The Swiss Federal Council,
Having regard to art. 10 and 38, para. 1, of the Act of 18 December 1970 on Epidemics 1 ,
Stops:
This order sets out the measures to be taken to combat an influenza pandemic.
For the purposes of this order:

Based on a corresponding statement by the World Health Organization (WHO), the Federal Council, acting on a proposal from the Federal Department of the Interior (Department), announces the beginning and end of the threat to the authorities and the public Pandemic or pandemic.
1 During the duration of a pandemic threat or pandemic, the Federal Council shall establish, on a proposal from the Department, a special unit responsible for advising and supporting the Confederation and the cantons in the coordination of measures To execute. The special unit is headed by the department.
2 The special unit shall consist of representatives of the departments, the Federal Chancellery, the cantons and the economy, as well as, as appropriate, other competent persons.
In the event of a pandemic or pandemic threat, the Department coordinates the measures of the Confederation, while reserving the existing jurisdictional rules of other departments.
1 The Federal Office of Public Health (Office) promotes, in collaboration with the cantons, the prevention of influenza among the groups at particular risk of the population and of the health care staff.
2 To this end, it conducts campaigns and targeted actions to encourage influenza vaccination.

The Department establishes, on the basis of the pandemic plan, measures to be taken in response to a pandemic threat or pandemic.

Cantons may require hospitals and other institutions to maintain a stockpile of antiviral drugs and other appropriate anti-influenza drugs for the first adequate supply of their staff and patients in sight A pandemic threat or pandemic threat.
In the event of a pandemic or pandemic threat, the Federal Council may limit or prohibit the export of vaccines, antiviral drugs or other appropriate anti-influenza drugs in the face of, or in anticipation of, a shortage of such drugs.
1 The Department may, in the event of a shortage, adjust the allocation of vaccines, antiviral drugs or other appropriate influenza drugs, depending on the threat and by using a priority order and distribution key. To this end, it works in cooperation with the cantons and takes account to the extent possible of their wishes.
2 The award is intended to ensure the greatest benefit to the health of the population; in particular, adequate health care and the functioning of essential services must be maintained. In particular, the following categories of people may be given priority for attribution:
A. Medical and health care staff;
B. Persons working in important public services, such as internal and external security, transport, communications, and energy, drinking water and food supply;
C. Persons at risk of high mortality in the case of influenza.
3 In addition, the award is based on recognized medical and ethical criteria. Economic needs must be taken into account.
The cantons are responsible, during a pandemic threat or during the pandemic, for the costs of distributing pre-pandemic and pandemic vaccines.

At the request of the Office, the Swiss Institute for Therapeutic Products (institute) shall provide it with information on adverse reactions or incidents that are due or may be due to vaccines, antiviral drugs and others Appropriate influenza drugs.

In the event of a pandemic or pandemic threat, the Office shall, after taking the advice of the cantons and the Institute, make recommendations concerning the medical assessment of the adverse reactions or incidents which are due or may be due to the Vaccines, antiviral drugs and other appropriate influenza drugs.

In announcing the end of the pandemic threat or pandemic, the Federal Council determines when and what ordered measures are removed or repealed.
Following the end of the pandemic threat or the pandemic, the department, in collaboration with the cantons and the Federal Council, establishes a report on the adequacy, effectiveness and efficiency of the measures taken.
