Chapter 1 Purpose and scope

Art. 1

1 This ordinance regulates the conditions under which post-graduate education and post-graduate studies are recognized by the Confederation.

2 It is applicable to the following areas:

A.
Technical;

Hotels/restaurants and tourism;

Economy;

Agriculture and forestry;
E.
Health;
F.
Adult social and training;
G. 2
Visual arts, applied arts and design;
H. 3
Traffic and transportation.

3 Specific conditions governing certain areas defined in para. 2 are set out in the schedules to this order.

Chapter 2 Conditions of recognition

Section 1 Objectives of training, scope of training, forms of education and language of instruction

Art. 2 Training Objectives

1 The training courses and post-graduate studies of the higher schools provide their students with the skills they need to assume autonomous responsibilities in their area of technical responsibilities and Management responsibilities.

2 They are oriented towards practice and, in particular, encourage methodical and systemic thinking, the analysis of tasks related to the profession and the application of the acquired knowledge.

Art. 3 Extent of Training

1 The dies shall include at least the number of hours of training within the meaning of Art. 42, para. 1, OFPr below:

A.
3600 hours of training for sectors requiring a federal capacity certificate in the field of study;
B.
5400 hours of training for streams requiring another level of secondary level II.

2 A postgraduate course consists of a minimum of 900 hours of training.

3 Training benefits to be achieved may, on the basis of the number of hours of training, be converted to a recognised credit system. Balances remaining after conversion are rounded.

Art. 4 Forms of Education

1 Training courses and post-graduate studies can be offered on a full-time basis or in the course of employment.

2 For in-service training courses, a professional activity of at least 50 % in the field of study is required. The specific regulations in the Annexes to this Order shall be reserved.

3 Professional activity on the margins of the on-the-job training courses is taken into account as follows:

A.
It is equivalent to 720 hours of training maximum for training courses requiring a federal capacity certificate;
B.
It is equivalent to a maximum of 1080 hours of training for training streams requiring another level of secondary level II.

4 Specific forms of education, such as distance education, decentralized education or teaching on the basis of modules, can be recognized.

Art. 5 Language of instruction

National and English languages are the languages of instruction.

Section 2 Management plans, promotion rules and qualification procedures

Art. 6 Enactment of Master Study Plans

1 The training courses are based on Master Study Plans.

2 The plans of the framework studies are designed and enacted by the providers of training, in collaboration with the organisations of the world of work; the State Secretariat for Training, Research and Innovation (SEFRI) 1 Approves on a proposal from the Federal Commission of Higher Schools (committee).

3 Master plans may be drawn up for postgraduate studies, provided that the annexes to this order provide for it.

Art. 7 Contents of Master Study Plans

1 The framework study plans set out:

A.
The profile of the profession and the skills to be acquired;
B.
... 1
C.
Training areas and their duration;
D.
Coordination of school components and practical components;
E.
The contents of the qualification procedure;
F.
General thematic content such as questions relating to equality between men and women, sustainable resource management, intercultural competence, workplace safety, and environmental and environmental protection Health.

2 They may also determine which federal certificates of capacity or equivalent degrees of secondary level II are required for admission to training courses.

3 They take into account the current international standards governing the practice of professions.

4 They are reviewed periodically and adapted according to economic, technological and didactic developments.

Art. 8 Promotion Regulations

The providers of the training issue a regulation of the promotions.

Art. Qualification Procedures

1 The final qualification procedures in the training courses and post-graduate studies include at least:

A.
A practice-oriented diploma or project work; and
B.
Written or oral examinations.

2 Other requirements for final qualification procedures are set out in the Master Study Plans.

3 Training providers regulate the details of qualification procedures. When preparing the examination papers, they shall take into account the content of the teaching and the requirements defined by it in accordance with the relevant study plans.

4 Organisations in the world of work participate in the final qualification procedures through their experts.

Section 3 Internships

Art. 10

1 If the training courses include traineeships, the training providers are responsible for the choice of the traineeship.

2 The requirements for the traineeship company are set by the training providers.

3 Internships are focused on the skills to be acquired and placed under the aegis of professionals as well as under the supervision of training providers. The student's field of assignment and his/her activities correspond to his or her level of training.

Section 4 Training providers and teachers

Art. 11 Training Providers

1 Those responsible for training and post-graduate studies must justify the relevant technical qualifications and managerial skills.

2 Equipment, teaching methods and auxiliary means must meet the requirements of a high level education both from a technical point of view and from the point of view of vocational education.

3 The Commission may also, outside the framework of a recognition procedure, periodically review in an appropriate manner whether providers of training meet the requirements.

Art. 12 Teacher Body

1 Faculty members must justify:

A.
Graduation from a high school or higher school, or an equivalent qualification in the branches they teach, and
B.
Training and training in professional pedagogy, with the following:
1.
1800 hours of training when performing their principal activities,
2.
300 hours of training when operating as an accessory.

2 Failing teachers who are graduates within the meaning of para. 1, let. A, the providers of the training may engage, in the branch to be taught, persons with relevant professional experience and knowledge.

3 A deemed activity is any activity within the meaning of s. 47, para. 1 and 2, OFPr.

4 The person teaching less than four hours a week on average is not subject to the provisions of para. 1, let. B.

5 The SEFRI enacts plans of framework studies for the qualification of faculty members. For this, it is based on art. 48 and 49, para. 1, OFPr.

