Having regard to the Federal Act of 3 February 1995 on the military and military administration 1 (LAAM), given art. 11, para. 1, 12, para. 2 and 13, of the organization of the army of 4 October 2002 (OOrgA) 2 , 3

This order applies to persons who are subject to military service (on-call duty):

The duration of the obligation to perform military service;

The total duration of the training services;

2 This order shall apply during the service of support and active service as long as the Federal Council, in the case of active service, and the Federal Department of Defence, Population and Sports Protection (DDPS), in the case of Support service, do not decide otherwise.

Art. 3 Terms and Abbreviations

1 The terms and abbreviations used in this order are defined in Appendix 1. 1

2 Where, in this order, formulations such as "member", "candidate", "commander", "superior", etc. are used, they apply to both male and female members.

Title 2 Duration of military duties for specialists, military personnel and persons assigned and assigned 4

Art. 4 Specialists

1 The activities of specialists according to art. 13, para. 4, LAAM, are listed in Appendix 2.

2 The services responsible for personnel matters (responsible services) inform the specialists in writing about their status.

3 Specialists may be released before the age of 50, provided that they have completed the normal length of military service:

A.
If they no longer carry out the activity referred to in Appendix 2; or
B.
If the need or ability to incorporate as a specialist no longer exists.

Art. 6 Military Personnel

1 Military personnel are subject to legislation concerning military obligations for the duration of the employment contract.

2 Provided that they have performed the ordinary duration of military service, military personnel are released from military obligations when they cease their professional activity.

3 The voluntary extension of military service after the cessation of professional activity is governed by art. 8 A And 8 C . 1

Art. 7 Persons Assigned and Affected by Art. 6 LAAM

Affected and assigned persons are released in accordance with s. 6 LAAM:

A.
When making the request in writing for reasons relating to their person;
B.
When their maintenance is no longer required.
Art. 8 1 Release Amount

1 The releases mentioned in this title as well as s. 8 C Occur at the end of the year in which the determining event occurs.

2 Once the event has taken place, the military can no longer be summoned; the convening of the annual report of the Grande Unity is an exception.

3 The army's general staff of conduct is responsible for the execution. It controls at least every five years that the requirement under s. 4, para. 3, let. B, art. 7, let. B, or s. 8 B , para. 2, let. A, still exists.

Heading 2 A 5 Extension of military obligations

Art. 8 A Condition and duration

1 The military obligations of the specialists referred to in Appendix 2, non-commissioned officers and officers may be extended with their agreement and if they have the appropriate skills, to the extent that the function for which they are intended is not May not be performed by other members.

2 The extension of military obligations will last at most until the end of the year in which the member reaches age 65; this rule does not apply to fire commissioners outside the service.

3 Members may not be summoned for service from the age of 65; the exception is the convening of the annual report of the Grande Unity.

Art. 8 B Request

1 The Grande Unity or the administrative unit to which the member concerned must carry out the service addresses the request to extend the military obligations to the Chief of Personnel of the Army before the ordinary release.

2 The application must include:

A.
The rationale for the need;
B.
Written agreement of the member concerned and his/her employer.

3 The Head of Personnel of the Army or his alternate shall decide on the application and shall notify the requesting body in writing of the reasoned decision. Decision-making authority cannot be delegated.

4 In the event of approval of the application, the person concerned shall remain subject to military service. Its obligation to perform educational services is governed by s. 9, 9 A And 50. 1

Art. 8 C Release

Members whose military obligations have been extended are released:

A.
When making the request in writing to the Chief of Personnel;
B.
Where the requirement under s. 8 B , para. 2, let. A, no longer exists.

Title 3 Total duration of training services

Chapter 1 Scope

Art. Training Services 1

1 Members with ranks perform, for the duration of the obligation to serve in the army, up to 3 days of recruitment, as well as

A.
145 days of recruit school and 6 repeat courses of 19 days each; or
B.
124 days of recruit school and 7 rehearsal courses of 19 days each.

2 If they perform other services, longer or shorter than those mentioned in para. 1, the total duration of their compulsory services is 260 days, and at 285 days for grenadiers. 2

3 The total duration of the mandatory services of the senior NCO and NCO is: 3

A.
Corporal: 260 days;
B.
Sergeant: 400 days;
B Bis . 4
Grenadier: 425 days;
C.
Chief sergeant: 430 days;
D.
Sergeant Major: 450 days;
E.
Master Sergeant Major and Burrier: 500 days;
F.
NCO Warrant Officer: 620 days;
G. 5
Military Staff Officer: 630 days;
H. 6
Chief Warrant Officer and Chief Warrant Officer: 730 days.

4 Junior officers complete 600 days of training service.

5 The following exceptions apply to members who completed their recruit school prior to December 31, 2003:

A.
Soldiers, appointed and appointed-leaders complete up to 130 days in troop development services; the total duration of training services must not exceed 300 days;
B.
Master corporals, sergeants and sergeants perform a maximum of 160 days in troop development services; the total length of training services must not exceed 460 days;
C.
Ants, sergeant-majors, sergeants-majors and junior officers complete up to 200 days in the ranks of the company's development services. The total duration of training services must not exceed 570 days for forays, 590 days for sergeants and sergeants-majors, and 770 days for junior officers. 7

5bis Members promoted to the rank of Warrant Officer before 1 Er January 2004 provides a maximum of 200 days in the company's development services. The total duration of training services must not exceed 590 days. 8

5ter The following exceptions apply to members who have been promoted before 1 Er January 2008:

A.
Staff Warrant Officers complete 670 days of training service;
B.
Master Warrant Officers and Chief Warrant Officers perform 770 days of training service. 9

6 The total duration of the training services of masters and senior officers depends on the duration of the conduct of a command or the exercise of a function under s. 50.

