary policy, financial statistics, treasury management, accounting or Public works government;
D.
It develops legislative acts in the fields of:

Budgetary law,

Monetary law and the law governing the action of the national bank, except as regards the stability of the financial markets;
E.
It represents the Confederation in order to recover disputed claims or to reject unfounded pecuniary claims;

Coordinates risk management and provides centralized management of the insurance of the Confederation;

It maintains relations with the SNB on behalf of the Confederation in areas outside the competence of the IFC.

Art. Special provisions

1 The AFF has the following special tasks:

A.
Carries out the borrowings and investments of the Confederation;
B.
It develops and implements normative acts in the area of financial equalization between the Confederation and the cantons;
C.
It establishes the financial statistics of public administrations;
D.
Manages the DFF Finance Service Centre;

It gives the approval of the DFF necessary for the conclusion of insurance contracts.

2 The AFF defines the terms and conditions of budgetary management, accounting and payments of the federal government. It lays down the directives required in this respect.

3 The following units are subordinate to the AFF: 2

The clearing house;

The Federal Compensation Fund, together with the Family Benefits Clearing Fund;
C.
The Swiss Compensation Fund;
D.
The DI Board for policyholders residing outside Canada;

Section 4 Federal Office of Personnel

Art. 10 Objectives and functions

1 The Federal Office of Personnel (OFPER) has the following objectives:

A.
It creates the basis for the Confederation to conduct a staff policy and forward-looking foresight policy;
B.
Ensuring the efficient and economical use of financial and human resources;
C. 1
Promoting equality between men and women within the federal government;

Providing training and staff development tailored to the needs and practice, with the exception of specialized training.

2 In this context, OFPER has in particular the following functions:

A.
Develops, develops and implements the personnel policy and the pre-need policy of the Confederation;

Art. 11 Special provisions

1 The OFPER has the following specific tasks:

A.
It provides a social counselling service for federal personnel;
B.
Manages the DFF Personnel Services Centre;
C.
Manages the federal government's training centre.

2 The following are administratively attached to OFPER:

A.
The secretariat of the joint body of the Provident Fund of the Confederation;
B.
The Mediation Service for the staff of Confederation.

Section 5 Federal Contributions Administration

Art. 12 Objectives and functions

1 The objectives of the AFC are to:

A.
It provides the Confederation with the bulk of the revenue it needs to finance its tasks;
B.
Ensures the fair and effective collection of federal taxes under its jurisdiction.

2 In this context, the AFC carries out in particular the following functions:

A.
It draws up normative acts in the field of tax law, taking into account the imperatives of economic and budgetary policy;
B.
It shall ensure, in cooperation with the cantons, the formal harmonisation of the direct taxes of the Confederation, the cantons and the municipalities;
C. 1
Advising on national tax issues and, in consultation with the IFC, on questions of implementation of international tax law;
D.
It contributes to a favourable tax environment and to the development of the tax system.

Art. 13 1 Specific Tasks

The AFC has the following specific tasks:

A.
It supports the IFC in the negotiation of international tax treaties and applies these treaties; it coordinates the necessary contacts with the IFC;
B.
It represents Switzerland in international organizations and bodies responsible for the implementation of the tax law; it coordinates with the IFC and complies with its guidelines;
C.
It collects from other States taxes at source agreed in international treaties;
D.
It draws up statistics on Swiss taxation and maintains documentation on the Swiss tax system and, in collaboration with the IFC, on foreign tax systems.

Section 6 Federal Customs Administration

Art. 14 Objectives and functions

1 AFD has the following objectives:

A.
It provides the Confederation with a substantial share of the revenue it needs to finance its tasks;
B.
Manages the movement of goods at the border using simple procedures and a reasonable cost, in accordance with the international standards recognized by Switzerland in the flow of goods;
C.
Preventing and combating illegal acts in border areas and thereby contributing to the internal security of the country and the protection of the population.

2 In this context, AFD has in particular the following functions:

A.
Monitoring and controlling the movement of persons and goods across the customs border;
B.
It provides security in the border area;
C.
It levies customs duties and taxes owing under federal non-customs laws, provided that the legislative acts concerned provide for it;
D.
It participates in the performance of non-customs requirements of the Confederation, provided that the legislative acts concerned provide for it;
E.
It works with the economic community, in particular with a view to simplifying and speeding up customs procedures;
F.
It works with foreign customs administrations, in particular as regards the coordination of customs procedures.
Art. 15 Specific Tasks

AFD has the following specific tasks:

A.
Negotiating, in consultation with the IFC and in accordance with its directives, international treaties on customs technical matters, provided that they are not external economic policy issues of the SECO, and Enforcing them;
B.
It represents, in consultation with the SFI and the SECO and in accordance with their directives, Switzerland in international organisations and bodies responsible for customs technical matters.

