The Federal Department of Foreign Affairs presents its compliments to the Embassy of the Principality of Liechtenstein and has the honour to acknowledge receipt of its note of 20 December 2012, which reads as follows:
" The Embassy of the Principality of Liechtenstein presents its compliments to the Federal Department of Foreign Affairs and has the honour to inform it of the following:
Based on the Treaty of 29 January 2010 between the Principality of Liechtenstein and the Swiss Confederation on Environmental Taxes in the Principality of Liechtenstein 2 And the Agreement on the Treaty 3 , with a view to the entry into force of the revised Swiss law on CO 2 And the CO Order 2 Relative to 1 Er January 2013, given the gap to be filled until the entry into force of the law on CO 2 Liechtensteinoise being amended and the CO order 2 In order to ensure comparable conditions of competition for enterprises in the common economic area, the Government of the Principality of Liechtenstein proposes the following rules for the Swiss Federal Council:
Liechtensteine companies that commit to a reduction in greenhouse gas emissions may, after the entry into force of the law on CO 2 Liechtensteinoise and CO Ordinance 2 Liechtensteinoise, ask the relevant Swiss Federal Authorities for the exemption from 1 Er January 2013 tax on CO 2 On fuel.
In the event that the Swiss Federal Council approves the above, the present note and the response of the Federal Department for Foreign Affairs constitute an agreement between the Principality of Liechtenstein and the Swiss Confederation.
This agreement shall enter into force on the date of the reply note. The exchange of notes of 29 January 2010 between the Principality of Liechtenstein and the Swiss Confederation concerning the distribution of tax products on the CO 2 And the tax refund on the CO 2 Undertakings governed by the Liechtenstein law on trade in emission rights 4 Is revoked on the same date as it has been fully executed.
The Embassy takes this opportunity to renew to the Federal Department of Foreign Affairs the assurance of its high regard."
The Federal Department of Foreign Affairs has the honour to inform the Embassy of the Principality of Liechtenstein that the above has been approved by the Swiss Federal Council. The note by the Embassy and the present note are therefore an agreement between the Swiss Confederation and the Principality of Liechtenstein, which enters into force on the date of the reply note, that is, on 20 December 2012. The exchange of notes of January 29, 2010, is repealed on the same date.
The Federal Department of Foreign Affairs takes this opportunity to assure the Embassy of the Principality of Liechtenstein of its high regard.
