Guidelines for the protection against noise and laser radiation during demonstrations

(Ordnance and laser order, OSLa)

The Swiss Federal Council,

Having regard to art. 13, para. 1, and 39, para. 1 of the Act of 7 October 1983 on the protection of the environment 1 ,

Stops:

Section 1 General provisions

Art. 1 Purpose

The purpose of this Order is to protect the public attending demonstrations against noise and laser radiation.

Art. 2 Scope of application

1 This order applies to events taking place in buildings and outdoors, in which the public is exposed to sounds produced or amplified by electroacoustics, or to laser beams.

2 It does not apply to infrasound or ultrasound.

Art. 3 Information

1 The Federal Office of Public Health (FOPH) provides information on noise and laser radiation and recommends appropriate measures to reduce the risks to health.

2 The cantons support the OFSP in this approach.

Section 2 Sound clouds

Art. 4 1 Noise level per hour

Art. 5 Emission Restriction

1 Anyone who organises demonstrations is obliged to limit noise emissions so that the immissions produced at the event do not exceed the sound level per hour of 93 dB (A) throughout the duration of the event. 1

2 Demonstrations with higher immissions are permitted if they meet the requirements of ss. 6 or 7.

3 Immissions in excess of 93 dB (A) are not permitted in events intended primarily for persons under 16 years of age. 2

Art. 5 A 1 Maximum noise level

The maximum sound level L AFmax (Frequency weighting A, time constant Fast (F) t Ein = 125 ms) of 125 dB (A) shall not be exceeded throughout the duration of the event.

Art. 6 1 Demonstrations with sound levels per hour between 93 dB (A) and 96 dB (A)

Anyone who organises events whose sound level per hour is between 93 dB (A) and 96 dB (A) must ensure that:

A.
Noise emissions are limited so that the immissions do not exceed the sound level per hour of 96 dB (A);
B.
...
C.
That the public be clearly visible in the entrance area of the event:
1.
The maximum sound level per hour of 96 dB (A),
2.
The risk of hearing injury from high noise levels and the increase in the risk with duration of exposure;
D.
That ear protectors comply with the SN EN 352-2:2002 standard 2 Be made freely available to the public, and
E.
The noise level per hour is measured and controlled during the event by means of a sound-level measuring device as per the Annex, c. 2.1.

Art. 7 1 Demonstrations with a sound level per hour between 96 dB (A) and 100 dB (A)

1 Anyone who organises events with a maximum duration of three hours and whose sound level per hour is between 96 dB (A) and 100 dB (A) must ensure that:

A.
Noise emissions are limited so that the immissions do not exceed the sound level per hour of 100 dB (A);
B.
The maximum sound level per hour of 100 dB (A) is clearly visible in the entrance area of the event, and
C.
The requirements set out in s. 6, let. C, c. 2, let. D and e, be completed.

2 Anyone who organises events of more than three hours and whose sound level per hour is between 96 dB (A) and 100 dB (A) must ensure that:

A.
The requirements set out in para. 1 be completed;
B.
The sound level is recorded throughout the duration of the event according to the Annex, c. 1.3;
C.
The recording of the sound level, as well as the indications on the place of measurement, the place of determination and the difference in the sound level between those two places according to the annex, c. 1.1, para. 2, be kept for 30 days and submitted at the request of the executing authority, and
D.
The public has at its disposal a hearing recovery area and is clearly visible in the entrance area of the event.

3 The hearing recovery area must meet the following requirements:

A.
Sound emissions shall not exceed the sound level per hour of 85 dB (A);
B.
Must include at least 10 % of the display surfaces that are intended for the public;
C.
Shall be communicated to the public in a visible manner and shall be freely accessible throughout the duration of the event.

Art. 7 A 1 Multiple-part events

If a demonstration of more than 93 dB (A) per hour takes place in several parts, the requirements set out in s. 6 and 7 apply to the event as a whole.

Art. 8 Obligation to advertise

1 The organizer is required to give written notice to the executing authority, at least 14 days in advance, of the events under s. 6 and 7. The announcement must specify:

A.
The location and nature of the event;
B. 1
The noise level per hour maximum;
C.
The date, the start of the event and its duration;
D.
The name and address of the organizer;
E.
The name and contact information of the person responsible for the event;
F.
Where applicable, the application of the specific method of measurement and calculation according to the Annex, c. 1.4.

2 In the case of events under Art. 7, para. 2, a site map showing the location of the auditory recovery area, its size and signage must also be provided.

Art. Identification of immissions

1 The measurement and calculation methods used to determine the immissions are defined in the Annex.

2 The measuring instruments available to the organizers shall meet the requirements set out in the Annex, c. 2.1.

Section 3 Laser radiation

Art. 10 Principle

1 Anyone who organises events using laser installations must develop and exploit them in such a way as to:

A. 1
The requirements of the IEC technical directive 2 60825-3:2008 on laser safety 3 Are respected;
B.
They do not produce immissions harmful to the public.

2 In particular:

A. 4
Laser installations of classes 1M, 2M, 3R, 3B and 4 in accordance with chap. 8 and 9 of SN EN 60825-1:2007 5 Be equipped with an easy-to-use safety switch that immediately terminates the laser radiation;
B.
That laser installations are fixed so that they cannot be displaced by mob movements, vibrations or wind gusts;
C.
That no repair or other operation, such as beam adjustment or correction, should be performed during a demonstration.

