Federal Professional Maturity Ordinance

Stops:

Section 1 General provisions

Art. 1 Purpose

This Order governs federal professional maturity, including the following:

A.
Organization of education;
B.
Requirements for training courses;
C.
Assessment of benefits during training;
D.
Examination of professional maturity;
E.
Recognition of training courses by the Confederation.
Art. 2 Federal Professional Maturity

Federal professional maturity includes:

A.
Initial vocational training sanctioned by a federal capacity certificate; and
B.
Comprehensive general training that complements initial vocational training.
Art. 3 Goals

1 In particular, holders of federal professional maturity are able to:

A.
Undertake studies in a specialized high school and, in so doing, prepare to take on demanding tasks in the economy and society;
B.
To understand and understand the world of work and its complex processes and to integrate them;
C.
To think about their professional activities and experiences in their relationship with nature and society;
D.
To exercise their responsibility for themselves, others, society, economy, culture, technology and nature;
E.
To open up to the acquisition of new knowledge, to develop their imagination and ability to communicate;
F.
To make the link between the knowledge acquired and their general and professional experiences and to make this knowledge profit for the development of their professional careers;
G.
To be understood in two national languages and in a third language and to understand the cultural context linked to these languages.

2 Education leading to professional maturity promotes the acquisition of systematic knowledge structures on the basis of skills based on the profession and the professional experience of persons in training and allows to acquire A certain openness of mind and personal maturity. It promotes autonomous and sustainable learning, overall development and interdisciplinary work of people in training.

Art. 4 How training is acquired

1 Comprehensive general training that leads to professional maturity is followed in recognised training courses.

2 The State Secretariat for Training, Research and Innovation (SEFRI) 1 Regulates the federal examination of professional maturity for holders of a federal capacity certificate that did not follow a recognized training stream.

Art. 5 Training Hours Volume

1 Federal professional maturity includes at least:

A.
5700 hours of training when initial vocational training lasts three years;
B.
7600 hours of training when initial vocational training lasts four years.

2 On this volume of hours, at least 1800 hours are devoted to in-depth general training.

3 Hours of training include:

A.
Training in professional practice;
B.
Intercarrier courses;
C.
Time for school attendance;
D.
The average time required for the personal study and for individual work or group work;
E.
Knowledge checks and qualification procedures.

4 Education leading to professional maturity includes at least 1440 teaching periods.

Art. 6 Unlawful deduction on salary and taken into account of working time

1 No deduction from salary can be made due to attendance at vocational maturing education during initial vocational training.

2 Education leading to professional maturity followed during initial vocational training is attributed to working time. This rule also applies if this education takes place outside the usual working time.

Section 2 Education leading to professional maturity

Art. 7 Structure

1 Education leading to professional maturity includes:

A.
A fundamental area;
B.
A specific domain;
C.
A complementary domain.

2 It also includes the development or creation of interdisciplinary work focused on a project carried out in accordance with guidelines and on the basis of guidance.

3 In the specific and complementary fields, the schools propose the two branches which correspond to the orientation of the initial vocational training of persons in training.

Art. 8 Fundamental Domain

1 The branches of the fundamental domain are:

A.
First national language;
B.
Second national language;
C.
Third language;
D.
Mathematics.

2 The cantons define the languages.

3 The objectives of training in the branches of the fundamental field are defined according to the requirements of the initial vocational training and related fields of study of the specialised high schools and are differentiated accordingly.

Art. Specific Domain

1 The specific area aims to deepen and broaden knowledge and knowledge from the perspective of high school studies in a field of study related to the profession.

2 The branches of the specific domain are:

A.
Finance and accounting;
B.
Applied arts, art, culture;
C.
Information and communication;
D.
Mathematics;
E.
Natural sciences;
F.
Social sciences;
G.
Economy and law.

3 As a general rule, education must be followed in two branches.

4 The teaching of the branches of the specific field focuses on the initial vocational training and the related fields of study of the specialized high schools.