Section 7 Federal Office of Informatics and Telecommunications

Art. 16 Objectives

As an internal IT and telecommunications provider, the Federal Office of Information Technology and Telecommunications (OFIT) has the following objectives:

It provides IT and telecommunications services to support recipient processes and ensure the security required for IT infrastructure and data; in doing so, it complies with Confederation Informatics Council (IT) guidelines;
B.
It focuses its offer of benefits on the needs of the beneficiaries;
C.
It uses the means available economically and efficiently.
Art. 17 Tasks

The OFIT has the following tasks:

A.
Developing and operating systems and applications focused on the specific processes of clients;
B.
Developing and operating systems and applications for e-government, including the publication of information on the Internet;
C.
It operates systems and applications as well as the relevant centres of competence;
D.
Ensuring the operation of calculation centres for disaster prevention;
E.
It uses the office facilities of its clients, ensures its operation and assists users;
F.
Ensuring the technical interoperability of office automation across the federal government;
G.
Providing voice and data communications services within the federal government and connecting it to the Internet;
H.
Providing general or specific training in the field of information technology;
I.
It collaborates with organisations active in the provision of IT services and represents the Confederation within these organisations.
Art. 18 Special provisions

2 OFIT charges its services to its customers and ensures cost transparency vis-à-vis DFF. 2

3 It provides interdepartmental benefits in accordance with the IC guidelines.

Section 8 Federal Office for Construction and Logistics

Art. 19 Objectives and functions

1 The Federal Office for Construction and Logistics (OFCL) has the following objectives:

A.
Pursuant to s. 6 of the Order of 5 December 2008 concerning the management of the real estate and logistics of Confederation (OILC) 1 , it ensures the provision of premises, in particular for:
1.
The federal government,
2.
The Federal Assembly and Parliamentary Services;
3.
Federal courts,
4.
Swiss representations abroad;
B.
As the sole provider of benefits during all phases of the logistics process, it covers the needs:
1.
The central federal government,
2.
Commissions for decision-making,
3.
Units administered administratively to the federal government.

2 In this context, OFCL has in particular the following functions:

A.
Ensuring overall real estate management;
B.
As a central purchasing service in the civilian field, it guarantees, in particular, the basic logistical supply of standard products and assortment articles;
C.
Ensures the centralized distribution of federal and print publications to the public and to the federal government;
D.
Ensuring the packaging and editing of the Confederation data.

Art. Special provisions

1 The OFCL has the following specific tasks:

A.
Conducting the Conference on the Coordination of Construction and Building Services of Public Works Teachers (KBOB) and providing its secretariat;
B.
Leads the Confederation Purchasing Commission (CA) and provides its secretariat;

Leads the Public Procurement Competence Centre;
D.
It is the implementing authority of the Confederation in accordance with the order of 27 November 2000 on construction products 2 And heads the secretariat of the Construction Products Commission.

Section 9 5 Confederation IT Steering Unit

Art. A

1 UPIC is an administrative unit within the meaning of Art. 7, para. 1, let. D, in relation to s. 7, para. 2, OLOGA.

2 It is headed by the Chief Information Officer.

3 It has the following goals:

A.
Create the conditions for effective, appropriate, economic, user-driven, and secure use of information and communication technologies within the federal government;
B.
Encourage, through the use of information and communication technologies by governments and public administrations throughout Switzerland, effective administration, close to the citizens and the economic community;
C.
To promote the safe operation of important IT infrastructures in Switzerland.

4 In pursuit of its objectives, the UPIC fulfils in particular the tasks and functions listed in the December 9, 2011 Ordinance on Information Technology in the Federal Government 1 .


Chapter 3 Decentralized Federal Government Units

Section 1 Federal Liquor Control Board

Art. Objectives and functions

1 In the area of distilled beverages, the Federal Liquor Control Board (FRG) has the following objectives:

A.
It provides the Confederation with some of the revenue it needs to finance its tasks;
B.
It ensures the supply of the Swiss high-alcohol market for consumption or industry;
C.
It contributes to the promotion of health, particularly in the field of youth protection.

2 In this context, the Federal Republic of Germany carries out in particular the following functions:

A.
Grants concessions to Swiss producers;
B.
It levies consumption tax on distilled beverages;
C.
It carries out the commercial provisions of the alcohol legislation;
D.
Purchases, stores and sells high-grade alcohol;

Art. Special provisions

1 The RFA has the following specific tasks:

A.
It encourages, in the application of alcohol legislation, the exchange of information and cooperation between federal offices, cantons, economic circles and prevention organisations;
B.
It pays the tithes of alcohol to the cantons for the purpose of prevention.

2 In the field of high degree alcohol trade, it manages the profit centre "Alcosuisse".

Section 2 Federal Financial Market Supervisory Authority

Art.

1 FINMA is the supervisory authority of the Confederation in the field of financial markets.

2 Its role, tasks, competencies and organization are governed by FINMA 1 .


Section 3 Federal Pension Fund PUBLICA

Art. 24

1 The Federal Pension Fund PUBLICA manages the social welfare of employers covered by art. 4 of the Act of 20 December 2006 on PUBLICA 1 ;

2 Its role, tasks, competences and organisation are governed by the law on PUBLICA.


Section 4 Federal Finance Control

Art. 25 Objectives and functions

1 The Federal Audit Office (CFO) is the supreme body of the Confederation in the field of financial supervision. It carries out its tasks independently and independently in accordance with the legal requirements.

2 Through its monitoring and advisory function, it supports:

A.
The Federal Council, in the exercise of its oversight of the federal government;
B.
Parliament, in the exercise of its high oversight of federal administration and justice.

3 In examining the financial management at each phase of the budget implementation, the CDF ensures, in the field assigned to it by law, that this management meets the criteria of regularity, legality and efficiency.

Art. 26 Notice to the Federal Council

As part of the co-report procedure, the CDF may itself issue opinions to the Federal Council.

Chapter 4 Final provisions

Art. 27 Organization Regulation

The DFF shall issue an organisational regulation, in accordance with Art. 29 OLOGA.

Art. 28 Repeal of the law in force

The Order of 11 December 2000 on the organization of the Federal Department of Finance 1 Is repealed.