6bis The total duration of the training services of career sub-officers depends on the length of time a function is exercised according to s. 50, para. 3. 10

7 Specialists from the rank of captain to colonel and specialist officers perform, as part of the troupe's development services, a maximum of 300 days of training service.

Art. A 1 Troop Development Services

1 In the space of two consecutive years, the members of the active army listed below may be called upon to the troupe's development services as follows:

A.
Troop and non-commissioned officers, no more than 60 days;
B.
Non-commissioned officers and junior officers, up to 65 days;
C.
Senior non-commissioned officers and captains, at most 70 days;
D.
Senior officers, up to 75 days.

2 Consummons under s. 26, para. 3, let. B, are reserved.

3 As part of the Troop Development Services, the Reserve Officers listed below may be called as follows:

A.
Junior officers, not more than two days per year;
B.
Captains and senior officers, no more than five days per year;
C.
Captains and senior officers in brigade staffs up to a maximum of 30 days in two consecutive years;
D.
Officers of the General Staff, maximum 40 days in the space of two consecutive years.

4 The development services of the company referred to in paras. 1 and 3 can also be accomplished during the day.

Art. 10 Long Service Military

Members who wish to perform without interruption the total length of their training service under s. 54 A LAAM performs their training service as follows:

A.
Military with ranks for 300 consecutive days;
B. 1
Sergeants and sergeant-chiefs: for 430 consecutive days;
C. 2
Sergeant-majors, sergeants-chiefs and forays: for 500 consecutive days;
D. 3
Junior officers: for 600 consecutive days.

Art. 11 Total duration of military training service

1 A 19-day annual repeat course is charged to military personnel who do not perform militia duties and, therefore, cannot be called to any training services.

2 Basic education services referred to in s. 15, para. 1, are performed in the form of attributable training services. 1

Art. 12 1 Imputation of service days

1 Each day of the training service shall be charged on the total duration of the training services, from the day of entry to service until the day of the lay-off; are reserved:

A.
RFSP regulations regarding the allocation of voluntary services;
B.
The regulations of this Order concerning the charging of leave.

2 Travel days shall be charged on the total duration of training services for members who, in order to arrive in time for the gathering place, must be on their way to the day before entering service or who can return to their homes The day after the layoff only.

3 For members placed in preventive detention on the order of the military court service responsible during a training service, the days of service performed up to the date of the arrest included shall be charged as days of service on the Total length of training services. If the proceedings are interrupted or if the accused is acquitted, the days of detention until the day of the dismissal of his troop are also charged.

Art. 13 2 Imputation of the weekend between two training services

1 The end of the week between two training services is charged to the compulsory education service when these two services are interrupted only by weekend days:

A.
Two days of service on a normal weekend;
B.
Three days of service when the day before or after the weekend is a holiday within the meaning of s. 25 A , para. 1;
C.
Four days of service when the day before and after the weekend is a holiday within the meaning of s. 25 A , para. 1.

2 If a day of service is performed only on Friday, the weekend and the subsequent holiday may not be charged.

Chapter 2 Training Services

Section 1 General provisions

Art. 14 Instruction Service Types

Training services include Basic Training Services and Troop Development Services. The names are specified in Appendix 3.

Art. 15 Training Services to be performed

1 Basic training services, training courses, retraining courses, preparatory courses, specialist courses and supplementary training to be carried out during the duration of the obligation to serve are listed In Appendix 4.

2 Senior NCOs and junior officers perform eight rehearsal courses as well as other training services based on their incorporation, rank and function, until they have completed Total mandatory services.

3 Captains and senior officers of the active army, as well as officers of the reserve, perform all training services for their training, subject to s. 9 A . 1

5 Members who are subject to service may be summoned for up to seven additional days of additional service per year to training courses in order to:

A.
Work during the preparatory course for frameworks and preparations;
B.
Termination of employment;
C.
Ensure operational readiness.

6 Duration of executive preparatory courses:

A.
Rehearsal and conversion courses: as a general rule from Wednesday to Friday, and five days to the most in the case of special training needs;
B.
Other training services: two days a week at most;
C.
Basic training services of more than 26 days: five days at most.

7 May be called for recognition and additional special services in the same year:

A.
Military with ranks of the troop and non-commissioned officers: no more than three days;
B.
Non-commissioned officers and junior officers: four days at most;
C.
Senior officers of the Staffs and Captains: six days at most;
D.
Senior officers: seven days at most.

8 Members of operational detachments for military service as well as on-duty military personnel who are not incorporated into army formations within the meaning of s. 60 LAAM are called to perform at least ten days of service each year as part of the company's development services. Subject to Art. 9 A , the convocation is governed by the needs of the service. Training services can also be performed during the day. 3

Art 15 A 1 Service in military administration; conditions 2

1 For the convocation of military personnel in military administration, the following shall be considered: 3

A. 4
As an extraordinary overload: an overload that cannot be controlled in time with the usual staff or by taking ordinary organisational measures;
B.
As a special skill: any military, technical or scientific knowledge:
1.
Which cannot be acquired in the labour market;
2.
Which is only required for a short period of time that does not justify the undertaking of a person on a full-time or part-time basis; or
3.
Which is necessary for participation in a classified project in the field of internal or external security involving access to classified information, materials or installations.

