Having regard to art. 5, para. 2 and 3, 8, para. 3, 13, para. 1, 15, para. 1, 20, para. 2, 21, para. 3, 30, para. 2, 38, para. 2, 39, 85, para. 1, let. A, and 96, para. 2, of the order of 18 November 2015 regulating the trade in the import, transit and export of animals and animal products with third countries (OITE-PT) 1 ,

Art. 1 Harmonized import and transit conditions

(art. 2, para. 1, 5, para. 1 and 2, 38, para. 1, and 2, OITE-PT)

The legislative acts of the European Union (EU) laying down harmonised import and transit conditions are set out in Annex 1.

Art. 2 Additional health guarantees

(art. 5, para. 3, OITE-PT)

1 In the event of importation, the following additional health guarantees should be provided:

A.
Bovine animals: a guarantee that animals are free of infectious bovine rhinotracheitis and infectious pustular vulvovaginitis (IBR/IPV);
B.
Animals of the porcine species: a guarantee that animals are free from Aujeszky;
C.
Galliformes, ansériformes and struthioniformes: a guarantee that the animals have not been vaccinated against Newcastle disease;
D.
Eggs to be incubating the animals referred to in the let. C: a guarantee that these eggs come from herds, including animals:
1.
Have not been vaccinated,
2.
Have been vaccinated with an inactivated vaccine, or
3.
Have been vaccinated at least 30 days before laying, if vaccination has been carried out with a live vaccine.

2 The health guarantees referred to in para. 1, let. A and b shall be recognised only if the conditions laid down in Annex 2 are fulfilled.

Art. 3 Products of animal origin that pose a high risk to the police of epizootic diseases or food hygiene

(art. 8, para. 1, let. A, and 3, OITE-PT)

Products of animal origin which pose a high risk to the police of epizootic diseases or to the hygiene of foodstuffs referred to in Art. 8, para. 1, let. A, OITE-PT are listed in Annex 3.

Art. 4 Reservation on the use of bovine meat from states which do not prohibit the use of hormone-treated substances as performance enhancers

(art. 9, para. 2, let. B and 30, para. 2, OITE-PT)

This reserve must be included in the documents for the sale and delivery of the meat referred to in s. 9 OITE-PT, has the following wording:

" Beef from a state which does not prohibit the use of hormones as performance enhancers, to be used in the Swiss customs territory. Export is prohibited. The charges laid down in Art. 9 and 30 of the order regulating trade in the import, transit and export of animals and animal products with third countries must be complied with. '

Art. 5 Animal products carried in passenger traffic

(art. 13 and 39, let. A, OITE-PT)

The import and transit conditions laid down by the legislation on epizootic diseases applicable to products of animal origin carried in passenger traffic for personal use are set out in Annex 4.

Art. 6 Obligation to present consignments to veterinary border control

(art. 15 and 39, let. B, OITE-PT)

Animals and animal products subject to veterinary control at the border are listed in Annex I to Decision 2007 /275/EC 1 .

Art. 8 Health certificates

The formal requirements to be met by health certificates are set out in Annex 6.

Art. Quarantine Stations

(art. 85, para. 1, let. A, OITE-PT)

The requirements for quarantine stations are set out in Annex 7.

Art. 10 Border inspection posts

(art. 96, para. 2, OITE-PT)

The requirements to be met by the premises, equipment and installations of authorised border inspection posts are set out in Annex 8.

Art. 11 Updating annexes

The FVO updates Annexes 2, 3, 4 and 7 in the light of international developments or developments in technology.

Art. 12 Repeal of the law in force

The DFI Ordinance of 16 May 2007 on the control of the import and transit of animals and animal products 1 Is repealed.

Art. 13 Entry into force

This order shall enter into force on 1 Er January 2016.

Products of animal origin which pose a high risk to the police of epizootic diseases or to the hygiene of foodstuffs referred to in Art. 8, para. 1, let. A, OITE-PT are products which must be equipped with one of the following supporting documents:

Formal requirements to be met by health certificates

1
The representative of the authority of the exporting country or of the undertaking issuing the health certificate must sign and equip it with the official stamp. This requirement applies to each page of the certificate, if the certificate contains more than one. The stamp and signature must be of a different colour than the other data on the certificate. The name and title of the signatory in legible and capital letters will be added.
2
The content and appearance of the health certificate must correspond to the model fixed for the animal, the animal product and the State in question. The certificate must be completed in full and can only be established for a single destination establishment.
3
The certificates must be written in German, French, Italian or English and, if it is a consignment in transit to the Member States of the EU, Iceland or Norway, in the official language of the country of destination; otherwise they Must be accompanied by a legal translation in the relevant language.
4
Certificates must be established:
A.
A single sheet of paper;
B.
Two or more pages forming part of a single sheet of paper that is not to be divided; or
C.
A sequence of numbered pages to indicate that it is a specific page of a finite sequence (e.g., "page 2 of 4").
5
Certificates must have a unique identification number. When the certificate consists of a sequence of pages, each page must specify this number.
6
Any changes must be made by means of ratures duly signed and sealed by the person responsible for the certification.
7
The certificate must be issued before the lot to which it refers leaves the supervisory authority of the competent authority of the sending country.

