Mr. Federal Councillor,

I have noted with interest the Provisional Agreement on the Privileges and Immunities of the United Nations concluded between the Swiss Federal Council and the Secretary-General of the United Nations on 19 April 1946. 3 .

It is the result of a prior exchange of views between your services and mine that the Federal Council is prepared to consider the said Agreement as applicable to the Intergovernmental Committee on European Migration, provided that the latter gives Its agreement. It is understood, however, that the provisions of this Agreement will not be applicable to the Swiss staff, which will not be able to claim the benefit of the exemption from taxes as planned: I have taken note of the fact that staff Switzerland of the Committee on Migrations will thus be treated as is generally the case of other intergovernmental bodies having their headquarters in Switzerland.

In these circumstances, I can give the name of the Committee, in accordance with my mandate (Resolution No. O 20 of the Committee), my full and full agreement to the Agreement, as defined above.

I would be grateful if you would also confirm your agreement. Our exchange of letters would then be regarded as an arrangement between the Federal Council and the Intergovernmental Committee on European Migration, which could be denounced under the same conditions as the Interim Arrangement. 19 April 1946 between the Federal Council and the United Nations.

At the Intergovernmental Committee on European Migration,

Mr. Director,

We had the honour to receive your letter of 7 April on the application to the Intergovernmental Committee of the Provisional Arrangement on the Privileges and Immunities of the United Nations 4 .

We have duly noted that you consider that arrangement to be applicable to your Committee; however, it is understood that the provisions of this Agreement are not applicable without any other to the Swiss staff, who cannot claim Exemption from taxes as provided for in the arrangement.

As the Federal Council decided on 28 December 1951, we can, for our part, confirm that the Federal Authorities will apply the provisional arrangement with the Organisation to the Committee on European Migration United Nations, with the reservation above.