2 Part of the military administration within the meaning of s. 59, para. 2, LAAM:

A.
The administrative units of the Defence Group; and
B.
The administrative units of the cantons responsible for applying military federal law. 5

3 Not allowed:

A.
Services performed by military administration employees to complete their daily work;
B.
Services that compensate for unauthorized positions;
C.
Services performed to fill vacancies;
D.
Consecutive services over an extended period of time, to the same position and for the same purpose, regardless of whether the same or several members are summoned for that purpose;
E.
Services aimed solely at preventing the member from being unemployed or reducing the duration of his/her unemployment. 6

4 Not considered military service in military administration:

A.
Training services or in the framework of the commitment of members of military training to which the tasks of the military administration are entrusted in the event of the undertaking of the undertaking;
B.
Military services within the meaning of Annex 1, let. E, ch. 1, of the Order of 24 November 2004 concerning the medical assessment of the aptitude for military service and the ability to make military service 7 . 8

Art. 15 B 1 Service in military administration; procedure

1 The administrative unit within the military administration for which the performance of a military service meets an imperative requirement addresses an application to the Chief of Personnel of the army as soon as possible.

2 The application must include:

A.
A justification to demonstrate the extent to which the conditions of s. 15 A , para. 1 and 2, are completed;
B.
The express declaration of the requesting body that this is not an inadmissible case within the meaning of s. 15 A , para. 3.

3 The Head of Personnel of the Army or his alternate shall decide on the application and shall notify the requesting body in writing of the reasoned decision. Decision-making authority cannot be delegated.

4 The convening authority may not issue the convocation for a service in the military administration as long as the decision referred to in para. 3 is not taken.

5 The head of the army checks that the procedure is respected and that the decisions taken under para. 3 are executed successfully.

Art. 16 Skills

1 The RFSP:

A.
Fixed, in multi-year planning, the basic dates for instructing services;
B.
May provide, for exceptional measures and for the purpose of increasing their degree of availability, to convene certain formations or detachments prior to the date set out in the military convening table;
C.
May exceptionally prescribe, in the case of special education requirements, in lieu of certain training services specified in this order, the performance of other services normally of equal or lesser duration;
D.
May request, where justified, the completion of retraining courses outside the rehearsal courses;
E.
Decides on the reduction or extension of training services in case of force majeure events;
F. 1
Lays down guidelines for:
1.
Service in schools and courses as well as in military administration,
2.
Completion of mandatory training services where there is less than 19 days to complete (balance of days of service).

2 In addition to the responsibilities set out in this Order, the Chief of the Army has the following responsibilities: 2

A.
Lays down guidelines for the organisation and conduct of the training services of the school;
B.
Fixed annually, in the military convocation table that it publishes, when the basic training services and development services are held, and who organizes them;
C.
May order, on an exceptional basis, to split basic education services, in particular in the case of special training needs or in the case of reorganizations;
D.
May exempt, in whole or in part, officers from the reserve of certain staffs and certain functions of the obligation to perform the instructing services;
E.
Decides who is competent for the direction of conversion;
F. 3
Enacts instructions for the instruction services required for a function or advancement.

3 The armed forces' general staff may summon military personnel to the military service to perform educational services outside their units of incorporation. 4

Section 2 Convening

Art. 17 Convocation

1 The military is summoned to the army's training services:

A.
By the public establishment of the arena;
B.
By a personal work order;
C.
By a special convocation.

2 The head of the army enacts directives concerning the administrative details of the procedure.

Art. 18 Public Establishment of the Army

1 Public implementation of the army is published no later than the end of September of the previous year, in all political communes, in the media and on the Internet.

2 The on-call members are summoned to the service of their incorporation by the public setting up of the army, which is also used to inform employers about the absence of employees due to military service.

3 It requires military personnel to include their military activities in the planning of their civilian activities.

Art. 19 Personal Walking Order

1 As a general rule, the personal march order is sent by mail to the military no later than six weeks prior to the commencement of the service.

2 The details of the entry to the service are defined in the personal work order.

3 The on-call members who have not yet received the order of march two weeks before the start of the service shall immediately inform the commander of their incorporation training or the office that announced the service.

Art. Special purpose

1 The appropriate service or commander shall proceed as soon as possible to a special convocation when:

A.
The formation of the embodiment is not mentioned in the public setting up of the army or is included with the words "according to special convocation";
B.
The incorporation training is part of an intervention force which, as a result of the advancement of the commencement of the service or the extension of the service, is called at an earlier date or terminated at a later date than the date on the On a public basis of the art;
C.
The dates of the service have been changed since the release of the public establishment of the service;
D.
The member is not required to complete the training with the member's incorporation training;
E.
The member must complete another training service with a charge on the training instruction service;
F.
The member is incorporated into the reserve, in training and support formations or, according to art. 3 of the Order of 26 November 2003 on the organisation of the army (OOA) 1 , if it is not incorporated into training and is required to perform service;
G. 2
Other disaster relief groups must provide assistance in disaster response training in the country.

2 Members whose training service is on the military notice board receive a notice of service 20 weeks before the start of the service. 3

Art. Convocation in case of further training

Members considered for the purpose of performing a new function or being promoted to a higher rank may not be called for training services until they have completed their basic training services except with their agreement, except In case of an imperative need of the army.

Art. Convocation during a procedure

1 When members of the military are subject to a military criminal investigation, it is the military prosecuting authority which decides what follow-up will be given to a summons to training services.

2 Persons subject to military service against which a procedure for the exclusion of the army under Art. 22, para. 1, LAAM or a degradation procedure under Art 22 A , LAAM has been introduced to no service as long as the procedure is in progress. 1

Art. Convocation of conscientious objectors

Conscientious objectors will again be summoned for investigative services only after the execution of the sentence or the action against them.