5 The framework curriculum defines the branches taught according to the orientations of the initial vocational training and related fields of study.

Art. 10 Complementary Domain

1 The complementary domain allows for the acquisition of an ability to act and a capacity to orient itself in the branches referred to in para. 2.

2 The branches of the complementary domain generally complement those of the specific domain; these branches are as follows:

A.
History and political institutions;
B.
Technical and environmental;
C.
Economy and law.

3 Education must be followed in two branches.

4 The framework curriculum defines the branches taught according to the orientations of the initial vocational training and related fields of study.

Art. 11 Interdisciplinary work

1 A tenth of education leading to professional maturity and hours of training is devoted to the development of methodological skills in interdisciplinary approach and problem solving.

2 Interdisciplinary work is promoted and practised on a regular basis in the teaching of all three areas, in particular in small projects, transfer benefits, project management and communication.

3 The benefits provided in the interdisciplinary work are subject to separate notes. These are included in the score assigned to interdisciplinary work under s. 24, para. 5.

4 Towards the end of the training stream, people in training write or develop interdisciplinary work focused on a project. This work is an integral part of the professional maturity review and relates to:

A.
The world of work; and
B.
At least two branches of education leading to professional maturity.

Section 3 Requirements for training courses

Art. 12 Master Study Plan

1 The SEFRI enacts a framework study plan.

2 The Fixed Framework Study Plan:

A.
The objectives of training the branches of the fundamental, specific and complementary fields, defined in terms of the initial vocational training and related fields of study of the specialised high schools;
B.
The share, hours of training allocated to the different branches and the number of teaching periods in each branch;
C.
Guidelines for interdisciplinary work and interdisciplinary work focused on a project;
D.
The form of final examinations;
E.
Directives on multilingual professional maturity.

3 The cantons, labour organisations, vocational schools and the high schools are involved in drawing up the framework study plan.

Art. 13 Organisation of training courses

1 Education leading to professional maturity can be followed:

A.
During initial vocational training;
B.
In the course of employment or full time in the extension of initial vocational training completed successfully.

2 The training courses taken during initial vocational training are coordinated with the teaching of professional knowledge.

3 In this type of stream, education leading to professional maturity cannot be provided at the beginning of initial vocational training in the form of block education.

4 If the education leading to professional maturity is followed in full time after initial vocational training, it shall extend to at least two semesters.

Art. 14 Admission requirements and procedure

1 The cantons shall lay down the conditions for admission to education leading to professional maturity and admission procedure.

2 They are based on this effect on the conditions of admission and on the procedures governing admission to the other general culture training of secondary level II.

3 The candidate whose application has been selected at the end of the admission procedure in his/her canton of residence may also follow the education leading to professional maturity in another canton; the cantonal rules on free Traffic that deviates from this rule remains reserved.

Art. 15 Taking into account the acquis

1 The person who has the knowledge and skills required in a particular branch may be exempted from the corresponding education by the school. The word "exempt" is recorded in the semi-annual bulletin.

2 The person who justifies the knowledge and skills required in a particular branch may be exempted from the relevant final examinations by the cantonal authority. The word "acquired" is entered on the professional maturity certificate.

Section 4 Assessment of benefits and promotion

Art. 16 Assessment of benefits and establishment of notes

1 Benefits are assessed in accordance with s. 34, para. 1, of the order of 19 November 2003 on vocational training 1 .

2 Notes which correspond to the average of several benefits which have been assessed are rounded to whole notes or to half-notes.

3 The overall score corresponds to the average, rounded to the first decimal, of all the notes taken into account.


Art. 17 Promotion

1 At the end of each semester, the school documents in the form of notes the benefits provided in the branches taught and in the interdisciplinary work. It draws up a newsletter.

