The Swiss Confederation, hereinafter referred to as "Switzerland" and the European Economic Community, hereinafter referred to as "the Community", hereinafter referred to as "Contracting Parties",
Whereas, by its decision of 3 October 1983, the Swiss Federal Council adopted, for the period 1985-1990, a Swiss national research programme entitled 'Materials for the needs of the future', hereinafter referred to as 'the Swiss programme', which is Executed and financed in Switzerland by the Swiss National Scientific Research Fund;
Whereas, by its decision of 10 June 1986, the Council adopted, for a period of four years from 1 Er January 1986, a research programme in the materials sector (raw materials and advanced materials), which includes a sub-programme on advanced materials (EURAM), hereinafter referred to as "the Community programme"; Decision provides for the conclusion of agreements with third countries, in particular those involved in European cooperation in the field of scientific and technical research (COST);
Whereas the Community and Switzerland have concluded a framework agreement for scientific and technical cooperation 1 Which entered into force on 17 July 1987;
Whereas cooperation between the Swiss and Community programmes would be in the interests of both parties, ensuring the complementarity of research undertaken on both sides and avoiding unnecessary duplication,
Agreed to the following:
The Community and Switzerland shall cooperate in the framework of the Community and Swiss programmes, as set out in Annexes A and B.
Each Contracting Party shall bear the cost of implementing its programme.
The costs resulting from cooperation between programmes shall be borne by the Contracting Parties for the amounts concerned.
The cooperation referred to in Art. The objective of 1 is to coordinate and stimulate the implementation of the Community Programme and the Swiss Programme in order to increase the performance of the research efforts undertaken on both sides.

It is carried out by means of:
The Commission of the European Communities, on the one hand, and the bodies designated by the Swiss Federal Council, on the other hand, ensure the implementation of cooperation between the Community programme and the Swiss programme.
To this end, the Head of the Community Programme shall invite, as appropriate, the Head of the Swiss Programme to participate in meetings of Community working groups and experts and the Head of the Swiss Programme shall invite, according to the Needs, the head of the Community programme to participate in meetings of Swiss working groups and experts.
These officials may be accompanied by experts to participate in the meetings to which they are invited.
The knowledge arising from the implementation of the Community programme during the validity of this Agreement shall be communicated to Switzerland and its bodies (bodies, undertakings or persons) carrying out research or production of To justify access to such knowledge, under the same conditions as to the Member States of the Community.
The knowledge arising from the implementation of the Swiss programme during the validity of this Agreement shall be communicated to the Member States of the Community and their bodies concerned under the same conditions as the relevant bodies of Switzerland.
If, in the performance of the actions of the respective programmes, are made or conceived of patentable inventions which will be protected by patents, the Contracting Parties shall encourage, as far as possible, the grant by the holders of these Patents, non-exclusive licences for persons and undertakings established in the Community and in Switzerland. Where appropriate, such licences shall be granted on non-discriminatory terms.
This Agreement shall apply to the territories in which the Treaty establishing the European Economic Community is applicable and under the conditions laid down in that Treaty, on the one hand, and on the territory of the Swiss Confederation, of the other part.
(1) This Agreement shall be concluded for the duration of the programme of the Contracting Party which expires first.
Except denunciation of the agreement within one month following a decision to revise the programme of one of the Contracting Parties, Annex A or B shall be amended to take account of the revision. The Contracting Parties shall communicate the revision decisions.
(2) Except in the month following the decision to adopt a new programme by one of the Contracting Parties, this Agreement shall be renewed for the duration of the programme of the Contracting Party which expires first.
The provisions of s. 1, para. 2, shall apply mutatis mutandis.
(3) This Agreement shall not be deemed to have expired solely because of a delay in the adoption of a subsequent programme of one of the Contracting Parties.
4. Except for the provisions of s. 1 and 2, each Contracting Party may, at any time, terminate the agreement with six months' notice.
Annexes A and B form an integral part of the Agreement.
This Agreement shall be approved by the Contracting Parties in accordance with the procedures in force for each of them. It shall enter into force as soon as the Contracting Parties have notified the completion of the procedures necessary for that purpose.
This Agreement shall be drawn up in duplicate in the German, French, Italian, English, Danish, Spanish, Greek, Dutch and Portuguese languages, each of these texts being equally authentic.
