The Ministry of Foreign Affairs of the Kingdom of the Netherlands has the honour to confirm to the Embassy of Switzerland the receipt of its note n O 147 of 4 December 1995 to read:

" The Embassy of Switzerland, referring to the European Convention on Mutual Assistance in Criminal Matters of 20 April 1959 2 , has the honour to communicate to the Ministry of Foreign Affairs of the Kingdom of the Netherlands the following:
The Embassy proposes that documents concerning violations of the rules of road traffic may be transmitted directly, by mail, by the authorities of the State in whose territory the violation was committed, to persons whose Place of habitual residence is in the other State. This does not exclude that either State requests exceptionally that the transmission be carried out in accordance with Art. 7 and 15 of the European Convention on Mutual Assistance in Criminal Matters.
Direct transmission is allowed for violations of road traffic rules which, according to the law of either state, are considered to be fine or ticketing fines and fines. For Switzerland, the provisions of the Federal Law on Road Traffic of 19 December 1958 3 And enforcement orders are, within the meaning of the note, the road traffic provisions. For the Netherlands, it is the provisions of the Law on Road Traffic of 21 April 1994, the provisions of the "Provinzgesetz" or the "Gemeindegesetz" amended by the Act of 17 November 1994 and the implementing ordinances which find application.
An explanatory memorandum should be attached in Annex I to the documents transmitted to persons residing in Switzerland and according to Annex II to persons in the Netherlands.
Requests for information, in the course of investigations, concerning holders of vehicles which have committed a violation of road traffic rules in one of the two States may be addressed directly to the police commands Cantonals and the Dienst Wegverkeer (RDW) to Zoetermeer The answers are given in the same way. 4
The Embassy is proposing to the Department that this memorandum and the Department's response constitute an agreement between the Swiss Confederation and the Kingdom of the Netherlands, which will enter into force on the date of the reply note. This agreement may be terminated at any time. Denunciation shall take effect three months after the date of receipt of the notification."

The Ministry of Foreign Affairs communicates to the Embassy that it agrees with the above. Consequently, the note from the Embassy of Switzerland and the present note constitute an agreement between the Kingdom of the Netherlands and the Swiss Confederation which comes into force on the date of that day.

The Ministry of Foreign Affairs takes this opportunity to renew to the Swiss Embassy the assurance of its high regard.


Annex I

1 Introduction

You have breached a traffic rule or a traffic rule has been breached by the vehicle registered in your name. You will therefore be given an administrative sanction. You will find attached the decision by which this sanction was imposed.

If you have appealed the decision to the Queen's Counsel, the decision of the Queen's Counsel following your appeal is attached (in lieu of the original decision).

3 Possibility of appeal to the Queen's Prosecutor

If you do not agree with the decision, you can lodge an appeal in writing within six weeks of the date of the decision (see Verzen D Datum ). In this event, you should send your letter to the Queen's Counsel (see Officer van Justitie ). The Queen's Counsel must receive your letter no later than the application deadline (see Beroepsdatum ). In your letter, you must explain why you disagree with the decision. You should also mention:

Your bank account number or postal check account number.

You must also attach to your letter a copy of the decision. If you personally want to comment on your appeal, you must make an express request in your letter. In this event, the Queen's Counsel will send you a summons.

If the sanction is imposed on you because the registration number of the vehicle with which the offence was committed is established on your behalf, the decision may be cancelled if you:

Admit that the vehicle was used by someone else against your will and that you were not reasonably able to prevent it, or,
-
Produce a written lease agreement for a period not to exceed three months, allowing you to know who was renting at the time of the offence, or
-
Produce proof of warranty that at the time of the offence you were no longer the owner or holder of the vehicle in question.

If you are of the opinion that these conditions apply to you, you may send a letter containing the supporting documents to the Queen's Counsel.

4 Appeal to the Court of Instance

If you do not agree with the decision of the Queen's Counsel indicated on the front of this notice, you may appeal, within six weeks of the date of this order, to appeal to you by Written to the Court of Instance at the address indicated on the front.

An appeal to the Tribunal may be made for one of the following reasons:

The act complained of was not committed or committed by you (unless the sanction was imposed on you as the holder of the grey card (read vehicle; see in this case the last indent);

The Queen's Prosecutor should have, having regard to the circumstances in which the offence was alleged to have been committed, impose a less severe sanction or cancel the order;

Within 15 days from the date of receipt of your request for appeal by the Court of Instance, you will have to ensure, at the Registry of the Court of Instance, the payment of the penalty imposed on you. You can do so in cash or by bank or postal check of an amount equal to the penalty imposed on you. If you do not make this payment, the trial judge will not take your request into consideration.

5 Terms of Payment

The amount of the penalty must be entered before the deadline (see Vervaldatum ) To the Centraal Justitieel Incassobureau (CJIB). You can use a bank payment order to this effect. You must consider a processing time for the transfer to be carried out by your bank. A staggered payment is not allowed. You can also send a money order to the CJIB .

If you do not make the payment or if you do so in part or beyond the prescribed time limits, the amount of the penalty will be increased and you will receive a payment. If you have still not paid the amount after this action, a second increase and a second payment will follow (see Sanctity na 1st in 2nd verhog ).

If you do not pay the amount due within the prescribed period, you may be placed on the list of persons sought in the Netherlands for the purpose of arrest.
