1 This order regulates the production and distribution of propagating material and plants certified in the broad sense (s.l.) of the following species and genera for fruit production:

A variety of common knowledge means a variety protected by the Federal Law of 20 March 1975 on the protection of plant varieties 1 Or is the subject of an official description.
1 Propagating material refers to seed, plant parts and plant material, including rootstocks and grafts, for propagation and production of plants.
2 By plant, a plant is intended to be planted or replanted after its marketing.
A conservatory means the place where the smallest unit used in a variety accepted for certification is retained.
1 Initial equipment refers to propagating material and plants:
2 An initial plant is derived from the use of initial propagating material.
1 Basic equipment refers to propagating material and plants:
2 A base plant is derived from the use of basic propagating material.
1 Certified material refers to propagating material and plants:
2 A certified plant is derived from the use of certified propagating material.
1 The Federal Office of Agriculture (Office) lays down the list of varieties accepted for certification for the genera and species listed in Art. 1.
2 In the case of clonal certification, the clones of the variety admitted to certification are listed.
1 A variety shall be registered in the list of varieties by the Office under the following conditions:
2 The Office shall record in the list the varieties or clones, the condition of registration laid down in par. 1, let. B was examined by a foreign official service after verifying that the methods used by the foreign official service are equivalent to the methods used in Switzerland.
3 A variety whose official description is in preparation may be provisionally recorded in the list for a period not exceeding the duration of the preparation of the description if it satisfies the condition laid down in para. 1, let. B.
1 Applications for registration in the list of varieties shall be submitted to the Office by the breeder or his representative.
2 The applicant is required to provide a registration file in accordance with the indications of the Office.
3 The Office may, at the request of a group of producers or a professional organisation, register in the list a variety which is not protected by the Federal Act of 20 March 1975 on the protection of plant varieties 1 Whether the variety is of particular interest in the field of arboriculture. 2

A variety or clone can be removed from the list if:

The maximum number of generations within the meaning of s. 6, para. 1, let. B, is fixed at:
4 The maximum number of generations within the meaning of s. 7, para. 1, let. B, is attached to one for apple, apricot, cherry, griottier, plum, peach, pear, cognassier and strawberry. 2
5 The Office may, in derogation from para. 3, the multiplication of an additional generation of basic equipment where the availability of initial material on the market is insufficient. It decides on the requirements for this production.

1 Only material which complies with the condition laid down in Art. 9, para. 1, let. B, may be installed in the conservatory.
2 The material installed in the conservatory is intended for the production of initial material.
3 The equipment installed in the conservatory shall be kept under conditions that exclude any contamination by the harmful organisms listed in Annex 2.
4 The Office may, in derogation from Art. 5, para. 1, let. D, a producer authorized to produce original equipment; the Agency shall determine the requirements for such production.
1 Applications for approval by producers are filed with the Agency, which issues the approval and assigns a number to each producer.
2 A specific authorisation is required:
3 Producers shall be approved for a period of one year, which may be extended tacitly from year to year as long as the conditions are met and the quality of the certified material (s.l.) meets the requirements of this order.
Registered producers are required to:

The Office may withdraw, in part or in whole, the approval of a producer if it finds that:
1 Applications for the registration of certified propagating material (s.l.) shall be filed with the Agency.
2 Multiplication plots shall be registered by the Office if the conditions set out in Annex 1 are fulfilled and the varieties installed comply with the description referred to in Art. 9. Compliance with these conditions shall be monitored during an official visit of the parcel by a monitor recognised by the Office.
3 Any new planting of mother plants in a previously registered parcel of propagation requires a new registration of the parcel in accordance with the procedure described in paras. 1 and 2.
4 The duration of registration of the different types of production plots is set out in Annex 1.
5 The registration decision may at any time be revoked, in part or in whole, if the conditions are no longer fulfilled and the propagating material or plants produced no longer meet the requirements set out in Annex 3.
1 A lot may contain only propagating material or plants of the same class and variety, if any, of the same clone, produced by the same producer. If in the case of rootstocks the material does not belong to a variety, the lot may contain only equipment of the same species or the same interspecific hybrid.
2 The Agency may, by decision, limit the origin of a lot to a motherboard or a group of mother plants.
1 A lot of equipment is certified (s.l.) under the following conditions:
2 The producer shall advertise each parcel of multiplication to the Office.
3 Multiplication plots shall be allowed for the production of certified equipment (s.l.) if they meet the requirements set out in Annex 2. These requirements shall be monitored on the basis of official visits by a recognised controller By the Office.
4 The certification of a lot shall be valid for the year following the admission of the parcel.
5 If the controller suspects the presence of harmful organisms, it may take a sample of propagating material in order to have it checked in a licensed laboratory.
6 In the event of refusal of the admission of the parcel, the producer may make an objection in writing to the Office within three working days of the communication of the opinion of the Controller. The Office is required to make a final reply within four working days from the date of receipt of the opposition. No changes shall be made to the state of the culture during this period.
1 During production, harvesting and storage, propagating material and plants are kept in separate and marked lots.
2 Where, subject to the provisions of s. 18, para. 2, propagating material or plants of different origin are assembled or mixed, in the packaging, storage, transport or delivery, the producer shall record in a register the composition of the lot and the origin of its Different components.
1 The packaging is closed under the responsibility of the producer.
2 Packages are closed with a non-reusable closure system or a system that incorporates the label so that they cannot be opened without the closure system or label being damaged.
3 The requirements for the packaging of propagating material are defined in Annex 4.
4 Official labels shall be distributed under the control of the Office on the basis of an estimate of the production potential of the parcel made during the official visit provided for in Art. 19.
5 The affixating of the labels referred to in s. 23 shall be under the responsibility of the producer in accordance with the instructions of the Office. The producer maintains an accounting for packaging and labelling as operations are carried out.
6 The Agency may conduct inspections at any time in the production, packaging and storage areas to ensure that the requirements of this section are met.
1 Only propagating material and plants of the original equipment, basic equipment and certified equipment that meet the requirements set out in Annex 3 may be put into circulation as certified equipment (s.l.).
2 Propagating material and certified plants (s.l.) may be put into circulation only in homogenous lots in closed packagings with an official tag in accordance with the requirements described in s. 21. The placing in circulation of small quantities intended for a non-professional final consumer is not subject to these conditions.

4 Where the phytosanitary quality of propagating material and plants so requires, the Office may order that they be treated by means of plant treatment products or another effective method against diseases and pests Transmitted by propagating material.

Notwithstanding s. 5, para. 1, let. B, the Office may allow initial material to come from registered production plots whose mother plants meet the requirements of the material installed in the conservatory.
The Agency is responsible for the application of this Order.

This order shall enter into force on 1 Er July 1999.

Multiplication plots are isolated from the production cultures of strawberries and propagating plots of uncertified material by a minimum distance of 50 m.

The propagation plots shall be free of the harmful organisms defined in Annex 1 to the Plant Protection Order of 5 March 1962 2 And in the decree of the DEFR of 25 January 1982 on the mandatory declaration of pests and diseases presenting a general danger 3 .