Section 3 Completion of Training Services

Art. 24 Principles

1 Training services must be fully performed in accordance with the military convening table.

2 Members shall be summoned annually to training services until they have completed all compulsory services.

3 Members of the military who perform the training assistance are summoned for the same number of days of service that they would have to perform in their training. 1

4 Training services can be performed in several parts:

A.
If there is a need for service; or
B.
Whether the private interests of the armed forces or their employers outweigh the public interest.

5 Training services shall be regarded as fulfilled when the sum of unchargeable isolated days does not exceed 20 per cent of the total duration of appraisal services. 2

6 In the case of basic training and training services for members of the military in long service, an uninterrupted series of days not attributable to the duration of the training services shall not exceed 10 per cent of the total duration Statement service. 3

7 During the year in which they reach the age of 34, members with a rank of troop and non-commissioned officers with the exception of senior non-commissioned officers are only invited to:

A.
If it is an imperative military requirement;
B.
If requested in writing by the member. 4

Art. 25 Dismissal for specific reasons

1 Persons who are subject to military service shall be dismissed from the training services when, for personal or service reasons, the interest of the service requires them, in particular: 1

A.
When an indictable offence under military or civil jurisdiction is strongly suspected and the presence of the suspect in the force is no longer tolerable;
B. 2
When, during the service, a procedure for non-recruitment, exclusion of the army, degradation or change of function has been initiated in accordance with art. 21, 22, 22 A Or 24 LAAM;
C.
Where a prohibition of summons is imposed under s. 66;
D.
Where, in a training service for a higher grade or for a new function, a candidate is deemed to be unqualified after a previously written test period;
E.
When the application for admission to the civilian service has been definitively approved;
F.
When, due to a lack of attributable service days, a training service can no longer be performed.

2 Is competent for the written notification of dismissal:

A.
In the Training Training Service: the direct superior commander;
B.
In the other training services: the commander of the basic training service concerned.

Art. 25 A 1 Start or end of service on holidays

1 Holidays within the meaning of this Ordinance shall include all official holidays throughout Switzerland and in a significant number of cantons which do not regularly fall on a Sunday.

2 If the beginning or end of a training service falls on a holiday, the Chief of the Army may reduce the training service by one day, for several days, respectively, in the military convening table. 2

3 In this case, the holiday shall not be charged on the total duration of the appraisal services and shall not give rise to any pay or compensation for loss of gain. 3

Art. 26 Replacement of unaccomplished training services

1 The on-call members whose training services are deemed to be unfulfilled by a lack of chargeable service days must replace them completely or until the total duration of the compulsory services has been completed.

2 In basic education services, the missed training period must be replaced within the two-year period.

3 Training training services are caught up with the training of incorporation; remain reserved:

A.
An additional summons for up to 19 days in case of military need;
B.
An additional meeting for the 19-day catch-up for members with more than two repeat courses in the performance of their mandatory training services. 1

Art. 27 Recruit School Period

1 The on-call members who deferred the recruit's school to the end-of-school exam, until graduation from an educational institution or gymnasium, performed the recruit's school following the exam, the end of the exam. Studies or their interruption. 1

1 Non-commissioned officers, senior non-commissioned officers and officers perform basic training services for the higher rank or for the new position within three years of the approval of the proposal.

2 Members whose proposal for a training service as a military physician, military dentist or military pharmacist has been accepted, perform their executive courses (CC MED) as follows:

A.
CC 1 MED (ESO MED): after completing five weeks of recruit school and passing the aptitude test for university medical studies with Clausus number Or have obtained the certification of a student's place in medicine, dentistry or pharmacy from a university without a numerus clausus;
B.
CC 2 MED (EO MED): after obtaining the Bachelor of Medicine, the Bachelor of Dental Medicine, or the Bachelor of Science in Pharmaceutical Sciences and having started the corresponding master's studies or at most two years after completing them with Success. 1

6 Only non-commissioned officers and officers who have completed the technical training course may be invited to the training courses of Staff I and II; the command of the Senior Formation of the Executive of the Army decides on exceptions. 5

7 Future commanders shall complete the technical training course at the latest before performing the practical service referred to therein. The armed forces' general staff shall decide on duly substantiated exceptions. 6

Section 4 Service displacement

Art. Service displacement for military reasons

1 The competent authority may order a service move for military reasons, in particular:

A.
To meet the need for specialists and managers in training services;
B.
Where several services coincide wholly or partly over time and cannot be regarded as being made as a result of having been carried out in part;
C.
When a benefit of more than 26 days of service is already provided during the calendar year or year of study;
D.
In the case of lack of training places in the basic training services.

2 Where a number of services under para. 1, let. B, coincide:

A.
Training of managers and specialists in a timely manner takes precedence over the training service;
B.
Training with the incorporation training takes precedence over courses with another training.
Art. Moving the service for personal reasons

1 The competent authority may, at the request of the member, grant a service shift for personal reasons.

2 Applications may be accepted only where the private interest of the member is required to prevail over the public interest in the performance of the training service. 1

3 Applications for movement of service cannot be accepted if the applicant's needs can be met by the granting of personal leave, by the interruption of service or by the performance of a split service.

Art. 32 1 Form of application

1 Members are required to submit requests for movement of service in writing or electronically within the following time frames:

A.
No later than fourteen weeks prior to the commencement of the service provided that the reason for the trip is already known at that time;
B.
For the other cases: within three days of becoming aware of the reasons.

2 Supporting documents relied upon as evidence by the on-call member must be attached to the application as long as the request is available.