Requirements to be met by quarantine stations

1
The quarantine station shall:
A.
Be under the permanent control and under the responsibility of the official veterinarian; and
B.
Be located in a place sufficiently distant from breeding units with animals susceptible to the animal diseases concerned.
2
It must have:
A.
Facilities that are easy to clean and disinfect, allowing the loading and unloading of different means of transport, control, supply and care of animals and having an area, lighting, ventilation and an area Supply in relation to the number of animals to be accommodated;
B.
Premises that are large enough to accommodate animals, including changing rooms, showers and toilets, to the staff responsible for monitoring tasks;
C.
Suitable premises and equipment for the collection and processing of samples and for routine checks;
D.
Facilities and equipment required for housing, feeding, watering, treatment and, where appropriate, slaughter or killing of animals;
E.
Suitable equipment for rapid exchange of information through TRACES; and
F.
Cleaning and disinfection equipment and equipment.

Requirements to be met by the premises, equipment and facilities of authorized border inspection posts

1 Licensed border inspection posts for the control of animals

Border inspection posts must be available:
A.
An access line reserved for the transport of live animals;
B.
Facilities that are easy to clean and disinfect, allowing the loading and unloading of different means of transport, control, supply and care of animals and having an area, lighting, ventilation and an area Supply adapted to the number of animals to be controlled;
C.
Premises that are large enough to house, control and sequester animals, as well as locker rooms, showers and toilets available to the staff responsible for monitoring tasks;
D.
Suitable premises and equipment for the collection and processing of samples and for routine checks;
E.
The services of a specialized laboratory capable of conducting special analyses of the samples taken at the inspection station in question;
F.
The services of a company which, in the immediate vicinity, has the facilities and equipment required for housing, feeding, watering, treating and, where appropriate, slaughtering the animals;
G.
Appropriate facilities permitting, in the event that these stations are used as staging points or transhipment points for animals during transport, to unload them, to water and feed them, if necessary, to house them properly and to Give them care or, if necessary, put them to death on the spot in a way that avoids unnecessary suffering;
H.
Suitable equipment for rapid exchange of information through TRACES; and
I.
Cleaning and disinfection equipment and equipment.

2 Licensed border inspection posts for the control of animal products

2.1
Border inspection posts must be constructed in such a way as to provide an adequate level of hygiene and avoid cross-contamination.
2.2
The premises where the products are unloaded, examined or stored must be sufficiently large and include the following:
A.
Smooth and washable wall surfaces that, like soils, are easy to clean and disinfect, and a suitable water flow system;
B.
An easy to clean ceiling;
C.
Adequate natural or artificial lighting; and
D.
An appropriate cold water and hot water system in all inspection facilities.
2.3
The various authorized border inspection posts at the same customs office must be at a convenient distance from each other.
2.4
Border inspection posts approved for the handling of refrigerated, frozen or ambient temperature must be capable of simultaneously storing adequate volumes of products for each temperature category. The border veterinarian must be able to dispose of the required amount of storage at any time.
2.5
For products under the control of a defined temperature for human consumption, the junction between the means of transport and the unloading areas shall be protected or isolated from the external environment.
2.6
Border inspection posts must be available:
A.
An office with all the means of communication required, including a telephone, a fax machine, a TRACES terminal and a photocopier, all the documents necessary to carry out the controls and reference works, of a local Storage of a sufficient volume to retain all controlled documents;
B.
Locals including locker rooms, washrooms and washbasins for personnel at the border inspection post, which can only be shared with other persons involved in official controls;
C.
A closed or covered area for the unloading of means of transport;
D.
An inspection room in which the products can be examined and samples taken for subsequent tests; the sampling location may be located in the control room;
E.
Suitable storage space or storage areas for storage at both refrigeration and freezing temperatures or at room temperature, under the control of the official veterinarian, the consignments held in anticipation of the Results of laboratory analyses or other reviews;
F.
Suitable premises and equipment for the collection and processing of samples and for routine checks;
G.
Laboratory services that are able to analyze samples taken at the inspection station;
H.
Facilities and refrigerated facilities for the storage of samples taken from batches for analysis and products for which release has not been authorized by the border veterinarian responsible for the border inspection post;
I.
Refrigeration premises and installations where food and other animal products are kept separately and which allow them to be kept separately at the required temperature for each category of products;
J.
Suitable equipment for rapid exchange of information through TRACES;
K.
Services of a company capable of processing the treatment provided for in the order of 25 May 2011 on the disposal of animal by-products 1 ;
L.
Cleaning and sanitizing equipment and products stored in an appropriate location adapted to the needs of the position, or a proven system of cleaning and disinfection by an external company; and the effectiveness of cleaning and cleaning Disinfection must be proven and documented; and
M.
Installations for the temporary storage of samples under temperature control pending shipment to the laboratory, as well as containers suitable for the transport of such samples.
