Convention

Between the Swiss Federal Council and the Government of the French Republic concerning the protection of the waters of Lake Léman against pollution

The Swiss Federal Council

And

The Government of the French Republic

Desiring to coordinate their efforts to protect the waters of Lake Léman against pollution

Have agreed as follows:

Art. 1

The Contracting Governments agree to work closely together to protect against pollution the waters of Léman Lake and those of its emissary until its exit from the Swiss territory, including the surface and ground waters of their Tributaries to the extent that they contribute to the pollution of the waters of Lake Geneva and its emissary.

Art. 2

The Contracting Governments constitute an international commission for the protection of the waters of Léman Lake against pollution, hereinafter referred to as "the Commission".

Art. 3

The Commission has the following powers:

A.
It organizes and conducts all necessary research to determine the nature, extent and origin of the pollution, and exploits the results of such research;
B.
It recommends to the Contracting Governments the measures to be taken to remedy the current pollution and prevent future pollution;
C.
It can prepare the elements of an international water safety regulation for Lake Geneva;
D.
It shall examine any other matters relating to water pollution.
Art. 4

The Commission shall be composed of delegates appointed by the Contracting Governments.

The Commission shall be assisted by an International Technical Sub-Committee, hereinafter referred to as "the Technical Sub-Committee", composed of experts in the field of water protection designated by the Contracting Governments. It may also form other sub-committees for the study of specific problems.

Each of the two Contracting Governments may also appoint other experts. The Commission shall determine the conditions for their participation in its work.

Art. 5

The deliberations of the Commission shall be taken unanimously.

The Commission shall draw up its rules of procedure.

Art. 6

The Commission shall meet once a year in ordinary session on the convocation of its President.

In addition, the Commission shall be convened in extraordinary session by the Chairman on the proposal of one of the Contracting Governments.

Art. 7

Each of the two Contracting Governments shall examine the recommendations of the Commission and decide on the conditions under which the necessary implementing measures may be taken.

Art. 8

Each Contracting Party shall bear the costs of its delegation to the Commission and the experts appointed by it.

All other expenditure resulting from the operation of the Commission shall be distributed among the Contracting Parties in accordance with the arrangements laid down in each case by the Commission.

Art.

The Commission shall establish such links as it deems necessary with the international bodies responsible for water pollution and with those competent for Lake Léman and the Rhone in respect of navigation, fishing and Regulation of the flow of water.

Art. 10

Each of the Contracting Governments shall notify the other Contracting Government of the execution for its part of the constitutionally required procedures for the implementation of this Convention.

The Convention shall enter into force on a date agreed upon by the Contracting Governments. At the expiration of a period of three years after its entry into force, it may be denounced at any time, with six months' notice, by each of the Contracting Governments.
