See art. 46 A The Geoinformation Order of May 21, 2008 (OGéo) 1 , given art. 29, para. 1 of the order of 21 May 2008 on national measurements 2 ,

Stops:

Art. 1 Purpose

1 This order shall govern the rates of emoluments applicable to the official benefits of the Federal Office of Topography in the fields of national measurements, national geology and geographical names.

2 The unit price of the basic fee, the discount coefficients, the preparation costs and the flat-rate emoluments are set out in the Annex.

Art. 2 Value Added Tax

The value added tax is collected in addition to the fees payable for the official benefits submitted.

Art. 3 Waiver of Fees

1 No emolument is levied for the use of basic geodata in texts of a strictly scientific nature intended for publication, in particular in research reports or qualifying work (such as the work of diplomas, Master, or doctoral theses).

2 The Federal Office of Topography may waive the collection of fees for certain official benefits or for certain categories of official benefits, for a fixed period of time or not. This provision applies in particular to official benefits for the purposes of:

Promotion of the Federal Office of Topography;
B.
Of tests.
Art. 4 Exemption of emoluments

Anyone who provides geological information may be totally or partially exempted from the emoluments due to the use of the geological information service.

Art. 5 Free and Unauthorized Use

Basic geodata may be used free of charge and without authorization if they are used:

A.
The establishment of transformed analog cards at a scale of less than 1:300,000;
B.
The production of transformed digital data whose average accuracy (degree of generalization) is less than that of 1:300,000;
C.
To the publication of data transformed in analog form to a size of 3.2 dm 2 (A5 format);
D.
To the publication of data transformed in analogical form to a size of 12.5 dm 2 (A3) and for a circulation of 100 copies;
E.
The establishment of summary sketches, without scale, or the production of highly transformed or altered data;
F.
Publication in research reports or qualifying work (degree, master, doctoral thesis, work of maturity, etc.) for a circulation of less than 100 copies or in the form of static images isolated on networks Public;
G.
To the publication in the daily press to comment on the daily news up to a size of image of 3.2 dm 2 (A5 format) or as static images isolated on public networks up to a size of 500,000 pixels;
H.
To non-commercial publication on websites up to a size of 500 000 pixels in the form of isolated static images.
Art. 6 Repeal of the law in force

The Order of DMF dated 28 November 1991 concerning the surrender and sale of national cards 1 Is repealed.

Art. 7 Transitional provisions

The terms of payment entered into by contract on the basis of the current law shall apply until the end of the contract concerned, but not later than 31 December 2014.

Art. 8 Entry into force

This order shall enter into force on 1 Er January 2010.

5.7 Licence and Licensing Amendments

5.8 Post-clearance authorization

For the authorisation procedure for use issued a posteriori (Art. 27 OGéo), a flat-rate treatment fee of 100 to 400 francs, depending on the time spent, is to be paid in addition to the fee charged for use.

5.9 Disposition of Destruction or Confiscation

For the decision of destruction or confiscation (art. 33 OGéo), a flat-rate treatment fee of 100 to 500 francs, depending on the time spent, is to be paid in addition to the fee charged for use.

6 Benefits of experts

For the benefit of engineers and other experts, the appropriate recommendations of the Conference for the Coordination of Construction and Building Services of Public Works Teachers (KBOB) relating to fees are to be applied. SIA LHO 106 applies to the benefits of geologists.