2 At the end of each semester, she decides on admission to the following semester on the basis of the newsletter.

3 The grades obtained in the taught branches count for promotion; the note of interdisciplinary work does not count.

4 The promotion takes place if:

A.
The global score is 4 or greater;
B.
The sum of the discrepancies between the deficient scores and Note 4 is less than or equal to 2; and
C.
Up to two notes are less than 4.

5 The person who does not meet the conditions of promotion is:

A.
Provisionally promoted whether education leading to professional maturity is followed during initial vocational training; if it does not meet the conditions for promotion a second time, it is excluded from education leading to the Professional maturity;
B.
Excluded from education leading to professional maturity if it is followed after initial vocational training.

6 The year of instruction can be repeated only once.

Art. 18 Teaching leading to multilingual professional maturity

If a part of the education leading to professional maturity, with the exception of branches which cover languages, takes place in languages other than the first national language, the semi-annual bulletins shall mention it and indicate the languages Concerned.

Section 5 Professional maturity review

Art. 19 Notion

The professional maturity examination covers the whole qualification procedure for comprehensive general training.

Art. Regulation, preparation and organization

1 The cantons shall ensure that examination requirements are harmonised throughout the canton.

2 Teachers who provide education prepare and pass the examination of professional maturity.

Art. Final reviews

1 The final review will include:

A.
The four branches of the fundamental field; and
B.
The two branches of the specific domain.

2 The cantons hire experts to evaluate the final exams.

3 Written final reviews are prepared and validated at the regional level.

4 The high schools are adequately involved in the preparation and organisation of the final exams.

Art. Timing of final exams

1 The final exams take place at the end of the training course.

2 A maximum of three branches may be subject to a pre-term review.

3 In initial vocational training in schools with an internship at the end of training, the final exams can be organised before the start of the probationary period. Interdisciplinary work focused on a project is written towards the end of the internship.

Art. Recognized Language Degrees

The SEFRI may recognise foreign language diplomas. In this case, the diploma replaces all or part of the final exam in the corresponding branch.

Art. 24 Calculating notes

1 In the branches where final exams take place, the score is equally composed of the examination note and the school grade.

2 The examination note corresponds to the performance noted or to the average of the examination benefits in the branch concerned.

3 The school note corresponds to the average of the notes of the semi-annual bulletins obtained in the branch concerned or for interdisciplinary work.

4 The marks awarded in the branches of the supplementary domain correspond to the school notes.

5 In interdisciplinary work, the note is composed equally of the note of interdisciplinary work centred on a project and the school grade.

6 The project-based interdisciplinary work note corresponds to the assessment of the development process, the final product and the presentation.

7 Art. 16 applies by analogy to the assessment of benefits and the calculation of notes.

Art. 25 Success Criteria

1 The following are considered criteria for the success of the occupational maturity review:

A.
Notes obtained in the branches of the fundamental field;
B.
Notes obtained in the branches of the specific domain;
C.
Notes obtained in the branches of the complementary domain;
D.
The score obtained for interdisciplinary work.

2 The conditions of promotion laid down in Art. 17, para. 4, apply by analogy.

Art. 26 Repetition

1 The person who fails the examination of professional maturity may be represented once.

2 Only branches whose score was insufficient for the first time that the examination was passed were re-examined.

3 When the examination is to be repeated in branches of the fundamental and specific fields, only the examination note; the school note is not taken into account.

4 When the examination is to be repeated in branches of the complementary domain, a review must be carried out. Only the examination note counts.

5 If the interdisciplinary work score is insufficient, the following rules apply to the repetition:

A.
Interdisciplinary work focused on a project needs to be reworked if deemed insufficient;
B.
Interdisciplinary work should be subject to an oral examination if the school grade is insufficient;
C.
The school note is taken into account if it is sufficient.

6 If a person follows the teaching for at least two semesters in order to be considered for examination, only the new school notes count for the calculation of the notes.

7 The cantonal authority decides on the date of repetition of the examination.

Art. 27 Consequences in case of failure under examination

1 The person who fails the examination of professional maturity at the end of a training programme followed during the initial vocational training shall receive the Federal Certificate of Capacity, provided that it meets the requirements for Get it.