Art. 33 Effect of demand and movement of service

1 Members are required to enter the service until the movement of duty has been authorized.

1bis Insufficient requests in their form or content are returned to applicants for correction within ten days. Insufficient requests for the second time are not processed. 1

1ter Applications sent less than 14 days before the start of the service are delivered directly by the administrative units to the commander who is the superior of the applicant for the service to be performed. The commanding officer decides on the applications. It may permit personal leave, partial service, suspension of service or termination of employment. Specific regulations are set aside for the convening of senior NCOs and officers for basic training services. 2

Section 5 Voluntary services

Art. 35 1 Principles

1 Members may perform a voluntary service:

A.
When they and their employer or the regional placement office with whom the unemployed have registered have consented in writing; and
B.
When a need within the meaning of s. 35 A Exists.

2 They may be admitted and summoned each year to a voluntary service of up to 38 days. An exception is the voluntary completion of a basic education service under s. 35 A , para. 1, let. A.

3 Services performed in accordance with ss. 9, 9 A And 50 by persons assigned or affected, as well as those whose military obligations have been extended, are not considered as voluntary services. 2

Art. 35 A 1 Army Requirements

1 Members who are capable of performing a superior function for which candidates are not available in sufficient numbers may voluntarily perform the basic training services required for this function:

A.
When they have already completed their compulsory education service with the last rank obtained;
B.
When they reach the end of their compulsory education service during the basic training service; or
C.
When the duration of the compulsory education service with the new grade after the basic instruction is less than four repetition courses.

2 Members may voluntarily carry out training services by performing their usual duties in training courses in which these functions show a lack of manpower which:

A.
Makes the organization of such services significantly more difficult; and
B.
Cannot be filled by taking ordinary measures.

3 Voluntary service in the military administration is authorized only:

A.
To perform work requiring the specific technical knowledge referred to in s. 15 A , para. 1, and b; and
B.
If no appropriate military personnel still to perform training services are available.

Art. 36 1 Procedure

1 The organ of the military or military administration for which the performance of a voluntary service responds to a need address as quickly as possible a request to the Chief of Personnel of the Army.

2 The application must include:

A.
The consents provided for in s. 35, para. 1, let. A;
B.
The rationale for the need;
C.
The express declaration of the requesting body that it is not a case referred to in s. 15 A , para. 3.

3 The Head of Personnel of the Army or his alternate shall decide upon the request and shall notify the requesting body and the member concerned in writing of the reasoned decision. Decision-making authority cannot be delegated.

4 The Army's leadership staff communicates the decision to the commander of the military's incorporation training.

5 The convening authority may not issue the convocation for a voluntary service as long as the decision referred to in para. 3 is not taken.

6 The head of the army checks that the procedure is respected and that the decisions taken under para. 3 are executed successfully.

7 Records relating to these procedures shall be kept for five years from the end of the service.

Section 6 Leave

Art. 1 Types of leave

1 General leave is defined as the free time of more than one day ordered for a large proportion of participants in a training service.

1bis General leave of longer duration is defined as a general leave of more than three days during or between basic training services. The head of the army shall determine the period and duration of extended leave for longer periods and shall issue directives concerning the administrative details of longer-term general leave. 2

2 Individual leave is defined as the free time granted by the competent commanding officer upon presentation of a personal request.

3 A general leave of absence or a longer general leave of absence shall correspond to an individual leave:

A.
When it coincides with an individual leave;
B.
When he immediately precede or follows an individual leave and the member does not join the troop between the general leave or the longer-term general leave and the individual leave. 3

Art. 38 Request for Individual Leave

1 In order to obtain individual leave, members shall send a written request prior to the service concerned to the direct superior commander, under whose orders the service is to be performed. In case of unforeseen circumstances, the application may also be addressed during the service concerned.

2 The application must be reasoned, accompanied by the necessary evidence and signed by the applicant.

Art. 39 Granting of individual leave

1 Individual leave is granted:

A. 1
Where the ground relied upon would justify a shift in service under s. 30, para. 2, but the application was not made or when the displacement of service was refused under s. 30, para. 3;
B. 2
When the member's private interest in granting the leave takes precedence over the public interest in the fulfilment of military obligations.

2 In all other cases, the commanding officer may grant individual leave as long as this does not interfere with the proper operation of the service and the applicant's military benefits are considered sufficient. 3

3 The decision shall be communicated in writing to the applicants.

4 The head of the army is responsible for a uniform practice in granting leave.

Art. 44 Procedure

1 Qualifications shall be notified orally and in writing after approval by a higher body. If prior approval is not possible, any amendments will have to be re-notified. 1

Chapter 2 Incorporation, Appointment and Withdrawal

Section 1 Incorporation

Art. 45 Allocation and Assignment

1 The persons referred to in s. 6 LAAM can be assigned or assigned to the Army as soon as they reach the age of 18.

2 They are either incorporated into a function according to the army's regulatory establishment plan (allocation), or assigned to the army without occupying a place in the regulatory workforce (allocation).

Art. Assigning a Command or Function Ad interim

Art. 50 1 Duration of the exercise of a function

1 The exercise of a specific function in the active military lasts:

A.
Where advancement is expected:
1.
At least three rehearsal courses for captains and senior officers of the corps,
2.
At least three rehearsal courses for unit commanders for training at the rank of command assistance of the corps,
3.
At least three years for the captains and senior officers of the Large Units in which the troop advance services are performed,
4.
At least two rehearsal courses for alternate commanders;
B.
If no progress is expected:
1.
Four to eight years for the captains and senior officers of the Grandes Units, during which they perform the development services of the troupe,

4 The exercise of a function in the reserve lasts at least four years for masters and senior officers, subject to the attainment of the age limit under s. 13 LAAM or reincorporation into the active army. 3

Section 2 Appointment to specialist officer

Art. Conditions

1 The duties that are open to specialist officers are listed in the Regulatory Workforce Tables.

2 If the prescribed staffing tables provide for several officer ranks, it is the lowest officer rank (minimum first-lieutenant) who determines duties and duties as a specialist officer.

