Agricultural Agreement between Switzerland and the SACU States

Art. 1

1. This Agreement on Trade in Agricultural Goods (hereinafter referred to as "this Agreement") between the Republic of Botswana, the Kingdom of Lesotho, the Republic of Namibia, the Republic of South Africa and the Kingdom of Swaziland, which together form The Southern African Customs Union (hereinafter collectively referred to as "SACU" or individually "SACU States"), on the one hand, and the Swiss Confederation (hereinafter referred to as "Switzerland"), on the other hand, jointly hereinafter referred to as "the Parties", Is concluded in accordance with and in connection with the 2006 Free Trade Agreement Between the EFTA States and the SACU States 1 (hereinafter referred to as "Free Trade Agreement") , especially with its art. 6. This Agreement forms part of the instruments establishing the Free Trade Area between the EFTA States and the SACU.

2. This Agreement shall also apply to the Principality of Liechtenstein as long as the Treaty of Customs Union of 29 March 1923 between Switzerland and the Principality of Liechtenstein 2 Remains in effect.


Art. 2

1. SACU grants tariff concessions to agricultural products originating in Switzerland in accordance with Annex I.

2. Switzerland shall grant tariff concessions to agricultural products originating in the SACU in accordance with Annex II. In addition, Switzerland continues to grant SACU States meeting the criteria of the least developed countries (hereinafter referred to as "LDCs"), according to the list approved by the Economic and Social Council (ECOSOC) of the United Nations Conference on Trade and development (UNCTAD), the tariff benefits of the Generalized System of Preferences of Switzerland 1 (hereinafter referred to as "Swiss SGP"). This commitment is specified as follows: the legal instrument by which the Swiss Parliament authorises the Federal Council to grant tariff benefits under the Swiss SGP will expire on 28 February 2007. If this authorization is extended, the granting of tariff benefits to LDCs under the Swiss SGP will continue to apply 2 .

Art. 3

1. Subject to paras. 2 and 3, the rules of origin and the customs cooperation provisions applicable to trade governed by this Agreement are set out in Annexes V and VI of the Free Trade Agreement respectively. Any reference to "EFTA States" shall apply to Switzerland.

2. With respect to this Agreement, s. 3 of Annex V of the Free Trade Agreement applies Mutatis mutandis SACU and Switzerland.

3. Art. 34 of Annex V of the Free Trade Agreement shall not apply to this Agreement.

4. The preferential treatment accorded by Switzerland to goods originating in the LDCs shall apply Mutatis mutandis However, for LDCs to obtain preferential treatment, the following wording should be inserted in Box 7 of the movement certificate or after the last sentence of the invoice declaration, as the case may be: " LDC/PMA: art. 2.2 CH-SACU satisfied ". Furthermore, cumulation within the SACU is not permitted.

Art. 4

The following provisions of the Free Trade Agreement apply Muta N Dis Between Switzerland, on the one hand, and SACU or the States of the SACU, as appropriate, on the other hand: art. 4, 5, 10, 11, 14, 19, 20, 21, 23, 25, 33 (al. 1 and 2), 35, 36, 37 and 41.

Art. 5

(1) The Parties shall not grant export subsidies under Art. 9 of the WTO Agreement on Agriculture 1 , for their trade in products subject to the tariff concessions provided for in this Agreement.

2. The Parties shall not grant domestic support for trade and production, under the WTO Agreement on Agriculture, for their trade in products subject to the tariff concessions provided for in this Agreement.

3. The Parties shall promptly and transparently transmit the information necessary for monitoring compliance in relation to paras. 1 and 2.

Art. 6

SACU and Switzerland examine any difficulties in their trade in agricultural products and endeavour to find appropriate solutions.

Art. 7

1. SACU and Switzerland undertake to continue their efforts to extend the liberalisation of their agricultural trade within the framework of their respective agricultural policies.

2. The first review shall occur no later than three years after the entry into force of this Agreement, with the following reviews to be agenate at the first.

Art. 8

1. This Agreement shall be subject to ratification, acceptance or approval, in accordance with the respective constitutional requirements of the Parties.

2. This Agreement shall enter into force on the same date as the Free Trade Agreement.

3. The Government of Switzerland shall act as Depositary. An original copy of this Agreement shall be deposited with the SACU Secretariat.

Art.

This Agreement shall remain in force for as long as the Parties remain Parties to the Free Trade Agreement.

Annex I

Customs duties on imports from Switzerland into the SACU

(art. 2, para. 1)

1. Art. 9 of the Free Trade Agreement also applies Mutatis mutandis In this Annex.

2. The customs duties on imports into the SACU of products originating in Switzerland, listed in Table 1 of this Annex and classified in list 0 and in list 1, shall be abolished upon entry into force of this Agreement.

3. The customs duties on imports into the SACU of products originating in Switzerland, listed in Table 1 of this Annex and classified in List 2, shall be phased out according to the following agenda:

On the date of entry into force of this Agreement, each customs duty shall be reduced to 67 % of the basic right;
-
One year after the entry into force of this Agreement, each right shall be reduced to 33 % of the basic right;
-
Two years after the entry into force of this Agreement, the remaining rights shall be abolished.

4. The customs duties on imports into the SACU of products originating in Switzerland, listed in Table 1 of this Annex and classified in list 3, shall be phased out according to the following agenda:

Two years after the entry into force of this Agreement, each customs duty shall be reduced to 88 % of the basic right;
-
Three years after the entry into force of this Agreement, each customs duty shall be reduced to 75 % of the basic right;
-
Four years after the entry into force of this Agreement, each customs duty shall be reduced to 63 % of the basic right;
-
Five years after the entry into force of this Agreement, each customs duty shall be reduced to 50 % of the basic right;
-
Six years after the entry into force of this Agreement, each customs duty shall be reduced to 38 % of the basic right;
-
Seven years after the entry into force of this Agreement, each customs duty shall be reduced to 25 % of the basic right;
-
Eight years after the entry into force of this Agreement, each customs duty shall be reduced to 13 % of the basic right; and
-
Nine years after the entry into force of this Agreement, the remaining customs duties shall be completely abolished.

5. The customs duties on imports into the SACU of products originating in Switzerland, listed in Table 1 of this Annex and classified in List 4, shall be abolished upon entry into force of this Agreement within the limits of a quota Total annual not exceeding 20 tonnes 1 .

6. The customs duties on imports into the SACU of products originating in Switzerland, listed in Table 1 of this Annex and classified in list 5, shall be deleted within the limits of a global annual quota not exceeding 200 tonnes, under Reserves that these products are imported only for direct consumption. This quota will be effective at 1 Er July 2007.

Switzerland reduces or eliminates customs duties on products originating in the SACU as indicated for each Tariff Number in the following table. Where the concession is listed in column 3 (Rate of applicable law), Switzerland may not apply a customs duty higher than that specified in that column. When the concession is listed in column 4 (Rate of MFN duty reduced by), Switzerland reduces the applicable customs duty at the time of importation of the amount specified in that column.