2 The cantonal authority shall determine the scope and organisation of the necessary replacement examinations and the provisions applicable to special situations.

Art. 28 Federal Certificate of Professional Maturity

1 The following are mentioned on the certificate of notes of the Federal Certificate of Professional Maturity:

A.
The overall score;
B.
Notes from the branches of the fundamental domain;
C.
Notes from the branches of the specific domain;
D.
Notes from the branches of the complementary domain;
E.
The score obtained for interdisciplinary work;
F.
The note and theme of interdisciplinary work focused on a project;
G.
The orientation of professional maturity according to the framework study plan;
H.
The title protected under the federal capacity certificate.

2 If a part of the examination of professional maturity, with the exception of branches which relate to languages, takes place in languages other than the first national language, the certificate of notes shall indicate this by indicating the other languages in Which took place.

3 The SEFRI ensures that federal certificates of professional maturity are presented in a uniform manner throughout Switzerland.

Section 6 Recognition of training courses

Art. Principle, conditions and procedure

1 Training providers of federal professional maturity must be recognized by the Confederation.

2 They are recognized if:

A.
The provisions of this order and the framework study plan are complied with;
B.
A study plan is presented for the training stream;
C.
Adequate qualification procedures are planned;
D.
Appropriate quality assurance and quality development instruments are available;
E.
Teachers are sufficiently qualified.

3 Applications for recognition are submitted to the SEFRI by the cantonal authority.

4 SEFRI decides on recognition after consultation with the Federal Commission on Professional Maturity.

Art. Canceling discovery

1 If a training stream recognized by the Confederation no longer meets the requirements, SEFRI shall grant the provider a period of time to remedy the deficiencies noted.

2 If the deficiencies are not remedied before the expiry of the time limit and in accordance with the conditions laid down, the SEFRI shall cancel the recognition.

3 The SEFRI shall consult the competent cantonal authority and the Federal Commission on Professional Maturity in advance.

Art. Teaching Body Qualification

The minimum requirements set out in s. 40, 42, 43, 46, 48 and 49 of the Ordinance of 19 November 2003 on vocational training 1 Apply to the qualification of teachers in the training courses of federal professional maturity.


Section 7 Enforcement

Art. 32 Confederation

The SEFRI has the following tasks and responsibilities:

A.
Exercises high surveillance over federal professional maturity;
B.
Ensuring national coordination;
C.
It shall decide on the pilot projects and the proposals of the cantonal authorities derogating from the provisions of this order or of the framework study plan.
Art. 33 Federal Commission on Professional Maturity

1 The Federal Commission for Professional Maturity is made up of up to 15 representatives from the cantons, labour organisations, vocational schools and specialised high schools. 1

2 She is self-represented.

3 It shall assume the tasks and functions defined in Art. 71 LFPr.

4 It may submit proposals to the SEFRI, in particular as regards the further development of professional maturity.

5 It collaborates with other committees in the field of vocational training, in particular with the Federal Commission for Vocational Training and the Federal Commission for Vocational Training.

Art. 34 Cantons

The execution of this order shall be the responsibility of the cantons, provided that the cantons do not otherwise dispose of it.

Section 8 Final provisions

Art. 35 Repeal and amendment of the law in force

1 The order of 30 November 1998 on professional maturity 1 Is repealed.

Art. 36 1 Transitional provisions

1 The old right applies to candidates who have started training leading to professional maturity before 1 Er January 2015.

2 The repetition of the examination of professional maturity under the conditions of the old right takes place for the last time in 2019.

3 The framework study plan shall be enacted no later than 31 December 2012.

4 Cantonal prescriptions are adapted to this order by 31 December 2014 at the latest.

5 The curricula of the recognised training courses shall be adapted to this order by 31 December 2014 at the latest.

Art. Entry into force

This order shall enter into force on 1 Er August 2009.