If a specialist no longer performs the duties of an officer, the appointment to the rank of specialist officer shall not be acquired if he has been promoted on the basis of a professional activity which he no longer exercises and:

A.
He has served as an officer for less than six years; or
B.
He voluntarily renounces the officer function.

Section 3 Appointment to Chaplain

Art. 1 Conditions

1 The following conditions must be met for the appointment to the chaplain function:

A.
Fitness for military service;

The completion of at least 19 days of basic training in a recruit school or the completion of a basic technical training.
2 In addition to the conditions set out in para. 1, the following conditions must be met for evangelical-reformed chaplains: 3
A.
Be recognized as pastor or have received academic training in theology or equivalent and be ordained by the competent ecclesiastical authority;
B.
Be recommended by the competent ecclesiastical authority.

3 In addition to the conditions set out in para. 1, the following conditions must be met for catholic-Roman chaplains: 4

A.
Be recognized as a priest, deacon or pastoral assistant by the competent episcopal ordinariate or religious superior;
B.
Be recommended by the competent episcopal ordinariate.

3bis In addition to the conditions set out in para. 1, the following conditions must be met for Christian-Christian chaplains:

A.
Be active as a deacon or a priest in the Swiss Christian-Christian Church;
B.
Be recommended by the Bishop and the Synodal Council of the Swiss Christian-Christian Church. 5

4 Chaplains are appointed only in case of proven army need.

Art. Rights and duties

1 At the time of his appointment, the chaplain is awarded the rank of Captain.

2 After his appointment, he performs a technical training course (SFT A of the chaplaincy of the army) of 19 days and a practical service of up to five days.

3 The Service Head Chaplain performs a technical training course (SFT B Head of Army Chaplaincy) of up to five days.

Section 4 Withdrawal of Command or Function

Art. 56

1 Officers and non-commissioned officers who do not meet the requirements of their duties must perform a probationary service with the same function within another training period within a year.

2 The competent service shall order the completion of the probationary service; the member concerned and the commander of the other training shall be clearly informed of the status of the probationary service.

3 If the probationary service confirms the incapacity or if the interest of the troop requires an immediate withdrawal of the function, the competent service shall request the military leadership of the army to rule on the assignment of a new function. 1

Chapter 3 Promotion

Art. 57 1 Principles

1 There is no right to promotion or promotion at a particular rank.

2 For the advancement or promotion of a member at a particular rank, the following conditions must be met:

A.
The need for the military is proven;
B. 2
The member is competent and competent to perform the function in relation to the higher rank and, in particular, has the required oral and written knowledge of a second official language;
C.
The training services necessary for this promotion or promotion set out in Appendix 4 have been completed;
D.
The other special conditions of this order are met;
E.

Art. Promotions at the rank of appointed and appointed chief

1 Soldiers with very good or excellent qualifications can be promoted to the rank of appointed.

2 In training services, soldiers or staff who perform the following duties, and whose qualifications are very good or excellent, may be promoted to the rank of chief:

A.
Specialist at the unit level (chief of equipment, ammunition, etc.);
B.
Replacing the group leader.

3 The following proportions must be met:

A.
For the stipend:
1.
Basic training services: 5 % of the actual strength of the soldiers;

Art. 61 1 Promotion to Senior Officer

1 The promotion to the rank of Senior Officer is only possible after an officer rank for at least eight years.

2 Former Logistics Section Heads may not be promoted to the rank of Senior Officer until after having been commissioned for at least five years.

3 Promotion to the rank of lieutenant-colonel as commander is only possible after the age of 35.

4 Promotion to the rank of lieutenant-colonel as command assistance is only possible after the age of 38.

5 Promotion to the rank of colonel is only possible after the age of 42.

6 The head of the DDPS shall decide on duly substantiated exceptions.

S. 62 Multiple Grades

1 If the tables of the regulatory staff provide for several grades for a function, a promotion for the immediately above grade is possible at the earliest four years after taking the lower grade.

S. 63 Granting of the grade for a limited duration

1 The head of the army may, for the duration of a stay abroad in the course of a commitment, assign the necessary degree except the rank of general officer to persons who, on the terms of office of the Confederation, exercise abroad: 1

A.
A particular office or function in relation to national defence;
B.
The completion of a particular military training;
C.
A commitment to a peacekeeping operation.

2 The Federal Council may grant officers the rank of General Officer for a limited period if they perform a particular function in Switzerland and abroad or if they carry out a specific mission on the mandate of the Confederation. 2

1 The rank of General Officer may be awarded only with the approval of the Chief of the DDPS.

2 The head of the army enacts directives concerning the administrative details of the promotion procedure.

Chapter 4 Illegal Deployment

Art.