Section 5 Admission

Art. 13 Training Subsidiaries

1 Admission to training courses presupposes a diploma of secondary degree II and, provided that the corresponding annexes to this order require it:

A.
Professional experience; and
B.
A aptitude test.

2 The scope and content of the aptitude test are addressed by the training providers.

3 Admission on the basis of qualifications deemed equivalent is reserved.

Art. 14 Postgraduate studies

1 Admission to postgraduate studies presupposes a tertiary degree.

2 Admission on the basis of qualifications deemed equivalent is reserved.

Section 6 Diplomas and qualifications

Art. 15 1

1 The diploma refers to the training course or post-graduate studies, as well as the corresponding title with the term "graduate" or "graduate" and ES or EPD-ES supplements. The headings can be supplemented by the reference to the orientation.

2 The titles of the training courses are set out in the annexes.

3 The SEFRI maintains a list of recognised postgraduate studies and corresponding protected titles.

Chapter 3 Recognition procedure

Art. 16 Discovery Request

1 Anyone who wishes to have a training or post-degree course recognised must submit an application.

2 The application must be submitted to the competent cantonal authority. The latter shall take a decision and forward its position to the SEFRI, together with the request.

3 National private sector organisations active at the national level submit their applications directly to the SEFRI.

4 The request provides information on:

A.
The responsible body;
B.
Funding;
C.
Organization and forms of education;
D.
Equipment and teaching facilities;
E.
Teacher qualifications;
F.
The study design;
G.
Regulations on admission, promotions and qualification procedures;
H.
Quality assurance and quality development systems.
Art. 17 Decision

The SEFRI decides on recognition, on a proposal from the committee.

Art. 18 Canceling discovery

1 If the minimum conditions are not met, the SEFRI sets a deadline in which the deficiencies will have to be filled.

2 If this time limit is not used or if the deficiencies are not filled in such a way that the minimum conditions are met, the SEFRI shall cancel the recognition. In advance, the competent cantonal authority shall be heard.

Art. 19 Statistical Data

1 The providers of training shall make available to the SEFRI, for purposes not relating to persons, the necessary data or figures concerning:

A.
Students, including their number, pre-training, training, orientation, post-graduate studies, the conduct of their studies and their results in examinations;
B.
Staff, including the number and structure of the teaching staff;
C.
Funding, including resources from third parties, as well as the structure of expenditures and costs.

2 The DEFR sets out, in agreement with the Federal Statistical Office, the uniform rules for the entry of data in relation to lists and definitions of characters, periodicity and time limits.

Chapter 4 Federal Commission on Higher Schools

Art. Composition

1 A federal commission of the higher schools was established.

2 The Commission has a maximum of 15 members.

3 Branch organizations, schools, townships and confederation, as well as linguistic and gender regions, must be equitably represented.

4 The committee itself is itself.

5 The secretariat of the committee is provided by the SEFRI.

Art. Tasks

1 The Commission assesses, for the purpose of the SEFRI, the plans for the framework studies as well as applications for federal recognition of training courses and postgraduate studies.

2 It shall examine, in cooperation with the cantons, for the purpose of SEFRI, if the conditions for recognition under this order are met.

Chapter 5 Final provisions

Art. Repeal of the law in force

The following orders are repealed:

Order of 15 March 2001 concerning minimum requirements for recognition of technical upper schools 1 ;
B.
Order of 14 December 1983 concerning minimum conditions for the recognition of higher schools of applied arts 2 ;
C.
Order of 10 July 1998 concerning minimum conditions for recognition of the higher schools of family economy 3 ;
D.
Order of 18 December 1986 concerning minimum conditions for the recognition of higher schools of tourism 4 ;
E.
Order of 15 March 2001 concerning minimum conditions for the recognition of higher schools of restoration 5 ;
F.
Order of 15 March 2001 concerning minimum conditions for recognition of higher schools of economy 6 ;
G.

Art. Transitional provisions

1 The training courses and post-graduate studies of the higher schools recognised by the DEFR under the former right are always regarded as recognised. The same applies to training courses and post-graduate studies in higher schools governed by intercantonal law.

2 Training courses and post-graduate studies initiated on the basis of federal or inter-cantonal law prior to the entry into force of this Ordinance and prior to the approval of the relevant Master Study Plans shall be completed according to the former Right.

3 Teachers who, at the time of the coming into force of this order, have taught at least five years in a training stream in a higher school or in traineeships meet the requirements under s. 12.

4 The holders of a title granted by a higher school recognized under the old federal law or governed by the former inter-cantonal law shall be entitled to carry the relevant new titles, provided that the annexes to this order Do not have otherwise.

Art. 24 Entry into force

This order shall enter into force on 1 Er April 2005.

2 Holders of other certificates of proficiency and other degrees of secondary degree II are admitted if they can, as part of an aptitude test, certify that they possess the basic knowledge required and justify an experience Work of at least one year in a corresponding professional field before admission to the training stream.

3 For in-service training courses, the admission procedure may be replaced by a six-month trial period.

4 Training providers may provide for additional admission requirements.

3 Qualification procedure

Only those who have followed the training course in its entirety are admitted to the qualification procedure.

4 Titles

The Technical SEs issue the protected titles "ES graduate technician"/"ES graduate technician" supplemented by the "en" preposition and orientation.

Have a federal certificate of capacity or another diploma in secondary level II;

Have certified, as part of an aptitude test, that they possess the basic skills and knowledge required; and
C.
Justify professional experience of at least one year in a relevant professional field.

2 For in-service training courses, the admission procedure may be replaced by a six-month trial period.

3 Training providers may provide for additional admission requirements.

3 Qualification procedure

Only those who have followed the training course in its entirety are admitted to the qualification procedure.
