Between the Swiss Federal Council, the Austrian Federal Government and the Government of the Principality of Liechtenstein concerning the establishment of juxtaposed national control offices

The Swiss Federal Council, the Austrian Federal Government and the Government of the Principality of Liechtenstein,

See art. 1, para. 3, let. A, of the Convention of 2 September 1963 between the Swiss Confederation and the Republic of Austria on the establishment of juxtaposed national inspection offices and the checks in vehicles on the road 2 , having regard to the Protocol of 2 September 1963 concerning the application to the Principality of Liechtenstein of the Austro-Swiss Convention, with final protocol, relating to the establishment of juxtaposed national inspection offices and the checks in vehicles Along the way 3 ,

In order to promote reciprocal cooperation between the Swiss Confederation, the Republic of Austria and the Principality of Liechtenstein (hereinafter referred to as "the Contracting States") and

In order to speed up and simplify control at the common border,

Agreed to the following:

Art. 1 Principle and purpose

1 In order to speed up control, the Contracting States agree to establish at the border between the Austro-liechtensteinese national offices with juxtaposed national controls allowing the international movement of persons and motor vehicles to Stop only once for control purposes.

2 The Contracting States shall ensure that all the authorities involved in the control cooperate closely and that all measures to ensure prompt control in the areas defined in Art. 2 to 5 be taken and harmonized as best as possible.

3 The agents of the Contracting States assigned to the juxtaposed national control offices support each other in the control of cross-border traffic in order to facilitate this control and to simplify the movement of persons at the border Com-mune.

4 In order to support each other in the execution of their daily service, in particular when the bodies in service, the parties present on the premises and the non-affected parties are threatened or their lives endangered, the agents of the States Shall be entitled to assist each other, including in the installations, buildings and parts of installations or buildings which they are usually the only ones to be used.

Art. 2 Nofels-Ruggell Border Crossing Point

1 Juxtaposed national control offices are set up in Liechtenstein at the Nofels-Ruggell border crossing point.

2 As defined in Art. 4, para. 1, of the Convention of 2 September 1963, the Austrian control office is attached to the commune of Feldkirch.

3 The control area includes:

A.
The facilities used jointly by the agents of the two States Parties, namely:
-
A sector of the Noflerstrasse measuring 115 metres from the fronting on the bridge over the Hasabach to Ruggell,
-
A strip of land of 2 metres wide around each of the two customs buildings,
-
Parking spaces adjacent to the control buildings;
B.
The control building located south-east of the Noflerstrasse, reserved for the exclusive use of the Austrian agents.
Art. 3 Nofels-Fresch-Schellenberg Border Crossing Point

1 The juxtaposed national control offices are set up in Liechtenstein territory and in Austrian territory at the Nofels-Fresch-Schellenberg border crossing point.

2 The control area includes:

A.
For Austrian agents, premises and installations reserved for the exclusive use of Austrian agents or used in common by Austrian agents, namely:
-
The control building,
-
The totality of the old customs road leading to the border; western boundary: the place of the postal car and parking places below the Löwen restaurant (house number 5), instead of Winkel de Hinterer Schellenberg,
-
Stopping and parking places adjacent to the customs building;
B.
For Swiss and Liechtenstein agents, the facilities used in common or exclusively by the agents of the States Parties, namely:
-
A district of Feldkirch-Oberfresch, 26 metres long and 4 metres wide, from the Austrian border in the direction of Feldkirch-Nofels,
-
The control building and parking spaces adjacent to it.
Art. 4 Tosters-Mauren Border Crossing Point

1 Juxtaposed national control offices are set up in Austrian territory at the Tosters-Mauren border crossing point.

2 As defined in Art. 4, para. 1, of the Convention of 2 September 1963, the Liechtenstein control office is attached to the commune of Mauren.

3 The control area includes:

A.
The facilities and premises used jointly by the agents of the States Parties, namely:
-
An area of Highway L 61 between the border and the control building used in common, including the official location,
-
Parking spaces adjacent to the control building,
-
The audit room, the premises for social activities and health;
B.
Offices reserved for the exclusive use of Swiss and Liechtenstein agents, located in the south-west half of the building.
Art. 5 Tisis-Schaanwald Border Crossing Point

1 The juxtaposed national control offices are set up in Austrian territory and in Liechtenstein territory at the Tisis-Schaanwald border crossing point.

2 The control area includes:

A.
For Austrian agents:
-
The premises of the control building reserved for the exclusive use of Austrian agents or used in common by the Austrian agents,
-
The official location for the traffic of the goods surrounding the Swiss customs vessel, including the premises and surfaces used for the control of passengers,
-
Road sector number 234 between the Heiligwies border and bifurcation;
B.
For Swiss and Liechtenstein staff:
-
The premises of the control building used in common or exclusively by the agents of the States Parties,
-
Mark (control island) PL number 485,
-
The Liechtensteinerstrasse L 191 between the border, at km 3.23, and the end of the parking space for heavy goods vehicles located at km 3.10; in addition, the parking spaces and control surfaces in this Adjacent to this sector near the customs office building (PL number 242) and the building (container-PL number 484) located to the north of the control island marquise.
Art. 6 Entry into force and termination

1 This Agreement shall enter into force on the first day of the first month following the month in which the signature took place.

2 The Contracting States shall conclude this Agreement for an indefinite period. It may be terminated by each of the Contracting States at any time by the diplo-matic route. In such a case, the agreement shall cease to be in force on 90 E (not Fortieth) day after receipt of the termination of the other Contracting State.

3 The application of this Agreement may be temporarily suspended by each of the Contracting States, in whole or in part, for reasons relating to public order, security or public health. In advance, the Contracting Parties shall inform each other of the adoption and repeal of such measures.

4 Apart from termination, this Agreement shall cease to be valid if the Convention of 2 September 1963 between the Swiss Confederation and the Republic of Austria on the establishment of juxtaposed national inspection offices and controls In vehicles en route as well as the Protocol of 2 September 1963 concerning the application to the Principality of Liechtenstein of the Austro-Swiss Convention, with final protocol, concerning the establishment of national control offices The juxtaposition and controls in the vehicles on the road cease to be in force.

5 Upon the entry into force of this Agreement, shall cease to be in force:

A.
The Agreement of 24 May 2000 between the Swiss Federal Council, the Government of the Principality of Liechtenstein and the Federal Government of Switzerland concerning the establishment of national control offices juxtaposed at the border crossing Ruggell/Nofels 1 ;
B.
The Agreement of 24 May 2000 between the Swiss Federal Council, the Government of the Principality of Liechtenstein and the Federal Government of Switzerland concerning the establishment of national control offices juxtaposed at the border crossing Mauren/Tosters 2 ;
C.
The Agreement of 30 March, 7 April and 23 June 1993 between the Austrian Federal Government, the Government of the Principality of Liechtenstein and the Swiss Federal Council concerning the creation of the Tisis/Schaanwald road border crossing Juxtaposed national office for the traffic of goods 3 .
