Federal law encouraging innovation, cooperation and professionalisation in tourism 1

On 30 September 2011 (State 1 Er February 2012)

The Swiss Federal Assembly,

See art. 103 of the Constitution 2 , given the message from the Federal Council of 23 February 2011 3 ,

Stops:

Art. 1 Purpose

The Confederation may, within the limits of the appropriations allocated, grant financial aid to encourage innovation, cooperation and professionalisation in the field of tourism.

Art. 2 Projects eligible for support

1 The Confederation can support projects with the following goals:

A.
Develop and implement new products, equipment or distribution channels;
B.
Improve the quality of existing benefits;
C.
Creating competitive organisational structures for efficiency gains;
D.
Improve training and development.

2 It concentrates most of the available funds on a few important projects.

Art. 3 Conditions

1 To receive support, projects must meet the following conditions:

A.
To help strengthen Switzerland's tourism competitiveness;
B.
Promote sustainable tourism development;
C.
Create or maintain attractive jobs.

2 Projects supported by Confederation under para. 1 must also meet one of the following requirements:

A.
Be national in scope or require coordination across the country;
B.
If they have a regional or local scope, meet the criteria for model projects of the Confederation.

3 Projects must be planned and implemented on the basis of cooperation between companies.

Art. 4 Loads

Projects must begin within six months of the granting of financial assistance.

Art. 5 Terms and Conditions of Financial Assistance

1 The Confederation may grant financial assistance covering up to 50 % of the costs attributable to a project. This financial assistance is allocated in the form of a lump sum contribution.

2 Where the proponents of a given project are eligible for several federal grants, the total financial assistance provided by the Confederation must not exceed 50 % of the total cost.

Art. 6 Procedure

1 Requests for financial assistance are to be sent to the State Secretariat for Economic Affairs (SECO). The latter shall consult the cantons directly concerned. Experts may be invited to review applications.

2 It decides on the granting of financial aid after consultation with the Federal Offices directly concerned.

Art. 7 Information and evaluation

1 SECO promotes the exchange of information in the field of tourism in general and on subsidised projects in particular.

2 It ensures that these projects are evaluated.

Art. 8 Funding

The Federal Assembly fixes the commitment credit by simple federal order every four years.

Art. Report

The Federal Council reports to the Federal Assembly on the use of the allocated funds.

Art. 10 Executing

The Federal Council shall issue the implementing provisions.

Art. 11 Referendum and entry into force

1 This Law shall be subject to the referendum.

2 The Federal Council shall fix the date of entry into force.