1 If a transfer is contrary to the LAAM or any of its implementing provisions, it will be declared void.

2 Are competent:

Title 5 Irregular personal situation

Art. 66 Principles

1 The armed forces whose personal situation is irregular require the authorisation of the army's general staff to: 1

Art. 67 1 Condemnation

1 Authorization under s. 66, para. 1, may be issued to a person convicted by an enforceable judgment to:

A.
A monetary penalty of up to 30 days of fine or ordered work of general interest up to 120 hours;
B.
A financial penalty of more than 30 days of suspended or partial relief, a conditional sentence of suspended or partial stay, or a work of general interest with a suspended or partial stay of more than 120 hours: after the expiry of the period The army's general staff may, however, if the behaviour of the convicted person incites it, to extend the time limit or, upon request, to reduce it;

Art. 69 A Degradation

Title 7 Exemption from Military Service

Chapter 1 General provisions

Art. Requests

Requests for exemption must be submitted in writing, by means of prescribed forms, to the armed forces' general staff.

Art. Activity change

1 The service that processed the request for exemption must announce to the Army Conduct Staff, within 14 days, any change in the activity of the exempted person from the service.

2 If the exempted person from the service is not reincorporated into the military, it is released from military obligations.

Art. 72 Skills

1 The Army's Conduct Command adjudicates the claims and sets the date for the commencement of the military service exemption. With respect to persons subject to s. 18, para. 1, let. D, LAAM, the General Staff of the Conduct of the Armed Forces shall take a decision on the request of Health Affairs. 1

2 It controls those who are exempt from service.

3 It may adopt acts relating to such controls, carry out inspections and conduct hearings of witnesses.

4 It decides on re-incorporation into the army when the activity justifying the exemption from service is no longer exercised.

Chapter 2 Members of the Federal Assembly under Art. 17 LAAM

Art.

Members of the Federal Assembly who are subject to military service who are not performing, or in part, a training service to attend a session or meeting shall announce it in writing, as soon as possible, to the General Staff of The army.

Chapter 3 Exemption from service due to activities required by s. 18 and 19 LAAM

S. 74 Main business activity

1 A professional activity is deemed to be primary when the person who is required to serve in the military service is employed on the basis of fixed service reports of an indefinite duration or a minimum period of one year, and that the essential activity is On average for at least 35 hours per week.

2 No service exemption is granted during training preparing to carry out the required activity, with the exception of the completion of the police recruit school and the introductory course I of the border guards.

S. 74 A 1 Completion of Recruit School

The recruit school is considered to be completed pursuant to s. 18, para. 5, LAAM when:

A.
The conditions of s. 24, para. 5, are completed; or
B.
That a military advance has already begun and that the completion of the recruit school may be excluded before the age of 26.

Art. 75 Ecclesitics

Are considered ecclesiastical within the meaning of s. 18, para. 1, let. B, LAAM, persons who:

A.
Are Protestant theologians or members of a free, ordained or consecrated Evangelical Church, and who, through their installation, have an ecclesiastical ministry recognized by the Federation of Protestant Churches of Switzerland, by one of its Member churches or by one of the member churches of the Federation of Churches and Evangelical works in Switzerland; ecclesiastics who are teaching are not exempt;
B.
Are part of the Roman Catholic Church or the catholic-Christian Church, which:
1.
Have been ordained deacons and are entrusted with an ecclesiastical ministry recognized by one of the Roman-Roman Catholic dioceses or the Christian-Christian Church; theologians who follow studies without a mandate from the Church or who teach a subject Without a church mandate are not exempt, or
2.
Have delivered early wishes or perpetual vows and who work for a religious order;
C.
Are part of a religious order or Christian religious congregation with common life and common rules, as soon as they have delivered the first time vows or promise and work for the community;
D.
Belong to a religious grouping or religious association having a well-defined status, if:
1.
They have received an ecclesiastical mandate from the religious group or religious association, are at least 25 years old, have received at least three years of ecclesiastical training, and if the religious association or association counts at least 2000 Members in Switzerland; an additional ecclesiastical may be exempted from service for any new 800 members, or if
2.
They live in a community with common life, common rules, vows or promises, and work for the group or association.
Art. 76 Public health

1 Public health medical infrastructure is considered to be public health infrastructure. 18, para. 1, let. C, LAAM, the institutions referred to in s. 39, para. 1, Federal Act of 18 March 1994 on Medicare (LAMal) 1 , as well as the Swiss Red Cross blood transfusion service.

2 The following are considered essential personnel for the operation of these institutions:

A.
Directors, hospital administrators and operating managers;
B. 2
Physician heads and physician assistants (without clinical leaders or physician assistants), dentists (as long as they have undergone training as a maxillofacial surgeon) and pharmacists;
C.
Nurses holding a professional degree awarded or recognized by the Swiss Red Cross, the Swiss Psychiatric Society or the cantonal public health authority;
D.
Medical specialists and medical technicians with a university degree or a professional degree recognized by the cantonal public health authority.

Art. 77 Rescue services, police services, fire services and response services

Are exempt from military service:

A.
Members of rescue services who, in accordance with s. 56 of the order of 27 June 1995 on health insurance 1 (OAMal), perform a function within the meaning of s. 76 or rescuers holding a recognized federal degree;
B.
The members of the police services of the Confederation, the cantons, the towns and municipalities whose services are necessary to carry out the tasks of the judicial police, the security and the road traffic;
C.
The members of the professional fire brigades and the fire brigade bases, as well as those exercising the duties of fire brigade, substitute, fire-fire officer, chief of gear, chief of staff Special detachments, respiratory carriers, respiratory protective equipment, chemical accident specialist and radiation protection specialist The bodies of fire-fighters and intervention services recognised by the State.

S. 78 Institutions, prisons and homes

1 The following are considered to be establishments, prisons and homes according to Art. 18, para. 1, let. E, LAAM, the institutions responsible for the enforcement of custodial sentences, administrative and criminal measures as well as those for persons subject to criminal procedure or preventive detention.