3 In accordance with Table A. 1 of the standard SN EN 60825-1:2007 on the safety of laser devices, immissions exceeding the maximum permitted irradiation values shall be deemed to be harmful for the direct exposure of the cornea to laser beams. 6 . 7

4 The immissions of a laser beam facility are deemed to be non-noxious if the radii are not broadcast directly or indirectly in the area reserved for the public, i.e. the space up to 3 m above the surface occupied by the public and On a 2.5 m band around the band.

Art. 11 Obligation to advertise

1 The organiser is required to give written notice to the executing authority, at least 14 days in advance, of the events using Class 1M, 2M, 3R, 3B and 4 laser installations.

2 The advertisement must in particular contain the following particulars and documents:

A.
The location and nature of the event;
B.
The date, the start of the event and its duration;
C.
The name and address of the organizer;
D.
Location and hours of use of laser facilities;
E.
The classification of laser facilities used;
F.
Information that indicates whether laser beams are broadcast, directly or indirectly, in the public area during the event;
G. 1
A site map showing the area reserved for the public, the location of all laser projectors and, for each, the shortest distance to the public area;
H.
The name and contact information of the person responsible for the event;
I. 2
Specification of each laser projector (shortest distance to the area reserved for the public, maximum total output power for radiation in the public area, minimum beam divergence, beam diameter And wavelengths).

Section 4 Execution

Art. 12 Execution Authority

The cantons shall execute this order.

Art. 13 Review of announcements

The enforcement authority reviews the completeness of the advertisements. If she finds deficiencies, she asks the organizer to fill them without delay.

Art. 14 Measures and controls

1 The implementing authority shall monitor by surveys, during the demonstrations, whether the obli-gation to announce is fulfilled and whether the sound levels and other requirements set out in Art. 5, 6, 7 and 10 are respected.

2 The measuring instruments available to the implementing authorities shall comply with the requirements set out in the Annex, c. 2.2.

Art. 15 Measures

1 If the announcement of the event shows that the requirements of this order are not met, the implementing authority shall take the necessary measures or prohibit the event.

2 If the measures or controls carried out during the demonstration indicate that the decisive sound levels are exceeded or that the obligations for the protection of the public are not met, the executing authority shall order the person Responsible for the event to limit emissions or take appropriate action.

3 The implementing authority may, in the event of repeated infringement of this order, order the installation of an electronic monitoring or limitation of the sound levels. 1

Art. 16 Costs

Anyone who organises an event shall bear the costs of the measures and controls of the implementing authority and the special benefits provided by the implementing authority.

Section 5 Final provisions

Art. 17 Repeal of the law in force

The Sound and Laser Order of January 24, 1996 1 Is repealed.

Art. 18 Transitional provisions

Derogations granted and valid under the former right shall be granted no later than two years after the entry into force of this order.

Art. 19 Entry into force

This order shall enter into force on 1 Er May 2007.

Annex 1

Measurement and Calculation Methods and Measurement Instrument Requirements

1 Methods of measurement and calculation

1.1 Principle

1 Sound immissions are determined by ear height, where the public is the most exposed (place of determination).

2 If the place of measurement differs from the place of determination, the immissions shall be calculated in relation to the place of determination. The place of measurement, the place of determination and the difference in the sound level between the two places shall be fixed in writing.

3 The sound level is an average of one hour (equivalent continuous sound level). The calculation of this average starts at any time of the event and will last 60 minutes without interruption. The equivalent continuous sound level shall not exceed the noise limit value at any time during the event.

1.2 Measurement Methods

The instruments used to measure the sound level shall have the following adjustments:

A.
Frequency weighting A;
B.
Fast time constant (F) (time constant t Ein = 125 ms).

1.3 Sound Recording

Recording of the sound level within the meaning of s. 7, para. 2, let. B, must meet the following requirements:

A.
The equivalent continuous sound level per five-minute interval L Aeq5min Must be registered every five minutes at least throughout the event;
B.
The measured data must be recorded in electronic form indicating the exact time of the measurement.

1.4 Specific measurement and calculation method

1 The sound level is measured at the mixing table if the following conditions are met:

A.
The mixing table is in the area where the public is directly exposed to sound immissions;
B.
The acute or medium loudspeakers are arranged in such a way that the public is exposed to uniform sound immissions;
C.
The microphone of the mixing table used for the monitoring of the sound level shall be fixed at the height of the case;
D.
The difference in the sound level between the mixing table (place of measurement) and the place of determination according to the c. 1.1, para. 1, is established using a defined broadband signal (pink noise/noise simulation using a program according to the standard CEI-60268-1 2 ) Or other equivalent calculation method;
E.
The place of determination and the difference in the sound level, as well as the method, shall be fixed in writing;
F.
The specific method of measurement and calculation has been announced in accordance with Art. 8.

2 The limit value applicable to the event shall be deemed to be respected in such measures if the value of measurement at the mixing table plus the difference in sound level is less than or equal to the limit value.

2 Measurement Instrument Requirements

2.1 Organisers' measuring instruments

Organizers' measuring instruments must meet the following conditions:

A.
They must be used to measure the weighted sound level L A ;
B.
They must be able to directly or indirectly determine the equivalent continuous sound level L Aeq .

2.2 Measuring instruments of implementing authorities
