814.076 Ordinance on the designation of the organizations authorized to use the areas of the protection of the environment as well as the protection of nature and landscape (ODO) of 27 June 1990 (State October 1, 2015) the Swiss federal Council, view the art. 55, al. 3, and 55f, al. 2, of the law of 7 October 1983 on the protection of the environment (LPE), view the art. 28, al. 2, of the Act of 21 March 2003 on genetic engineering (LGG), view the art. 12, al. 3, of the Federal law of July 1, 1966, on the protection of nature and landscape (LPN), stop: art. 1Organisations authorized to use are authorised to use in accordance with the art. 55, 55f LPE, 28 LGG or 12 LPN organizations listed in the annex to this order.

Art. 2 audit any organization authorized to use that modifies its statutory goals, its legal form or its name must immediately notify the federal Department of the environment, transport, energy and communication (Department).
The Department checks if organizations authorized to use always fulfil the conditions under which the right of appeal. It may take knowledge of the documents necessary for this assessment. If it finds that an organization no longer meets the required conditions, he asked the federal Council to amend the annex accordingly.

Art 3 requests for other organizations to benefit from the right of appeal organizations which meet the conditions laid down in art. 55, al. 1, 55f, al. 1, LPE, 28, al. 1, LGG or 12, al. 1, LPN will be included in the list of organizations authorized to use upon request (annex).
These organizations must submit their application to the federal Council at least 18 months before the date at which they want to be given this right.
The application must include: a. information on the right of appeal, that the organization wants to achieve; b. proof that the requirements are met, etc. necessary receipts, in particular the statutes and annual reports of the last ten years.

The economic activities of an organization continuing a non-profit in the sense of art. 55, al. 1, EPA and art. 12, al. 1, LPN, if the type of activity corresponds to that purpose and if this activity is not predominant compared with the other activities of the organization.

Art. 4reports organizations hold annual statistics on their use activity. They give them, at the same time as the annual reports, before end of April to the federal Office for the environment (FOEN) and make this information public.
In addition to the competent authority, organizations must do appear in their statistics the number of closed cases last year where: a. the use has been admitted, partially admitted, rejected or considered moot; (b) they have reached an agreement with the applicants in accordance with art. 55 c, al. 1, LPE or art. 12d, al. 1, LPN, and then withdrew the application; c. they withdrew the appeal without agreement.

The FOEN determines the form in which the information referred to in para. 2 provided. It is the synthesis of these statistics and publishes.
Every year before the end of April, organizations shall communicate to the FOEN, the amount of their revenue from the past year related to the exercise of the right of appeal.

Art. 5 entry into force this order comes into force on August 1, 1990.

Transitional provision on the 19 September 2008 amending the organizations are accountable for the exercise of the right of appeal in accordance with art. 4, al. 1, 2 and 4, for 2008, the first time in April 2009.