2 Are exempt from military service:

A.
Those responsible for such institutions, prisons and homes, and their alternates;
B.
Persons engaged in the security services or in charge of direct supervision of the detainees.
Art. Postal services, telecommunications companies and transport companies

1 Under s. 18, para. 1, let. H, LAAM, are considered as:

A.
Postal services: the operations and postal administration of La Poste suisse;
B.
Telecommunications company: Swisscom SA as the main supplier;

Chapter 4 Assignment to civil protection or other areas of national security cooperation 7

Section 1 Assignment Under Art. 61 LAAM 8

Art. Principle

1 Persons liable to service may, in accordance with Art. 61 LAAM, be made available to civil protection, civil bodies of conduct of the Confederation and the cantons, as well as to the provision of fire-fire bases as managers or specialists, where:

A.
These persons are at least 30 years of age;
B. 1
The necessary strength of the function they carry out in their incorporation training is achieved;

2 Not available:

A.
Persons who are required to serve the support service and the active service, as well as those who are required to be engaged in peacekeeping operations;
B.
Military personnel.

Art. Conditions

Are considered executives and specialists within the meaning of s. 61 LAAM:

A.
In civil protection: persons subject to civil protection under s. 2 of the Order of 9 December 2003 concerning duties, grades and pay in civil protection (SFO) 1 ;
B.
To civilian conduct bodies: persons performing similar duties under the applicable law;
C.
In firefighting bases: persons performing a function referred to in s. 77, let. C, and performing at least 20 days of service per year in this function.

Section 2 9 Dispense and leave the support service and active service under s. 145 LAAM

Art. A Conditions

1 There is no entitlement to an exemption or leave of the active service or support service.

2 On presentation of an application, a person who is required to serve may, however, be granted an exemption or a leave of absence from the support service or active service:

A.
If she is at least 30 years of age;
B.
If, in the case of a support service or an active service, it must carry out, in the civil sphere of national security cooperation, an important task that it is the only one to be able to carry out; and
C.
If the needs of the army permit.

3 An exemption is granted only:

A.
Whether the important task is to be carried out throughout the service;
B.
If a leave for a part of the service is insufficient or inadequate.

4 A leave of absence is granted only if the service does so. Art. 37, para. 2, 38 and 39 shall apply mutatis mutandis.

5 In imperative cases, and in order to remedy an emergency or shortage situation, the Military Conduct Staff may order an exemption or general leave of absence for certain groups of persons who carry out important tasks.

Art. B Major Tasks

The following are considered important tasks:

A.
For which an exemption from service would be granted under s. 18 LAAM;
B.
The governments and administrations of the Confederation, the cantons and the municipalities;
C.
Civilian bodies for the conduct of national security cooperation;
D.
Public health medical infrastructure;
E.
People's rescue services;
F.
The alarm service of the fire brigades and the intervention services recognised by the Etat;
G.
The basic supply of telecommunications services and the operation of the issuing facilities for the information of the entire population of the country;
H.
Services that operate the lines of communication;
I.
Bodies responsible for ensuring the country's economic supply;
J.
Administrations and operations which provide the civilian population, the army and civil protection of products of vital importance or which provide important public, civil or social services;
K.
Organs of justice.
Art. C Request

1 The body responsible for carrying out the important task and the person who is subject to the service shall jointly address the request to the army's conduct of conduct.

2 The request for an exemption must be sent as soon as possible, but no later than seven days after the call to a support service or an active service. The request for leave must be submitted as soon as the reasons for the leave are known.

3 The summons shall remain in all cases valid until the application is the subject of a binding decision.

Art. D Request for reconsideration

1 If the application is refused, the co-applicants may, within seven days, file a request for review.

2 The decision on the request for review is final.

3 The General Staff of the Armed Forces may at any time reconsider its decision if the conditions of an exemption or leave of absence have changed.

The Federal Council determines the number of days of service that a member must serve in the course of his or her training services.

Central School (EC)

The central school is part of the senior training of army officers. The basic training of senior militia officers is the main task of the CBS. It comprises the following schools: training courses for officers, staff, command and technical training for warrant officers and intelligence officers. It is partly responsible for the training of the military conduct of the future section chiefs and their replacements, unit commanders and command helpers.

Recruit School

Basic training service to integrate recruit into the military community and to provide basic training, basic training and training instruction.

Ecole de sous-Officers (ESO)

Basic training service to provide the future non-commissioned officer with the training for the group leader according to the weapon.

General Staff College (E EMG)

Basic training service (basic training: SFEM I-III; progress: SFEM IV and V) of EMG officers and aid of commands in the Major General Units and collective and individual training of EMG officers and aid Commands from the Large Units.

School of Officers (EO)

Basic Training Service to provide the future junior officer with the Section Head Training for the weapon.

Individual Training (EI)

Special service to maintain the level of education.

Military Staff Exercise (Ex EM)

Training exercise in collaboration between commanders and their staffs.

Troop Development Services (S perf trp)

A comprehensive definition consisting of Training Training Services (FIS), Special Services (Special Services) and Supplementary Training Services (CIS).

Peace Promotion Service (PPS)

Type of commitment ordered on the basis of a mandate issued by the UN or the OSCE. The peace promotion service is a voluntary service. The terms of engagement of the volunteers shall be determined by the order in question.

Additional Instruction Service (SIC)

Serves military training in a new or complementary technical field.

Instruction Service (S instr)

All services according to the convening military table each year; they include Basic Training Services (SIB) and Troop Development Services (PS trp).
